We have more risks in international trade market than in the domestic business market because economic activities are going on with business transactions in different countries. K-sure's Refund Guarantee System is the most important system for Korean Small and Middle Shipbuilding Industries' business, but Korean exporters of Shipbuilding Industries are more interested in export financing through K-sure rather than its financial supporting services. The export insurance becomes more important service for international trade business and it its count as the only one indirect way of supporting export business because export insurance is accepted internationally under the WTO system. Also, it is the only measure that can cover emergency risk, credit risk, exchange risk which cannot be covered by private insurance. As the major risk manager for Korean exporters, the K-sure needs to provide an integrated risk management service for customers. Korean exporters can take more challenges in ever competitive international trade market and we can witness promotion of export in the future which is essential to Korea's economic growth.

Recently, researches on the performance warranty contracting has been going on to improve construction quality in road pavement area. The performance warranty contracting gives construction companies opportunity to select materials and methods freely while asks them to maintain a certain level of performance during a given period. To introduce the performance warranty contracting in Korea, lots of research results on performance indicator and threshold value of asphalt pavement have been made to be included in the warranty specification. However, research effort on the performance indicator and threshold value of concrete pavement which is commonly constructed in expressway and national highway has not been enough. In this study, the warranty duration, performance indicator, and threshold value of the concrete pavement were investigated by reviewing literatures on cases of the performance warranty contracting in European countries and states of the US. Major distresses influencing the performance of jointed concrete pavement were investigated and analyzed to be compared to the warranty duration, performance indicator, and threshold value of foreign countries.

The paper is to assess the recent changes in Architectural Artworks system in two regional districts, Seoul and Gyeonggi Province, and to propose policies for further improvement. We focused on four aspects: overall pass rate, top-ranked artists' pass rate, proportion of artists ever passed, genre proportion artworks. It is observed that quality of artworks has improved, market monopolization has been eased, and entry to the market has become more active. However, sculptures accounted for the majority. Public art is gradually changing from 'decorative art' to 'site-specific art', and seeking harmony between architecture and surrounding landscape. To keep pace with this new trend, more institutional efforts should be made: fund raising to induce artwork supplies; introducing life-span concept to secure removal and deformation of artwork; imposing artists' follow-up services; imposing penalties against poor management; and authorizing the committee to choose exhibition sites.

대한설비건설협회는 그동안 설비건설업계가 공사대금을 제대로 받을 수 있도록 하도급대금지급보증제도 개선에 많은 노력을 기울여 왔다. 특히 국토해양부 장관과의 간담회를 비롯하여 건설산업 공생발전위원회를 통해 제도개선을 건의한 결과 하도급대금 지급보증 책임범위 확대 및 보증금 청구 시 청구일로부터 15일 이내에 지급토록 하는 등 건설공제조합의 약관을 개정하는 성과를 거두었다. 이로써 설비건설업계는 하도급대금 보증금을 원활히 받을 수 있게 됐다. 그러나 대한설비건설협회의 이러한 노력에도 불구하고 글로벌 금융위기 이후 100대 종합건설사 중에서 30여개 사가 부도 및 워크아웃, 법정관리 등으로 건설환경은 더욱 열악해지고 있다. 이에 따라 원도급업체가 부도날 경우 공사대금을 받을 수 있는 방법인 유치권과 하도급대금지급보증에 대해 설비건설업계의 관심이 커지고 있다. 본지는 유치권과 하도급대금지급보증에 대해 살펴본다.

국토해양부(장관 권도엽)가 원도급업체의 '하도급대금 지급보증서' 발급현황을 조사한 결과 이 중 보증서 미발급 혐의가 있는 6,695건(1,414개 업체)에 대해 최근 해당 지방자치단체에 사실관계 조사 및 시정명령 등의 처분을 통보했다. 대한설비건설협회가 그동안 건설산업 공생발전위원회와 국토부 장관과의 간담회 등을 통해 하도급대금 지급보증서 발급여부 감독 철저 등 불공정 하도급 관련 제도개선을 건의한 결과 이같은 시정명령이 통보된 것이다. 국토부는 원 하도급자 간의 공정한 건설문화 정착을 통해 하도급자가 보호받을 수 있도록 앞으로도 지속적으로 노력할 계획이라고 밝혔다.

Existing specifications of road pavement require contractors to meet only materials and construction conditions regardless of pavement life. There are limitation of developing road pavement technology and possibility causing dispute between ordering organization and contractor with this type of specification. Research efforts to introduce performance warranty contracting are in progress in the field of road pavement to improve the problems. The performance warranty contracting gives the contractors opportunity to select materials and construction methods as they like. But they should satisfy a certain level of performance during a given period. The performance indicator and threshold value of pavement which are main elements of the warranty specification should be defined first to introduce the performance warranty contracting successfully. In this study, the performance indicator, threshold value, and warranty duration of asphalt pavement were investigated by reviewing literatures on performance warranty contracting of some states of the US. Major distresses influencing the performance of the asphalt pavement were investigated at 24 national expressway lines and national highway lines in 16 regions, and the data were analyzed to be compared to the cases of the US. Development of rational performance warranty specification for domestic asphalt pavement is expected based on the research results.

정부는 지난 '10년 "ESCO산업 활성화 방안"을 발표, ESCO산업 진흥을 통해 국가 에너지 및 온실가스 절감목표를 달성하고 고용창출과 수출을 제고하는 신성장동력을 육성하겠다고 밝혔다. ESCO산업 활성화 방안은 ESCO성과보증계약을 확산하여 ESCO의 기술력을 향상시키고 수익성을 개선시키는 내용을 담고 있다. 성과보증제도 확산의 일환으로 성과배분계약 및 성과보증계약의 장점을 혼합하여 신성과배분계약방식을 '11년부터 도입하였으며, '13년에는 성과배분계약에 대한 정책자금 지원을 중단할 예정이다. 이러한 성과보증 육성정책으로 '10년 ESCO 사업 중 10%에 불과하던 성과보증계약 비율이 지난해 58%로 껑충 뛰는 등 놀라운 성과를 거두었다. 이러한 변화의 추세에 발맞추어, 협회에서는 ESCO실무자에게 직접 성과보증방식 위주의 ESCO사업 추진에 대해 실질적인 이야기를 들어보고 성과배분계약 지원 중단 정책에 대비하여 얼마나 준비가 되어있는지 점검해보았다.

'하도급 거래 공정화에 관한 법률' 법률이 일부 개정되어 지난 5월 28일 공포되었다. 이 법령은 오는 11월 29일부터 본격 시행된다. 개정된 주요 내용은 ${\Delta}$계약체결일로부터 30일 이내에 원사업자는 수급사업자에게 공사대금지급 보증 ${\Delta}$공사대금 지급수단이 어음인 경우 만기일까지, 어음대체 결재수단인 경우 하도급대금 상환기일까지 대금지급 보증 ${\Delta}$공사이행 중 원사업자가 공사대금 지급보증 사유 소멸 시 소멸일로부터 30일 이내에 공사대금 지급보증(다만, 일정한 경우 보증 제외) ${\Delta}$원사업자가 수급사업자에게 공사대금 지급보증을 하지 않은 경우 수급사업자가 한 계약이행 보증을 청구할 수 없도록 했다. 이로써 그동안 어음 수령으로 보호받지 못했던 대금지급 보증을 받을 수 있게 되었고 원사업자의 대금지급보증 면제사유(신용등급 A 이상, 발주자 대금직접지급, 한 건의 공사금액이 천만원 이하)가 소멸된 경우에도 30일 이내에 대금지급 보증을 해주는 등 대금지급 보증 범위가 넓어져 보증금을 원활히 받을 수 있게 됐다. 또한 원사업자가 대금이행 보증을 하지 않을 경우 하수급인의 계약 불이행을 사유로 계약이행 보증을 청구할 수 없는 조항이 신설되어 앞으로 대금지급보증 교부율이 높아짐은 물론 하수급인에 대한 보증을 주로 하는 대한설비건설공제조합의 보증 리스크 감소 효과가 기대된다. 대한설비건설협회(회장 이상일)와 대한설비건설공제조합(이사장 김기석)은 그동안 대부분의 하도급업체인 회원 및 조합원사의 권리보호와 원도급자의 불법 불공정 하도급 거래행위를 개선하기 위해 국회, 국토교통부, 공정거래위원회 등 관련부처에 지속적으로 건의하며 제도개선을 추진해 왔다. 이같은 협회와 조합의 공동노력에 의해 이번에 공정거래위원회에서 일부 개정한 것이다. 개정된 하도급거래 공정화에 관한 법률은 다음과 같다.

불공정 하도급거래 행위로 인한 회원사의 피해방지를 위해 대한설비건설협회는 국토부, 공정위, 국회 등에 지속적으로 제도개선을 추진한 결과 지난해 6월 국토부, 기재부, 공정위 등 5개 부처 합동 국가정책조정회의에서 '건설산업 불공정 거래관행 개선방안'이 발표됐다. 그 후속조치로 지난 2월, 하도급부당특약 설정금지를 비롯해 보증기관의 하도급대금지급보증금 지급사유 법제화, 하도급대금지급보증서 면제대상(2개 이상 신용평가 기관의 회사채평가 A이상 등급업체) 삭제 등 관련 법령이 개정됐다.
