  • In the maritime digital forensic part, it is very important and difficult process that analysis of data and information with vessel navigation system's binary log data for situation awareness of maritime accident. In recent years, anaysis of vessel's navigation system's trajectory information is an essential element of maritime accident investigation for vessel digital forensic process. So, we analysis of maritime navigation systems of vessel and feature of device and environments. In the future, we will research on information of ship's trajectory and movement for useful forensic service.

Current Status and Tasks of Maritime Territorial Policies in Korea (국내 해양영토 정책의 현황과 과제)

  • This article analyzed maritime territorial policies in Korea. Marine territory originally refers to the topography of the subsoil in a country's territorial sea. From a political perspective, it is a broad concept that includes islands and polar regions beyond the jurisdiction of Korean sovereignty or sovereign rights, such as territorial waters, EEZs, and continental shelves. Also, Korean researchers use "maritime territory" as a term for maritime zones that stretch from Ieodo (Korean EEZ) to Dokdo Island. The purpose of this study is to review the concepts of various domestic maritime territories and examine the formation and change of policies. The article is structured as follows. Chapter 2 reviews past discussions on maritime territories and analyzes the concept of maritime territory based on them. The term "maritime territory" is used indiscriminately with islands due to the lack of discussion on this matter between academic circles in the past. Therefore, this chapter provides an in-depth analysis of the concept of maritime territory. Chapter 3 tracks the formation and change of maritime territorial policies. Today, the concept of domestic maritime territory has been completed in the public domain. The activities of the Ministry of Oceans and Fisheries, the control tower of domestic maritime territorial policies, are summarized to explain this concept. Chapter 4 analyzes the concept of maritime territory by comparing it with China's blue state territory (藍色國土). As China's concept of blue state territory has many similarities with maritime territory as a political base for China's maritime activities today, comparing these two concepts would be significant. Based on the above, Chapter 5 derives suggestions to promote maritime territorial policies.

  • 해적은 공해상 해상안전을 위협 한다는 점에서 '인류공동의 적'으로 규정되어 모든 국가가 이를 규제할 수 있는 보편적 관할권이 행사되는 범죄이다. 한국을 포함한 아시아 지역 국가들은 말라카해협 통항에 관해 깊은 이해관계를 갖고 있어 해적 소탕에 대한 의지가 강한 편이다. 이러한 의지는 2006년 '아시아해적퇴치정보공유센터(ReCAAP ISO)'의 창설에 밑거름이 되었으며, 아시아 지역에서 해적이 출현하면 동 센터를 통해 17개국 회원국으로 즉시 통보되고, 주변국의 해경과 해군이 유기적인 작전을 통해 해적을 효율적으로 퇴치하고 있는 모범사례다. 그러나 2009년 소말리아 내란에 따른 무정부 상태가 지속되면서 소말리아 및 아덴만에서의 해적활동이 극성을 부리기 시작했으며, 선박납치 행위가 급증하자 세계 각국에서 함정과 항공기를 파견하여 해적퇴치 활동을 전개하고 있으나 근절되지 않을 뿐만 아니라 해적의 활동해역이 확대되고 있다. 이러한 배경 하에 시작된 본 연구는 연구결과를 중심으로 다음과 같은 대응 방안을 제시한다. 첫째, 소말리아 해적의 근본원인은 국가의 붕괴에서 비롯된 치안부재와 열악한 경제사정 등 내부적인 요인이 크기 때문에 다국적 해군 활동으로 인한 근본적인 해적퇴치에는 한계가 있다. 따라서 국제적인 차원에서 '지역협력협정'체결은 물론, 소말리아 국가재건을 위한 노력이 함께 이루어지는 종합적인 대책이 필요하다. 그러나 보다 더 근본적인 해결책은 유엔차원에서 빠른 시간 내에 소말리아가 정치적 안정을 유지할 수 있도록 정치적 차원에서의 지원이 필요하며, 해적과 테러리스트가 연계됨으로써 국제문제로 확대되지 않도록 하는 노력도 병행되어야 한다. 둘째, 해적문제는 특정국가에만 해당되는 것이 아니라 초국가적인 문제임을 감안하여 유엔안전보장이사회 결의 제1851호에서 '지역 센터' 설립을 권고하고 있는 것처럼 2006년 아시아 국가들이 설치한 ReCAAP ISO와 같은 형태의 지역국가 간 협력기구 또는 유엔 차원의 해적 전담기구를 설치하여 국제사회 공조 하에 해적에 대처하는 방안을 추진하는 것이 필요하다. 셋째, 최근 발생하고 있는 해적행위는 주로 항구 등 내수, 영해 등 연안국의 관할권이 행사되는 지역에서 발생하고 있어 유엔해양법상의 규정은 이러한 '해적' 퇴치에 더 이상 효율적이지 못하다. 국제사회는 이러한 문제점을 인식하여 국제해사기구 (IMO) 등 국제기구를 통해 영해내의 해적 처벌을 위해 최선의 노력을 기울이고 있다. 향후 궁극적으로는 유엔해양법협약의 개정을 통해 법적인 문제점이 개선되어야 한다. 넷째, 전술적인 측면에서도 지상에 기지를 두고 있는 해적들의 지도부가 그 동안 쌓아 놓은 네트워크를 이용하여 다국적 해군에 대한 정보를 수집하고 대응방안을 강구함으로써 나름대로의 생존전략을 구사할 것으로 예상된다. 특히, 선박을 납치한 후 소말리아 연안으로 이동하면서 해군함정과 대치하는 과정에서 해적들이 살상을 당하는 사례가 증가함에 따라 지금까지는 피랍된 선박의 선원을 단순히 해적활동에 참여시키거나, 항해지원을 위한 목적 등으로만 활용했는데, 앞으로는 해적들의 인명피해를 최소화하기 위해서라도 선원들을 방패막이로 활용할 가능성이 더욱 높아질 것으로 예상된다. 따라서 참가하는 해군함정 또는 부대간 해적들의 활동 관련 정보를 공유하는 등 사전에 정보를 획득하기 위한 협력을 강화해야 한다. 다섯째, 한국군함이 삼호주얼리호를 납치했던 소말리아 해적을 한국까지 대리고 와서 처벌하는 것은 불합리하고, 많은 문제점을 야기할 수 있기 때문에 향후 해적처벌을 위한 국제사법기구의 설치가 요구된다. 회원국 분담금으로 운영되는 유엔에 산하기관을 설치하여 소말리아 인접국에서 해결하도록 적극적인 노력을 경주할 필요가 있다. 마지막으로, 선박회사에서도 자국 선박이 위험구역으로 지정된 해역을 항해할 경우를 대비해서 선박자동식별 시스템 구축을 확대하고, 해적이 선박에 승선했을 경우를 대비해서 안전구역(citadel)을 설치하여 선원의 안전을 확보하는 등의 대책이 필요하다. 본 연구를 통해 해양안보는 어느 특정국가에게만 주어진 것이 아니며, 해적행위도 특정 국가의 선박을 대상으로 하는 것이 아니므로 각국 정부간 공동의 협력과 국제사회의 공조가 반드시 실현될 때 해적의 위협으로부터 선박의 안전과 국제사회의 평화가 실현될 수 있다는 것을 강조하고자 한다.

Effective Coastal Water Quality Management and Marine Environmental Impact Assessment (연안의 효율적 수질관리 방향과 해양환경영향평가)

  • This study examined principles and techniques of efficient water quality management as well as total coastal pollutant loads and the relevant examples in the advanced countries from the viewpoints of water quality improvement and pollution control in coastal areas. The problems and improvements in an estimation of the current total pollutant loads were also pointed out. In addition, discussion was made on the relationship between total pollutant loads and environmental capacity as well as particulars requiring extensive examination on access to and study on water quality model used as prediction tool for marine environment. Furthermore, this study proposed details of and improvement plans for water quality control to be reflected and absorbed into systems and policies related to coastal water quality. In coastal areas, which are subject to total coastal pollutant loads, it is necessary to calculate pollutant loads reduction and allocation, to propose them in detail in statement in relations to new pollution sources for the corresponding projects or plans in environmental impact assessment and prior environmental review system. Also, in relations to regional plans for coastal management, the local government concerned must focus more on environmental management plan to implement data on pollution sources and pollutant loads flown into sea areas under basic jurisdiction, therefore it is required to actively respond to expansion and introduction of total coastal pollutant loads system in the future. Total coastal pollutant loads system must be expanded and executed by considering characteristics of sea area and changes in the environment of land. For pollution sources in land, the competent authorities in charge of coastal environment will need to initiatively administer supervision, monitoring activities and achieve integration and operation of the related laws by preparing legal bases for management system or adjusting the related laws.

Study on Public Awareness of establishing Marine Protected Areas - Case Study of Guimaras Province, Philippines using Contingent Valuation Method (해양보호구역의 설정에 대한 대중인식도 연구 - 조건부 가치측정법을 이용한 필리핀 기마라스주의 사례)

  • In Korea and the Philippines, as well as all over the world, with the recognition of the importance of marine ecological resources, the marine protected areas(MPA) have been established and managed to protect and preserve these resources. While the number of marine protected areas for marine ecological resources protection has been increased, there is main problem that the most of MPAs do not achieve their intended management objectives. the effective management. Because of the positive and negative impacts on local communities and fishermen as direct stockholders, there has been ongoing debate on the pros and cons of implementing MPAs. Accordingly, this research conducted a case study of establishing Marine Protected Areas in Guimaras, Philippines because Philippines fisheries code of 1998 (Republic Act 8550), which is enacted to manage, conserve and protect fishery resources, obliged local governments to designate no less than 15% of jurisdictional municipal water as fisheries resource protection areas for a long time. To do this, a dichotomous-choice contingent-valuation survey was conducted in the two municipalities of Guimaras, Philippines to investigate public opinion in debates over MPAs and to estimate willingness to pay (WTP) for MPAs to protect and conserve marine habitats for fishery resources. Because of the expected economic costs by prohibiting fishing activities within the establishing newMPA, 58.7% of respondents thought the costs should be compensated, but 91.4% respondents voted in favor of increasing MPAs for fisheries resources as a protective measure. Finally, with Contingent Valuation Method(CVM), the aggregate mean WTP (375.5ha) of San Lorenzo and Sibunag residents in Guimaras Province, Philippines for establishing the additional MPA in their municipality waters was estimated to $1,046,791. Therefore, these findings could be used as a valuable data for establishing effective management plan of MPAs in Korea.

A Review on the International Trends for Establishing Post-2020 National Targets Relevant to Protected Areas - Focused on the CBD Decisions and Aichi target-11 Achievement Status - (Post-2020 국가 보호지역 목표 설정을 위한 국제동향 고찰 - 생물다양성협약 결정문 및 글로벌 목표 성취현황 분석을 중심으로 -)

  • This study aims to draw suggestions for establishing the Post-2020 national policy direction and goals related to protected areas in Korea by analyzing the trends of major discussion issues on protected areas in the Convention on Biological Diversity (CBD) and reviewing the achievement progress of the Aichi target-11. Regarding the CBD decisions on protected areas, two decisions (Decisions II/7 and II/8) were adopted in 1995, and then the Program of Work on Protected Areas (PoWPA), which presented an ideal blueprint for protected areas, was adopted at the 7th Conference of the Parties (COP) in 2004. At the 10th COP in 2010, the "Strategic Plan for Biodiversity 2011-2020 and the Aichi Biodiversity Target" (Decision X/2) was adopted along with the Decision X/31, which presented ten key issues related to protected areas. The global outcomes of the Aichi Target-11 include 15% of the earth's land area and 7.4% of the ocean being designated as protected areas. In Korea, 16.63% of the land and 2.12% of the ocean have been designated as protected areas. However, the outcomes of the effective and equitable management, protection of areas important to biodiversity and ecosystem services, and identifying "Other effective area-based conservation measures" (OECMs) and linking them with protected areas have been found to be significantly short of global goals. The first draft of the Post-2020 Global Biodiversity Framework (Post-2020 GBF) prepared in January 2020 presented multi-step objectives. They included protecting at least 60% of particularly important sites for biodiversity through protected areas and other effective area-based conservation measures, at least 30% of the entire land and sea areas, and at least 10% of them under strict protection by 2030. The Updated Zero drafted in August 2020 concisely set out one quantitative goal of at least 30% of the globe by 2030, adding qualitative goals that these areas should be protected and conserved through "well connected and effective system of protected areas and OECMs at least 30 % of the planet with the focus on areas particularly important for biodiversity." Based on the draft Post-2020 GBF's targets related to protected areas and Korea's national targets reflecting the current state of Korea and established national plans, we suggest the national targets "to protect and conserve at least 30% of the land area and 10% of the marine area and to strengthen the means of qualitative achievement by establishing sub-targets through an effective system of protected areas and OECMs by 2030.".

An study on guide to oil spill response in snow and ice condition in seas (유빙유입에 따른 해양오염사고 대응방안 마련 연구)

  • 2017년 겨울, 기록적인 한파로 인해 바다가 얼면서 인천 앞바다로 유빙이 유입되었다. 2013년 해상에서 유빙이 발견된 이후 약 5년만에 다시 유빙이 등장한 것이다. 중부청 소속 항공단 순찰결과에 따르면, 2018년 1월 12일 인천대교 인근 해상에서 최초로 발견된 이후 강화 연안, 영종도 북단 등 해상에서 광범위하고 불규칙한 형태로 유빙이 분포되어 있는 것으로 나타났다. 유빙의 문제점은 해상에서 선박의 안전운항을 저해하고 경비함정의 안전에 지장을 초래하며 기름 유출 시, 유출유의 거동 특성이 달라져 일반적인 방제방법의 적용이 곤란한 점이다. 이에 따라 해상에서의 해양오염사고 대응방안 마련을 위해 저온 및 유빙 유입 해상에서 유출유의 거동 특성을 알아보았다. 구분인자를 극한의 추위(Extreme Cold), 유빙(Pack Ice), 정착빙(Fast Ice) 3가지로 분류하여 기름의 성상변화 및 시사점을 살펴보고, 유출된 기름의 효율적 방제를 크게 3가지로 분류(기계적 봉쇄 및 회수, 화학적 분산제의 사용, 현장소각)하였다. 일반적인 방제장비를 저온 및 얼음분포 해상에서 사용 시 슬러시화 된 얼음으로 인해 유출유 회수가 어렵고, 동결온도에서 장비가 오작동할 우려가 있다. 이미 북유럽 국가에서는 극한의 추위와 얼음분포 해상에 특화된 방제장비를 도입하여 해양오염대비 대응을 하고 있다. 2003년 3월 발틱해에서 불법적으로 유출한 선저폐수를 특화 장비는 brush bucket 유회수기 이용 방제조치한 사례가 있으며, 2006년 5월 같은 장소에서 선박 침몰로 인한 기름 유출이 발생했을때도 brush bucket 유회수기 이용 방제조치를 하였다. 국내에도 이상 기후로 인해 기록적인 한파가 지속되면서 북극에서나 볼 법한 유빙들이 발견되고, 해양오염사고는 언제 어디서나 발생할 수 있으므로, 해양오염방제의 임무를 맡고 있는 국가기관으로써 특수한 환경까지도 고려하여 대응방안을 마련할 필요가 있다. 해양오염이 재난으로 인식되고 있는 상황에서, 그리고 지구온난화로 인한 이상기후변화가 지속되는 상황에서 겨울철 유빙 유입은 점점 더 많아질 수 있다. 본 연구에서는 자료나 방제경험이 부족하므로 일찌감치 북극항로 개발로 앞선 방제기술과 경험을 가지고 있는 북극이사회를 벤치마킹하여 관할 해역 특성에 맞는 대응방안을 고찰해 본다.

Regulation and Its Tasks of Privately Contracted Armed Security Personnel on Board Ships Against Somali-based Piracy (소말리아 해적행위 대응을 위한 민간무장보안요원 승선의 규제 및 그 과제에 관한 연구)

  • The increased threat to commercial shipping by Somalia-based pirates has triggered an increased use of PMSC(Private Maritime Security Contractors). The use of PMSC to protect merchant ships against Somali-based piracy threat seems to have been most effective counter-piracy measures. However, there are various legal and practical questions around using PMSC and PCASP(Privately Contracted Armed Security Personnel) on board at sea. This paper aims to study the regulation and its problems of PMSC and PCASP on board to protect merchant ships against Somali-based piracy in the Indian Ocean and Gulf of Aden. In particular, this paper focuses on the legal issues including jurisdictional issues of PCASP on board merchant vessels, use of force by PCASP in self-defense, and authority for using PMSC. Currently, the legal framework relating to use of PMSC and PCASP on board protecting ships from Somali-based piracy is complex, sometimes ambiguous or inconsistent, and currently in a state of flux. Thus, this paper concludes that at this juncture an effort to coordinate this legal framework is necessary, as regards both the interpretation of existing rules related to PCASP on board merchant ships under UNCLOS(United Nations Convention on the Law of the Sea) and the creation of new rules. Also, this paper suggested that there is an urgent need to establish the PMSC-specific laws in Korea.

Review on the Regional Cooperative Activities for Marine Environmental Conservation in Northeast Asia: with Special Reference to the Northwest Pacific Action Plan (NOWPAP) (동북아시아 해양환경보전을 위한 국제협력활동의 현황과 발전방향: 북서태평양보전실천계획(NOWPAP)을 중심으로)

  • The geography, circulation pattern, and ecology show that the semi-closed seas of Northwest Pacific be managed as one complete system. Ongoing multilateral cooperative efforts relevant to marine environmental protection in the Northwest Pacific area, include the Working Group for the Western Pacific (WESTPAC) established under the auspices of WNESCO's Intergovernmental Oceanographic Commissions, the UNDP/GEF Programme on Prevention and Management of Marine Pollution in East Asian Seas (PEMSEA), the North Pacific Marine Science Organization(PICES), and the United Nations Environment Programme(WNEP)'s Northwest Pacific Action Plan(NOWPAP). The present report firstly describes the current situations on the existing regional cooperative regimes for marine environmental conservation in the Northwest Pacific region, with a special respect to the Northwest Pacific Action Plan(NOWPAP) which was adopted in 1994 by Japan, People's Republic of China, Republic of Korea and Russian Federation. Then, problems of the existing regimes are also discussed, together with the suggestion of the possible solutions, focusing on NOWPAP. Suggestions include: 1) the Northeast Asian countries should understand the importance of legally-binding regional convention, and should build up any legally-binding instrument which can function as a big umbrella for real regional cooperation without prejudice to the rights of the States, 2) At present stage, it will be possible to make a regional convention flexible without prejudice to the sovereign right of the States or territorial issues; 3) taking into account that the region often faces many generic political problems that often inhibit the effective collective actions on environmental issues, the leadership from UNEP or other international organizations is required; 4) strong institutional and financial framework should be made, and 5) multilateral efforts to respond to the new marine environmental threats should be taken at the regional level in order to protect the coastal and marine environments in the Northwest Pacific.
