Research on the Effectiveness of Protecting Utility Model with China's Patent Evaluation Report (실용신안 권리보호에 대한 중국 특허권평가보고서제도의 유효성 연구)

  • China's utility model as a supplement to the invention patent, has short application duration, fast authorized speed, and has the same exclusive rights with patents, so companies can quickly dominate the market. But the utility model does not need to carry out substantive examination, so has lower stability, high frequency of invalid to accepted, so compare with the invention patent, difficult to be protected. In order to actively encourage the small and medium-sized enterprises to promote their inventions, and protect domestic patents, China established a protection policy of patent evaluation report for the utility model rights, especially the patent evaluation report can be used as evidence in a patent infringement trial, to provide judicial remedies for utility model patentee and the party of patent disputes. Many experts believe that the establishment of patent evaluation report system can improve the stability of the utility model patent right, and when the defendant request for invalidation of the patent right in the defense period, if there is no novelty, creativity lost or no other reason has not led to the stability of patent right given in a patent evaluation report of the utility model patents, the court may not suspend the trial, without having to wait for the Patent Reexamination Board makes the patent invalid declaration decisions, can improve the efficiency of the judicial process, accelerate the patentee's time. However, in practical patent infringement, the patent evaluation report system and invalidation system are in conflict. In this paper, through the analysis of the current China utility model system and compared with the South Korean utility model system, review the role and character of the patent evaluation report system, and through the actual cases of the utility model patent infringement litigation, analysis possible variates from the decision of patent evaluation report, to find out the reason of the patent evaluation report system being in conflict with the invalidation system, and research on the effectiveness for protecting Utility Model with China's Patent Evaluation Report.

Satisfaction Analysis of On-board Training in Shipping Companies: Impacts on Company Improvement Plans (위탁승선실습 만족도 분석을 통한 개선 방안 연구)

  • The purpose of this study was to explore the regulations and operational problems of on-board training, and to investigate and analyze the satisfaction level of consignment on-board training among students who completed their training at Korea Maritime & Ocean University. In terms of satisfaction differences by gender, female students generally had a higher relative satisfaction level than male students. The different types of satisfaction in the navigation and engineering categories, the overall practical effect and satisfaction level of the training records shows that the satisfaction level of the trainee is much lower than that of the trainee, so relevant educational institutions and shipping companies need to take measures to improve the satisfaction level of this part. The most important part of the comprehensive company evaluation completed by trainees asked whether they thought the training was equivalent in labor to the employees. Results suggest shipping companies must make a clear distinction between employees and trainees, while establishing relevant internal procedures so that the on-board training process can be carried out in accordance with the purpose of the on-board training consignment.

  • 목적: 1990년대 초반부터 시작된 우리나라의 산업 보건에 대한 사회적 관심의 증대와 시장의 요구에 따라 산업위생기관의 양적인 팽창이 이루어지긴 하였으나 실험실 관련 안전보건규정이 미비한 상태에서 추진되어 산업위생 실험실에서 다양한 유해 위험성 인자를 취급함에도 불구하고 사용되는 량이 소규모로 인해 안전보건과 관련된 사항은 대부분 간과하고 있으며, 산업위생 실험실의 안전보건관리 실태는 선진외국에 비해 상당히 낙후되어 있는 실정이다. 따라서 본 연구는 우리나라 산업위생 실험실과 관련한 안전보건관리 실태를 평가함으로써 향후 실험실의 안전보건관리 수준을 향상 시키는데 효과적인 자료로 활용하는데 기여하고자 한다. 방법: 산업위생실험실의 안전보건 실태를 파악하기 위해 설문조사를 수행하였으며, 설문은 실험실의 전반적인 안전보건, 화학물질 저장 및 용기, 가연성 및 인화성 화학물질, 가스 실린더, 의사전달, 응급처치 및 비상사태 장비, 정리정돈, 소방안전, 전기안전, 개인보호구, 흄후드 및 환기, 및 이황화탄소 취급 사례로서 12개 영역으로 구성되었다. 연구대상은 2001년 한국산업안전공단 정도관리프로그램에 참여한 기관으로서 총 대상은 119개 기관이었다. 연구기간은 2002년 7월 01일부터 8월 30일까지 약 60일 이었다. 설문은 반송봉투에 넣어 설문완성 후 연구자에게 보낼 수 있도록 배려하였으며, 1차 설문을 보낸 후 2주 후에 설문 참여를 독려하기 위해 엽서를 발송하였고, 다시 2주 후에 각 산업위생기관에 개별 전화 연락을 취하였다. 그 결과 63% (75개 기관)의 완성된 설문을 얻을 수 있었다. 설문의 총 조사항목은 79문항으로 구성되어 있으며, 산업위생실험실의 안전보건 수준을 정량적으로 평가하기 위해 안전보건 매뉴얼, 교육훈련프로그램 및 한국산업안전공단 실험실 지침서를 보유한 기관과 그렇지 않은 기관간의 차이는 선별된 67문항에 대해 각 문항에 합당하거나 적절할 경우 1점을 부여하는 방식으로 점수화하였다. 이들의 관련성을 파악하기 위하여 Microsoft-Excel 2000 프로그램을 이용하여 two-tailed t-test 분석을 실시하였다. 결과 1. 산업위생실험실 운영과 관련한 67개 항목(항목별로 각 1점 부여)에 대한 안전보건 성과지수화 (100점으로 점수 환산) 결과 안전보건 매뉴얼을 보유한 기관은 $42.98{\pm}13.36$(p<0.001)점, 교육훈련프로그램을 보유한 기관은 $50.75{\pm}14.12$(p<0.01)점, 한국산업안전공단 실험실 지침서를 보유한 기관은 $43.58{\pm}11.92$(p<0.01)점으로 그렇지 않은 기관에 비해 통계적으로 유의하게 높은 점수분포를 보였다. 2. 화학물질 보관 캐비닛이 있는 기관 중 64.8%의 기관은 화학물질을 알파벳 순으로, 27.8%는 분류 기준에 따라, 그리고 7.4%는 무작위로 보관하고 있었다. 3. 단지 8.0% (6개)의 기관만이 실험실내에 눈세정 분수(2 개), 샤워기(3개) 및 눈세정물병(3개, 2개 중복 응답 기관)과 같은 응급처치 장치 및 물품을 갖추고 있었다. 4. 89.0%의 기관이 흄후드내에 화학물질을 보관하고 있었다. 5. 물질안전보건자료, 흄후드 기록지, 비상사태 절차서 및 한국산업안전공단 실험실 지침서와 같은 문서관리는 부적절하게 관리 및 기록되고 있었다. 6. 대부분의 산업위생 실험실은 응급처치 장비, 화학물질 또는 가스용기 보관실과 같은 실험실 안전설비가 부족할 뿐만 아니라 정리정돈, 화학물질 저장 캐비닛, 안전보호구 및 흄후드와 같은 관리가 미비하였다. 결론: 이상의 결과에 근거하여 기관장은 실험실의 안전보건관리를 위하여 문서관리체계를 제공하고, 모든 실험실 종사자가 적절한 개인보호구를 착용할 수 있도록 하며, 비상 장비를 설치하고, 실험실과 관련한 적절한 규정을 제정하며, 교육훈련 프로그램을 제공하여야 한다. 또한 실험실 종사자는 실험 중 적절한 개인보호구의 착용하고, 비상장비 이용에 대한 교육훈련에 참여하며, 적절한 실험실 운영관리에 대한 책임감을 가져야 한다. 위의 권고사항 이행을 위해서 KOSHA는 KQCP 프로그램에 실험실 안전보건관리 항목을 삽입하여 주기적인 평가를 수행할 필요가 있다. 우리나라 실험실의 특성을 고려할 때 본 연구결과는 일반 실험실에도 적용될 수 있을 것으로 생각된다.

The Effect of Subject-Classified Consumer Education on Allowance Managing Behavior of Middle School Consumer (주체별 소비자교육이 중학생 소비자의 용돈관리 행동에 미치는 영향)

  • The purpose of this study is to investigate the middle school students' allowance managing behaviors and consumer education by the educational subject in order to explore a desirable direction of consumer education for allowance management. Questionnaire survey was conducted with 468 middle school students in Gyeongnam. The major findings are as follows: First, as for recognition of consumer education, the consumer education from home was the highest, and then the from school and mass media followed in that order. Second, the average score of the students' allowance managing behavior was low. The fulfillment ability was relatively high compared to planning and evaluative ability. Third, as for overall allowance managing behaviors, the more promoted a students' level of consumer education from school and mass media, the more cultivated his/her allowance managing behaviors. As for allowance managing behaviors in accordance with sub-factors, students' planning and fulfillment abilities were more cultivated, the more promoted his/her level of consumer education from school and mass media. Students' evaluative ability was more cultivated, the more promoted his/her level of consumer education from school and mass media. Fourth, there were differences in educational contents the students wanted in accordance with the educational subjects of consumer education. The consumer education can be more practical when it is connected with home, school, and mass media, development of an educational program with such connection is necessary.

A Pilot Study for Development of the Serious Game Contents for Education in the Elderly Diabetes (노인 당뇨환자 교육용 기능성 게임 콘텐츠 개발을 위한 예비연구)

  • This study was a pilot test of serious educational game content(named Roly Poly 160) designed to enhance self-care by elderly diabetics. Roly Poly 160 was developed in eight steps (literature review, demand survey and consultation, extraction of serious content using games, development of Roly Poly 160, pretest for users, workshop for health care workers, final completion of Roly Poly 160 and user satisfaction survey of Roly Poly 160). Roly Poly 160 is intuitively structured in three modules (self-management, card games, and quiz games) that can be self-managed by the elderly and is designed based on six principles. First, we constructed an intuitive interface considering the age of users. Second, the menu was selected as the main menu for Koreans and calorie learning was made at the same time. Third, the calories and nutrients (carbohydrate, fat, protein, calcium, sodium) of selected foods are analyzed, and all test data recorded in the questionnaire chart are graphically displayed by year, month and week so that the change trends can be grasped at a glance. Fourth, necessary data were saved and output and used as educational data. Fifth, user data are made compatible and aggregated and up to 100 million members can be registered. Sixth, it is designed to be developed as a mobile app if necessary. Using Roly Poly 160, 119 diabetic patients were diagnosed with diabetes, and the satisfaction score was 4.26 out of 5. These findings indicate that Roly Poly 160 is appropriate as a diabetes self-care tool and suggests that there is a possibility to use it as a program to educate people about diabetes in public health centers, hospitals and clinics.

The Research Relating to QA of the Absorbed Dose in the 10 MeV E-beam Facility in Accordance with the International Standards (국제표준에 따른 10 MeV급 전자빔 조사시설의 흡수선량 품질보증에 관한 연구)

  • In the field of healthcare, the conventional sterilization treatments have been replaced by irradiation methods which are in accordance with internationally well established quality standards. The quality control in radiation sterilization assures that the absorbed dose of the irradiated material is in agreement with its requirements and standards. The electron beam irradiation requires technical assessments of more process parameters than gamma irradiation does. Korea has witnessed wide uses of electron accelerators since early 2000 but there hasn't been research experiences relating to quality system in accordance with international standards. The new large scale e-beam irradiation system with the specification of 10 MeV, 8 kW was installed and operated in 2008 by Seoul Radiology Services Co. It consists of the electron accelerator, product handling system, safety, documentation and control subsystems into an integrated system to meet the requirement of the Good Manufacturing Practice such as process quality assurance and management of product tracking records. To implement the international standard such as EN ISO11137, it is necessary to understand the purposes aimed in the standard and carry out the tests following the procedures required. This study presented the specification of the e-beam facility and showed what its design requirements and features are. The test results on a variety of process parameters were presented and validated it they are within the required limits.

Consideration on National Rituals and Folk Beliefs Found in 『Hajaeilgi』 (『하재일기』에 나타난 국가의례와 민간신앙 일고찰)

  • "Hajaeilgi(荷齋日記)" was written by Ji Gyu-sik, a gongin of Saongwon(司饔院)'s branch, almost everyday for 20 years and 7 months from January 1st, 1891 until the leap month of June 29th, 1911. It deals with many different areas including domestic and foreign circumstances, custom, rituals, all the affairs related to the branch, and also everyday life events he did see or hear about. Particularly, Ji Gyu-sik did not belong to the yangban class, and we can hardly find diaries written by such class' people. Here, what this author pays attention to among the things written in "Hajaeilgi" is the contents about folklore. Ji Gyu-sik wrote in his "Hajaeilgi" about things related to folklore, for example, seasonal customs, folk plays, rituals, or folk beliefs that were actually practiced then as a person not belonging to the yangban class. Such diaries are rare, and its value is highly appreciated as a material, and it is meaningful in the aspects of folklore as well. Therefore, as part of the work to look into folklore found in "Hajaeilgi", this author focuses on national rituals and folk beliefs in it. The things that have been discussed earlier can be summed up as follows: About national rituals, it is sorry that it only deals with the emperor's enthronement and emperor and crown prince's birthday in garye(嘉禮); however, it is meaningful to know that the people faithfully carried out national ceremonies and celebrations then. Particularly, it is noteworthy that during the national ceremonies or celebrations, students were asked to sing the national anthem. About hyungrye(凶禮), only it deals with the court funeral rite. Aside from Minbi's funeral rite, the court funeral rite was performed properly at the right time according to the procedure like before, and also, it seems that the people fulfilled it faithfully by order of the government. Also, it can be learned from it that Japanese killed Minbi, burned the body with oil, and left the ashes behind. About folk beliefs, the branch held a memorial service at the shrine of the town regularly. The town, too, performed Gocheongsinsa each year. The money needed for the memorial service was collected from the town people differently according to their financial situations, and they prepared for jesu for the ancestral rite altogether. The memorial service was carried out in Sansindang or Bugeundang, too, and it was common that they summoned a shaman to perform a gut. The diary is valuable as material. After being a Christian, Ji Gyu-sik once tried to abolish sinsa jesa held in hoesa and get rid of saesin(賽神), that is, a gut or pudakgeori, but he had no choice but to follow the precedent. Meanwhile, it is also noteworthy that when the town suffered from floor and infectious disease, Ji Gyu-sik installed an altar in front of his house for the town's wellbeing and health, prepared for jesu including offerings and drinks, and held a memorial service to Hwangcheonhuto(皇天后土; the gods of heaven and earth) accompanied with the town people. Also, when he had any hardships in his family, Ji Gyu-sik summoned a shaman for a gut or offered a devout prayer to the mountainous god. Such shamanism or the things like worshiping Gwanseongjegun(關聖帝君) mostly in the beginning of January and telling fortunes about the year were all folk beliefs. This was very popular among the people, and it seems that it was deeply rooted in his life as well. Also, Ji Gyu-sik supported Fengshui beliefs, and it seems that it is not different from the people's general tendencies, either. As described above, "Hajaeilgi" dealing with national rituals and folk beliefs in it is valuable as material and is meaningful for research on forklore, and moreover, it is also significant in the aspects of forklore as well.

Chinese Communist Party's Management of Records & Archives during the Chinese Revolution Period (혁명시기 중국공산당의 문서당안관리)

  • The organization for managing records and archives did not emerge together with the founding of the Chinese Communist Party. Such management became active with the establishment of the Department of Documents (文書科) and its affiliated offices overseeing reading and safekeeping of official papers, after the formation of the Central Secretariat(中央秘書處) in 1926. Improving the work of the Secretariat's organization became the focus of critical discussions in the early 1930s. The main criticism was that the Secretariat had failed to be cognizant of its political role and degenerated into a mere "functional organization." The solution to this was the "politicization of the Secretariat's work." Moreover, influenced by the "Rectification Movement" in the 1940s, the party emphasized the responsibility of the Resources Department (材料科) that extended beyond managing documents to collecting, organizing and providing various kinds of important information data. In the mean time, maintaining security with regard to composing documents continued to be emphasized through such methods as using different names for figures and organizations or employing special inks for document production. In addition, communications between the central political organs and regional offices were emphasized through regular reports on work activities and situations of the local areas. The General Secretary not only composed the drafts of the major official documents but also handled the reading and examination of all documents, and thus played a central role in record processing. The records, called archives after undergoing document processing, were placed in safekeeping. This function was handled by the "Document Safekeeping Office(文件保管處)" of the Central Secretariat's Department of Documents. Although the Document Safekeeping Office, also called the "Central Repository(中央文庫)", could no longer accept, beginning in the early 1930s, additional archive transfers, the Resources Department continued to strengthen throughout the 1940s its role of safekeeping and providing documents and publication materials. In particular, collections of materials for research and study were carried out, and with the recovery of regions which had been under the Japanese rule, massive amounts of archive and document materials were collected. After being stipulated by rules in 1931, the archive classification and cataloguing methods became actively systematized, especially in the 1940s. Basically, "subject" classification methods and fundamental cataloguing techniques were adopted. The principle of assuming "importance" and "confidentiality" as the criteria of management emerged from a relatively early period, but the concept or process of evaluation that differentiated preservation and discarding of documents was not clear. While implementing a system of secure management and restricted access for confidential information, the critical view on providing use of archive materials was very strong, as can be seen in the slogan, "the unification of preservation and use." Even during the revolutionary movement and wars, the Chinese Communist Party continued their efforts to strengthen management and preservation of records & archives. The results were not always desirable nor were there any reasons for such experiences to lead to stable development. The historical conditions in which the Chinese Communist Party found itself probably made it inevitable. The most pronounced characteristics of this process can be found in the fact that they not only pursued efficiency of records & archives management at the functional level but, while strengthening their self-awareness of the political significance impacting the Chinese Communist Party's revolution movement, they also paid attention to the value possessed by archive materials as actual evidence for revolutionary policy research and as historical evidence of the Chinese Communist Party.

A Study on Coming of Age, Wedding, Funeral, and Ancestral Rites Found in 『Hajaeilgi』 (『하재일기』에 나타난 관·혼·상·제례 연구)

It deals with many different areas including domestic and foreign circumstances, custom, rituals, all the affairs related to the branch, and also everyday life. Here, what this author pays attention to among the things written in "Hajaeilgi" is the contents about rituals, especially coming of age, wedding, funeral and ancestral rites. Ji Gyu-sik did write in his "Hajaeilgi" about coming of age, wedding, funeral and ancestral rites that were actually performed then as a person not belonging to the yangban class. Such diaries are very rare, and its value is highly appreciated as a material. Particularly, from the late 19th to the early 20th century of this author focuses on the a study of coming of age, wedding, funeral and ancestral rites as we can see some aspects about it from his diary. Coming-of-age rites were carried out in the first month of the year generally, and in this period, we can see the transformation of their performing period as it was diversified then. This was not exceptional in yangban families. About wedding, while it was discussed, it came to be canceled more often than before maybe because they were going through the process of enlightenment then. It seems that choosing the day was not done in the bride's family always. Jungin or commoners had a weeding in the bride's house, but when it was needed, it was also performed in the groom's house. Ji Gyu-sik followed the traditional wedding procedure for his children rather faithfully, but it was applied flexibly according to the two families' situations or conditions. Ignoring the traditional manners, they had a wedding in the period of mourning or performed a wedding in the groom's house bringing the bride there. It seems that this was related to the decline of Confucian order in the society in the process of modernization. Also, the form of donations changed, too. Gradually, it was altered to the form of money gifts. Moreover, unlike before, divorcing seems to have been allowed then. Remarriage or divorce was the custom transformed from before. Funeral rites had different durations from death up to balin (carrying out a bier for burial) and hagwan (lowering a coffin into the grave), and so it means that they also went through transformation. Sa-daebu used usually 3 months but here was 7 days from death to balin normally, but it seems that there were yangban families not following it. The traces of 3-iljang (burial on the third day after death) most commonly found these days and chowoo jaewoo samwooje can be also found in "Hajaeilgi". Such materials are, in fact, very highly evaluated nowadays. Meanwhile, donations also changed gradually to the form of money. Regarding ancestral rites, time for memorial service was not fixed. Ji Gyu-sik did not follow jaegye (齋戒) before carrying out gijesa, and in some worse case, he went to pub the day before the memorial service to meet his lover or drink. This is somewhat different from the practice of yangban sadaebu then. Even after entering Christianity, Ji Gyu-sik performed memorial service, and after joining Cheondogyo, he did it, too. Meanwhile, there were some exceptions, but in Hansik or Chuseok, Ji Gyu-sik performed charye (myoje) before the tomb in person or sent his little brother or son to do it. But we cannot find the contents that tell us Ji Gyu-sik carried out myoje in October. Ji Gyu-sik performed saengiljesa calling it saengsincharye almost every year for his late father. But it is noticeable that he performed saengsincharye and memorial service separately, too, occasionally. The gijesa, charye, myoje, and saengsincharye carried out by jungin family from Gyeonggi Gwangju around the time that the status system was abolished and the Japanese Empire took power may have been rather different and less strict than yangban family's practice of ancestral rites; however, it is significant that we can see with it the aspects of ancestral rites performed in family not yangban. As described above, the contents about the a study of coming of age, wedding, funeral and ancestral rites found in "Hajaeilgi" are equipped with great value as material and meaningful in the perspective of forklore.

Target Advertisement Service using a Viewer's Profile Reasoning (시청자 프로파일 추론 기법을 이용한 표적 광고 서비스)

  • In the existing broadcasting environment, it is not easy to serve the bi-directional service between a broadcasting server and a TV audience. In the uni-directional broadcasting environments, almost TV programs are scheduled depending on the viewers' popular watching time, and the advertisement contents in these TV programs are mainly arranged by the popularity and the ages of the audience. The audiences make an effort to sort and select their favorite programs. However, the advertisement programs which support the TV program the audience want are not served to the appropriate audiences efficiently. This randomly provided advertisement contents can occur to the audiences' indifference and avoidance. In this paper, we propose the target advertisement service for the appropriate distribution of the advertisement contents. The proposed target advertisement service estimates the audience's profile without any issuing the private information and provides the target-advertised contents by using his/her estimated profile. For the experimental results, we used the real audiences' TV usage history such as the ages, fonder and time of the programs from AC Neilson Korea. And we show the accuracy of the proposed target advertisement service algorithm. NDS (Normalized Distance Sum) and the Vector correlation method, and implementation of our target advertisement service system.
