Water Governance and Basic Water Law (물거버넌스와 물관리기본법)

  • 본 연구의 목적은 물거버넌스 개념과 1997년, 2006년 물관리기본법안 분석을 통해 한국의 새로운 물관리 체제를 모색하는 것이다. 물거버넌스는 물관리정책과 계획의 수립, 시행, 평가에 있어 정부뿐만 아니라 일반 기업, 시민, 환경단체, 전문가 등 여러 이해당사자를 참여시키는 것을 핵심으로 한다. 거버넌스란 기존의 정부 주도의 정책 계획, 수립, 시행이 아닌 비정부 조직과의 타협, 협의, 논의를 통한 양방향 정책결정 과정을 뜻한다. 따라서 물거버넌스의 가장 중요한 원칙은 다양한 이해당사자 참여를 통한 정책결정의 복수화 과정이다. 한국의 물거버넌스를 시행하기 위해 가장 필요한 요건은 이해당사자 참여를 우선 중앙, 지방정부에서 그 필요성을 인식하고 법, 제도 등을 통해 제도화하는 것이다. 환경부 주도로 입안된 1997년 물관리기본법안은 물관리일원화, 적정사용, 유역관리, 비용부담, 균형배분의 5원칙을, 2006년 물관리기본법안은 물관리일원화 대신 통합물관리, 적정사용 대신 수요관리를 삽입하여 5원칙을 제시하였지만 이해당사자 참여는 원칙에 포함시키지 않았다. 이해당사자 참여 원칙의 제도화가 없이는 위의 두 법안이 제시한 원칙의 적용과 시행이 어려움에 봉착할 가능성이 높다. 왜냐하면 다른 원칙은 다양한 이해당사자 참여를 통한 사회적 합의 없이는 시행이 쉽지 않은 정치적으로 민감한 사항들이기 때문이다. 예를 들어 물의 균형배분 원칙 관련, 만약 상류와 하류 주민 간의 합의가 없이 어느 한 이해당사자의 일방적 행위가 있을 경우 큰 갈등을 유발할 수 있다. 물거버넌스을 실행하기 위해 중앙에 필요한 조직은 물이용 관련 물분쟁 발생 시 이를 조정하고 국가물관리계획을 수립하며 물관리 문제 전반을 총괄하는 조직이다. 1997년, 2006년 기본법안은 국가물관리위원회 설치를 제시하였고 2006년 기본법안에서 보다 구체적으로 위상, 운영, 역할 등에 대해 언급하였다. 하지만 국가물관리위원회는 물관련 중앙부처의 장, 지방행정조직의 장만을 포함하여 유역관리를 책임질 유역관리조직의 장에 대한 언급이 없다. 물거버넌스 실현을 위한 유역관리 시행이 바람직하기에 유역관리조직의 장도 국가물관리위원회에 참여하는 것이 바람직하다. 또한 두 기본법안 모두 국무총리실 산하에 위원회를 속하게 하였는데 이를 수정하여 대통령 직속기구로 규정하는 것이 국가물관리위원회가 정치, 행정, 재정적 압력에서 벗어나 일관성 있는 정책을 펼 수 있는 지름길이 될 것이다. 또한 지방의 물문제를 물관리계획에 적절히 반영하고 대응방안을 수립, 시행하기 위해서는 정부 관료뿐만 아니라 지방의회 의원, 환경단체, 기업, 시민, 전문가 등의 다양한 이해당사자가 참여하는 유역위원회가 필수적이다. 또한 유역 관련 물관리계획을 수립하고 사업을 추진하는 유역관리청도 필요하다. 유역위원회와 유역관리청은 유역 내 여러 이해당사자들이 물관리에 대해 다양한 의견을 개진하고 토론하며 합의점에 이르는 거버넌스를 수립할 수 있는 중요한 조직이다. 두 기본법안은 유역관리 원칙을 제시하긴 하였지만 유역관리 시행 관련 조직, 역할, 운영 등에 대해서는 언급이 없었다. 한국의 물관리는 소득, 문화 수준 향상으로 인한 양질의 물공급에 대한 요구, 시민사회의 발전, 지방분권화 등 정치, 경제, 사회의 변화를 수용하고 발전해 나가기 위해서는 여러 이해당사자의 참여와 합의에 바탕을 둔 물거버넌스 수립이 무엇보다 중요하다. 또한 이를 시행하기 위해서는 물관리기본법을 하루 속히 제정하여 제도적 기반을 갖춰 보다 효율적인 물관리시스템을 수립해야 한다.

  • The most important thing in the trial reveal the truth regardess of civil trial or criminal trial. The criminal procedure should be amended to guarantee victims the right to attend court hearings, to receive information about the progress of their case. But the new Criminal Procedure Law 2007 stipulated merely reading right of investigation records after prosecution while reading and printing rights prior to prosecution were not legislated. All sections of the criminal justice process must ensure that the process of dealing with the offender should not increase the distress or add to the problems of victims of crime in secondary victimisation. Reading and printing rights of prior to prosecution should be stipulated at earliest to protect the criminal victims and to prevent the secondary victimisation, The purpose of this study is to practically protect the right of the victims on the criminal procedures.

Stakeholder's Expectations in the National Space Exploration Enterprise (우리나라 우주개발사업에서 이해당사자(Stakeholder)의 기대조건)

  • Various stakeholder's expectations and constraints are to be efficiently resolved into a program consensus prior to the beginning of its substantial design processes. This study focuses on the analysis of the stakeholder's expectations in determining the design requirements at the initial stage of space exploration programs including Naro launcher and currently on-going KSLV-II program. Naro program seems to unilaterally account for the government expectations of accelerating program phase speed without making any efforts to converge various expectations from related sectors. The planning of Naro launcher is also found lack of the concept of operations (ConOps), which is of critical importance by envisaging the operational applications of end products. Similarities are found in KSLV-II program regarding the lack of implementation for stakeholder's expectations. Moreover, the government plan for KSLV-II disclosed without considering all expectations and other comments. The increase in design conflicts and program uncertainties would be unavoidable, if the government plan for KSLV-II would be insisted. It is required to modify the government plan and to establish the ConOps with the convergence of stakeholder's expectations at this early stage of the program.

  • Korea has been suffering from increases in various disputes as well as militant behavior of resolving them. Industrial relations has become a typical case. However, research on the occurrence and resolution of a dispute has been rare. Especially, it has been difficult to find a study on barriers to dispute resolution. This paper investigates psychological barriers, information barriers and institutional barriers to reduce the efficiency of negotiation. It applies them to the typical cases of labor disputes and proposes implications to improve the way to resolve labor disputes.

  • The number of dangerous goods are increasing in maritime transport. As a result, a number of nations and international organizations are establishing or amending the rules of dangerous goods. There is necessarily the transport of dangerous goods like fuel and the importance of the definition and scope of the goods is increased. In addition, the responsibility between the parties is different with the notification of the goods and its awareness of transporters. In particular, responsible clauses of the transport rule show antithetical concepts between the scope of immunity and the responsibility of a shipper concerned with wether transporters aware. This research performs two works. First, this research analyzes the definitions and scope of dangerous goods through prior research. Second, this research suggests the necessary of united interpretation of the articles through a comparative analysis on judical decisions concerned with awareness of transporters to dangerous goods. Dangerous goods have a distinctive feature and that is why responsibility and immunity between parties should be differently interpreted with general rules. Parties have duty concerned with faults on general goods and the scope of duty between parties can be specifically made. However, if there is no specific articles concerned with responsibility between parties to dangerous goods, they could confuse the responsibility on duties concerned with risk. Therefore, this research suggests solutions and necessary of the united criteria for the articles to dangerous goods through analyzing precedent cases.

A Study on the Doctrine of Standing in the Suits caused by the Press Reports (언론소송에 나타난 보도의 개별적 연관성과 당사자적격)

  • Standing to sue has become one of the most important and controversial issues in suits between the press and the victims injured by the press reports. Even thought Korean law was patterned after the European legal system, there is no denying that the Korean Constitution was influenced by that of the United States. The judicial system was also influenced by its counterpart in the United States. The doctrine of standing to sue has plagued the U.S. Supreme Court for several decades. The traditional test of standing in the federal courts was, at the beginning of the century, whether the interest asserted by the plaintiff amounted to a 'legal right', entitled to the protection of the common law. In recent years, the Supreme Court seems to have settled on a two-tiered method for determining whether a plaintiff has standing to sue in federal court. The first level of inquiry is the constitutional core, and the second is the judicially imposed prudential limitations. The purpose of this study is to find out the doctrine of standing in the legal proceedings caused by the press reports. The press needs to internally transform as well to prevent legal dispute, enforcing confirmation when collecting news materials and building up the device for pre-examining the news. The press is also requested to help sincerely the victim recover, realizing that they waste their reputation and credit not to mention a lot of time and monet during the legal dispute.

A Qualitative Study on the Mental Crisis Occurence and Self-Help Support Process of People with Mental Disabilities - Focused on the Experience of Participating in Self-Study and Mutual Help of Bethel's House (정신장애인의 정신적 위기 발생과 자조적 지원과정에 관한 질적 연구 - 베델의 집 당사자연구 참여경험을 중심으로 -)

  • The purpose of this study is to analyze the records of 8 people with mental disabilities who had participated in Research and Mutual Help of Bethel's House and to investigate the occurrence of mental crisis and process of self-help by using the grounded theory method. As a result of axial coding, the central phenomenon of crisis experience of the people with mental disabilities was derived as 'being overwhelmed by hardships in the life related to their symptoms'. In the self-help process of overcoming the crisis, Action-interaction strategies were derived as 'talking about the hardships', 'researching and practicing with peers', 'participating in various groups', etc. through the intervening conditions such as 'understanding patterns and meanings of hardships led by the person' and 'finding ways to overcome the hardships with the person'. These strategies were analyzed as a process in which the person with mental disabilities leads his/her life reassuming control over his/her crisis. The result of this study shows that it is necessary to expand the political crisis concept in the support system for the mental crisis of people with mental disabilities, and the self-help approach in which the persons participate autonomously can be useful.

A Case Study on Persons with Developmental Disabilities Participating in Personalized Support Service (개별유연화서포트서비스에 참여한 발달장애인의 경험에 대한 사례연구)

  • The purpose of this study was to understand the experience of persons with developmental disabilities participating in the Personalized Support Services. For case study, we conducted in-depth interviews with the persons with developmental disabilities and with the active supporters for them who were using the community welfare centers for the disabled. Through this, we have come up with three core categories: 'coming out into the community', 'experimenting with various choices in life', and 'living a subjective life'. This suggests the followings; First, it can be seen that persons with developmental disabilities who have limited communication and self-determination should be allowed to participate in the service through the participation process, and active support for the parties is needed in the process. Second, it is necessary to plan and support for them, centering on the parties, away from institution-centered services. Third, sufficient budget support should be provided for the self-determination, selection and control of the parties. Fourth, we should be able to enjoy everyday life by participating together in the local community, and change the perception of local residents to participate in the community. Fifth, continuous support is needed rather than temporary support. Finally it will be needed for us to listen to the voices of both parties and to represent their rights with all our efforts.

이해 당사자 신뢰성 증진을 위한 유럽 연합의 RISCOM II 프로젝트 사례 현황

  • 방사성폐기물 처분 사업을 둘러싼 논란은 지난 50 여년간 국내외에서 계속되었다. 세계 각국은 뛰어난 과학 기술의 도입과 대규모의 홍보에도 불구하고 많은 경우 처분 사업의 실패를 맛보았다. 그러나 핀란드, 스웨덴 등 일부 유럽 국가들은 다른 나라들에 비해 비교적 적은 예산과 기술 인력을 투입함에도 불구하고 부지 확보 및 안전성 확보에서 괄목할만한 성과를 거두고 있다. 본 논문에서는 이러한 현상에 주목해 방사성폐기물 처분 연구 사업에서 쌍 방향 대화의 중요성을 간파하고 이를 적용하는 방안을 연구한 유럽 연합의 RISCOM II 프로젝트 중 프랑스, 핀란드, 스웨덴 사례에 대해 살펴본다.

  • 국가를 당사자로하는 계약에 관한 법률 시행령∙시행규칙 및 회계예규가 일부 개정되었다. 이번에 개정된 주요 내용은 입찰참가자격 사전심사 대상의 확대 및 의무화, 최저가낙찰제 대상공사의 확대, 건설재해 및 제재처분 사항 관련 신인도 평가제도 개선(본지 법령과 고시① 참조), 공사의 현장설명제의 보완, 계약이행보증방법의 변경제도 도입, 부정당업자의 입찰참가자격 제한 범위 확대, 입찰방법 심의기구의 일원화 등이다. 본지는 국가계약법 시행령∙시행규칙 및 회계예규의 주요 개정 내용을 게재한다.
