  • 본 논문에서는 정보화의 발전에 따라 사이버 공간에서의 청소년들의 사이버 폭력이 증가하고 있는 현실에 비추어 사이버 폭력의 개념과 유형을 알아보고 청소년들의 사이버 폭력의 발생 원인에 대해 청소년의 유일한 놀이문화로의 인터넷, 스트레스 해소, 청소년의 인정받고 싶은 욕구만족, 사이버 폭력에 대한 죄의식 결여로 나누어 간략히 살펴보고, 청소년의 사이버 폭력의 예방을 위한 대응방안에 대해 건전한 사이버 공간의 형성, 온라인서비스제공자(OSP)의 책임 강화, 사이버윤리교육 강화 등을 들어 보았다.

  • 본고를 통해 일반적으로 소비자, 이용자·네티즌 등의 법적의미와 온라인 사업자로 지칭되는 인터넷 기타 정보통신관련 사업자들의 법률 적용 범위를 명확히 함으로써 사업자, 전기통신사업자, 정보통신서비스제공자, 전자거래 사업자, 전자상거래 사업자, 통신판매업자의 관계를 관련 특별법을 통해 비교,분석해 그 정의와 법적 범위를 분명히 하는데 일조하고자 한다. 또한 이러한 관계에서 정보주체의 개인정보 도용사례를 기술적 과정과 동향을 통해 구체적으로 살펴보기로 한다.

A Study on the Copyright Protection Liability of Online Service Provider and Filtering Measure (온라인서비스제공자(OSP)의 저작권보호 책임과 필터링)

  • Although the primary liability for online copyright infringement may fall on the individual who illegally copies, transfers, and/or distributes the copyrighted content, the issue of indirect liability for Online Service Providers (OSPS) that provide a channel for the distribution of illegal content has recently come under the spotlight. Currently, in an effort to avoid liability for indirect copyright infringement and improve their reputation, most OSPs have voluntarily applied filtering technology. Under the Copyright Act of Korea, special types of OSPS including P2P and Web-based Hard Drive (WebHard) are required to incorporate filtering technology, and may be charged with penalties if found without one. However, despite the clear need for filtering mechanisms, several arguments have been set forth that question the efficacy and appropriateness of the system. As such, this paper discusses the liability theory adopted in the US. -a leader in internet technology development-and analyzes the scope of liability and filtering related regulations in our copyright law. In addition, this paper considers the current applications of filtering as well as limits of the applied filtering technology in OSPS today. Finally, we make four suggestions to improve filtering in Korea, addressing issues such as clarifying the limits and responsibilities of OSPS, searching for cooperative solutions between copyright holders and OSPS, standardizing the filtering technology to enable compatibility among different filtering techniques, and others.

  • 인터넷과 멀티미디어 기술의 발달은 우리에게 다양한 콘텐츠를 손쉽게 접할 수 있는 환경을 제공하였다. 그러나 멀티미디어 콘텐츠의 무분별한 복제와 불법유통으로 인한 저작권 침해는 심각한 사회적 문제로 대두되고 있다. 이에 정부는 저작권법을 전면 개정하면서 강력한 대응책을 마련하고 있다. 특히 개정 저작권법은 동영상, 음악, 게임 등 다양한 콘텐츠에 대한 불법 유통을 방지하고자 특수한 유형의 온라인서비스제공자들의 기술적 조치(필터링)를 의무화하고 있다. 이에 따라 필터링기술에 대한 관심이 높아지면서 해당 온라인서비스사업자(OSP)들은 필터링 기술의 적용을 준비하고 있으며, 기술개발업체들은 법적 기준을 충족시킬 수 있는 필터링 기술의 개발을 위해 노력하고 있다. 본 고에서는 이러한 상황의 배경과 필터링 기술의 개요와 국내외 동향 및 향후 전망을 제시한다.

  • 인터넷 이용이 활성화되면서 온라인서비스의 종류와 양은 계속 증가하고 있다. 최근에 서비스제공자들은 이러한 다양한 서비스들을 효율적으로 제공하기 위해 개인화서비스를 제공하기 시작하였고, 이에 따라 개인정보의 중요성은 더욱 증대되고 있다. 하지만 개인정보의 수집은 프라이버시 침해 문제를 유발할 수 있어 개인화서비스는 쉽게 적용되지 못하고 있다. 또한 다가오는 유비쿼터스 환경에서는 수집 가능한 개인정보의 증가가 예상되며, 따라서 프라이버시 침해 문제는 더욱 심각해질 것으로 예상된다. 본 고에서는 개인화서비스 모델에 대해 소개하고, 개인정보 보호를 위한 기존 기술들에 대해 분석하여, 유비쿼터스 환경에서의 개인화서비스를 위한 개인정보 보호방안에 대한 제언을 하고자 한다.

A proposal of assurance model based on i-PIN assurance level (아이핀 보증 등급에 기반한 보증 모델)

  • The electronic transactions over the Internet are growing across the world recently. There have been a lot of identity theft incidents during these online transactions nowaday. Therefore, a high level of identity proofing shall be carried out when using online services to deal with these matter. To prevent this kind of incident, i-PIN was introduced in Korea, which is used as an Internet Personal Identification Number. The i-PIN is designated to provide an online identification of the Internet users. As such, the unique identification numbers are provided to the internet service providers. This paper is to analyze the capabilities that the i-PIN provides, to propose the assurance security model for i-PIN. Furthermore, the security analysis results are presented. The result of this paper can be applicable to improve the applicabilities of the i-PIN.

  • Defamation is one of the most frequently occurring daily legal violation because it can easily be done by words. In the internet generation with flooding internet forum websites and social network services, internet defamation is becoming one of the most serious problems in many leading IT countries including Korea and the United States. Being such a critical issue that can lead to a suicide, Korean policy makers has undertaken efforts to prevent the internet defamation by defining the liabilities of internet users and internet service providers. Many of the policies and laws including "the Telecommunication Information Usage Promotion and Security Protection Act of 2007" are modeled after that of the United States. Thus, the study aims to explore American defamation law and internet defamation law analyzing "the Communications Decency Act of 1996" and a recently decided precedent, "Brodie" case, in Maryland state court.

Sentiment Analyses of the Impacts of Online Experience Subjectivity on Customer Satisfaction (감성분석을 이용한 온라인 체험 내 비정형데이터의 주관도가 고객만족에 미치는 영향 분석)

  • The development of information technology(IT) has brought so-called "online experience" to satisfy our daily needs. The market for online experiences grew more during the COVID-19 pandemic. Therefore, this study attempted to analyze how the features of online experience services affect customer satisfaction by crawling structured and unstructured data from the online experience web site newly launched by Airbnb after COVID-19. As a result of the analysis, it was found that the structured data generated by service users on a C2C online sharing platform had a positive effect on the satisfaction of other users. In addition, unstructured text data such as experience introductions and host introductions generated by service providers turned out to have different subjectivity scores depending on the purpose of its text. It was confirmed that the subjective host introduction and the objective experience introduction affect customer satisfaction positively. The results of this study are to provide various implications to stakeholders of the online sharing economy platform and researchers interested in online experience knowledge management.

  • The new article, related to temporary copy on exploitation of copyrighted works, has been introduced in the copyright law as partly revised on December 2, 2011. While number of researches on in-network caching including Content-Centric Networking are conducted quite actively in recent years, the need for legal and institutional considerations has arisen since temporal storage (i.e. temporal copy) may be made not only at user devices but also in routers such as network equipments. This paper examines issues on temporary copy of copyrighted works mainly focusing on the articles and the related articles of the recently revised copyright law as well as the Free Trade Agreement between the Republic of Korea and the United States of America and further studies necessary institutions required to actualize in-network caching.

Service Innovation in Digital Contents Industry: A Case of Korean Online Games (디지털컨텐츠산업의 서비스혁신 패턴 분석: 온라인게임 사례를 중심으로)

  • The paper presents and empirically tests a model of the digital contents(DC) innovation systems that enables us to study interactions between users, service providers, contents developers and network providers, and to examine the relationship between manufacturing innovation and service innovation as well as patterns of innovation in the DC industry. The framework of Gallouj and Weinstein(1997) and Gallouj(2002) is modified into the DC innovation model according to characteristics of the DC industry, that is, user involvement and network externalities. The model is applied to a case analysis that traces the growth of the online game industry in Korea since its introduction. The model offers several advantages over other approaches in understanding the dynamics in the DC industry. Most importantly, it provides a single unified basis within which both service innovation resulting from users and service providers and manufacturing innovation induced by contents developers, platform holders and network providers are analyzed. The distinction between service and manufacturing innovation is important in many ways, for instance in selecting proper government policy tools for promotion or regulation of the DC industry. Second, the Korean online game industry has experienced both radical innovation during the beginning period and non-radical innovation throughout the maturation period. The model developed herein helps to illustrate several types of non-radical innovations such as recombinative innovation that are crucial to sustainable development of the DC industry. Third, the model clarifies impacts of network externalities that are characteristics of the DC industry.
