  • Integrated Pollution Prevention and Control(IPPC) has become an idealistic environmental prevention concept in developed countries and corresponds with principles of Industrial Ecology. The concept of emissions regulatory integration is a key factor for an integrated environmental management system. While most EU member countries have a cross-media regulatory system, Korea has a media-specific regulatory system which was found to have significant environmental management problems. The purpose of this study is to integrate the emissions regulatory system by resolving difficulties through procedural, organizational, and substantive analysis of integration. To this end, the following research was performed: The first task was to determine the target of the integrated emissions regulatory system. In connection with this, the "IPPC directive" of the EU and the "PPCA 2000" schedule 1 of the UK, as well as environmental laws in Korea were compared and analyzed. The second was to design a regulatory system model. This model was divided into three groups after considerations were made regarding the time it would take for the pre-application,application, and permission stages. Lastly, on the basis of this research, a revised bill for an integrated emissions regulatory system was suggested. Nevertheless, substantive analysis of integration focused on BAT requires supplementation in order to make the integrated emissions regulation system operate normally as an environmental management policy and regulation method. To this end, the specific characteristics of Korean society, culture, and law should be actively considered.

  • Some clauses of the prior review rules for broadcasting commercials, which are enforced by the Broadcasting Act violate the right to free speech guaranteed by the Constitution. The range of prohibited expression under the clauses are too vague and overbroad to distinguish between permissible and impermissible broadcasting commercials. The clauses also fail to pass the constitutional principle that restrict government from excessive regulation on constitutional rights. The principle has a four-pronged test on the government action; 1) the validity of its goal; 2) availability of appropriate means; 3) necessity of infringement; 4) and balancing test of interests. Some clauses of the prior review rules that forbid expressions on sensitive political and cultural issues fail to pass none of the four-pronged standards.

  • Biodiversity is defined as totality of genetic, species, and ecosystem variability. It provides natural sources of crop improvement, traditional medicine and biotechnology. In 1993, the Convention on Biological Diversity(CBD) became a legally binding framework for conserving and utilizing global biological diversity. It recognizes national sovereign rights over all genetic resources, such as the need to compensate developing countries for the resources they have provided to the industrialized world. The CBD grants access to those resources in exchange for compensation as well as technology transfer, so that the access to genetic resources would be made under prior informed consent(PIC) and mutually agreed terms(MAT). On the other hand, the developed countries argued that unfettered exchange of genetic resources was essential for scientific research and development, and that technology using genetic resources should be protected. There are many countries today, developing legal frameworks concerned with access to their local genetic resources and benefit sharing. In this study, we analyzed the international trends for conservation of biodiversity and sustainable use of genetic resources, and suggested how to cope actively with the situation.

  • The international mobile roaming service has been provided for more than one decade, but high price of international mobile roaming service, which is represented as 'bill shock' is still of major concern in lots of countries including Korea. With understanding of the given price issues, the international organizations, such as OECD, EU, WTO, ITU have been conducting extensive analyses and studies to find suitable solutions and appropriate measures. In the case of EU regulate the international roaming charges and implement the regulation policy. OECD do not have a compelling regulation on roaming charges, but OECD request to member state to find the reasons of high roaming charges and its solution. WTO Council for Trade in Services is reviewing the international mobile roaming in terms of whether impede international trade in services. The purpose of this study is to review many different approaches in international organizations related to reducing international roaming service charges, to drive some regulatory policy directions for reducing roaming charges.

  • Bayesian methodology is appropriated for use in PRA because subjective knowledges as well as objective data are applied to assessment. In this study, radiological risk based on Bayesian methodology is assessed for the loss of source in field radiography. The exposure scenario for the lost source presented in U.S. NRC is reconstructed by considering the domestic situation and Bayes theorem is applied to updating of failure probabilities of safety functions. In case of updating of failure probabilities, it shows that 5 % Bayes credible intervals using Jeffreys prior distribution are lower than ones using vague prior distribution. It is noted that Jeffreys prior distribution is appropriated in risk assessment for systems having very low failure probabilities. And, it shows that the mean of the expected annual dose for the public based on Bayesian methodology is higher than the dose based on classical methodology because the means of the updated probabilities are higher than classical probabilities. The database for radiological risk assessment are sparse in domestic. It summarizes that Bayesian methodology can be applied as an useful alternative lot risk assessment and the study on risk assessment will be contributed to risk-informed regulation in the field of radiation safety.

  • The regulation of satellite remote sensing is generally included with the scope of statutes governing outer space activities. But not all states opted for dedicated satellite remote sensing regulation. The decision whether to do so depends in part on the specific capabilities of national satellite remote sensing programs. Five states that have dedicated statutes governing operations with remote sensing data are the United States, with its developed Landsat regime (the Land Remote Sensing Policy Act of 1992, LRSPA), Canada, with its Remote Sensing Systems Act, Germany, with its Satellite Data Securities Protection Act (SatDSiG), France, with its Law on Space Operations (LOS), Japan, with its Act on Ensuring Appropriate Handling of Satellite Remote Sensing Data. The major purpose of this article is to shed light on some legal issues surrounding remote sensing activities by comparative review. The paper analyzes international conventions or soft law and national law and policies relating to satellite remote sensing. It also offers some implications and suggestions for regulations of satellite remote sensing operations and satellite data.

  • This study investigated the criteria for evaluating the impact of artificial intelligence services. The study classified AI evaluation targets into two areas: AI service and AI technology, and identified influence, sustainability, efficiency, effectiveness, and appropriateness as potential evaluation criteria. The time aspect of AI service evaluation was divided into pre-evaluation and post-evaluation, with pre-evaluation focused on reviewing items during development and design. The AI service area was classified into public, private, and mixed forms, and the impact assessment was classified as vertical or horizontal. The application of AI services was divided into normative and regulatory aspects, and the purpose of the evaluation could be impact or process evaluation. The subject and field of the AI service could also be used for classification purposes. The results of this study can be used to support the creation of AI service impact policies and countermeasures. However, further research is needed to develop specific indicators based on the criteria identified in this study to evaluate the impact of AI services.

  • Rapid urbanization has elevated the risk of urban flooding due to the increase in the impervious surface, causing environmental disasters and environmental pollution problems, such as lowering the groundwater level and increasing water pollution. In Korea, low impact development (LID) techniques have been introduced to minimize these environmental impacts and maintain the water cycle soundness. However, most small-scale development projects are in blind spots because there is no legal basis for rainfall runoff management. Small-scale development projects that increase the surface runoff of rainwater are required to mandate the application of LID facilities in accordance with the polluters' responsibility principle. Therefore, it is necessary to implement a preliminary consultation system for water cycle recovery. This study focuses on the cost-benefit analysis on the application of LID techniques for small-scale development projects. The scale of nationwide small-scale development projects used for cost-benefit analysis were defined as buildings with a land area of more than 1,000 ㎡ or a total floor area of 1,500 ㎡. As a result of analyzing the cost-benefits from the installation of LID facilities, they were found to be much lower than the economic standard value of 1. This might be due to the high cost of facilities compared to the scale of the project. However, considering the overall environmental value of improving the water environment and air quality by the installation of LID facilities and the publicity of reducing the operating cost of sewage treatment facilities, the introduction of a prior consultation for small-scale development projects is inevitable. In the future, institutional and financial support from local governments is required to improve the cost-benefits with the introduction of a prior consultation for small-scale development projects.
