Factors Influencing Mental Care Facility Workers' Rights Guarantee for People with Mental Disorder (정신요양시설 종사자의 정신장애인에 대한 권리보장 영향요인)

  • The purpose of this study was to investigate the factors affecting the rights guarantee of people with mental illness among mental care facility workers. The subjects of this study were 132 mental care facility workers, and the research tools were rights and protection-related characteristics, rights recognition, and rights guarantee. The data were analyzed with descriptive statistics, t-test, one-way ANOVA, Pearson's correlation coefficients, and multiple linear regression using the SPSS/WIN 24.0 program. The result showed that the difference in rights guarantee relating to general characteristics were significant differences in religion. There were significant positive correlations among rights recognition and rights guarantee. The factors influencing the rights guarantee were rights recognition, recognizing the need to advocate rights, and religion. Based on the research results, it is necessary to improve recognition and actively advocate rights through continuous education in order to strengthen the rights guarantee of people with mental illness. Enhancement of rights guarantee will help people with mental disorder recover.

  • The Convention on the Rights of Persons with Disabilities is the international conventions to acknowledge that persons with disabilities have dignity as human being and to give us duty to make an effort for protection of persons with disabilities' rights. This study deducts several tasks in spatial information field to fulfill the Convention on the Rights of Persons with Disabilities effectively. First of all, For the deduction, this study starts by considering accessability, personal movement, freedom of expression and accessability to information. Second, this study defines persons with disabilities as the spatial information what ensure for prior considerations. Third, this study deducts some requirements on spatial information of persons with disabilities on the basis of the survey targeting persons with disabilities and the expert opinion, and suggests objectives, strategies, tasks, systems for effective implementation of the Convention on the Rights of Persons with Disabilities. Especially, this study sets up a goal on spatial information establishing strategy of persons with disabilities as 'Disadvantaged groups like persons with disabilities can obtain requirable information without distinction of person, thereby pursuing the convenience of life and improving the quality of life.

A View on the Guarantee of Cultural Right of the Disabled (장애인의 문화적 권리 보장에 대한 소고)

  • The culture is an integral factor when we deal with the quality of life of members of society, and the cultural right is accepted as the basic right. However, the cultural right of the disabled in our society stays in the conditions of the discrimination and alienation by social prejudices and barriers against people with disabilities, and that results from the lack of understanding as a right. The aim of this study is to further raise awareness about the cultural right of the disabled as the basic human right, make it clear to be a universal right based on that, and insist on implementing 'Affirmative Action' for actualizing the disabled's cultural right to equality. The political measures derived from this study to guarantee and realize the cultural right of the disabled are as follows. First, the target extent of cultural voucher system should be expand to not recipients of national basic livelihood guarantees and near poverty groups, but all the disabled. Second, to take full charge of the cultural support of the disabled as a independent organization, it is necessary to establish Ministry of Culture, Sports and Tourism-affiliated 'Bureau of Culture for Persons with Disabilities'. Third, the nationwide survey on cultural activities and desires of the disabled periodically is required.

  • 정보전달매체가 발달된 오늘날에 있어서도 시각장애인은 각종 정보와 문화적 혜택으로부터 소외되고 있는것이 사실이다. 특히 도서관은 시각장애인에게도 주체적 삶의 의지, 공부할 권리, 알권리를 제공해 주어야 할 의무가 있다. 지금까지의 선행 연구들은 시각장애인 정보봉사를 도서관 쪽으로만 국한시키고 있으나 시각장애인 정보봉사는 국가와 사회의 관심하에 도서관, 매스미디어, 맹인복지기관, 특수맹학교 그리고 멀티미디어 신기술을 활용하여 전개되어야 하며 이를 위한 체계적인 연구가 필요하다.

Collaboration Strategies Between the Vocational Rehabilitation and Independent Living Services for People with Disabilities (장애인 직업재활과 자립생활 서비스 연계전략에 관한 연구)

  • The concept of the Independent Living (IL) movement has been affected on recent disability public policy to enhance the right of consumers with disabilities, as well as to eliminate the barriers on employment. The IL movement emphasizes the empowerment and autonomy of consumer with disabilities to achieve their rights in educational, social, and employ environment. This paper presents three vocational rehabilitation(VR) services that affect consumers with disabilities based on the values of the Independent Living movement, and recommend some practical strategies. These VR services include the collaboration projects between the VR agencies and Independent Living Centers, the intervention programs to enhance the self determination or informed choice as a consumer, and the projects to strengthen the relationship between consumers with disabilities and their service providers.

Disability-Rights Based International Cooperation: With Some References to North Korea (장애 권리 기반한 국제협력: 북한 관련하여)

  • This paper attempts to explore the place of human and disability rights from the perspective of Social Welfare within the context of the UN Disability Rights Convention of 2006. The overall discussion is focused especially upon the situations of human and disability rights in the Democratic People's Republic of Korea (North Korea) as it is being challenged to drastically address the issues of human rights in general, and disability rights in particular. The UN Disability Rights Convention challenges every ratified State party to commence legal reforms, legal harmonization, and policy and program developments to implement the Convention. Both North and South Korea are not exceptions to this. Even without drawing upon the UN's the Commission of Inquiry on Human Rights in the Democratic People's Republic of Korea, the dire situation of human rights in North Korea is well documented. However, this paper does not assume South Korea's human rights are any way superior to that of North Korea. This paper spells out areas for further action common to two Koreas and to any other nations for that matter. Apart from the general discussion on disability rights, the distinctive contribution of this paper lies in the fact that it has endeavored to draw upon any latest information and data on North Korea. It relied on various sources from UN and also from North Korea itself. One can note that North Korean disability authorities are making strenuous efforts to improve human rights of persons with disabilities in their desires to seek assistance from outside. It also shows an enormous need for international cooperation in seeking financial and material supports. This paper notes the latest political development between North and South Korea in taking "phased" steps for peace and stability as a positive sign for North and South Koreans' DPOs collaboration under the banner of International Cooperation of the article 32 of the UN Disability Rights Convention. More critically, this paper points to the further need to improve the overall data bases to ensure balanced legal reforms, policy developments and sharpen the areas of international collaboration.

A Study on Practical Recognition about Rights Advocacy of Social Workers in Disabled Welfare Centers (장애인복지관 사회복지사의 권리옹호에 관한 실천적 인식연구)

  • Recently, rights advocacy in disabled welfare centers is one of the most important estimation and also transition of paradigm. However it is difficult to define rights advocacy specifically, so each disabled welfare center goes to conceptualize rights advocacy based on practical experiences. Study of practical recognition of the advocacy rights of social workers in disabled welfare centers provides greater foundation to establishing specific concept and direction of rights advocacy. Method of this research is analysis of metaphors, figuring out concepts and perception of social workers through survey. Analysis of metaphors is a method of analyzing a person's perception in specific context and situation by providing a concrete explanation of new thing, that is, basis of metaphor and analyzing it later. As a result of this research, it is shown that ideological type(necessary thing) and practical type(being together) are the perceptions about rights advocacy of social workers, and rights advocacy is recognized as 'practical concept' which plan and provide direct service at fields. According to these results, policy and environment should be constructed to provide advocacy services at welfare fields, reflecting these perceptions of social workers. Also this should be reflected on practical fields for them to learn appropriately and practice rights advocacy.

Toward Cinema for All People -Barrier-free Films and Cultural Civil Rights ('더 많은' 모두를 위한 영화 -배리어프리 영상과 문화적 시민권)

  • Barrier-free films enhance accessibility to audiovisual image contents by providing specific information on screen and through sound so that people with vision or hearing loss can receive the same amount of information as those without disabilities and immerse themselves in the audiovisual images. This study pays attention to barrier-free audiovisual contents in relation to the cultural civil rights of people with vision or hearing loss in South Korea. While institutional efforts have been made in the 2010s to improve the access to audiovisual media of people with vision or hearing loss, the goal of enabling people with vision or hearing loss to fully enjoy all audiovisual contents at a level equal to the non-disabled has not yet been realized. Amid the lingering conflict between disabled groups and multiplexes that has lasted years, the global video streaming service Netflix has aggressively threatened the dominance of local multiplexes with the launch of its Korean service. As Netflix, which is subject to U.S. regulations guaranteeing the rights of people with vision or hearing loss, has produced original dramas and movies involving Korean production teams, the cultural civil rights discourse of the disabled has transitioned to the issue of the rights of cultural consumers crossing national borders in the era of globalization. Changes in the media environment raise the issue of civil rights guarantees in which disabled people enjoy the right to simultaneously watch movies and comment on movies by participating in a common discourse, equally with non-disabled people. The "right to be part of the audience for Korean cinema" for Korean deaf people, which has long been neglected, should also be considered as a cultural civil right that crosses the boundaries of language, nation and disabilities. This essay examines the current issues surrounding the right to cultural entertainment of people with vision or hearing loss in South Korea in conjunction with the contemporary trend of rapid changes in the media environment and the global spread of the movement for cultural civil rights of people with disabilities, and suggests the need for visual culture studies to take a serious step toward disability studies.

  • 국제연합은 1975년에 "장애인 권리선언"을 결의하였고, 1981년을 "세계 장애인의 해"로 결정하였다. 우리나라에서도 1981년 6월 5일, 법률 제 3452호 "심신장애자 복지법"을 제정, 공포하였고 1989년 12월 30일 "장애인 복지법"으로 개정하였다. 한편, 미국에서는 1990년 7월 26일 George Bush 전 대통령이 "The American with Disabilities Act of 1990(ADA)"에 서명하였다. 이 법은 인종, 성별, 출신지, 그리고 종교에 관계없이 장애자에게도 같은 시민 권리 보호를 제공한다는 것이다. 그럼에도 불구하고 장애인을 위해 설계된 건물이나 시설물들이 그렇게 많지 않다는데 그 문제점이 있다. 따라서 본 연구의 목적은 신체 장애인에게 “동등한 생활의 질”을 제공하자는 데 있다. 그에 따른 목표로써 신체장애에 대한 구분이 이루어 졌고, 이동 수단으로서의 wheelchair에 대해 조사되었고, ADA accessibility guidelines가 분석되었다. 또한 인간공학과 감성공학으로 재활공학에 접근하였으며 가상현실이 이용되는 현 추세도 연구되었다. 결론적으로, 제시된 guidelines를 이용하여 가상현실의 세계에서 충분히 simulation을 마친 후에 장애인을 위한 좀더 과학적이고 합리적인 건물 또는 시설물 그리고 wheelchair를 제작할 수 있으면 한다.과학적이고 합리적인 건물 또는 시설물 그리고 wheelchair를 제작할 수 있으면 한다.

  • In recent years it seems to be accepted as absolutely right by almost all the people in the world that person without disabilities and person with disabilities are equal and should be treated so regardless of their race, national origin, sex, religion, disability, etc. This article deals with (1) "Anti-Discrimination against and Remedies for Persons With Disabilities Act" and (2) Human Rights of Persons With Disabilities. The purpose of "Anti-Discrimination against and Remedies for Persons With Disabilities Act" is to realize the human dignity and worth of persons with disabilities by prohibiting disability-based discrimination in all areas of society, and effectively safeguarding the rights of individuals discriminated based on disability, thus enabling them to fully participate in society and to secure equal rights.
