  • This research employed a comparative legal analysis to explore the rules of CISG, Incoterms 2010, Chinese Contract Law, and Korean Civil Act with precedent researches and present customs in the international sale of goods. The results of this study show that there are some differences in the provisions of seller's delivery obligation to those regulations, such as the time and place of delivery goods, the conformity of goods on the contract, and delivery of documents. Therefore, the parties of contract, especially between Korean and Chinese traders, must be aware of the differences in the provisions of those selected regulations in order to reduce disputes between them, out of or in relation to or in connection with their sales contract.

  • This paper reviews basic considerations for establishing managerial requirements on the domestic low- and intermediate-level radioactive waste repository and presents the corresponding draft requirements. The draft emphasizes their close linking with the related regulations, standards and safety assessment for the repository. It also proposes a desirable direction towards harmonizing together with the existing waste acceptance requirements for the repository

  • It seems extremely incongruous that genocide, crimes against humanity and war crimes could ever be justified or excused by 'defensive force'- self-defence, defence of others and defence of property. Nonetheless, art 31(1)(c) of the Rome Statute of the International Criminal Court codifies defensive force as a ground for excluding criminal responsibility. This provision was controversial and extremely difficult to negotiate at the Rome Conference of 1998, largely due to the conceptual differences that exist in respect of criminal defences between the various domestic legal systems of the world. This paper analyses the drafting history and wording of art 31(1)(c) in order to clarify the precise scope of defensive force under the Rome Statute. It then seeks to ascertain the applicability of the provision to genocide, crimes against humanity and war crimes, and to thereby explore the nature of these crimes and the intended prosecutorial strategy of the International Criminal Court.

  • This paper deals with the tradition and identity of physical expression(${\bar{a}}{\dot{n}}gika$ abhinaya) system in Indian traditional theatre and dance. The ${\bar{a}}{\dot{n}}gika$ abhinaya of Indian dance and theatre has been stylized through long terms and thereby defines their identity and peculiarity by its highly stylized expression techniques while following dramatic way($n{\bar{a}}tya$-dharmi). The ${\bar{a}}{\dot{n}}gika$ abhinaya is said to had been derived from the ritualistic practice of ancient Vedic period(B.C. 15th-B.C. 5th c.), which is most clearly exemplified in hand gesture(hasta mudra). In $N{\bar{a}}tya$ ${\acute{S}}astra$, ${\bar{a}}{\dot{n}}gika$ abhinaya is explained in detail. It is classified broadly into facial expression(mukhaja abhinaya), gesture expression(śārīra abhinaya), movement expression($cest{\bar{a}}krita$ abhinaya). Further, $N{\bar{a}}tya$ ${\acute{S}}astra$ divides their various usages by parts which include head, glance, eyes, nose, eyelid, cheek, lower lip, chin, mouth, hand, chest, waist, belly, hip. thigh, claf, foot. Besides, it explains diverse ways of foot movement($c{\bar{a}}ri$), standing poses(sthana), gait(gati) and their combined movements(mandala). Many forms of Indian traditional theatre and dance basically follows the rule of ${\bar{a}}{\dot{n}}gika$ abhinaya proposed in $N{\bar{a}}tya$ ${\acute{S}}astra$, which identifies their unique characteristics.

  • India is a gigantic market with a population of 1.2 billion and an economy that is growing at the second-fastest pace in the world. The volume of trade between India and Korea has been sharply increased with the increase of dispute since 2000. Although avoidance of disputes is always a priority, it is also important to prepare methods of dispute resolution which are efficient and economical. So, understanding of Indian dispute resolution system is a necessary requirement for successful business operation with Indian companies. This article analyzed and compared with the various ways of Indian ADR such as negotiation, mediation, conciliation, Lok Adalat and arbitration in order to help the Korean traders who enter into business with the Indian companies to settle their disputes efficiently. In conclusion, this article suggests the following ways to overcome problems of dispute with Indian companies: First, the Korean companies should recognize the characteristics of Indian ADR Ways respectively. Second, the Korean companies should utilize the conciliation or the mediation in small claim but arbitration in large claim. Third, Write a contract and insert the KCAB's standard arbitration clause in their contract.

  • The regulation for the low and intermediate level radioactive waste to be transferred to the disposal facility, recently revised, require that radioactive waste generators should set up waste certification program to verify the radioactive waste conform to the waste acceptance criteria(WAC) before disposal. The radioactive waste disposal facility, scheduled to be constructed in Korea, will institute WAC for the wastes to be transferred to the facility. This WAC is expected to compose of the requirements for the radiological characterization, physical and chemical characterization, physical/chemical restriction, prohibited item, packaging, identification, labeling, and documentation. For the compliance with this regulation, The radioactive waste generators should verify that the waste meet WAC through performance of the waste certification program and are responsible for handing in all the certification documents to the disposal facility. This waste certification program plan was set up as a preliminary program for the certification of radioactive waste generated in Korea Atomic Energy Research Institute (KAERI) and should be further revised until preparation of WAC by disposal agent.

  • The proposed regulation for low and intermediate level radioactive waste disposal facility, scheduled to be revised, recommends that the waste generator should verify the radioactive waste conforms to the disposal requirements before disposing of it. According to the regulation, the radionuclide concentration of the radioactive waste, and its physical and chemical characteristics and safety must be confirmed prior to the disposal of low and intermediate level radioactive wastes, and the waste generator is required to deliver this information to the disposal facility operator. In addition, the disposal facility operator must assess the safety of the disposal site to establish the SWAC (Site Specific Waste Acceptance Criteria) in consideration of the characteristics of the site, whereas the waste generator must comply with the criteria in managing, disposing of and delivering low and intermediate level radioactive wastes. To abide by the afore-mentioned regulation and criteria, the waste generator must verify that the radioactive wastes to be disposed of are suitable for disposal before they are transported to the disposal facility, and to this end a radioactive waste certification program must be developed. This study conducted an in-depth analysis of the radioactive waste certification programs enforced in countries advanced in atomic energy to develop a draft of a certification program applicable to local power plants, and the program is currently applied as pilot to Uljin Power Plants No. 1 & 2 to prove its applicability. This study is going to analyze the results of the pilot application with a view to developing a radioactive waste certification program suitable to local conditions.

  • This paper proposes acceptance requirements and the corresponding implementation strategy for the near-surface repository of low- and intermediate-level radioactive wastes. The proposed requirements include details on waste classification and radionuclide concentration limitation and inventory analysis. The strategy considers a relevant linking between predisposal waste management, disposal safety assessment and the overall disposal system.
