Guidelines for Provisional Sum in Public Construction Projects (국내공공공사의 잠정금액(Provisional Sum) 집행기준)

  • Recently, the term 'Provisional Sum(PS)' has been used in domestic public construction projects especially for civil works. Nevertheless, the guideline for PS has not been clearly stipulated in contract documents or construction-related laws. Due to these ambiguous contract situations, disputes between owners and contractors are surely expected to settle down PS in construction projects. This paper focused on suggesting a guideline to settle down PS in these ambiguous contract situations. The guideline suggested in the paper is expected to be used as a reasonable method to settle down PS avoiding nonproductive disputes about PS in construction projects

Feasibility Analysis of Introducing CM at Risk Delivery Method to the Korean Public Construction Industry by Analyzing Attributes of the Projects (대상공사의 특성요인 적합도 분석에 의한 공공부문 'CM at Risk 방식' 도입의 타당성 분석)

  • A high degree of management skills and functions is essential to the success of construction projects. While the various construction management delivery methods have been realized as the solutions, Korean government is planning to introduce 'CM at Risk Method' to the public construction projects. However, even if its effect has been verified successful in the international market, it must be considered before legally adapting the method that it would be suitable to our public sector, In this respect, the purpose of this study is to evaluate and analyze feasibility of 'CM at Risk Method'. In order to do that, 15 attributes of construction projects were found, which were suitable to 'CM at Risk Method' in general, 'CM at Risk-GMP Method', and 'CM at Risk-Cost Reimbursable Method' and suitability of each attribute to each of 9 categories of public construction facilities was evaluated by questionnaire survey to CM specialists. Results showed that 'CM at Risk Method' might not bring improper effect to the industry but due to the characteristic of public sector, the effect would be very limited.

  • Dispute is construction itself. Serious difficulties ore occurred between contract parties when These disputes have occurred. Authority may fear the defective work if the requirement of contractor is fully reflected in the adjustment of contract. On the other hand the contractor may have fears that no payment or some payment of the extra work or the additional work done will be required. Therefore these problems must be resolved before these result in an enlarged riffle effect. To reduce the fear of the contract parties, ADR(Alternative Dispute Resolution) process were suggested.

  • Estimated construction cost is an important index to secure an optimal budget which needs to go into construction projects in the previous of basic design phase. In order for public institutions to calculate the estimated construction cost, the cost per unit area of public buildings is used. However, the current calculation method of the estimated construction cost in public buildings is impossible to reflect the characteristics of many facilities and combinations. The purpose of this study is to develop an estimation model in the previous of basic design phase for the elementary, middle and high school facilities. it is expected that it is possible to estimate the construction cost of the elementary, middle and high schools in a reasonable and reliable manner through the estimation model developed in this study.

  • On December, 1996, Construction Management(CM) was introduced in Korean construction industry due to its managerial efficiency proven in the international construction industries. However, It have had serious problems with many regulations, standards, manuals and details of practices considering its constituents and industry conditions. Especially, there were controversial points in the CM fee estimate; difference between the fee on the owner's view point and that from contractor's that impedes appropriate CM services. Therefore, this paper is to analyze public construction projects into Cm fee calculation such as fee as a percent of construction cost, cost plus fixed fee and contract price, and analyzed what is irrationality and why irrationality is made. So it makes a contribution to a study on standards for paper CM fee calculation.

  • The CM at Risk project, which started with the aim of strengthening the global competitiveness of the domestic construction industry through innovation of ordering system, is being implemented in the form of pilot projects in the public sector. However, it seems that it is necessary to enact related laws and regulations to move to the formal ordering system, and the performance analysis of the project is still insufficient. In this paper, the effectiveness and reliability of the project were verified through the performance analysis of the Pre-Construction Service of the four pilot projects currently being implemented. The results of the study were analyzed in five areas including Team Building, Design Book, Construction Period, VE, and BIM. Through the interview survey, the problems were confirmed and improvement plans were presented. The results of this study are expected to be used as basic data for the legalization of ordering system to be implemented in the future.

  • Aging buildings over 15 years reaches about 74% of 177 thousand buildings in Domestic public buildings. Due to the aging building, the energy loss is a serious problem. In order to reduce the energy usage through improving the energy efficiency on the existing buildings, the government & the local autonomous entity conduct the energy efficiency projects through the remodeling, repairing & equipment replacement on the existing buildings. The green remodeling is applied to the existing public buildings in recently revised the act on the creation and support of green building. However, the standard is not obvious that the work scope of green remodeling, financing and project delivery method. This paper propose is to suggest project delivery system for vitalizing the green remodeling. Green remodeling is defined on basis of the occurring work under project life cycle based on the existing building process and the financing method for owners and companies and the project delivery system according to work scope of green remodeling are proposed in this paper

  • 제안요청서(RFP)는 사업목적 달성을 위해 발주자가 공급자의 제안을 받기 위한 요구사항을 정의한 문서로 프로젝트 목표 수행의 중요한 요소이고, 불명확한 요구사항과 요구의 변경, 외부 수행 작업의 문제, 일정과 예산의 비현실성 등은 프로젝트의 성공적인 수행을 저해하는 위험요인이다. 본 논문에서는 2005년부터 2009년까지 공공 SI(System Integration) 프로젝트의 RFP를 대상으로 첫째, 미국 프로젝트 표준규격인 PMBOK(Project Management Body of Knowleage) 지식 및 관리 프로세스 영역을 적용하여 현황을 분석하였고 둘째, Core와 Support 프로세스 영역을 비교분석하고, 셋째, Core 프로세스의 범위, 일정, 비용 영역에 대해 분석하였다. 연구결과로 공공 SI RFP의 범위, 일정, 비용을 의미한 항목에서 분명한 차이를 보여 보완이 요구되었다. 향후 본 연구를 통해 공공 SI 프로젝트의 RFP 작성시 명확성을 제고하여 프로젝트 성공 수행에 도움이 되도록 하고자 한다.

  • Design build (DB) is a construction project delivery system which has become one of the favored ones and the growth of DB by the public agencies has been steadily increasing. DB can be viewed as an evolutionary project delivery system, since DB project team members collaborate on work with each other, keep seeking cost effective and innovative alternatives that meet the construction needs of the project. Thus DB outperformed others in delivery speed, cost saving, and turnover quality. In Korea, DB projects likewise have steadily increased that it is needed to analyze characteristics of DB delivery system in Korea. For that purpose, this research would offer an analysis of characteristics of DB delivery system in Korea using system dynamics model with investigating the public market trend, comparing DB performance to DBB, and analyzing questionnaire survey.

하도급대금 어음.대물변제 "뚝" - '09.1.28일부터 '하도급대금 지급확인 제도' 시행 -

  • 최근 건설경기 침체에 따라 하도급 대금을 현금으로 지급하지 않고 불법 장기어음이나 미분양 아파트로 대물변제 등의 불법 하도급대금 지급행위를 근절하기 위해 국토해양부가 지난 1월 28일부터 '하도급대금 지급확인제도' 시행에 들어갔다. 하도급대금 지급확인제도는 원도급자가 하도급자에게 지급한 공사대금 내역과 하도급자가 수령한 하도급 대금을 발주자가 직접 비교 확인하여 하도급 대금의 적정지급 여부를 점검토록 한 것으로, 국토부 산하 지방청(국토관리 해양항만 항공)과 공사 공단에 전담부서를 지정하여 수시로 지급실태를 점검하고, 5개 국토관리청이 관할 구역 내에 공공발주 공사에 대하여 하도급대금 시급 실태를 총괄 관리하는 제도이다. 이 제도의 시행으로 공공공사에서는 불법 하도급대금 지급행위를 원천 차단 하여 불법 부당한 대금지급 관행이 근절될 것으로 기대된다. 이같은 제도를 시행하게 된 것은 그동안 대한설비건설협회(회장 강석대)가 불법 하도급대금 지급 근절을 위해 끊임없이 건의한 결과이다. 협회는 그동안 2차례에 걸친 국토부 차관과의 간담회를 비롯하여, 한나당 및 국토부 등 관련기관에 수차례에 걸쳐 건의했으며, 특히 연말에 이명박 대통령께 직법 건의하는 등 불법 하도급대금의 근절을 위해 많은 노력을 기울였다. 협회의 이러한 건의에 대해 국토부가 일정 부분을 수용함으로써 이 제도가 시행된 것이다.
