The Study on Aviation Crime in Aviation Safety and Security Act of Korea ("항공안전 및 보안에 관한 법률"에 있어서 항공범죄에 관한 연구)

  • Soon after September 11 attacks in 2001, there were strong demands in Korea on making relevant laws and regulations on aviation security, and Korean parliament legislated "Aviation Safety and Security Act"to fulfill the demands on safety and security of aircrafts during aviation. However, the current Aviation Safety and Security Act seems to have many problems which do not meet the practical needs in Korea, because there were not enough considerations on the practical needs and extinguishable national circumstances on civil aviation system in Korea, but only regarded the relevant international conventions and foreign practices on it. In this context, it is necessary to amend several provisions in Aviation Safety and Security Act to enhance more practical efficiencies in its implementation through systematization of the provisions on crimes which may happen during aviation. In this context, this article argues two main issues. First, Article 39 of Aviation Safety and Security Act does not express whether it is possible to punish the attempt of crime of causing damage to aircraft. Therefore, regarding a principle of legality, it is impossible to punish the perpetrator even when coincidently failed to destruct or damage aircraft. In this context, this article argues that the necessity to introduce the possibility to punish the attempt of crime of causing damage to aircraft. Second, regarding Article 160 of Civil Aviation Act of Korea, current Aviation Safety and Security Act should be amended by guaranteeing the culpability of negligence of crime of causing damage to aircraft.

  • Block system has been used to protect trains from occupying the same section of track at the same time so that only one train is permitted in each block at a time. Domestic driving regulations on the block system is divided into two classifications, such as regular block and substitute block. If it is impossible to use this regulation, the block applied method can be applied. However, domestic urban railway administrator has established his own operation rule within the regulation. Therefore, in order to assure continuous safety of train in operation, it is necessary to strengthen the regulation as can cope with the various block systems. In this study, domestic urban railway administration's own rules are examined and the appropriate driving regulation on the block system is proposed.

  • As the urban railroad durability period law has revised on march 19, 2009, the life cycle of urban railroad cars has lengthened to 40 years for the longest period. It seems to be attributed to the development of railroad car making technique along with their durability being longer thanks to the quality improvement of their materials and parts. As the stability of urban railroad cars is directly linked to the safety of passengers, safety should be considered first, and more precise examination is necessary for endurance extension. Hereupon, the rolling stocks with their durability near expiration should get precise diagnosis following the revised "RDG for urban railroad cars" This study aims to suggest a diagnosis method for the institute and the urban railroad operating body which enforce the revised diagnosis, through the case of Busan transportation corporation which firstly started the revised diagnosis after the durability related law has been revised.

The Effect of Behavior Based Safety Program on Safe Behaviors of Bus Drivers and Passengers: A Field Case Study (행동기반 안전관리(Behavior Based Safety: BBS) 프로그램이 버스 기사 및 승객의 안전행동에 미치는 효과 검증: 현장 사례 연구)

  • This study examined the effect of Behavior Based Safety(BBS) program on safe behaviors of bus drivers and passengers. Four male bus drivers working at a H transportation company situated in Seoul participated in this study. BBS program consisted of education, prompts, and self-monitoring with goal setting. Dependent variables were the percentage of two safe driving behaviors of bus drivers (departure after stopping for 3 seconds, announcement for holding bus handles) and the percentage of one safe behavior of passengers getting on the busses those drivers drove (holding bus handles). A primary observer and two trained assistant observers measured two safe behaviors of the bus drivers with behavior checklists by riding on the busses and the passengers' safe behavior was observed by CCTV installed on each bus. An ABC multiple baseline design across participants was adopted. After baseline(A), education and prompts(B) and self-monitoring with goal setting(C) were introduced sequentially to each participant. The results showed that BBS program was effective to increase both bus drivers' and passengers' safe behaviors. Especially self-monitoring with goal setting was more effective in improving safe behaviors of bus drivers than education/prompts. These results suggest that education/prompts and self-monitoring with goal setting would be an alternative treatment technique to improve safety for lone workers such as bus drivers.

A Study on Priority Evaluation of the Rope-type Platform Safety Door(RPSD) Installation by Multi-criteria Decision Analysis (다기준 분석에 의한 로프형 승강장 안전도어의 설치 우선순위 산정에 관한 연구)

  • Recently, a study on the commercialization of Rope type Platform Safe Door (RPSD) technology has commenced. The study focuses on RPSD, in which a rope screen ascends to allow safe passage from the platform to the transit vehicle in aboveground stations. Currently, a pilot installation has taken in place with Daegu Metro Line 2 in MoonYang station starting from March of 2013. However, there is a need to select an appropriate pilot installation's object for the improvement in the future RPSD. An appropriate designation would correspond with the needs of the railroad corporation and as a historic railway platform with safe facilities. This study tried to usa Analytic Hierarchy Process (AHP) to determine the priority of the KTX stations to attain a list of appropriate designations for future RPSD installations by analyzing the followings: management of the facilities, operational risks, and intent of business projects. As a case study, it was applied to the evaluation of the KTX stations. For the application, it used relative measurement to calculate the weight of upper level structuring, and absolute measurement for low level structuring instead of pairwise comparisons.

  • To improve occupants' safety in an emergency, crashworthy design is necessary to rotorcraft design and development. Especially, landing gear has the important role for crashworthy design because landing gear absorbs relatively large energy for the crash landing. In addition, military specifications require failure of landing gear shall not increase danger to any occupants by penetration of the airframe. To meet the specification requirements, crashworthiness device like failure mechanism should be prepared so that landing gear is collapsed safely and doesn't penetrate the airframe. In this study, design and design development test of the failure mechanism which is necessary for the rotorcraft landing gear was performed. First, collapse scenario was determined for the landing gear not to penetrate the airframe. Then, the failure pin which is the most important part of the failure mechanism was designed with 2 strength range in order to meet design criteria. Finally, design of the failure mechanism was verified successfully by design development test.

A Study on the Legislative Guidelines for Airline Consumer Protection (항공소비자 보호제도의 입법방향)

  • From a historical point of view, while the Warsaw Convention was passed in 1924 to regulate the unified judicial responsibility in the global air transportation industry, protection of airline consumers was somewhat lacking in protecting air carriers. In principle, the air carrier does not bear any obligation or liability when the aircraft is not operated normally due to natural disasters such as typhoon or heavy snowfall. However, in recent years, in developed countries such as the US and Europe, there has been a movement in which regulates the air carriers' obligation to protect their passengers even if there is no misconduct or negligence. Furthermore, the legislation of such advanced countries imposes an obligation on the airlines to compensate the loss separately from damages in case the abnormal operation of the aircraft is not caused by force majeure but caused by their negligence. Under this historical and international context, Korea is also modifying the system of aviation consumer protection by referring to other foreign legislation. However, when compared with foreign countries, our norm has a few drawbacks. First, the airline's protection or care obligations are mixed with the legal liability for damages in the provision, which seems to be due to the lack of understanding of the airline's passenger protection obligation. The liability for damages, which is governed by the International Convention or the Commercial Act, shall be determined by judging the cause of the airline's liability in respect of the damage of the individual passenger in the course of the air transportation. However, the duty to care and the burden for compensation shall be granted to all passengers who feel uncomfortable with the abnormal operation regardless of the cause of the accident. Also, our compensation system for denied boarding due to oversale is too low compared to the case of foreign countries, and setting the compensation amount range differently based on the time for the re-routing is somewhat unclear. Regarding checked-baggage claim, it will be necessary to refund the fee only from the fact that the baggage is delayed without asking whether there is any damage occurred from the delayed baggage. This is the content of the duty to care, which is different from the current Commercial Act or the international convention, in which responsibility is different depending on whether the airline takes all the necessary measures in order to prevent delaying of the baggage. The content of force majeure, which is a requirement for exemption from the obligation to care passengers on the airplane, shall be reconsidered. Maintenance for safe navigation is not considered to be included in force majeure, and connection to airplanes, airport conditions are disputable. According to the EC Regulation, if the cause of the abnormal operation of the airline is force majeure, the airline's compensation obligation is exempted but the duty to care of airline company is still meaningful. Furthermore, even if the main role of aviation consumer protection is on an airline, it is the responsibility of government agencies to supervise the fulfillment of such protection obligations. Therefore, it is necessary for the Korean government to actively take measures such as enforcing incentives for airlines that faithfully fulfill their obligation to care and imposed penalties on the contrary.

A Study on Smoke Extract Vents in a Subway with Screen door by Evacuation Performance Evaluation through RSET vs. ASET based on Computer Simulations (스크린도어가 설치된 지하철 승강장의 대피안전성 평가를 통한 제연환기구의 방재성능 개선방안 연구)

  • This study provides comprehensive design improvements covering technical issues concerning life safety matter In case of fire train stoppage in the middle of a tunnel. Recently Government announced that most of subway platforms will have screen doors in 3 years. Therefore, many fire safety engineers considered that they may contribute on life safety on train stoppage in tunnel. Especially The screen door can protect platform from smoke along tunnel ceiling when fire train stopped in tunnel. The study showed that platform ventilation ducts and the a tunnel ventilation chimney in the middle of tunnel in exiting subway tunnel could not guarantee life safety ability in terms of RSET vs. ASET comparison. Furthermore during evacuation process many peoples may be threatened from the smoke spread from the origin of fire. Although only additional vertical route can be installed in tunnels In order to decrease RSET, it will costs high or no spaces remains in outside on the road. The study suggested that increase of ASET can be best solution without additional escape route, therefore alternative design methods suggested on the base of simulation results. Finally the study shows alternative methods can give good result in terms of evacuation performance evaluation. The evacuation performance evaluation helps the decision-maker to determine the preferred alternatives or upgrades to existing tunnel infrastructure and other measure to meet safety objectives. Finally, the study details the effectiveness of measures the can be taken to reduce the risk of incidents in subway tunnels.

A Study on Shaft Dynamic Characteristic for G/T 250TON Double-Ended Car-Ferry (G/T 250톤 양방향 차도선 축계의 동특성에 관한 고찰)

  • The car ferry operating between the mainland and the island plays an important role on transportation of goods and passengers. Therefore, the improvement of efficiency and safety as well as economic factor are importantly considered in the development process of car ferry. Double-ended car ferry is already popularized because of its economic feasibility and convenience for passenger in Europe and developed countries, and the demand is booming in domestic. In this paper, dynamic characteristics of propeller shaft and strength in double-ended car ferry are analyzed using campbell diagram and modal analysis. Based on the analysis of dynamic characteristics, resonant phenomenon and critical speed are stable when occurring the propeller shaft vibration due to forward and reverse propeller shaft working.

Assessment of the Structural Safety for Light-Weight Steel Twin Car-Ferry for Coastal Voyage (연안 항해용 스틸 쌍동 차도선의 경량화 모델 및 구조안전성 평가)

  • This paper discusses the main findings of the development of the twin-hull Car ferry for island freight and passenger transport. The final model had a 19 m wide beam to create enough space for cars on the deck area and thus, enhance the economic feasibility in the market. The vessel had a V-shape with a bulbous bow to minimize the wave-making resistance and the hydrodynamic performance of the ship was verified through computational fluid dynamics. Multi-objective optimization problems of Pareto simulated annealing were used to achieve a weight reduction of approximately 3.9 % and reduce the manufacturing cost. The main results obtained in this study are expected to be useful to engineers and professionals in related industries interested in research on twin catamaran.
