Post-evaluation system reflects the results of performing a public construction project in the future similar public construction projects to be utilized in the planning. However, the current system simply compares the expected values, such as demand, B/C ratio, cost of construction, construction period, with the actual values after the completion of construction. In addition, most public owner does not actively conduct the post-construction evaluation tasks, so that the evaluation results has not been returned to early stage of a construction project. In this study, status of the post-construction evaluation system is investigated by a survey of the public owner and the construction project evaluation system of the United States and Japan was analyzed. This paper presents the improvement scheme of utilization of the results of the post-construction evaluation system. Through improving the post-construction evaluation system, it is expected that public agencies would easily utilize the post-construction evaluation.

공정거래위원회는 지난 8월 16일 하도급대금 직접지급제도 운영지침을 마련하고 시행에 들어갔다. 이에 따라 구청$\cdot$교육청 등 행정기관에서 하도급대금 직접지급 의무를 위반하게 되면 해당 행정기관장이 시정명령을 받게 되며, 발주자의 하도급대금 직접지급의무는 수급사업자의 직접지급요청이 발주자에게 도달한 때를 기준으로 하고, 직접지급요청에 특별한 방식을 요하는 것이 아니라 요청의 존재를 입증할 만한 증거가 있으면 되게 했다. 또 공정거래위원회는 하도급대금의 직접자금에 대한 발주자, 원사업자, 및 수급사업자간의 합의 여부를 판단하는데 있어 3자간의 명시적이고 동시적인 의사합치만이 유효한 것이 아니라 발주자 및 수급사업자가 직접지불에 대한 동의 등 어떤 형식으로든 인식하고 있는 묵시적$\cdot$순차적 합의도 인정하기로 했다.

올해 1월 1일부터 기계설비의 겸업제한이 폐지되면서 주계약자공동도급제도가 기계설비에 적용되고 있다. 이에 따라 한국철도시설공단이 지난 4월 2일 총 700억원 대의 기계설비공사를 주계약자 공동도급으로 발주하였고 LH공사에서도 600여억원대의 기계설비공사를 주계약자 공동도급으로 발주할 예정이다. 이같은 성과는 대한설비건설협회가 지난해부터 건설산업 공생발전위원회를 비롯하여 국토해양부 장관과의 간담회, 국가기관 및 정부투자기관 등에 주계약자 공동도급을 기계설비공사에 적용하여 줄 것을 강력히 건의한 결과이다. 또한 서울특별시회를 비롯한 13개 전국 시 도회에서도 지방자치단체에 주계약자 공동도급이 적용될 수 있도록 적극 건의하고 있어 앞으로 국가공사와 지자체 공사에서 주계약자 공동도급이 활발히 발주될 전망이다. 지난 2009년 겸업제한이 폐지된 전문업종에 한하여 주계약자 공동도급이 도입된 이래 전문공사의 경우 3년 동안 총 1,100억원 대의 공사가 발주되었다. 그러나 기계설비공사는 대한설비건설협회의 부단한 노력에 힘입어 주계약자 공동도급이 적용된 지 4개월 만에 한국철도시설공단과 LH공사에서 6건의 공사에 총 1천300억원 대의 공사가 발주되는 성과를 거두었다. 이번 호에는 주계약자 공동도급에 대하여 자세히 알아본다.

정부가 건설산업의 투명성 제고를 위해 건설공사대장 통보제도를 원도급 공사는 지난 2003년부터, 하도급 공사는 지난 2008년부터 시행하고 있다. 도입 취지는 발주자와 정부가 건설산업종합정보망을 통해 불공정 하도급거래 및 불법행위를 상시 모니터링함으로써 하도급업체를 보호하고 하도급 과정 및 실적을 투명하게 관리하기 위함이다. 이 제도는 의무사항으로, 통보하지 않을 경우 시정명령 및 과태료가 부과된다. 이에 따라 설비건설업계는 누락되지 않도록 각별히 주의할 필요가 있다. 최근 회원사로부터 이 제도에 대한 문의가 많아짐에 따라 건설공사대장 통보제도에 대해 게재한다.

Clients demands have been changed by construction circumstances such as high-technology, mega-projects, and the complexity of construction. Advanced foreign countries have already introduced and applied new project delivery systems(i.e, CM, DB, etc.) to deal with the change of such that. Recently, Korea also launched two new project delivery systems, "Best Value Contracts to which the State is a Party" to provoke the project delivery system, which helps a public owner select a project delivery system appropriate to the project characteristics. Even though government has made his efforts as stated above, some clients have still used those to public construction projects uniformly. That is because there are not a selection criteria of project delivery system for clients. Therefore, this paper proposes the selection criteria of project delivery system based on project types in the public large construction projects.

In many cases, the construction industry in Korea has a hierarchical structure in which a general contractor in charge of the entire project is subcontracted from the client and entrusts the construction to a specialty contractor in charge of detailed work types. In this structure, the general contractor manages and takes responsibility for the entire construction, but the person directly involved in the construction is an individual specialty contractor, so the quality and safety of the facilities will vary according to their construction and management capabilities. In order to solve quality and safety problems that may arise due to the difference between the person receiving the order for construction and the person who actually constructs it, it is necessary to let the person who receives the order perform the construction directly for projects under a certain amount. The system introduced for this purpose is the direct construction mandatory system. As described above, although this system was introduced to prevent bad construction and risk transfer, it is a system that has various problems due to the characteristics of the domestic construction industry, institutional limitations, and practical problems, so it is necessary to improve it legally and institutionally.

감사원은 부실시공방지를 위해 건설제도 전반을 일대 혁신하는 총54개 사항의 건설제도 개선 방안을 최종 확정하고 재정경제원과 건설교통부등 관계부처에 통보했다. 앞으로 예정가격이 일정규모 이상인 낙찰자 선정방법이 가격경쟁에서 기술경쟁방식으로 개선되고, 공동도급으로 발주되는 공사의 입찰참가자격이 제한군 입찰대상업자만 입찰할 수 있도록 바뀐다. 또 감사원은 입찰 보증제도에서 일괄입찰보증하는 경우 매 공사별 입찰보증금 납부를 면제하도록 하고, 각종 보증 수수료를 건설업자의 성실도에 따라 차등 징수하도록 했다.

금년초부터 지식경제부의 발주로 한국석유관리원(이하 석관)에서 RFS(신재생연료의무보급제도) 국내 도입방안 연구를 수행중에 있으며, 연료업계, 지동차업계, 전문가 등이 참여하는 TF가 구성 운영되고 있다. 이미 2007 년부터 바이오디젤 0.5%가 자동차용경유에 혼합되어 사용되고 있는 가운데, 지경부에서는 신재생에너지법 상에 동 제도를 담아 고시가 아닌 법의 형태로 운용하려는 계획을 갖고 있다. 또한, 국회 지경위에서도 RFS 제도 시행 법안이 논의되었으나 계류된 바 있다. 국내 전체 차량이 1,870만대에 달하고 있는 상황에서 바이오연료 의무보급제도 시행은 전체 국민에게 영향을 미치는 중요사항이나 만큼 반드시 사전검토가 필요한 사항 등에 대해 논하고자 한다.

The Small and Medium Business Administration specified 123 construction materials mandatory to purchase directly and forced the public owners to provide the contractors with materials as required by related law. This study extensively reviewed various characteristics and management factors of the owner-providing materials consumed in the public apartment housing under Direct Buying System(DBS) from the public owner's perspective. Subsequently, the major managed materials were identified, and the proper response plan was developed along the material procurement process. The Procurement Management Load Indices (PMLI) of 43 materials were evaluated according to rating criteria with procurement path, project-specified level, user requirement level, supplier's responsibility, on-site work requirement, additional parts, and inspection standards. The tile and aluminum windows were classified in the group needing high-level procurement efforts to reduce the errors and ensure the efficiency. The accurate quantity estimation method, definite purchase details, management activity definition before and after production, additional quantity for rework, interference coordination were defined as the essential activities for effectively responding to DBS.
