In order to combat the spread of COVID-19, on January 30, 2020, the World Health Organization declared that the spread of COVID-19 has met the criteria of a "Public Health Emergency of International Concern" under Article 1 of the International Health Regulations(2005) and proposed a variety of preliminary recommendations to fight against the pandemic accordingly. All of a sudden, people are ordered to wear face-masks in public-which is forbidden for different reasons in many jurisdictions. Of course, the legal world was hit by the virus as well. Needless to mention that where economic and social life will change so drastically, the legal world will change(ex. virtual hearing) as well. Most probably, it will not ever be the same after COVID-19. And where the whole legal world will change, it is easy to state the obvious, namely that COVID-19 has and will have an impact on international arbitration as well. This paper will describe how international arbitration is dealing with this new challenge.

지속적으로 발생하는 대형 해양사고에 대한 대처방안의 일환으로 진행된 국제해사기구에서의 조사 및 연구는 선박의 물리적 감항성 이외에 선박을 운영하는 인적자원의 과실에 주목하게 되었다. 이러한 인적과실에 대한 대처방안으로 1994년에 '1974년 SOLAS 협약'의 부속서로 '국제안전관리규약'이라고 하는 이른바 'ISM Code'를 채택하게 되었다. 우리나라는 1999년에 'ISM Code'를 구 해상교통안전법(현 해사안전법)에 관련 조항을 신설하여 시행하고 있다. 최근 개정된 해사안전법에서는 해운선사가 선박의 안전운항 및 해양환경보호를 위한 안전관리체제를 수립하고, 이를 이행하기 위한 사업장의 인적 구성원들이 갖추어야 할 요건에 대해서 규정하고 있다. 하지만 법률 이행당사자인 선박소유자 또는 안전관리대행업자 등은 조문내용을 해석함에 있어 명확하고 통일된 의견을 내지 못하고 있어 혼란을 야기하고 있다. 이 논문에서는 해사안전법상 안전관리책임자와 안전관리자의 자격기준 등에 관한 법률상의 문제점을 살펴보고, 이에 대한 개선방안을 제시하고자 한다.

우리나라는 1991년 동물에 대한 학대행위 방지 등 동물을 적정하게 보호 관리하기 위하여 필요한 규정을 만들어 동물의 생명과 그 안전을 보호하고, 생명의 존중 등 국민의 정서 함양에 이바지하게 함을 목적으로 '동물보호법'을 제정하였다. 그러나 당시 법에서는 반려동물과 실험동물을 대상으로 한 동물학대 금지 및 유기동물 등에 대한 조치와 동물을 교육 학술연구 및 기타 과학적 목적으로 이용시 고통을 주지 않토록 하는 내용을 규정하고 있다. 그 후 우리 국민의 동물보호 복지에 대한 관심과 의식수준이 점차적으로 향상되면서 국민들의 요구에 따라 그 간 수차례 법령을 개정하였고, 2008년에 전면 개정된 법령에는 반려동물과 실험동물뿐아니라 농장동물에 대하여도 동물학대 금지 및 해당 동물을 적정하게 보호 관리토록하는 동물보호 복지 개념을 도입하게 되었다. 우리가 이처럼 농장동물복지에 대해 초보단계에 있는 것과 달리, 이미 세계동물보건기구(OIE) 및 동물복지 선진국은 농장동물복지 정책에 대해 많은 기준을 만들고 다양한 연구를 수행하고 있다. 또한 한-EU FTA 협상과정에서 EU측이 농장동물복지를 의제화 할 것을 요구하는 등 국가간 통상에서도 농장동물 복지가 중요한 이슈로 작용하고 있어 이 분야에 대한 깊은 관심과 정책개발이 필요하다고 하겠다. 따라서 일반 국민뿐아니라 축산업계에서도 '과연 농장동물복지란 무엇인가'에 대한 궁금증과 더불어 '국내 소비자 및 축산농가에 큰 부담을 주지 않을까'하는 우려를 하고 있는 것이 현실이다. 이에 동물복지란 무엇인가에 대하여 간략히 알아보고, 농장동물 복지에 대한 국제동향 및 국내정책의 방향에 대해서도 논의하고자 한다.

The Korea Post plays a public role in providing postal services such as mail, savings, and insurance to the public. Although postal machines are becoming automated, workers are still exposed to various industrial accidents caused by being caught in the mail, and musculoskeletal disorders. Therefore, occupational safety and health activities are needed to prevent serious accidents. In this study, the level of safety and health consciousness was analyzed for employees working in the postal logistics center The tasks such as regulations and procedures, organization composition, and safety and health education method improvement, were classified into five items and proposed, and efficient industrial accident prevention was presented.

The World Health Organization (WHO) announced the 11th International Classification System (ICD-11), which classifies game addiction as a disease in 2018. Sin stocks are defined as the companies that have negative addictive properties and are taxed on social costs. If a game disorder is listed in the disease classification system in Korea, it is highly likely that Korean game companies may be considered as sin stocks that causes negative addictive properties and social costs such as the game addiction and the game addiction tax. This suggests that game companies could be newly included in the scope of sin stocks in Korea. In this study, we examine the effect of the inclusion of game companies in the scope of sin stocks on the job preferences of game companies. We found that there is a high level of opposition to the opinion of the listing sin stocks of game companies, and a high degree of addiction and gambling was suggested as the cause of the game companies being classified as sin stocks. We also found that firm value and job preference would be decrease if a game company was classified as sin stocks. The study is meaningful in that it suggests that game companies can be perceived negatively as sin stocks due to the disease code of game disorder, which has recently emerged as a social issue. Also, this study will contribute to the academia and market participants by reporting statistically the effect of the classification of sin stocks in game companies on job preferences for game companies.

급속하게 변화되는 IT서비스에 적극적으로 대응하고, 효율적인 IT서비스의 관리 운영을 위하여 정보화기관에 최적화된 통합 IT서비스관리 모델을 수립하여 운용할 필요가 있다. 이에 기술관리 중심의 IT운영에서 프로세스 중심으로의 새로운 IT서비스관리를 위한 정보화 업무 처리 및 관리 프로세스의 재정립이 필요하며, 운영조직과 정보시스템간의 유기적인 관리를 위해서 선진화된 국제 IT서비스 운영 모델인 ITIL(Information Technology Infrastructure Library)에 기반한 IT서비스의 체계적인 관리가 요구되고 있다. 본 연구에서는 K기관의 통합 IT서비스 관리 모델 수립 사례를 통해서 정보화기관을 대상으로 효과적인 정보서비스 제공 및 고객만족을 위한 IT서비스 관리 규정, 지침에 따른 베스트프랙티스 적용 및 프로세스 개선, ITSM(Information Technology Service Management, IT 서비스 관리) 구축 과정에 대한 사례 연구를 진행함으로써 향후 ITSM 시스템 구축 시 가이드라인으로 활용할 수 있는 이론적 기반을 제시한다.

Aviation safety is the stage in which the risk of harm to persons or of property damage is reduced to, and maintained at or below, an acceptable level through a continuing process of hazard identification and risk management. Many accidents and incidents have been taking place since 2014, while there had been relatively safer skies before 2014. International civil aviation community has been exerting great efforts to deal with these emerging issues, thus enhancing and ensuring safety throughout the world over the years. The Preamble of the Chicago Convention emphasizes safety and order of international air transport, and so many Articles in the Convention are related to the safety. Furthermore, most of the Annexes to the Convention are International Standards and Recommended Practices pertaining to the safety. In particular, Annex 19, which was promulgated in Nov. 2013, dealing with safety management system. ICAO, as law-making body, has Air Navigation Commission, Council, Assembly to deliberate and make decisions regarding safety issues. It is also implementing USOAP and USAP to supervise safety functions of member States. After MH 370 disappeared in 2014, ICAO is developing Global Tracking System whereby there should be no loophole in tracking the location of aircraft anywhere in world with the information provided by many stakeholders concerned. MH 17 accident drove ICAO to install web-based repository where information relating to the operation in conflict zones is provided and shared. In addition, ICAO has been initiating various solutions to emerging issues such as ebola outbreak and operation under extreme meteorological conditions. Considering the necessity of protection and sharing of safety data and information to enhance safety level, ICAO is now suggesting enhanced provisions to do so, and getting feedback from member States. It has been observed that ICAO has been approaching issues towards problem-solving from four different dimensions. First regarding time, it analyses past experiences and best practices, and make solutions in short, mid and long terms. Second, from space perspective, ICAO covers States, region and the world as a whole. Third, regarding stakeholders it consults with and hear from as many entities as it could, including airlines, airports, community, consumers, manufacturers, air traffic control centers, air navigation service providers, industry and insurers. Last not but least, in terms of regulatory changes, it identifies best practices, guidance materials and provisions which could become standards and recommended practices.

Due to the recent occupational accidents, the government made efforts such the Severe Accident Punishment Act and roadmap for reducing severe accidents. In particular, more than 80% accidents occur in small businesses, such as those with less than 50 employees and construction sites with a construction cost of less than 100 million, and practical efforts are needed to reduce them. In small businesses, the appointment of a safety managers and safety and health management regulations have been excluded in whole or in part, and technical guidance from an institution specializing in accident prevention is compulsory to supplement them. In this study, the problems of the safety and health technology support project for small workplaces has been identified through a survey and improvement plans were proposed.

This paper defines the Safety Management System (SMS) based on the rail safety act and surveys the status of the English rail SMS and International Civil Aviation Organization (ICAO) SMS and OHSAS18001 SMS. Through the analysis of the domestic rail operators' safety management regulations and the results of the universal rail safety audit, the status and problems of domestic rail operators' SMS are investigated and the improvement scheme are derived. First, to establish the continual improvement system for SMS, the instruction which describe the detailed continual improvement method for each steps of SMS including management review by CEO shall be established. Second, to settle the risk management based SMS, converting the rail operators mind and establishing the supply system of safety risk operating model and basic data for the risk analysis and safety evaluation and including the precise requirement for the risk management in the related instruction should be conducted.
