The insurer's right to take legal proceedings in the name of the assured against a third party who has caused loss of or damage to the goods is of particular importance in marine cargo insurance under international trade transaction. The amounts recovered in subrogation actions, known in practice simply as recoveries, form a significant element in the balancing of the cargo insurer's underwriting account by improving ing the loss record. However, even if the carrier involved in the accident have a liability for damages, in some cases can not claim damages in accordance with the after clauses and carrier's exemption clauses indemnity carrier under the contract of carriage. In recent, the dispute cases to argue damages claim of the carrier in connection with business practices of surrender B/L, the claim is dismissed cases in accordance with the Arbitration Rules of the after clauses. In the future, the surrender B/L is continually to use as a marine transport method, it may also be interested in insurance subrogation of damages claims to insurance accident by a surrender B/L.

본 연구는 최근 높은 관심을 일으키는 도심 내 한옥이 젠트리피케이션으로 이어지는 과정을 분석하고 이 과정에서 간과될 수 있는 공간의 중층성에 주목하였다. 흔히 젠트리피케이션은 도시 내 개발 압력에 따라 이뤄지는 대대적이고 급작스런 공간의 천이로 인식되는 경향이 강하다. 하지만 이러한 이해 방식은 실제 도시 공간변화에서 벌어지는 변증법적 과정과 다층적 존재들의 복잡한 상호 영향을 간과하게 한다. 본 연구는 서울시의 재개발 과정과 익선동에서의 한옥 개량 등을 살펴봄으로써 도시 공간 속 다양한 주체들의 관점과 실천이 젠트리피케이션에 다층적이고 변증법적으로 작용하는 과정을 분석한다. 더불어 문화유산의 요소를 매개로 한 도시공간의 변화가 도시 내 문화장소 형성에 있어 어떠한 함의를 갖는지를 논하도록 한다.

2002년 의료 관련 선고된 판결들 중에는 , 환자의 자기결정권 행사를 보장하기 위하여 구체적인 상황에서 환자에게 의료행위의 위험성과 부작용 등에 관하여 충분히 숙고한 후 결정할 수 있는 시간적 여유가 주어져야 한다는 점을 명시하면서 설명의무의 이행시기와 관련된 의미 있는 판결이 있었다. 또한 보험회사가 실손보험상품 가입자들을 대위하여 의료기관에 대해 부당이득반환을 청구한 사례에서 채권자대위권의 보전의 필요성 관련 적극적 요건과 소극적 요건을 분설하여 명확한 기준을 제시한 판결이 있었다. 의료행정 영역에서는, 국민건강보험법에 따른 요양기관 업무정지처분의 성격을 대물적처분으로 명확히 한 판결, 코로나 백신투여 부작용에 대한 보상 인정 사례에서 인과관계를 폭 넓게 인정한 판결 및 한의사의 초음파 의료기기 사용 등 의료인의 면허범위 관련 판결이 있었다. 환자에 대한 의료기관의 퇴거 청구 사례에서 의료법 제15조 제1항과 관련하여 입원진료계약의 해지에 관한 정당한 사유에 대한 판결을 검토하였다.

There is an agreement that sociocultural forces affect on the types of arts. There have been a little attempts to draw analogy between architecture and music. There are many objective and subjective factors for this to be true. If, however, the two arts are out of much the same social conditions, they show a degree of conformity in design and general organization. Our study shows the interrelationship between the Residential Space and structure of music. In order to clarify the interrelationship between architecture and music, the study examines ten Residential Spaces suggested by Yi-Jinkyung. The Residential Spaces are analyzed by using theory of Space Syntax. The structure of music is analyzed by tonality, counterpoint and harmony. The comparison between the Residential Spaces and music follows : From Renaissance to the 19th century, they have the same tendency to 1) openness & closure to the outer space and 2) the netting diagram in the inner space & Counterpoint 3) the tree diagram in the space & Harmony

This study is about a relationship of architecture and polyphony music. In the field of interior architecture, there have been many tries of applying characteristics of music, such as abstraction and nature of time for users of space to have new experience. It has been possible because architecture and music have similarities in many ways. Regarding using proportional characteristic in architecture and music, the both fields are enormously related in some ways. The purpose of this study is explaining of possibility of architectural expression in music and suggesting a way of analysing architectural design based on musical elements emphasizing proportional characteristic. Therefore, it is going to analyse Counterpoint of Bach, which is well expressed in music and compare it with proportional characteristic of space through this study.

본 연구에서는 개발도상국 해외투자 입지 결정요인을 실증 분석하였다. 분석의 결과 입지요인인 피투자국 시장규모, 경제 발전 정도, 경제성장율, 인적자본의 질, 경제의 개방도, 현지시장 매력요인의 대위변수인 현재 외국인 투자 유치액등은 해외투자 유치에 정의 영향을 미치는 요인으로 나타났다. 수정된 중력 모형에서 중 요변수인 피투자국의 모든 투자국들로 부터의 상대적인 시장가중치를 감안한 원격성은 낮을수록 해외투자 유치가 활발한 것으로 나타나고 있어 거래비용이나 현지시장 친숙도가 중요한 해외투자 고려 요인임을 알 수 있었다.

본 논문에서는 셀 단위 바나듐 배터리의 220회의 충·방전 사이클 기반으로 획득한 데이터를 통해 장기간 사이클 시험에 따른 바나듐 배터리의 전기적 등가회로 모델에 적용되는 파라미터 분석 결과를 제시한다. 또한 온도에 따른 영향성 분석을 위해 상온(25℃), 저온(15℃) 및 고온(35℃)에서 각 10회 충·방전 사이클 실험을 진행하였고, 이에 대한 파라미터 분석 결과도 제시한다. 장시간 사이클 실험에 따른 전기적 특성분석 결과 바나듐 배터리의 핵심 노화인자는 배터리 전기적 모델에서 직렬저항인 Ri 파라미터임을 시험 검증하였다.

청소년 남 녀의 채형관련 변인의 연령증가에 따른 발육 달성율의 변화양상을 분석 평가 하였다. 4개부위의 피하지방후 합은 $12{\sim}14$세를 제외한 전연령구간에서 여자가 남자보다 유의하게 높았으며, 13세를 분기점으로 성차가 커지는 경향을 보였다. 골의 상완골폭은 $13{\sim}15$세를 제외한 전연령구간에서 남자가 여자에 비해 높았으며, 15세를 분기점으로 성차가 컸다. 대퇴골폭은 전연령구간에서 남자가 여자보다. 유의하게 높았으며, 연령이 증가할수록 성차가 약간씩 커지는 경향이었다. 근육의 상완이두근최대위는 7세를 제외한 전연령구간에서 남자가 여자보다. 유의하게 높았으며, 15세를 분기점으로 성차가 점차가 커졌으며, 하퇴대위는 남 녀 모두 연령이 증가할수록 높아지는 경향을 나타내고, $10{\sim}15$세에는 여자가 남자보다 높았다가 16세 이후 남자가 높아지는 교차현상을 나타내었다. 체형의 내배엽성요소는 $10{\sim}11$세를 제외한 전연령구간에 서 여자가 남자보다 높은 반면, 중배엽성요소는 15세를 제외한 전연령구간에서 남자가 여자보다 높았고, 외배엽성요소는 $8{\sim}12$세에 여자가 남자보다 높았다가 13세 이후 남자가 높아지는 교차현상을 보였다. 종합적으로 청소년 남 녀의 체형관련 변인에서 지방조직의 발육정도는 여자가 남자를 앞서며, 근과 골의 발육정도는 남자가 여자보다 높았다.

This study aims to disclose the dynamics of Daniel Libeskind Museums by the principles of counterbalance. Balance as a dynamic concept is the settlement of instability and tension and to draw overall sense of balance by controlling new perception elements that may cope with the unbalance elements. This is based on balancing compensation and can be explained as a counterbalance. Daniel Libeskind, a representative architect of deconstructivism, creates dynamic space by using oblique lines on the plane. The study was carried out under the assumption that this space would be designed under the certain principles rather than the result of momentary feelings and the analysis was conducted by the counterpoint of music and counterbalance. As a result, Daniel Libeskind balances in a way of forming the mutual right angle by using oblique lines which cancel out the unbalance in plane composition or making the same angle based on vertical / horizontal axis. Counterbalance has been achieved in the section and elevation as well as plane and complex and diverse oblique lines were worked under the constant principle not accidental results. The axes of Daniel Libeskind's architecture have been known to follow contextualism with symbolism and historicity but it was found that a design technique considering counterbalance was used in the overall control.
