  • 어린이의 안전이 확보되기 위해서는 단속 및 규제 외에도 가장 확실하고 장기적인 효과를 거둘 수 있는 교육정책이 실행되어야만 한다. 이미 선진국에서는 오래전부터 체계적인 안전교육을 실시함으로써 국민의 삶을 쾌적하게 보장해주고 있다. 따라서 지금부터라도 체계화된 안전교육을 의무적으로 실시한다면 어린이 안전사고를 크게 줄일 수 있는 전기를 마련할 뿐만 아니라 다음 세대를 지키는 좋은 선물이 될 것이다.

Content Regulation: Meeting the Regulatory Challenge in the Age of Media Convergence (미디어 융합시대 콘텐츠 규제방안과 과제 - 심의제도를 중심으로 -)

  • This study takes a critical perspective that current vertical regulatory framework for broadcasting, telecommunications, films and games cannot cope with media development in the age of convergence. Changes in media environment mitigate the uniqueness of terrestrial television causing doubts as to why television contents should be treated more strictly than the rest of media contents. Consensus is being reached that horizontal regulation would be the appropriate regulatory measure for media contents. However, which content should be aligned to what level of regulations have not been fully dealt with. The paper shows that the current regulatory framework which is established according to each delivery platform is no longer valid in convergent media environment. It shows why all content regulation should be applied in platform neutral manner. Then it also suggests both short and long term regulatory changes that need to be made in order to meet the future challenges in media convergence era.

A Study on the Legal System of Korea Nano-safety Related Regulations (국내 나노안전성 관련 규제의 법체계 고찰)

  • Recently, the social issue about harmful effects of nano-materials including nano-products to human body and environment have been raised, which were not expected in times past. To prevent the risks of nano-materials on the environment and human body, the regulatory policies are reinforced to ensure public health in world trends. In Korea, governmental department has prepared the policy for 'National nano-safety Management Master Plan' since 2011. However, it is very hard to manage all kinds of nano-materials, due to lack of nano-safety law and a wide range of nano-technology application. This study aims to analyze the current situation of the national policy related to nano-safety management and legislation, and also review the limitation of current system to propose improvement plan for nano-safety.

A Study on the Necessity and Direction of Regulations on the Emission of Hazardous and Noxious Substances from Marine Industrial Facilities (해양산업시설의 위험유해물질 해양배출 규제체계 개선의 필요성과 규제방향에 대한 연구)

  • In this paper, the current status of marine industrial facilities, regulatory legal systems, and emission status of hazardous and noxious substances (HNS) in these facilities were analyzed, and the direction of improvement of the regulatory system was presented accordingly. As a result of the analysis, it is estimated that about 1,100 marine industrial facilities are subject to the Marine Environment Management Act of 2007. It is estimated that 190 kinds of hazardous substances are discharged from these marine industrial facilities and are highly likely to flow into the ocean, of which 20 are estimated to be discharged into the water system. However, due to the lack of relevant laws and regulation, it is difficult to clearly determine whether the discharged material corresponds to an exceptional discharged material, making it difficult to effectively enforce regulations in the field. For this reason, effective regulatory enforcement is difficult in the regulatory field. The marine environment management law should clearly stipulate the exceptional emission standards and types of substances, and clarify the selection system, risk assessment system, and emission information collection and monitoring system for related Hazardous and Noxious Substances.

The Definition and Regulations of Drone in Korea (韓国におけるドロ?ンの定義と法規制)

  • Under the Aviation Safety Act of Korea, any person who intends to operate a drone is required to follow the operational conditions listed below, unless approved by the Minister of Land, Infrastructure, Transport and Tourism; (i) Operation of drones in the daytime, (ii) Operation of drones within Visual Line of Sight, (iii) Maintenance of a certain operating distance between drones and persons or properties on the ground/ water surface, (iv) Do not operate drones over event sites where many people gather, (v) Do not transport hazardous materials such as explosives by drone, (vi) Do not drop any objects from drones. Requirements stated in "Airspace in which Flights are Prohibited" and "Operational Limitations" are not applied to flights for search and rescue operations by public organizations in case of accidents and disasters. This paper analyzes legal issues as to definition and regulations of drones in Korean Aviation Safety Act. This paper, also, offers some implications and suggestions for regulations of drones under Korean Aviation Safety Act by comparing the regulations of drones in Japanese Civil Aeronautics Act.

  • 해상교통안전진단제도(이하 제도)의 고도화를 위하여 제도 및 법적 체계의 개선을 실시하였다. 하지만, 사업자를 비롯한 관련기관들은 제도 체계에 대한 인식 부족으로 제도를 규제로 보는 인식이 늘어나게 되었다. 따라서 본 연구에서는 사업자를 비롯한 관련기관들의 제도에 대한 이해도를 높이고, 제도에 능동적인 참여를 유도하기 위하여 제도의 프로세스 분석을 실시하게 되었다. 프로세스 분석은 개정된 해상교통안전진단 시행지침 중 "제2장 안전진단 및 안전진단서", "제3장 안전진단서 제출 면제사업 및 의견서 작성"의 안전진단항목 결정절차, 안전진단서의 제출 및 사전검토 절차, 진단면제의견서 검토절차에 대하여 실시하였다. 이는 제도의 교육자료 및 가이드북의 내용으로서 활용할 예정이다.
