Some Arguments on the Copyrights in Digital Library : Focusing on Proposed Copyright Act (디지털 도서관에서의 저작권 문제: 개정 저작권법(안)을 중심으로)

  • As Information Technology has developed, digital library has an opportunity to change the paradigm of role of library to adjust in digital environment. Digital library has promote information services with digitization of materials. In library fare use is allowed to the public for information services. However, digital copy and transmission is simple in digital environment, to balance between owner and user is not easy but important things. Therefor, current copyright act is revised to adjust these environment but the act restrict the users'accessing digital library through interned, not complied with the motive of revision. Moreover, proposed act which is proposed to facilitate digital library services also extremely limits information services. In this monograph, I will review the copyright act related library and seek for the improved means.

일라이트-운모의 이용 현황과 응용광물학적 특성 평가

  • 수천 년 전부터 인간생활에 이용되어온 일라이트-운모는 다른 광물자원에 비하여 사용량은 많지 않지만, 요업, 도료, 종이, 건축용 재료, 화장품 소재 및 전자부품과 전기 재료 등 여러 산업 분야에 널리 사용되고 있다. 일라이트-운모는 광물학적으로 같은 계열의 광물군임에도 불구하고 산출상태, 입도 및 용도의 차이에 따라 다른 광물자원으로 취급되고 있다. 특히 국내에서 일라이트는 용어상의 혼란과 불명확한 법정 등록광종 때문에 효율적인 자원관리와 연구개발이 곤란한 실정이다. 그러므로 일라이트를 비롯한 점토광물 자원에 대한 광업법규상의 개선과 제도적 정비가 시급히 요구된다. 국내에서 개발되고 있는 일라이트-운모의 광석 유형은 그 광물상과 산출상태에 따라 페그마타이트상 백운모, 운모편암상 백운모, 납석상 일라이트 및 점토상 일라이트로 구분된다. 일라이트와 운모는 서로 다른 용도로 사용되고, 그 용도에 따라 그 품위 및 품질 개념이 다르다. 일라이트-운모 광석의 품위 및 품질 면에서 가장 기본적인평가방식은 (1) 육안 및 편광현미경 관찰, (2) X-선회질 분석 및 (3) 화학분석인 것으로 생각된다. 특히 리트벨트법을 응용한 X-선회질 정량분석법은 일라이트의 품위를 산정하는데 유력한 수단이 될 수 있을 것으로 여겨진다. 국내 일라이트-운모 자원의 자원잠재성과 부가가치를 향상시키기 위해서는 광석에 대한 정확한 품위 평가를 바탕으로 가장 적절한 이용 분야를 모색해야 할 것으로 판단된다.

  • Recently all basement floor of apartment site have utilized as parking area to use efficiently space and to ensure lawful parking car figure. And the top of parking area has used as working vehicle's path and materials' carrying area during construction. Thus because crack and leakage status in underground parking area of under construction or completion building generate excessively not only performance of structure is diminished but also flaw repair cost is put in a lot of. And abroad confidence is diminish. So this study is intended to diminish flaw focus on investigation of under construction and completion fields through examine closely cause of crack and leakage status of apartment house underground parking area and prepare countermeasure with respect to design, construction and maintenance.

  • 대구시민의 삶의 질 향상에 크게 기여하는 신천은 홍수, 친수 및 하천환경 관리에 대한 필요성이 증가되는 상황에서 신천 복원을 위하여 하천횡단구조물 및 생태조사가 필요한 실정이다. 신천 내에 위치하고 있는 14개의 하천횡단구조물은 신천의 흐름을 가로막고 있어 수질악화 및 생물이동을 저해하고 있으며, 집중호우 등으로 인하여 구조물 주변에 대한 하천관리가 어려운 것이 현실이다. 특히 신천은 인구가 밀집해 있는 도심을 관통하는 하천으로 친수공간, 홍수 및 하천환경 관리에 대한 필요성이 증가하고 있다. 본 연구에서는 신천의 수질과 어류의 생태성의 상관관계를 확인하고 횡단구조물에 대한 해결방안을 제시하고자 한다. 현지조사 결과 총 3목 6과 10종의 어류가 관찰되었으며, 법정보호종인 멸종위기 야생생물 및 천연기념물은 관찰되지 않았으나, 고유종으로 긴몰개와 참갈겨니, 꺽지, 동사리 4종이 출현하였으며, 환경부 지정 생태계교란 생물 블루길 1종이 관찰되었다. 이러한 결과를 바탕으로 어류생물지수(FAI)를 검토하였을 때, 하류지역으로 갈수록 E등급으로 매우 나쁨의 환경상태를 나타내었다. 이는 상류에서 하류로 갈수록 비정상개체수가 증가하고 하상의 단순화 및 유기물의 축적으로 출현 종수의 감소에 따른 결과로 판단된다. 이러한 결과를 바탕으로 신천의 평균 FAI 지수는 14.71점으로 E등급의 매우 나쁨의 환경상태를 나타내는 것으로 분석되었다.

  • 배우자상속에 있어서 독일 등 다수 선진국들은 배우자 일방의 사망 시 부부재산제에 따른 청산을 통하여 생존배우자를 고정적으로 배우자상속분을 확보해줌과 동시에 철저히 보호를 하고 있는데, 우리나라 가족법에서는 다른 나라들에 비해 생존배우자에게 일정비율의 상속분만을 인정하고 있어 생존배우자의 상속권을 실질적으로 강화될 수 있는 방안이 필요하다고 본다. 특히 2014년 법무부 민법개정위원회의에서 현행법상 배우자 상속제도를 해결하기 위하여 제1008조의4 배우자의 선취분 조항과 제1008조의5 배우자의 선취분 침해에 있어서 회복청구권에 대한 조항신설이 논의 되어 국민들의 높은 호응이 있었음에도 불구하고, 생존배우자 법정상속분을 상향조정을 하게 되면 기업상속 등에 문제가 발생한다는 논리로 개정안은 입법예고도 못하는 상황에 이르게 되었다. 또한 초고령화사회에 살고 있는 생존배우자의 노후생활 보장과 직계비속과 공동으로 상속받는 경우 직계비속의 수에 따라 배우자의 상속분의 유동성 등이 문제점으로 대두되기 때문에 합리적인 생존배우자의 상속분 상향조정되는 입법안이 새롭게 시작되는 21대 국회에서 조속히 마련되기를 기원하는 차원에서 생존배우자의 효율적인 입법방안을 제시하고자 한다.

William Faulkner's Requiem for a Nun: Temple's Moral Growth (윌리엄 포크너의 『어느 수녀를 위한 진혼곡』: 템플의 도덕적 성장)

  • The purpose of this study is to reconsider whether Temple in William Faulkner's Requiem for a Nun has grown morally. Temple in Sanctuary, the previous work was raped with a corn cob by Popeye and perjured in the court, resulting in Lee Goodwin's brutal death. Now she is now a mother of two children and a wife of Gowan Stevens, but she cannot get out of the past and tries to run away with Pete, Red's brother, but she was resisted by Nancy Mannigoe, a nanny. Nancy tries to stop Temple sacrificing herself and Temple's baby. When confronting Nancy who accepted her death sentence without hesitation, Temple realized her past guilt which never fades out. A lapse of 20 years between Sanctuary and Requiem provides Temple and author himself opportunities for spiritual and moral growth in spite of painful realization that the past is never past. On the other hand, Faulkner tells the history and the past of Jefferson elaborating the description of the courthouse and the jail. Both are correlated in thematic perspective, the former representing humanity's need for security, the latter the opposite impulse toward aggression and destruction. but together represent the presentness of the past and the fluidity of time.

  • The Legal Floor Area Ratio (L-FAR) has been used as a major urban planning tool for efficient management of land use, landscape, and density. The Developed Floor Area Ratio (D-FAR) in each parcel is realized by such physical and institutional factors as urban tissue, local characteristics, and zoning with the L-FAR. The Achieved Floor Area Ratio (A-FAR), the ratio of the D-FAR to the L-FAR, is the relationship between realized density and the intended/desired outcomes of the regulations. The A-FAR informs the efficiency of L-FAR and its effect on parcels, and is an indicator of the demands of real estate developments under the zoning regulation. This study used detailed data of each parcel's characteristics, including parcel size, road width, and the number of roads bordered by a parcel, to identify the influencing factors on A-FAR. This analysis confirmed that the parcel size has a non-linear negative effect in the residential zone but a linear positive effect on A-FAR in the commercial zone. The width of the parcel's frontage in the commercial zone has a positive effect on the value, while in the residential zone the narrower width has higher A-FAR. In Seoul, the residential zone has higher A-FAR than the commercial zone, which means that the former has a relatively higher development pressure but a lower designated L-FAR. This result reflects that Seoul's residential zone absorbs the demand of commercial uses because of the significant permitting of mixed land use and has high-density residential buildings.

Analyzing the Defense Budgetary in the Republic of Korea with the Punctuated Equilibrium Theory (단절균형이론을 적용한 국방예산 분석에 관한 연구)

  • Previous research regarding budget analysis has been mostly limited to describing annual changes in defense budgets relative to total budgets without a theoretical background. More empirical defense budget research is needed with better data. This study conducts an empirical analysis of national defense expenditures using Punctuated Equilibrium Theory (PET). The purpose of this study is to examine trends in the Republic of Korea's (ROK) functional defense budgets (total defense budget, force operation budget, force improvement budget) and to identify and analyze radical points of change in the defense budget using punctuated equilibrium theory. This study also explores trends and punctuations in the national defense budgets using annual defense budget data from the ROK for every year from 1998 to 2017. This study finds that from 1998 to 2017 the spending pattern of the total defense budget in the ROK was characterized by 19 years of stable growth and a one-time punctuation (5.0%). The force operation budget exhibited stable growth in eighteen years and was punctuated twice (10%). The force improvement budget was punctuated five times.

A Rating Method for the Estimation of the Additional Overhead Expenses incurred by Schedule Extension in Public Construction Projects (공공건설공사의 공기연장에 따른 추가간접비 산출을 위한 요율방식 제안)

  • In domestic public construction, disputes are increasing due to differences among stakeholders regarding contract price adjustment. In particular, the actual cost-plus fee for overhead costs due to the schedule extension cannot be agreed upon at the administrative phase, and most of them seek judicial judgment. Thus, this study aims to propose a 'sufficiently satisfactory' alternative to reach an agreement before disputes in order to minimize disputes related to the calculation of additional overhead costs. To this end, this study proposes three alternatives based on the rate method. Firstly, when calculating additional overhead costs, it is not calculated as an actual cost-plus-fee method, but as a rate compared to direct labor costs among net direct costs. Secondly, the calculated indirect labor costs are compensated for up to the legal maximum of legal limit costs such as general management costs, profits and so on. Thirdly, it reflects overhead costs increased or decreased due to change orders. Risks were analyzed by collecting expert opinions on the proposed methods and applying actual cases. Finally, as a result of investigating the level of consensus for each stakeholder, it was confirmed that all stakeholders could agree regardless of the size of the company. The result of this study is expected to as a useful tool among stakeholders in the construction fields that can be able to easily agreed upon.

A Study on Job Characteristics, Job Satisfaction, and Life Quality of Aging Workforce: Focusing on the Mediating Effect of Regular and Non-regular Workers (고령화 인력의 직무 특성, 직무만족도, 그리고 삶의 질에 관한 연구: 국내 상용직 근로자와 비상용직 근로자의 매개효과를 중심으로)

  • This study suggests an alternative for solving quality-of-life problems of an aging workforce by seeking ways to utilize an aging workforce in corporations and society. This research empirically analyzed data from the 6th panel data of aging. Study results are as follows. First, it was confirmed that job satisfaction of aging manpower plays a mediating role in the relationship between quality of life and the job characteristics of an aging workforce. Second, it was found that the wage level of regular workers had a significant effect on job satisfaction and quality of life, and the job satisfaction of regular workers was mediated between wage level and quality of life. On the other hand, the wage level of non-regular workers did not have any effect on job satisfaction and quality of life. The results of this study suggest the necessity for companies to recognize the use of an aging workforce to improve social value. Furthermore, our results provide implications for domestic firms and government policymakers on how to use a domestic aging workforce and how to utilize regular and non-regular workers.
