  • 디지털 콘텐츠의 다양화와 인터넷 환경의 확산으로 인하여 디지털 유통 구조가 복잡해지면서 기존의 오프라인 형태에서 제공하는 방법으로는 새로운 유통 구조를 보호하기 힘들기 때문에 권리의 상호 침해를 방지할 수 있는 유통 구조 모델을 제시하고 이 모델에 적용할 수 있는 프로토콜 체계를 수려하여야 한다. 본 논문에서는 인터넷 환경에서 디지털 콘텐츠의 유통에 관여하는 유통 주체(Entity)들의 권리를 보장할 수 있는 메타데이터를 분류하였다.

  • 사업자는 소비자와의 관계해서 물품과 용역을 공급함에 있어 소비자의 안전을 보호하고 프라이버시를 침해하지 않으며 소비자의 생명과 신체를 해하지 않는 범위 내에서 최대한의 주의를 행할 의무가 있다. 단적으로 말해서, 광고 행위가 표현의 자유이든 영업상의 권리이든 간에 소비자의 권리를 침해할 자유만은 결코 없다.

  • 수사기관이 운영하는 포토라인이 피의자 망신주기용이며 헌법상 무죄추정의 원칙에 반하므로 없애야 한다는 주장과 국민의 알 권리를 위해 포토라인은 반드시 필요하다는 주장이 대립하고 있다. 포토라인의 문제를 헌법상 무죄추정의 원리와 알권리를 중심으로 합리적 해결방안을 모색해보고자 한다.

  • The uses of land were relatively simple in the old days, but they are being expanded rapidly to the aboveground and underground due to the urban concentration, the large-scale urban development and so on in these days. Accordingly, the concept of the rights to lands grows from 2D to 3D, and many studies about the 3D cadastral information have been performed in recent years. Several studies were performed about the construction and the visualization of the 3D cadastral information, but most of them focused on the 3D visualization of the buildings and facilities. However, it is more desirable to visualize the individual objects of the rights to lands while considering 'the information on the rights' as well as the 'physical information'. Therefore it is supposed to construct and use the 3D cadastral information based on the individual objects of the rights in this paper. The level of the cadastral information will be upgraded by making and describing more detailed 3D cadastral information through this paper. And also the applicability of the 3D cadastral information will be improved when it is used with the real estate information, the demographic information and many others.

The Construction and Characters of the Welfare Rights (복지권의 구성과 성격)

  • This study analysed the components and characters of welfare rights through discussions of the concepts and types of universal rights, and discussions of human rights and citizenship rights. Welfare rights is claims rights which requires somewhat, and it is positive rights. And it is generally passive rights, but it contains collective participation rights which is active rights. The result of total discussions of rights, human rights, and citizenship rights led us to know the components and characters of welfare rights. Welfare rights contains social rights, economic rights, and cultural environmental rights. Social rights are composed of the right of social security, social welfare service, health, education, and residency. Economic rights are composed of the right of labor, intervension of labor market, job security, and capital control. cultural environmental rights are composed of the right of culture and environment. And welfare rights has several characters. First, it is natural rights which is bestowed on the citizens or people in modern civil societies. it is samely characterised as liberties and political rights. second, it has the same values like other rights such as lberties and political rights. Or it is more important, because it is necessary for other rights. Third, it is not the objective being which is constant, but it is changed, formed and constructed as total rights with human rights and citizenship rights. Fourth, it is truely rights, but is simultaniously accompanied by obligations. But the obligations is unconditional like as other rights. Endly, levels of welfare on the welfare rights must be modicum rather than minimum. The meaning of modicum level is uncertain, but it aims to the entire participation of peoples as citizen and social integration. And it has to aim to the prevention of heridity and continuity of inequality.

An Exploratory Study on the Rights of Students in their Social Work Field Practicum -In the aspect of the rights to learn and the rights to work- (사회복지 현장실습 참여 대학생의 권리에 대한 탐색적 연구 - 학습권 및 노동권의 측면에서 -)

  • This study is aimed at examining the rights of students who are under social work field practicum, as trainees, in the aspect of the rights to learn and the rights to work, in particular. This study utilized FGI method, and a total of 18 trainees participated. As a result, awareness of students who joined social work field practicum was reduced to five categories in total and 19 sub-categories. The results is as following. First, social work field trainees did not aware of their rights. Second, the field trainees were taking the role with double positions as a trainee and a worker, and experiencing confusion and difficulties thereof. Third, they were not provided proper instructions as trainees, and feeling burden therefrom. Fourth, even though the students were providing actual labor at the field, they felt anxiety and unfairness because they were not properly protected when they were faced with issues regarding reasonable reward and safety. Fifth, due to such difficulties, students were demanding that field organizations and schools make positive efforts to improve awareness about protection of the rights. Based on such results, offered basic data for field training improvement plans and intended to explore alternative plans for improvement of social work field practicum.

A View on the Guarantee of Cultural Right of the Disabled (장애인의 문화적 권리 보장에 대한 소고)

  • The culture is an integral factor when we deal with the quality of life of members of society, and the cultural right is accepted as the basic right. However, the cultural right of the disabled in our society stays in the conditions of the discrimination and alienation by social prejudices and barriers against people with disabilities, and that results from the lack of understanding as a right. The aim of this study is to further raise awareness about the cultural right of the disabled as the basic human right, make it clear to be a universal right based on that, and insist on implementing 'Affirmative Action' for actualizing the disabled's cultural right to equality. The political measures derived from this study to guarantee and realize the cultural right of the disabled are as follows. First, the target extent of cultural voucher system should be expand to not recipients of national basic livelihood guarantees and near poverty groups, but all the disabled. Second, to take full charge of the cultural support of the disabled as a independent organization, it is necessary to establish Ministry of Culture, Sports and Tourism-affiliated 'Bureau of Culture for Persons with Disabilities'. Third, the nationwide survey on cultural activities and desires of the disabled periodically is required.

The Study on the Self-Esteem, Group Consciousness and Consciousness of Right of People who are Mentally III (정신장애인의 자아존중감과 집단의식이 권리의식에 미치는 영향)

  • The purpose of this study is to offer information needed in developing mental health service programs which can help mental patients to improve their self-esteem. For that purpose, the difference and the interrelation between mental patients' characteristics, and their self-esteem, group consciousness and consciousness of right were examined. And also, in practice, I observed 374 patients suffering from mental problem, who live in Busan and in Kyeong Nam province. As the result, the several facts which could be got from this theoretical examination and practical observation are as follows: First, it is shown that what is meaningfully related to mental patients' self-esteem are their educational level, the families' monthly earnings, a feeling of satisfaction to family relationship, the time spending together with their friends, or a feeling of satisfaction to their friends Second, it is appeared that there was a significant interaction between group consciousness of mental patients, and whether they have got married and the time spending together with their friends. Third, it is found out that their feeling of satisfaction to family relationship and the time spending together with their friends have meaningful relation to consciousness of right which mental patients have. Finally, speaking of interaction among self-esteem, group consciousness and consciousness of right, it is understood that self-esteem has significant effect of group consciousness, and that group consciousness has confidential effect on consciousness of right.

Die politische Diskussion des Patientenrechtegesetzes in Deutschland und die wesentliche Regelungen (독일의 환자권리법에 대한 입법정책적 논의와 중요내용)

  • Mit dem Patientenrechtegesetz, das im $Fr{\ddot{u}}jahr$ 2013 in Kraft treten soll, $f{\ddot{u}}rt$ der Gesetzgeber eine jahrzehntelange Diskussion um die Rechte von Patientinnen und Patienten zu einem guten Ende. Demnach geht es darum, Transparenz ${\ddot{u}}ber$ die bereits heute bestehenden, umfangreichen Rechte der Patientinnen und Patienten herzustellen, die $tats{\ddot{a}}chliche$ Durchsetzung dieser Rechte zu verbessern, zugleich Patientinnen und Patienten im Sinne einer verbesserten Gesundheitsversorgung zu $sch{\ddot{u}}tzen$ und insbesondere im Fall eines Behandlungsfehlers $st{\ddot{a}}rker$ zu $unterst{\ddot{u}}tzen$. In Verfolgung dieser Zwecke $schl{\ddot{a}}gt$ die Bundesregierung ein Artikelgesetz vor, dessen wesentliche Teile das BGB und das Recht der sozialen Krankenversicherung betreffen. In das BGB soll ein neuer Abschnitt ${\ddot{u}}ber$ den "Behandlungsvertrag" $eingef{\ddot{u}}gt$ werden. Als Standort ist der ${\ddot{U}}bergang$ vom Dienstin das Werkvertragsrecht vorgesehen, der um die neu zu schaffenden Vorschriften der ${\S}{\S}$ 630 a bis 630 h BGB erweitert wird. Die acht Paragrafen enthalten im Kern eine Kodifikation der von der Rechtsprechung entwickelten $Grunds{\ddot{a}}tze$ zur Arzthaftung. Der Beitrag stellt die bisherige politische Diskussion des Patientenrechtegesetzes vor (II). Im Anschluss daran wird die einzige wesentliche Neuerung des Gesetzes $n{\ddot{a}}her$ untersucht und werden Regelungsziel und Grundkonzept der Kodifikation einer $Pr{\ddot{u}}fung$ unterzogen (III). $Schlie{\ss}lich$ werden einen politischen Ausblick auf die neuen Herausforderungen und die Bewertung der $gegenw{\ddot{a}}rtigen$ Lage und der erwarteten Entwicklung gezogen (IV).

The Effect of Childcare Teacher's Happiness and Self-Leadership on Respect for Young Children's Rights (보육교사의 행복감과 셀프리더십이 유아권리존중에 미치는 영향)

  • Objective: This study examined the how childcare teachers' happiness and self-leadership influences on respect for young children's rights. Methods: For this purpose, 350 childcare teachers in G city were surveyed. Data of 291 copies as final research subjects were analyzed through one-way ANOVA and hierarchical regression analysis. Results: First, external and self-regulating happiness sub-factors of happiness, differed according to the academic background. Behavioral and cognitive strategies, the sub-factors of self-leadership, differed according to the academic background and career. The right to life, right to protection, development rights, and participation rights, which are sub-factors of respect for young children's rights, differed according to the academic background and career, and the development rights differed depending on the type of childcare center. Second, there was a significant positive correlation among the happiness, self-leadership and respect for young children's rights. Third, the happiness and self-leadership of childcare teachers have a significant effect on the respect of young children's rights. Conclusion/Implications: This study is to confirm the necessity of efforts for institutional and educational measures to promote the happiness and self-leadership of childcare teachers as part of efforts to raise childcare teachers who are highly aware of the need to respect young children's rights.
