Agenda-setting Process in Enacting the Korea's Nuclear Safety Act in 2011 adopting Multi Streams Approach (다중흐름모형을 통한 원자력 규제정책 의제설정 과정 분석: 2011년 원자력안전법 제정을 중심으로)

  • 본 연구는 2011년 "원자력안전법" 제정 사례에 있어 정책의제 설정 과정을 동태적으로 이해하기 위해 다중흐름모형을 활용하여 분석을 수행하였다. 연구범위는 이명박 정부와 제18대 국회임기가 겹치는 기간인 2009년부터 2011년 간 기간으로서, 동 기간은 UAE 원전수출과 후쿠시마 원전사고라는 정 반대의 초점사건이 발생하면서 두 차례 의제설정 여부를 결정하는 정책의 창이 개방되었다. 분석결과, 문제의 흐름 영역에서는 정부의 원자력 정책에 있어 진흥과 규제기능을 별도 법령으로 분리하고 독립된 예산 및 전담조직을 구성하는 체계를 구축해야 한다는 문제는 장기간 존재해왔다. 1990년대부터 소수의 법학자들을 중심으로 문제인식과 대안제시가 이뤄지는 정책의 흐름이 발전되어 왔는데, 이후 UAE 원전수출 이후 2010년에 이르러서야 본격적으로 표출집단인 관료와 국회의원을 통해 구체적 대안이 제시되었고, 2011년 후쿠시마 원전사고 직후인 5월 원자력안전법이 제정되었다. 분석결과, 2009년 UAE원전수출 이후, 수출 확대 목적으로 제시된 원자력 규제 독립 법안이 통과되지 못했던 것에 반해, 2011년 후쿠시마 이후 원자력안전법이 통과 된 이유는 대안의 가치정합성, 사회여론, 정치환경 등 정치의 흐름이 크게 작용한 것으로 분석되었다.

기획 - 국회 계류 원자력 관련 법률안 및 개정안

  • 본지는 2016년 10월호(통권 365호)와 2017년 2월호(통권 369호)를 통해 국회에 계류되어 있는 원자력 관련 법률안 및 일부개정법률안 36건을 소개한 바 있다. 그 이후 5월 24일 현재 '원자력발전소의 단계적 폐쇄 및 에너지전환 특별법안'이 발의되었고, 원자력안전법 일부개정법률안 6건, 방사성폐기물 관리법 일부개정법률안 1건, 발전소주변지역 지원에 관한 법률 일부개정법률안 2건 등이 발의되었다. 발의된 의안들은 현재 해당 소관위 심사중이며 본회의에서 처리된 의안은 아직까지 없다. 올해 2월 22일 이후 제안된 의안들을 사안별로 나누어 제안 이유와 주요 내용, 의안 전문을 게재하며 사계의 진단을 기대한다.

A Study on the Convergence Perception of Students in Radiology on the Reorganization of Safety Management System by person with frequent access of Nuclear Safety Act (원자력안전법 수시출입자 안전관리체계 개편에 대한 방사선학과 재학생들의 융합적 인식 연구)

  • This study will examine the awareness of students in radiology who have applied the reorganization of the safety management system of frequent visitors according to the amendment of the Nuclear Safety Act. A survey was conducted on 175 students from the Department of Radiology at K University. 98.1% of the students in the second grade, 90.3% in the third grade, and 97.7% in the fourth grade were recognized as need to be classified as person with frequent access by the Nuclear Safety Act. Limiting the operation of radiation equipment in radiography practice is a regulation that violates students' right to learn, and it is necessary to enact an exception rule for learning so that the right to study is not violated.

  • In medical institutions, there are radiation-related workers such as radiological technologists, physicians, dentists, and dental hygienists who handle diagnostic radiation generators. Also, there are work assistants, such as nurses and assistant nurses, who assist in radiation treatment or transfer patients to the radiation examination room. Radiation exposure management for radiation-related workers is carried out under the 「Medical Service Act」, but there is no legal basis for work assistants, etc. And the management of radiation exposure for diagnosis is regulated by the 「Medical Service Act」, and the management of radiation exposure by therapeutic radiation and nuclear medical examination is governed by the 「Nuclear Safety Act」. Thus, to improve the management of radiation exposure for diagnosis, the regulations on radiation exposure management for diagnosis under the 「Medical Service Act」 were compared and reviewed with those of the 「Nuclear Safety Act」. As a result, the main contents are as follows. First, it is necessary to legislate to include nurses, assistant nurses, and clinical practice students who are likely to be exposed to radiation besides radiationrelated workers as subjects of radiation exposure management for diagnosis. Second, when a radiation-related worker for diagnosis is confirmed to be pregnant, the exposure dose limit should be defined. Third, it is necessary to revise the regulations on the types of personal exposure dosimeters in the 「Rules on the Safety Management of Radiation Generators for Diagnostics」. Fourth, it seems that health examination items for radiation-related workers, radiation workers, and frequent visitors should be the same. Fifth, It is necessary to unify and regulate diagnostic radiation and all medical radiation, including therapeutic radiation and nuclear medicine, in one legal system.

  • 원자력안전위원회는 12월 8일 제62회 원자력안전위원회를 개최하고, '제2차('17~'21년) 원자력안전종합계획안'에 대한 심의를 거쳐 동 계획을 확정하였다. 제2차 종합계획은 '국민이 공감하는 원자력 안전, 방사선 위험으로부터 안전한 사회'를 비전으로 원자력, 방사선 및 핵안보 등 분야별 안전 강화를 위한 7대 전략 21개 중점 추진 과제를 포함하고 있다. 주요 내용은 ${\triangle}$정상 운전부터 중대사고까지 원전의 안전 관리 강화, ${\triangle}$정보 공개 소통을 통한 투명성 제고, ${\triangle}$해체 사용후핵연료 등 원자력산업의 후행주기 안전 관리 체계 구축, ${\triangle}$지진 등 재난대비 및 방사능 비상 대응 체계의 실효성 제고, ${\triangle}$핵안보 핵비확산체제의 국제사회 선도, ${\triangle}$환경 변화에 대응한 선제적 방사선 안전 관리, ${\triangle}$R&D, 인력 양성, 국제 협력 인프라 확충 등이다. 원자력안전종합계획은 "원자력안전법"에 근거하여 5년 단위로 수립되는 원자력 및 방사선 안전 관련 최상위 국가 계획이다.

Problems of the Radiation Safety Management System and Legal Improvement Plans in the Department of Radiological Science: Focusing on the survey of the head of the Department of Radiological Science (방사선(학)과 방사선 안전관리제도의 문제점과 법적 개선방안: 전국 방사선(학)과장 설문조사를 중심으로)

  • The current radiation safety management system is also applied to radiation practices at universities. The application of the law raised concerns about poor radiation practice education and hindering the development of radiology. Accordingly, the Korean Radiology Professors Association needed to grasp the reality of the management system for radiation practice education at each university and the current radiation safety management system in the department of Radiological science. So, a survey was conducted on heads of radiological science departments across the country. Through the survey, it was found that the current application of the Nuclear Safety Act to radiation safety management in the department of Radiological science is excessively restrictive and not very effective. In addition, radiology practice education for the purpose of training health and medical professionals should be controlled by the Ministry of Health and Welfare and the Korea Centers for Disease Control, but there is a problem of being supervised by the Nuclear Safety and Security Commission. Therefore, in this study, as a legal improvement plan to solve this problem, first, a plan according to a partial amendment to the Higher Education Act, second, a plan to be supervised by the Ministry of Health and Welfare through the amendment of article 37 of the Medical Service Act, third, article 20-2 of the Enforcement Decree of the Medical Service Technologists Act was newly inserted to propose three measures to be supervised by the Ministry of Health and Welfare.

A Study on the Exposure Dose of Workers and Frequent Workers in the Radiology Department (방사선(학)과의 작업종사자와 수시출입자의 교내 실습에 따른 피폭선량에 대한 고찰)

  • In this study, the purpose of this study was to analyze the degree of exposure of radiation workers assigned to the Department of Radiology and frequent visitors during on-campus practice, and to conduct a basic study on the feasibility and optimization of the radiation protection of the Nuclear Safety Act for the Department of Radiology. . The average exposure dose of occupational workers by year was 0.01 mSv, the lowest in 2014 and 2016. The highest figure was 0.12 mSv in 2018. The average exposure dose of frequent visitors by year was the lowest at 0.013 mSv in 2018, and the highest at 0.022 mSv in 2016. According to this study, the annual exposure dose received by professors, practical assistants, and students in the department of radiology (department) who use only radiation generators in the course of in-school practice is less than 1 mSv, which is the dose limit for the general public. Therefore, at the time when the radiation dose of students in the Department of Radiology is lower than the dose limit of the general public, the current safety regulation of the Nuclear Safety law is judged to be excessive regulation. Therefore, it is considered necessary to revise the regulations for radiation generators in the current Nuclear Safety law or to revise the radiation safety management system for university students.

  • Diagnostic radiation devices that is used in the country has reached to 78,000 units. When used for human subjects diagnostic purposes, it is subject to Medical Service Act, when used in diagnostic purposes in animal subjects, the subject to Veterinarians Act. When used for other purposes are subject to the Nuclear Safety Act. Even the same radiation devices varies the legislation that is applied depending on the intended use and object. Diversified been p rovisions a re necessary compared to t he analysis o f l egal content in o rder t o prevent confusion of the legislation is a matter to be applied. It is a qualitative study that Nuclear Safety Act, Medical Service Act and Veterinarians Act administrative procedures for the introduction of the applied diagnostic radiation devices, safety inspection, human resources management, area management and the content related to administrative punishment. The Nuclear Safety Act sub-provisions, the introduction of diagnostic radiation generating devices, there are many complex and complete requirements administrative procedures on the concept of a permit. Inspection of safety associated with the use, would be subject to periodic inspection auditing characteristics over the entire field of radiation safety management. It must receive court regular education for the safety administrator and workers. Unlike the reference of the radiation dose rate to specify the radiation controlled area there is a measurement obligation of radiation dose rate. Quantitative difference of administrative punishment that is imposed when legislation violation has reached up to 10 times, over the entire field, the largest burden of radiation safety management at the time of application of the Nuclear Safety Act sub provisions. And it is applied differently depending on the purpose and the imaging target using the same diagnostic radiation devices. Depending on the use mainly under the current legal system, radiation can be lacking in fairness of the contents of the legislation for safety management, there is a risk of confusion. Alternatives such as centralized and standardization of legislation by diagnostic radiation devices use is expected to be necessary.
