Der Begriff der Heilkundeausübung nach deutschem Medizinrecht (독일법상 의료행위 개념)

  • Der Begriff der Heilkundeausübung ist im positiven Recht in Korea nirgends festgelegt. Der wurde jedoch indirekt durch die Auslegung der Heilkundeausübung ohne Erlaubnis gemäß § 27 Abs. 1 des "Medizingesetzes" geregelt. In der Vergangenheit beschränkte der kOGH(the Supreme Court of Korea) die Heilkundeausübung auf die "Behandlung von Krankheiten und stellte fest, dass "medizinische und technische Maßnahmen, die keine pathologischen Symptome oder Funktionsdefizite im Körper voraussetzen, nicht zur Heilkundeausübung gehören." Danach änderte der kOGH seine Rechtsprechung auf "Vorbeugung oder Behandlung von Krankheiten durch Durchführung ärztlicher Untersuchungen, Optometrie, Verschreibung, Medikation oder chirurgischer Eingriffe auf der Grundlage von Erfahrung und Fähigkeiten, die auf medizinischem Fachwissen basieren, und anderer Gesundheitsfürsorge, definiert "medizinische Maßnahmen" als "eine Handlung, die eine gesundheitliche Gefahr darstellen kann, sofern diese nicht von einem Mediziner durchgeführt wird". Der Begriff der Heilkundeausübung in der Rechtsprechung ist einerseits zu abstrakt und kann eine Leerformel sein, andererseits kann seine Einschränkung eine Gefahr für die öffentliche Gesundheit erbringen. Daher besteht Bedarf an einem Kriterium, das dar derzeitige Begriff der Heilkundeausübung entsprechend dem gesetzgeberischen Ziel reduzieren kann, das Risiko für das Leben, den Körper oder die öffentliche Gesundheit von Menschen zu verhindern, das durch die Durchführung medizinischer Arbeiten durch nichtmedizinisches Personal entstehen kann. Um ein Kriterium vorzustellen, das das aktuelle Konzept der Heilkundeausübung reduzieren kann, werden in diesem Artikel das positive Recht, Theorien und Rechtsprechung zum Begriff der Heilkundeausübung in Deutschland untersucht und nach einer Alternative gesucht.

구전 커뮤니케이션 유형에 따른 의료서비스 만족도에 관한 연구

  • 오늘날 병원마케팅에서 간호서비스는 병원 내 어느 전문직보다도 가장 많은 시간을 고객인 환자와 합께 나누며 환자의 욕구 충족을 위하여 고도의 분업화된 제반 부서들간의 활동을 조정하고 융화시키는 역할올 통하여 환자들이 지각하는 병원서비스의 만족도에 종요 한 부분을 차지하고 있으므로 병원마케팅의 전략적 초점으로 전환될 필요가 있다. 의료 서비스는 특성상 전문성이 강해서 정보가 소비자에게 공유되지 못하고 있으며 비영리조직이라는 인식하에 의료 서비스에 대한 광고를 제한합으로써 실제적으로 소비자에게 필요한 의료 관련 정보들마저도 제한을 받는 경우가 많이 있다. 그리고 의료서비스의 무형성, 비분리성, 이질성, 소멸성의 특성으로 어떠한 의료 서비스를 이용할 것인지해 대한 결정을 고객이 하기 어렵기 때문에 오늘날 의료 소비자들이 의료제공 기관을 선택 할 때는 밑올만한 다른 사랑의 추천에 크게 의존하고 있는 것으로 알려져 있으며, 국내의 연구에서도 의료소비자들이 병원을 선택하는 주된 정보 획득 원천이 주변의 제 3자인 것으로 알려져 있다. 이러한 정보 전달에 구전 커뮤니케이션이 주요한 제3자적 억할을 한다. 이러 한 관접에서 불 때 의료 소비자둘 사이의 구전 커뮤니케이션은 마케 팅 전략상 매우 종요하 며 마케팅 관리측면에서 의료 소비자들의 구전 커뮤니케이션 형태톨 파악하는 것은 매우 중요한 일이라고 할 수 있다. 이에 본 연구는 구전 커뮤니케이션의 내용 및 경로 그리고 유형을 파악하고 이들 유형간 의료서비스의 만족도를 알아봄으로써 효파적인 병원 마케팅 전략을 수립하는데 필요한 자료를 제공하고자 한다. 본 연구의 결과를 증합해 보면 의료소비자들이 연령 성별 학력, 소득, 직업, 주거지가 비슷한 사람과 구전이 활발하게 일어냐는 것을 파악 할 수 있어 특히 상업적 광고가 제한 된 병원의 마케팅 전략에 oH우 유용한 것이 훨 수 있다. 또한 불만족한 소비자일수록 발신 자적 입장에 서서 주위의 사람들에게 활발한 구전 활동을 수행하고 었음을 알 수 있다. 이 는 의료 소비자들이 만족한 경우보다는 불만족한 경우에 더욱 구전을 수행하려는 의지가 강해짐올 시사한다. 따라서 병원은 소비자들의 불만을 감소시키기 위해 노력해야 한다. 특히 의료인의 친절함이 가장 많이 구전이 되는 것을 알 수 있었는데 의사나 간호사는 치료 나 간호의 직접적인 제공자로서 의료 소비자들의 만족도에 중요한 영향을 미치므로 의료소 비자들의 요구에 부응하는 서비스를 충족시켜 줄 수 있도록 노력해야하며 이러한 바탕 위에 병원마케팅 전략이 수립되어야 할 것이다.

  • We medical software is becoming important means to secure competitive power of medical service by explosive increase of medical device based on software, and the quality of medical service is affected to quality of medical software as well as medical devices. But domestic related study and development is not sufficient for quality of medical software, and a falling-off in medical software quality can induce a falling-off in quality of medical service. Therefore, it is necessary to raise qualitative level of medical service by progress and quality improvement of medical devices. Therefore, in this paper, we developed test module and qualify inspection table which can test medical software and produce result based on ISO/1EC 12119.

An Analysis on Nonpatient Revenues in Hospitals (병원의 의료외수익 분석)

  • This study examines nonpatient revenues of hospital in korea. The data source for this study was the 11 national university hospitals over the period 2008-2012. In this study, patient revenues, patient expenses, operating profit, nonpatient revenues, total revenues, ratio of the nonpatient revenues in the total revenues, operating margin, normal profit to gross revenues were analysed by the annual. The analysis of nonpatient revenue differences by management performance, bed size, location was performed. The results were as follows. Nonpatient revenues of national university hospitals were increased during the period 2008-2012. Nonpatient revenues were no significant differences by management performance. Nonpatient revenues in hospitals which are large bed size and located in big city were larger. Based on these results, this study suggests implications to diversify profitability for management performance in hospitals.

  • Health care privatization will have a very significant impact on the quality of medical service and income redistribution and risk diversification. This study was conducted to improve the situation without too much insistence that one did not understand the essence rife about the privatization of health care. In this study, grasp the implications of the current health care debate to be privatized, and dealing with the claims accordingly. Seeks to help establish an objective perspective, looking at the pros and cons at the same time claims for medical privatization policy. The Health and diversification through the capitalist market access as part of the transition process is being overlooked as a new growth engine industries. But health care is constrained to follow the growth of universal access and how to deal with life because it is practical conduct of the person. In addition to services that are not only for the benefit of the profit or government institutions.

  • As a patient has recently been recognized as not a passive object but a subject of medical services, various attempts are being made to strengthen the status of a patient. Medical communication which has been led by a doctor so far is being made with a focus on a patient due to sovereignty of a consumer and activation of medical information. The purpose of this paper is to investigate the process to strengthen the status of a patient as a consumer of health care service through a patient association and consumer movement as medical information becomes public. As the patient centered medical service is creating a variety of health care service market using IT technologies, it has contributed to the improvement on asymmetry of medical information. As the expansion of IT fusion health care market is bringing the fundamental change into the traditional relationship between a doctor and a patient, the medical service market is being re-organized. A patient centered medical service such as expansion of mobile health care model led by a patient is being accelerated.

The Determinants and Medical Care Utilization Behavior of Private Health Insurance (민간의료보험의 가입요인과 의료이용행태)

  • This study analyzes actual conditions of private health insurance empirically by using the decision to join Korea Health Panel data. First, the study investigates how sociodemographic factors influence joining the private health insurance. Next, the relationship between the private health insurance membership and the frequency of medical service utilization is analyzed. The main results of these analyses can be summarized as follows: the socially vulnerable are less likely to join private health insurance relative to the middle and upper classes. The frequency of medical service utilization of private insurance members is relatively higher. This fact contains the possibility that the middle and upper classes are able to receive more medical services through private health insurance membership, while the socially vulnerable have difficulty with obtaining medical services in spite of much need. Therefore, policies are needed which manage the private health insurance more effectively and secure the publicity of health service socially.

  • The purpose of this study is to provide ways to utilize and create valuable medical information utilizing Medical Big Data created by field in hospital information system. The results of this study first creates new medical information of Medical Information system through medical big data analysis and integration of created data of PACS linked with many kinds of testing equipment and medical image equipment along with medical treatment information. Medical information created in this way produces various health information for treatment and prevention of disease and infectious disease. Second, it creates profit statistics information in various ways by analyzing medical big data accumulated through integration of billings and receipt, admission breakdown of patients. Profit statistics information created in this way produces various administration information to be utilized in profit anaysis and operation of medical institution. Likewise, data integration of personal health history, medical information of public institutions, medical information created in hospital information system produces valuable medical health information utilizing medical data.

New Medical Device Regulations (MDR) in Europe (유럽의 새로운 의료기기 규제제도 MDR)

  • MDR, a new European medical device regulation newly enacted in 2017, requires that medical device products that have received CE conformity certification through MDD be re-certified by May 2024 in line with the new CE MDR regulation. The new MDR requires more stringent medical device clinical evaluation and clinical investigation than the previous MDD required, and also require the submission of documented post-marketing surveillance data. Korean medical device makers also need to meet the new MDR requirements and obtain conformity certification, but the industry is still confused because they do not understand the new regulations thoroughly. In this study, medical device regulations in Korea, the United States, and Europe are compared, and the European MDR is further compared with the previous European Medical Device Directive MDD to help understand the requirements of the new European Medical Device Act.

  • 국민의 복지향상과 더불어 점차 증대되는 의료수요는 의료보험제도의 확대실시와 함께 국민에 대한 의료시혜를 점차 충족시켜아가고 있다. 그러나 한편 급증하는 의료수요와 함께 의료에 대한 선호도에 비해 의료기관의 발전은 현실성을 감안한 의료제도상의 각종문제로 인해 어려움을 겪고 있는 실정에 처해 있다. 본원은 이에 특히 병원제세면에 관심을 갖고 병원세제란을 마련하여 병원운영 발전에 일조가 되고자 하오니 회원병원의 많은 참여를 바라는 바입니다.
