Apportionment of Liquidated Damages and Compensation for Delay Damages in Domestic Construction Project : Analysis and Improvement (국내 현행 공기지연 책임에 따른 지체상금 및 손실보상의 문제점 및 개선방안)

  • To calculate the amount of owner-caused and contractor-caused delays based on a simplified delay analysis, which has been customarily used in Korea, has a limitation in reflecting the impact of the concurrent delay and the acceleration work. It also resulted in the apportionment of liquidated damages by applying the ratio of the number of delays between the owner and the contractor. This study analyzes that the conventional method does not meet the international standards. In order to improve the problem of construction delay analysis and the apportionment of liquidated damages based on it, owner delays, contractor delays, concurrent delays, and the impact of acceleration should be analyzed together. This study suggests that in the apportionment of liquidated damages, the extension of time should be extended by the sum of concurrent delays and the owner-caused delays, and liquidated damages should be imposed on delays incurred after the extension of time. It can be seen that it conforms to the international standards. The results of this study are expected to contribute to improving the problems of delay analysis and liquidated damages calculation, which have been conventionally accepted.

A Study on the Improving Life-up and Procurement Work Flow for Effectiveness of Resources increase in the Building Construction (건설공사의 자원 효용성 증대를 위한 조달 및 양중 작업흐름 개선에 관한 연구)

  • The purpose of this study is to present an improved lift-up & procurement work flow for effectiveness of resources increase in building construction. The current lift-up & procurement work flow has some waste factors; complicated information system, connection lack with process and decision-making delay. Therefore the study applied the value stream mapping methodology for improvement of current lift-up & procurement work flow. The main contents of the study are as follows; 1) A problem of current work flow were analyzed through current state mapping(CSM). 2) An improved work flow was suggested through future state mapping(FSM). 3) An improvement effect analysis of information system and lift-up planning The study recommends that continuous improvement of lift-up & procurement work flow and efficient management of information in building construction.

  • In the construction industry, projects are becoming increasingly large and complex, involving multiple subcontractors. Traditional centralized coordination techniques used by the general contractors become less effective as subcontractors perform most wok and provide their own resources. When subcontractors cannot provide enough resources, they hinder their own performance as well as that of other subconractors and ultimately the entire project Thus, construction projects need a new distributed coordination approach wherein all of the concerned subcontractors can reschedule a project dynamically. To enable the distributed coordination framework of project schedule changes, the author developed an agent-based compensatory negotiation methodology, which allows intelligent software agents to simulate negotiations on behalf of their human subcontractors. In addition to this theoretical work, 1 designed and implemented a prototype to demonstrate the effectiveness of the framework. Thus, this research formalizes the necessary steps that would help construction project participants to increase the efficiency of their resource use, which in turn will enhance successful completions of whole projects.

  • This study analyzed main causes of claims in EPC/Turnkey projects. For this purpose, this study referred to the FIDIC silver book, which lists the international standard contract conditions for EPC/Turnkey projects. The most frequent cause of claim was delay. A process was then proposed to determine whether the owner or contractor was the responsible party when the delay claim occurred. The proposed process was for damages for delay which is the conditions of contract for indemnities against delay claim. The process was based on conditions of the contract of two previous EPC/Turnkey projects that were constructed in 2010, the FIDIC silver book, as well as the obligations of owner and contactors. The proposed process is applicable depending on the conditions of the contract and the owner's meaning. Furthermore, by identifying the responsible party, this study will contribute in identifying the possible claim types before concluding a contract and writing the specific contract.

  • Various studies has tried to unveil causes of cost overrun and schedule delay in the road construction project. However, these causes need standardization due to difference by guidelines, relevant research, and facilities. Therefore, this study identifies and elaborate standard road construction cost and schedule variation factors that can be used in the planning and execution of the project. variation factors have been derived and grouped through literature review and modified and supplemented through expert interview. In addition, the connection with the relevant guidance factors is confirmed and the usability is reviewed by applying actual road construction cases. The factors suggested in this study comprehensively include factors of related guidelines and previous research, more clearly distinguish, support decision making.

  • In order to conduct construction projects effectively, the work delay factors would be managed by planned construction schedules. As construction works are delayed ceaselessly, the solution is to select and manage the key factors which delay the work ceaselessly. The subjects of this study were an apartment houses of reinforced concrete structure. Hidden work delay factor were extracted, the surveys were conducted and occurrence, severity and detection of each factor were analyzed. With this result, final orders of priority were fixed and key management factors were deducted and presented.

  • Appropriate management of the finish works in construction project is one of most important activities that must be conducted considering the total duration of the project. Masonry work is a fundamental process that is performed in the preliminary steps of finish works. However, it has been investigated that the analysis of delay factors affecting masonry work has been neglected in the domestic construction site. Therefore, this study deducts delay factors affecting masonry work by literature review and survey on site engineers and labors. This study has been conducted as a preliminary step of developing a construction project interference management system which is expected to suggest objective information for the decision making in construction sites.

  • Construction delays occur frequently in outrigger framework of tall buildings due to the unexpected conditions and lack of experience. However, delay factors of the outrigger framework has not been managed efficiently. Therefore, the systematic management is needed by perceiving possible delay factors before constructing management system. In this study, the major delay factors of outrigger framework are conducted to derive by using the Importance Performance Analysis(IPA). It is expected that the results of this study are utilized for planning of systematic scheduling in outrigger framework of tall building.

  • In order to achieve the best performance of a project, uncertainties involved in the building construction process need to be identified in the planning phase of the project. Risk management plays a significant role in construction to minimize risk occurred due to uncertainties of a project. Although the importance of the risk management has been known to the construction industry, a more effective system should be developed to meet the demands of the industry. The purpose of this study is to develop the effective risk management system for scheduling the construction processes. The study provides a tool that can optimize the management system which would assist managers to identify schedule risks in the planning phase of the project.
