Grounded Theoretical Approach to the Co-offending Implementation Process of Robbery and Burglary Crime (강·절도범죄의 공범실행 과정에 대한 근거 이론적 접근)

  • The purpose of this study is to examine the co-offending implementation process of robbery and burglary crime. To this end, interview data for research projects conducted by the Korea Institute of Criminology in 2013(Advancing Knowledge About Co-Offending - Burglary and Robbery in Korea) were used as secondary data. Using secondary data, we attempted a grounded theory approach. Based on the procedure presented by Strauss&Corbin (1990), the open coding stage was derived from 51 concepts, 22 subcategories and 8 upper categories. According to an analysis tool called "coding paradigm," the causal condition is the cause of the robbery and burglary crime. Contextual conditions are the formation of co-offending relationship and the reason for selecting co-offending. The central phenomenon is the co-offending implementation of robbery and burglary crime. Interventing conditions are conflict between co-offenders and occurrence of arrest factor. The action/interaction strategy is arrested all co-offenders. The consequence consisted of ending the co-offending relationship. Finally, the selective coding stage selected 'the development of conflict between formation and end of co-offending relationship' as the core category, and newly established the co-offending relationship of robbery and burglary crime through the process of 'formation-implementation-conflict-arrest-end'.

  • This Study analyzes the Eroticism in Jan Svankmajer's "Conspirators of Pleasure" which is Svankmajer's third feature film. the movie describes how six ordinary Prague people(: apartment-dwellers, a newscaster, a magazine vendor, and a postal delivery person) persue their own secret erotic fantasies. and Svankmajer self said this movie is actually a film about liberation, and about gaining a freedom. the poepose of this study is to find the meaning of liberation through investigate the erotic codes in "Conspirators of Pleasure" with Georges Bataille's Eroticism.

  • The view of not fully denying the application of accomplice regulations to non-punishable opponents has fallen into a formal and logical circular argument that only provides formal grounds for non-punishment and has failed to provide practical grounds. In addition, it can be said that it has a criminal policy problem contrary to the legal sentiment of the general public by not punishing the active government travel activities of non-punishable accomplices. Therefore, in order to solve this problem, it is necessary to respect the legislator's intention that general non-punishment accomplices can be punished if they exceed the 'minimum government travel commission'. Therefore, if an unpunishable accomplice acts at least within the act required to realize the constituent requirements, the application of the accomplice regulations shall be excluded, and the accomplice regulations shall be applied only if they exceed that extent. In addition, if the indispensable counterparty is a protected person or has no responsibility (possibility of expectation), it can be said that it has provided a practical basis for the inability to punish, so it can be understood as impossible to punish. This interpretation method is thought to be able to present concrete validity in marginal cases where the counterparty is more responsible by substantially presenting the basis for an unpunishable accomplice.

  • The present pater aims to review Barriers framework proposed by chomsky(1986b) to point out some potential problems and to give an alternative definition of barriers.Chomsky assumes that adjunction to non-argument is possible for syntactic movement But this assumption results in overgeneration of ungrammatical sentences.We do not allow any adjunction in syntax,and abandin the Empty Category Princile,instead we propose Head Licensing Cindition and Antecedent Condition.HLC requires empty non-proneminals to be marked by head either lexical or functional and AC states that traces should be 0-subjacent to their antecedents.

Comparison of relationship with friends among adolescents under probation and high school students (보호관찰청소년과 일반청소년의 친구관계 비교 분석)

  • The purpose of this study is to compare relationship with friends among adolescents under probation and high school students without any criminal record. A total of 510 respondents (253 adolescents under probation, 257 high school students) participated in this study. Results indicate that both adolescents under probation and high school students reported that they talk to talked to their friends when they were lonely, that they were comfortable when they are with their friends, and that they trusted their friends unconditionally. However, the two groups showed a difference in the place that they meet their friends. Adolescents under probation are likely to meet their friends at Internet Cafe to play internet games, while high school students are likely to meet their friends near their school. Compared to high school students, adolescents under probation had more friends who were expelled from school, who were under probation and who have been previously incarcerated. For adolescents under probation, compared to first time offenders, the repeat offenders were more likely to have friends who were under probation and who have been previously incarcerated. When discriminant analysis were conducted for adolescents under probation and high school students, the two groups can be distinguished by the number of friends expelled from school, number of friends under probation, and number of friends who have been previously incarcerated. For adolescents under probation, compared to first time offenders, the repeat offenders could be distinguished by the number of friends expelled from school, number of friends under probation, number friends who have been previously incarcerated, and number of times their partners in crime were under probation or incarcerated.
