Legal Review on the Regulatory Measures of the European Union on Aircraft Emission (구주연합의 항공기 배출 규제 조치의 국제법적 고찰)

  • The European Union(EU) has recently introduced its Directive 2008/101/EC to include aviation in the EU ETS(emissions trading system). As an amendment to Directive 2003/87/EC that regulates reduction of the green house gas(GHG) emissions in Europe in preparation for the Kyoto Protocol, 1997, it obliges both EU and non-EU airline operators to reduce the emission of the carbon dioxide(CO2) significantly in the year 2012 and thereafter from the level they made in 2004 to 2006. Emission allowances allowed free of charge for each airline operator is 97% in the first year 2012 and 95% from 2013 and thereafter from the average annual emissions during historical years 2004 to 2006. Taking into account the rapid growth of air traffic, i.e. 5% in recent years, airlines operating to EU have to reduce their emissions by about 30% in order to meet the requirements of the EU Directive, if not buy the emissions right in the emissions trading market. However, buying quantity is limited to 15% in the year 2012 subject to possible increase from the year 2013. Apart from the hard burden of the airline operators, in particular of those from non-European countries, which is not concern of this paper, the EU Directive has certain legal problems. First, while the Kyoto Protocol of universal application is binding on the Annex I countries of the Climate Change Convention, i.e. developed countries including all Member States of the European Union to reduce GHG at least by 5% in the implementation period from 2008 to 2012 over the 1990 level, non-Annex I countries which are not bound by the Kyoto Protocol see their airlines subjected to aircraft emissions reductions scheme of EU when operating to EU. This is against the provisions of the Kyoto Protocol dealing with the emissions of GHG including CO2, target of the EU Directive. While the Kyoto Protocol mandates ICAO to set up a worldwide scheme for aircraft emissions to contribute to stabilizing GHG concentrations in the atmosphere at a level that would prevent dangerous anthropogenic interference with the climate system, the EU ETS was drawn up outside the framework of the international Civil Aviation Organization(ICAO). Second, EU Directive 2008/101 defines 'aviation activities' as covering 'flights which depart from or arrive in the territory of a Member State to which the [EU] Treaty applies'. While the EU airlines are certainly subject to the EU regulations, obliging non-EU airlines to reduce their emissions even if the emissions are produced during the flight over the high seas and the airspace of the third countries is problematic. The point is whether the EU Directive can be legally applied to extra-territorial behavior of non-EU entities. Third, the EU Directive prescribes 2012 as the first year for implementation. However, the year 2012 is the last year of implementation of the Kyoto Protocol for Annex I countries including members of EU to reduce GHG including the emissions of CO2 coming out from domestic airlines operation. Consequently, EU airlines were already on the reduction scheme of CO2 emissions as long as their domestic operations are concerned from 2008 until the year 2012. But with the implementation of Directive 2008/101 from 2012 for all the airlines, regardless of the status of the country Annex I or not where they are registered, the EU airlines are no longer at the disadvantage compared with the airlines of non-Annex I countries. This unexpected premium for the EU airlines may result in a derogation of the Kyoto Protocol at least for the year 2012. Lastly, as a conclusion, the author shed light briefly on how the Korean aviation authorities are dealing with the EU restrictive measures.

Biotechnology for the Mitigation of Methane Emission from Landfills (매립지의 메탄 배출 저감을 위한 생물공학기술)

  • Methane, as a greenhouse gas, is some 21~25 times more detrimental to the environmental than carbon dioxide. Landfills generally constitute the most important anthropogenic source, and methane emission from landfill was estimated as 35~73 Tg per year. Biological approaches using biocover (open system) and biofilter (closed system) can be a promising solution for older and/or smaller landfills where the methane production is too low for energy recovery or flaring and installation of a gas extraction system is inefficient. Methanotrophic bacteria, utilizing methane as a sole carbon and energy source, are responsible for the aerobic degradation (oxidation) of methane in the biological systems. Many bench-scale studies have demonstrated a high oxidation capacity in diverse filter bed materials such as soil, compost, earthworm cast and etc. Compost had been most often employed in the biological systems, and the methane oxidation rates in compost biocovers/boifilters ranged from 50 to $700\;g-CH_4\;m^{-2}\;d^{-1}$. Some preliminary field trials have showed the suitability of biocovers/biofilters for practical application and their satisfactory performance in mitigation methane emissions. Since the reduction of landfill methane emissions has been linked to carbon credits and trading schemes, the verified quantification of mitigated emissions through biocovers/biofilters is very important. Therefore, the assessment of in situ biocovers/biofilters performance should be standardized, and the reliable quantification methods of methane reduction is necessary.

Status and Trends of Emission Reduction Technologies and CDM Projects of Greenhouse Gas Nitrous Oxide (온실가스 아산화질소(N2O) 저감기술 및 CDM 사업의 현황과 전망)

  • With the effectuation of Kyoto Protocol on the United Nations Framework Convention on the Climate Change, the emission reduction of greenhouse gases became an urgent issue and has been competitively secured among countries as the form of certificates through clean development mechanism (CDM) or joint implementation (JI). Nitrous oxide ($N_2O$) is one of the major greenhouse gases along with carbon dioxide ($CO_2$) and methane ($CH_4$) having warming potential 310 times that of carbon dioxide and chemically very stable in the atmosphere to give a life time of more than 120 years so that it reaches to the stratosphere to act as an ozone depleting substance. $N_2O$ hardly decomposes and thus, besides to the adoption of thermal decomposition at high temperature, selective catalytic reduction methods are usually used at temperatures over $400^{\circ}C$ in which the presence of NOx acts as a major impeding material in the decomposition process. In this article, the sources of various $N_2O$ generation, catalytic reduction processes and the status and trends of emission trade with CDM projects for greenhouse gas reduction are summarized and discussed on a condensed basis.

The Comprehensive Equity Implications of a Carbon Pricing Policy in South Korea: Based on Environmentally Extended Input Output Analysis Together with Household Expenditure Data (탄소가격정책의 분배적 함의: 가계동향조사자료와 환경산업연관분석 (EEIO)을 이용해)

  • A cap-and-trade program accounting for 60 percent of total national greenhouse gas emissions was launched in South Korea in 2015. Academic literature expects that the implementation of such a policy is likely to adversely impact income distribution among various socioeconomic groups in developed countries. South Korea is challenged by equity issues, as well circumstances, the distributional implications of carbon pricing policies need to be examined and reflected in the design of the program prior to implementation in order not to exacerbate social inequity. Using environmentally extended input-output analysis together with household expenditure data, this study finds that a carbon pricing policy will be regressive in South Korea, but the extent depends on whether relative burdens of a carbon pricing policy are measured based on current incomes or proxies of permanent incomes. Along with poor households, this paper finds that elderly and urban households will be more adversely impacted in South Korea. These burdens can be relieved if a small fraction of the revenue is redistributed to households.

  • 작년 9월 15일, 정전대란이 일어났다. 우리나라도 이제 전력 수요가 많아짐에 따라 블랙아웃에 절대 안심할 수 없는 지경에 이르렀다. 최근 전력수급과 에너지 효율성 등에 대한 관심이 커지고 있는 시점에 열린 2012 대한민국 녹색에너지대전은 '제4의 에너지'로 일컬어지는 신재생과 '제5의 에너지'인 에너지절약을 강조하는 행사로 다양한 에너지 문제에 대한 다양한 해법을 제시하였다. 지난 10월 9일부터 12일까지 코엑스에서 열린 '2012 대한민국 에너지대전'에서 대체에너지 생산과 에너지절약에 대한 지혜를 발견할 수 있었다. 녹색에너지대전, 신재생에너지대전, 녹색일자리엑스포 등 3가지 행사를 한 자리에서 볼 수 있었으며 '에너지절약시설자금 투자설명회'가 개최 돼 녹색에너지와 에너지절약을 궁금해 하는 일반인들과 에너지절약기업의 큰 관심을 끌었다. '2012년 대한민국 녹색에너지대전'은 에너지, 기후, 신재생 분야의 최신 제품, 기술, 정보 등 녹색 교류의 장이자, 동북아대표 기술교류 허브(Hub)로써 에너지효율, 기후변화-신재생에너지등 미래 에너지의 새로운 패러다임을 제시한 행사로 평가된다. 또한 에너지절약 차원으로는 에너지효율 향상을 주도하는 제품 및 기술 제안하여 보일러, 고효율조명, LED, 단열재, 하이브리드 자동차, 고효율가전기기, 전력수요관리설비 등 에너지효율 향상 제품이 전시되었고 기후변화대응과 녹색정책 및 기술 발표가 이어져 에너지 관련 공공기관, 협회 등 정책, 사업, 기술동향 등(CDM프로젝트, 탄소배출권 거래체, 탄소금융 사업 등)이 소개되었다.

Bike Transportation Activation Policy through Carbon Emission Trading (탄소배출권 거래를 고려한 자전거 활성화 정책)

  • OBJECTIVES : Currently, the market for carbon emissions trading has been increasing. In Korea, it is known that traffic mode rate in bike transportation is low. However, if bike transportation system is encouraged and the traffic mode rate is increased, it would be possible to reduce carbon emissions through the trading market. In this study, a practical policy to activate the bike transportation system in Korea will be proposed and verified. METHODS : Past studies regarding bike transportation system in international and domestic metropolitan cities were analyzed. Moreover, detailed reviews on recent carbon emissions trading market were performed. In particular, SWOT analysis on the bike transportation system in Korea and policy topology analysis were conducted. RESULTS : Based on the literature reviews and SWOT analysis, a new bike transportation policy was proposed. Several actual plans to adopt in Korea were proposed. In addition, a new bike transportation policy was analyzed using policy typology model, and a business model related to the cost of implementing the system and CERs were also proposed. CONCLUSIONS : It is concluded that the proposed bike transportation activation policy and several practical plans to connect CERs and a business model including bus, subway, T-money and bike riders to give some incentive were effective and reasonable. It is desired that this study will help Korea to get CERs through bike transportation activation in the future.

저탄소 녹색성장을 위한 녹색산업.기술 육성 II

  • 최근 세계 경제는 사상 유래를 찾기 힘든 경제위기에 홍역을 앓고 있다. 국제유가를 비롯한 원자재가격은 수급불균형과 정치적 이슈, 그리고 투기자본의 유입이 어우러져 급등락을 거듭하고 있다. 또한, 지구온난화를 막기 위해 국제사회에서 추진하고 있는 기후변화협약도 큰 어려움을 겪고 있다. 선진국들은 배출권 거래제도 시행, 탄소세 도입 등을 통해 본격적인 환경 무역시대가 도래에 대비하고 있으며, 포스트 교토체제에 대한 협상도 본격화 되고 있어 대응이 시급한 실정이다. 자원 환경위기의 시대에 녹색성장은 불가피한 선택이 되었으며 우리나라에서도 온실가스 감축을 위해 많은 노력을 하고 있다. 정부에서는 탄소포인트제도 도입과 10대 녹색기술 산업 육성, 그린 뉴딜을 통한 녹색일자리 4만 3천개 창출 등 기후변화 대응을 위한 정책들을 추진하고 있으며, 또한 저탄소 녹색성장의 한 주축으로 신재생 에너지 기술개발 및 보급의 확대를 통해 세계시장 선점을 위해 매진하고 있다. 환경부에서는 폐기물에너지화, 기후변화대응, 환경산업육성 등 '저탄소 녹색성장'을 이끌 사업과 '경제 살리기'에 역점을 두고 2009년도에는 환경부 소관예산 '08년 예산 3조 5,914억원 대비 5,008억원(13.9%) 증액된 총 4조 922억원을 투자할 계획이다. 이에 본지에서는 지난호에 이어 저탄소 녹색성장을 위한 녹색자원 기술 육성II로 주제를 잡고 "온 국민이 참여하는 기후변화 대응 정책 추진", "녹색성장 정책 추진에 있어 기업체 지원방향", "우리나라 신재생에너지 기술개발현황과 앞으로의 과제", "가정에서 온실 가스 줄인만큼 혜택받는 탄소은행"등에 대하여 살펴보고자 한다.

A Study on The Aviation policy for UNFCCC of Korea and Other states (기후변화 협약 이행관련 국내.외 항공정책에 관한 연구)

  • The United Nations (UN) has tried to make international agreement to restrict artificial greenhouse gas emissions and the UN has concluded the UN Framework Convention Climate Change (UNFCCC) and the Kyoto protocol. Moreover, in 2012, the European Union announced that they will enforce the Directive 2008/101/EC. Therefore, after 2012, aircraft carriers that depart or arrive from EU will follow that regulation. For these reasons, Korea should prepare systematic and effective policy to reduce greenhouse gas emission from aviation activities. The purpose of this study is to find out effective measures to reduce greenhouse gas emission from aviation activities through research by countries all over the world. Here are the 4 measures to reduce greenhouse gas emission from Aviation activities that were found through research UK and Japan's policies. First, Korea should implement aggressive incentive policies. Providing proper incentive can attract voluntary participation of aircraft carriers to reduce greenhouse gas emission. Second, the government should adopt environmental tax on use of fossil fuels. Third, Korea should adopt the greenhouse gas Emissions Trading Scheme (ETS). Lastly, the Korea government should pull in with the international community to establish world-wide environmental policies.

  • In pursuing carbon emission reduction efforts, companies have focused for the most part on reducing emissions due to the more efficient equipment and facilities. However they overlook a significant source of carbon emissions, one that is driven by operational policies. Currently companies are looking for solutions to reduce carbon emissions associated with their operations. Operational adjustments, such as modifications in order quantities could an effective way in reducing carbon emissions in the supply chain. Also, Cap-and-Trade mechanism is generally accepted as on of the most effective market-based mechanism to reduce carbon emissions. In this paper, we investigate a supply chain with single manufacturer and multiple retailers multi-product inventory model under the cap-and-trade system incorporating the carbon emissions caused by transportation and warehousing activities. Also, we provide an iterative solution algorithm and derive the common order interval and the number of intervals for each product. We show by numerical example that the inventory model incorporating cap & trade mechanism can reduce total cost and carbon emissions compared to the classical inventory model. Using the numerical examples, we also investigates different carbon price on the performance of the inventory model.

A Comparative Study of EU and Japan ETS for Activation in Korean GHG Emission Trading System (한국형 온실가스 배출권 거래제도 활성화를 위한 EU 및 일본 사례 비교 연구)

  • This study has aimed to compare an emission trading system (ETS) in the EU and Japan that introduced the scheme prior to Korea and provided the latter with a benchmarking model. Especially, the EU has a reputation for its well-organized and evolving system, and Japan has also successfully established the system despite its similar condition with Korea, such as an industrial structure and the degree of energy dependence. However, there are noticeable differences between the EU and Japan in their ETS. Whereas Japan has focused on securing certifications in CDM as the implementation of Kyoto protocol, EU has shown a tendency to transform the trading market from a parallel structure of EUA and CER transaction to only the EUA transaction after ending of 1st commitment period of the Kyoto Protocol. Since the differences were mainly caused by not only in a design of the system but also in internal governance and their national circumstance, it is meaningful to analyse the Korean case with a similar framework. This study may contribute to designing an appropriate system for emission trading in Korea through the comparison of the EU and Japanese case.
