Understanding the Access and Benefit-Sharing of Genetic Resources for Microbiology Researchers (나고야의정서 이행에 따른 새로운 유전자원 접근 이익공유 체계의 이해와 미생물 연구자의 대응방안)

  • Following enforcement of the Nagoya Protocol (NP), in which the sovereign rights to genetic resources of countries are recognized, new legal obligations regarding access and benefit-sharing (ABS) that did not exist before have now been imposed on researchers. To implement the NP, many countries are introducing new procedures and regulations when a researcher wants to obtain genetic resources for commercial or noncommercial uses. It is therefore expected that resource-rich countries will adopt strong regulations to protect their genetic resources. In this regard, Korean microbiologists will need to respond to these changes to minimize the potential damages caused by the ABS. This paper reviews the key contents of the NP to raise its awareness among scientific researchers and further presents specific measures to meet the ABS obligations accordingly. For example, Korean researchers, in principle, do not need to acquire Prior Informed Consents (PICs) when they access Korean microbial resources for both commercial or research purposes. Nevertheless, when a foreign culture collection agency such as DSMZ requests a confirmation of compliance with the NP to deposit genetic resources, Korean researchers can also apply for a PIC with the Korean government as an exception. By referring to this article, microbiologists will be able to conduct their research in compliance with the NP while respecting the legal ABS obligations of each resource-providing country.

An art exhibition needs assessment survey of persons with visual impairment (시각장애인의 전시예술품 관람 욕구조사)

  • The study was to improve the right to the enjoyment of culture of persons with visual impairment by increasing the accessibility to art exhibitions and exploring assistive measures through needs assessment survey of persons with visual impairment on arts exhibition. We used total 83 responses collected through an online survey. The result are as follows. First, watching movies at a teather was the most frequent leisure activity among persons with visual impairment, while respondents reported attending art exhibitions as the least frequent activity. Yet, 71.1% included attending art exhibitions as one of their top 5 culture and leisure activities. Most of the respondents reported the purpose of attending art exhibitions as fun. However, a primarily visual atmosphere prevented them from visiting the exhibition. Second, persons with visual impairment preferred approaching the art to have a closer look. More than about 50% of the respondents used their residual vision. Most of the respondents reported to use more than two senses when appreciating the exhibits. Moreover, respondents reported that devices/services for multi-sensory experiences would be helpful to appreciate the art. The findings imply that the consideration of the characteristics and needs of persons with visual impairment is required for establishing the environment of art exhibitions. This could further contribute to the improvement of the right to the enjoyment of leisure and culture of persons with visual impairment and lead to the realization of social integration.

Human Rights-based Approach toward International Development Cooperation and Canada's ODA Accountability Act (국제개발협력의 인권적 접근과 캐나다 ODA책무법)

  • Canada became the first OECD/DAC member state that legislated the ODA Accountability Act in 2008, which prescribe Canada ODA policies to meet the guidelines and norms of international human rights while other OECD/DAC member states was just emphasizing the importance of abiding by the international human rights norms. Paying attention to the Canadian case, this article critically examines under what structural environments and process this Act was passed. This article argues that the legislation of the ODA Accountability Act is closely related with Canada's international position as middle power and diplomatic strategies. Bring up the human security issues as a niche market, Canada demonstrates the characteristics of middle power state by emphasizing human rights agenda as new foreign policy strategies. Reflecting on the negative outcomes from neoliberal aid policy of structural adjustment and promoting the new aid norms in post cold war era would also help foster the enabling environment for the value-oriented aid policies and enactment of the Accountability Act. Civil society organizations were also playing catalyst role in constructing Canada's state identity of human rights defender.

Nurses' Perceptions of Person-Centered Care in Long-term Care Hospitals: Focus Group Study (인간중심돌봄에 대한 요양병원 간호사의 인식: 포커스 그룹 연구)

  • This study was conducted to understand and describe Korean nurses' perception of person-centered care for elderly patients in long-term care hospitals. Qualitative data were collected through four focus group interviews consisting of 21 nurses working in four long-term care hospitals in Jeolla and Gyeongsang provinces. Participants completed interviews from July 19 to 30, 2018. All interviews were recorded, transcribed, and analyzed by employing the thematic analysis method. Six main themes for the attributes of person-centered care for elderly patients in the long-term care hospitals were conceptualized: respecting individual needs, walking to the end, supporting hidden dreams, becoming a family partner, helping patients live like they are at home, and changing culture. Person-centered care perceived by nurses was conducted to provide individualized nursing according to elderly's preferences and help them discover the value and meaning of life through various activity programs. Nurses also recognized person-centered care to maintain cooperative relationships with their family members and share their decision-making process, as well as to form a physical environment and organizational culture that respects the rights and autonomy of the elderly. Based on the results of this study, it is necessary to identify the diverse needs of the elderly and develop nursing intervention programs based on person-centered care.

Reliability and Validity of an Instrument Assessing Advance Directives for Nurse (간호사의 사전의사결정 태도측정 도구의 신뢰도 및 타당도 검증)

  • Purpose: This methodological study was conducted to test the reliability and validity of an instrument that measures attitudes of advance directives (ADs) among nurses. Methods: 1) Sixteen items related to attitudes in the English version of the Knowledge, Attitudinal, and Experiential Survey on Advance Directives (KAESAD) were forward/backward translated into Korean. 2) The content was validated by an expert panel (three nursing professors and eight hospice nursing specialists). 3) The preliminary 12 items were selected as a tool to assess the Korean version of Nurses' Attitudes towards Advance Directives (NAAD-K). 4) The instrument was validated by a survey (n=216). 5) It was confirmed to use the 12 items for the final version of the instrument. Results: NAAD-K was shown to be valid in terms of factors, items and content. The three factors extracted from the factor analysis were named as follows: Caring for patients with an AD (factor 1), nurses' role in informing patients (factor 2) and patient right (factor 3). The three factors explained total variance 57.796%. Factor loadings of the 12 items ranged from 0.47 to 0.93. For the 12 items, Cronbach's alpha was 0.81, and Guttman split-half coefficient was 0.78. Conclusion: This instrument was identified to be applicable with satisfactory reliability and validity for further use in measuring nurses' attitudes towards ADs in hospice and palliative care.

Dental Hygienist's Harmful Factor Exposure and Recognition of Material Safety Data Sheets of Workplace Type (치과위생사의 근무기관 유형별 유해인자 노출과 물질안전보건자료 인식 연구)

  • This study was conducted on 238 dental hygienists working in Daegu and Gyeongbuk area. In order to understand the status of harmful transmission of dental materials by type of work, we compared the differences in exposure time and work environment characteristics of hospital types and investigated the difference in the degree of recognition of material safety data. The results of the study were as follows: In case of hospitals, the exposure time of dust generated from chemicals was the longest. Resin filling, contact with disinfectant. 37 workers (29.4%) and 14 workers (12.5%) answered that they perceive the question about whether they are aware of the material safety data sheet (MSDS) for dental materials. There were 18 hospital workers and 6 clinic workers who had experience reading MSDS before using dental materials. The respondents who answered that they provided the material safety data of the dental materials used had a 2.39 times MSDS in hospital workers. Therefore, by recognizing the health hazards of chemical substances in accordance with the characteristics of each type of hospital and continuing to conduct health and safety education, the work environment should be improved by establishing proper recognition of MSDS information. It suggests the necessity of a system that can strengthen the management of chemical information provision and guarantee the strategic approach and workers' right to know.

A Study on 50 states' Open Meeting Act in the United States (미국 50개 주 회의공개법 연구)

  • This study aims to elucidate the implications for 20 years of the establishment of the information disclosure law by analyzing contents of the public regulations of 50 states of the United States. For the purpose, it looks at the general outline of the open meetings law of the 50 states, including the requirements and procedure of the advance notification of the meeting, and the protest procedure and penalties for the violation of the law. As a result of analysis, under the law, public meetings should announce their schedule and agenda in advance, and minutes of meetings and recording of meetings should be accessible to citizens. Furthermore, a person who violates the law for opening meetings could be fined or imprisoned. The implications for the establishment of the Open Meetings Act in Korea are as follows: First, the open meeting system starts with the appropriate period and method of advance notice of meeting holding. Second, the substantive contents of the advance notification guarantee the effectiveness of the meeting disclosure system. Third, the method and subject of advance notification should be as wide and diverse as possible. Fourth, all decisions of the meeting that violate the law are null and void. Fifth, a system should be set up so that any citizen could easily raise objections to the violation of the law. Sixth, the person who violates the law should be held responsible. Lastly, citizen access to minutes, recordings as well as comprehensive meeting minutes writing including attendees, agendas, and ballots should be guaranteed.

A Qualitative Study on the Procedures and Characteristics of reading service Provision at Center of Archival Information of National Archives of Korea (국가기록원 기록정보센터의 열람서비스 제공 절차 및 특징에 관한 질적 연구)

  • Archival reference service is the ultimate goal and outcome of records management. It encompasses a whole range of activities to connect records with the demands for them. Intellectual needs for records are met by the procedure of information disclosure to guarantee the people's right to know and to provide active responses to archival information needs. Thus, it is required to establish an efficient search system by unifying search tools for archives used in information disclosure and sorting out the classification systems and description items according to the archive types. The qualitative enhancement of information disclosure can be expected when there is a harmonious circulation of attributes-such as applicants, records, search tools, and information providers-for the smooth implementation of reading processes in the context of archival reference service. Therefore, the present study holds its significance in the following aspects. First, it presented a picture of pending issues and the reality of reading service processes from an internal perspective by examining the factors and characteristics that influence "reading service."Second, it demonstrated the phenomenon of close interactions among information providers, applicant, search tools, and records in the process of requesting, searching, and providing records. Third, it proposed the need for a total integrated search tool around the pending issues of reading processes at the National Archives of Korea. Fourth, it promoted an understanding of archival information utilization at the working level among information providers. Finally, it showed major differences in the quality of information provision of "reading service" according to the "perceptions" and "attitudes" of information providers.

  • The purpose of this study is to derive basic data of the Guaranteed Maximum Price(GMP) process and to present specimens that can be used at the time of execution of CM at Risk project in South Korea. CM at Risk project is issued in South Korea, but the actual data is lack. On the other hand, CM at Risk project is universalized and the market of the CM at Risk is steadily growing. Because of that, in this study, The United States cases was selected as a sample. GMP consists of CM's fee, CM contingency, project direct cost, project indirect cost, allowance. GMP negotiations are performed before the end of design completion, and after 3 rounds of estimation comparison, preliminary GMP is confirmed. GMP can be multiple contract and it is useful for Procurement of long lead materials and early construction. If the actual cost is lower than expected GMP, sharing of the saving is an option since the conflict of interests between the client and the contractor can occur.

  • Recently, it has been observed that as the level of Science and Technology in Korea is improving, the demand for technology transfer from overseas buyers is also increasing. A technical value is an important factor for the technology transfer process and the valuation of technology should be performed reasonably. Specifically, a non-economical value has to be examined thoroughly when conducting the valuation for a technology that depends on public values. Since public technology has public benefit as its purpose when compared to technology from the private sector, its discount rate should be appropriately assessed and reflected in its valuation process. In this context, this study presents the methodology of valuation of public technology particularly relating to the transfer of technology from the national defense industries. To be specific, both an application method of the discount rate according to the characteristics and the purpose of the target technology and a qualitative and quantitative evaluation method to reflect the public values are presented. The proposed method for the valuation of defense technology could be used practically both in strengthening bargaining capability based on the reasonably derived technical values for transfer of national defense technology abroad and in the compilation of budgets for technology development in the future.
