A Study on the Court Records Management System (법원기록관리체제 연구)

  • This paper historically examines how the management system of administrative records and court records generated in court were established, and what it's features are. Because the court exercises jurisdictional rights such as confirming the legal rights and responsibilities of Korean nationals, the court records have a unique characteristic compared to general administrative records. In particular, court records are not composed only of rulings generated in courts, but also of various records such as civil case records and criminal case records. In order to understand the legal records management system, we must first identify the method of preservation and management after these records, which have different provenance, pass the court procedures.

Establishing the Educational Archives through Integrating Museum, Archives and Library Functions in Gyeongsangnam-do (통합형 지방교육기록물관리기관 설립 방안 : 경상남도를 중심으로)

  • This study is to investigate the development of 'Educational Larchiveum' especially for the Kyeongsangnam-do Provincial Office of Education. 'Educational Larchiveum' means Educational Archives including some museum and library functions. This study begins with articulating that why the provincial offices of education should establish their own archives despite of legal obligation. It draws the roles of 'Educational Larchiveum' and its environmental requirements, based on analysing the Archives/Museum case of Toronto District School Board Education. Finally it suggests that how Gyeongsnam-do Offie of Education can establish the 'Educational Larchiveum' in condition of integration of the Gyeongsnam-do Educational Museum and the private educational museum(Park Yeon-mook Educationl Museum).

A Case Study on the New Administrative Capital Construction Records Management: Focusing on the Arquivo Publico do Distrito Federal of Brazil (신행정수도건설기록물 관리 사례 연구: 브라질의 ArPDF를 중심으로)

  • The new administrative capital construction project is an important national project implemented to relocate the national administrative capital, and the records produced during the construction have high historical value. However, Korea's management of these records related to the construction of the new administrative capital is insufficient; thus, finding a management plan is necessary. In contrast, Brazil is a country that collects, builds, and maintains both public and private records produced during the construction of Brasilia, the new administrative capital. Thus, Arquivo Publico do Distrito Federal (ArPDF), the Brazilian records management organization established to manage Brasilia's construction records, was selected as the case analysis subject in this study. By analyzing ArPDF's website and official publications, this study investigated the overall matters related to the management of new administrative capital construction records and derived implications applicable to the management of new administrative capital construction records in Korea.

A Study on the Archives in the Federal Republic of Germany (독일 연방기록물관리법령 연구)

  • Records Management Act of a country is the basis for understanding its archives management system. Germany is regarded as a country that achieved remarkable development of the system in the process of nationalism and unification based on romanticism in the 19th century. In addition, the federal and local governments enacted and operated their own laws based on the administrative system of the federal structure. Recently, the National Archives of Korea is discussing ways to improve its expertise and the system of operation in conducting national records management. Therefore, it is meaningful to analyze Germany's Records Management Act, which has a management system of long-standing historical records and examine its features. In this study, we analyzed and derived the characteristics of the Federal Records Management Act, which is the standard for the management of Federal Records in Germany.

Presidential Archives Management in Crisis - An Archival Approach to the Solutions - (위기에 처한 대통령기록물관리, 문제의 인식과 해결을 위한 접근 방식)

  • This paper reviews recent records issues surrounding former president Roh Moo-Hyun's private possession of the copies of the presidential records in Korea. While the former president transferred his records to the National Archives of Korea, he copied his electronic presidential records and kept them in his house after the term. His retention of the "records copies" arouse critical records issues and criminal charges. In this paper, I examined the definition of presidential records and legal status of records copies, authenticity of electronic copies of public records in public and private records systems, nature and scope of presidential privilege of access to his records, and most importantly, political neutrality of national archives. I examined these issues comparing with foreign experience, especially that of the United States which has the Presidential Records Act like Korea. All issues are examined in the professional spirit of archives principles and archives ethics. Legal status of the electronic copies of presidential records is not firmly established and the criminal charge seems groundless. However, it is against public archives principles and ethics that private former president privately possesses and manages private information and national security information held in the electronic copies of the presidential records. Presidential Records Act of Korea provides an effective tool to protect the presidential records for 15 years and it should be respected. It is time to consolidate the public records management institutions in Korea, not to disintegrate them.

  • The aim of this study is to figure out a good point through comparing Korea's organization with Europe's Record Management regulations and organizations especially Britain, France, Germany. To the end, this study analyze each country's contents and distinctive features of Record Management laws, organizations and preservations for Record Management, training courses for Record Management Professional and business systems for Record Management. As a result of this study, main topic from three country's Record Management system is as follows. 1st, Promoting the use of public records and guaranteing the right of admission. 2nd, Encouraging local archives to be the center of local culture and history research. 3rd, Dividing of Record Management Professionals into levels and training as government official system. 4th, strengthening the collection and preservation of historical personal records.

A Study on Improving Records Management of Closed Private Universities (폐교 사립대학 기록물 관리 개선 방안에 관한 연구)

  • The recent demographic cliff caused the schooling population to steadily decline and the number of college admissions to sharply drop, which led to the prediction of the Ministry of Education wherein 38 universities in Korea will be closed within the next 3 years. As such, the legal, administrative, historical, and informational values of university records shed light on the importance of the follow-up process and management of closed university records. Although closed university records need to be systematically managed according to legal procedures similar to other public records, there is no practical and clear legal standard for the management of such records at present. Moreover, management standards considering the characteristics of (closed) university records and individual universities' situations and specificity have been insufficient. This study, therefore, examines the ambiguous standards for closed university records management and analyzed relevant problems. Furthermore, an integrated management system is suggested as a way to improve the records management of closed universities.

  • The main purpose of the archives is to maintain a history of the organization's functions and activities. Selecting valuable records for the permanent archives through objective appraisal from among many records that reflects the activities of organization is very important but also very difficult. The quantity and complexity of comtemporary records has rapidly expanded because of electronic storage, and with the information environment, and it is now possible to manage and control the records an entire lifetime. In this study, it is proposed the appraisal methods based on a business analysis that is combined the macro-appraisal factor and micro-appraisal factor; The former is functions and organizations as the objective guideline of selecting valuable records from the beginning and the latter is a contents appraisal (evidential value) of the individual records.

  • 겨울철이 되면 우리 주위에서는 불조심 강조 포스터를 쉽게 볼 수 있다. 학창시절 한번쯤은 불조심포스터 공모에 관심을 가져보지 않았던 학생은 드물었을 것이다. 한국화재보험협회(이사장 박정훈)에서는 금년도 불조심포스터 수상작을 발표, 지난 10월7일 시상식을 거행했다. 이에 본지에서는 그동안 한국화재보험협회가 주최한 불조심포스터 공모 수상작들을 살펴보는 한편, 포스터의 역사와 종류에 대해 알아보았다.

History and Archives : Colleagues or Strangers? (역사학과 기록학 학문의 인연, 학제의 괴리)

  • By redefining the concept of history, my colleagues and I have reformed our department in terms of curriculum and faculty members. This paper is a report of some of the conclusions that we have obtained from this procedure. Despite a long relationship, two disciplines do not seem to match or complement each other in the Korean education system. We believe that this is due to the fact that the Department of Korean History has focused on "national history (NH)." By conferring a privilege on NH, persons, families, societies, regions, and others were removed from NH. To make matters worse, a biased view that history is just an interpretation has prevailed, and the empiricism of history was weakened, which brought about an indifference in keeping records and archives. In East Asia, "history" means both modern history and archives. The concern about the authenticity of records did not come from H. Jenkinson or L. Duranti, and not even from the electronic environment or the Public Records Act of 1998. Key concepts such as records, documents-archives, manuscripts, authenticity, compilation-appraisal, arrangement, and description are different from their signifiant but are same or similar to their $signifi{\acute{e}}$. In case of "provenance" and "original order," they are used in education and practice in the traditional archives. History includes the recording, archiving, and the story or historiography of an event. In this context, the Department of Korean History should contain a more archives-oriented curriculum and select an archival-trained faculty. On the other hand, the department has accumulated long-term experience with appraisal and description of records; thus, archival science should absorb the criticism of the material. History will be shaken without the help of archives, while archives will lose their root without history. We are at the point in which we need to be reminded why we want to be a historian or an archivist, and for this, the more colleagues, the better.
