Analysis by Defensive Process Prerequisite and Offensive Cause of Action on the Merits of Lawsuit Cases in Urban and Housing Redevelopment - Based on Affirm-Rate and Staircase Matrix Tables - (도시정비사건 소송의 본안전항변사유와 본안쟁점사항에 관한 분석 - 인용률 및 행렬표식 분석기법을 활용한 -)

  • This study explored to analyze the winning determinants of the lawsuit cases on the urban and housing redevelopment project based on jurimetric methods. Based on affirm-rate and staircase matrix tables, 441 lawsuit judgments are analyzed. Research findings in affirm-rate analysis indicate that past legal relation, no own defect of accreditation, no ownership or association member status, lapse of period of litigation, and no legal interest are identified as higher rate in order for the reason for plea on the merit. And so are defect on calculation of consent rate, defect in relation with written consent, approval before zoning designation, defect in relation with general meeting, and defect on zoning designation for the issue on the merit. It is noteworthy from the staircase matrix table analysis that the criteria for affecting the lawsuit outcome is determined based on key forecasting variables such as past legal relation and no ownership or association member status. This study intends to provide the implication that the unnecessary disputes can be reduced in the urban and housing redevelopment project by the implementation of jurimetric quantitative analysis methodology from the perspective of empirical law.

Bibliometric Analysis on Health Information-Related Research in Korea (국내 건강정보관련 연구에 대한 계량서지학적 분석)

  • This study aims to identify and comprehensively view health information-related research trends using a bibliometric analysis. To this end, 1,193 papers from 2002 to 2023 related to "health information" were collected through the Korea Citation Index (KCI) database and analyzed in diverse aspects: research trends by period, academic fields, intellectual structure, and keyword changes. Results indicated that the number of papers related to health information continued to increase and has been decreasing since 2021. The main academic fields of health information-related research included "biomedical engineering," "preventive medicine/occupational environmental medicine," "law," "nursing," "library and information science," and "interdisciplinary research." Moreover, a co-word analysis was performed to understand the intellectual structure of research related to health information. As a result of applying the parallel nearest neighbor clustering (PNNC) algorithm to identify the structure and cluster of the derived network, four clusters and 17 subgroups belonging to them could be identified, centering on two conglomerates: "medical engineering perspective on health information" and "social science perspective on health information." An inflection point analysis was attempted to track the timing of change in the academic field and keywords, and common changes were observed between 2010 and 2011. Finally, a strategy diagram was derived through the average publication year and word frequency, and high-frequency keywords were presented by dividing them into "promising," "growth," and "mature." Unlike previous studies that mainly focused on content analysis, this study is meaningful in that it viewed the research area related to health information from an integrated perspective using various bibliometric methods.

Mapping the Knowledge on Socio-nuclear Studies in Korea through Keyword Network Analysis (키워드 네트워크 분석을 통한 원자력 관련 사회과학 연구경향 분석)

  • This research has attempted to conduct meta-analysis on 605 published papers in the field of socio-nuclear studies from 1957 to 2016 in Korea through network analysis of author-provided keywords. The findings lead to several straightforward conclusions. First, socio-nuclear studies including policy research have mostly been conducted by universities, while technology developments have been led by public organizations. Second, it is apparent that the Fukushima accident has provoked major engagement among social scientists in nuclear issues as the remarkable growth of the knowledge network after 2011 signify. Third, the research topics have been diversified as a result of growing multi-disciplinary research projects. Finally, there is between sub communities in the socio-nuclear knowledge network in terms of network properties. This article provides a stepping stone for future researchers with a wealth of information concerning the status of socio-nuclear studies. For policy makers, this meta-analysis is likely to provide guidance on what we need and do not need. It remains to be seen whether the socio-nuclear knowledge network in Korea is well-structured or not. provide an impetus for comparative studies with overseas cases in order to evaluate the network and its soundness.

A Bibliometric Analysis of Research Trends on Disaster in Korea (국내 재난 관련 연구 동향에 대한 계량정보학적 분석)

  • This study aims to investigate the research trends of disaster in Korea through a bibliometric analysis. To do that, it analyzed 772 scholarly articles published from 2002 to 2016, retrieved from KCI (Korean Citation Index) database. For analysis, discipline profiling analysis, journal profiling analysis, and co-word analysis methods were used. The study found that the number of scholarly articles on disaster has increased, especially after Sewol ferry disaster occurred in 2004. The major discipline areas were identified as 'policy sciences/public administration' area, 'engineering' area, 'GIS/telecommunication' area, and 'medical/humanities/social sciences' area. In terms of time series, the proportion of scholarly articles published in 'policy sciences/public administration' area has decreased since 2014 and at the same time, discipline areas have been diversified including law, medical, and journalism.

Analyzing Domestic Research Trends on Disclosure of Information By Comparing Major Academic Disciplines (주요 학문분야 비교를 통한 국내 정보공개 연구동향 분석)

  • Analyzing research trends is essential for the sustainable development of a discipline and is important for understanding the value of prior research and laying the groundwork for subsequent research. This study aims to draw implications for the future direction of convergence research on the disclosure of information from various disciplines by comparing and analyzing the trends in disclosure of information research in Korea. For this purpose, we analyzed the publication frequency of information disclosure papers listed in the Korea Citation Index (KCI) from 2002 to 2023 and the publication trend by discipline as a time series. In addition, we compared the keyword relationships and specialized research topics of each discipline by applying network analysis and LDA topic modeling techniques to the names and keywords of papers in law, public administration, and library and information science. As a result of the analysis, the law focuses on legal regulations and policy improvement, public administration focuses on changing social needs and administrative operation methods, and LIS focuses on practical approaches to record management and disclosure of information. Based on this, future research directions include combining policy research in law with social change research in public administration and developing realistic policies and operational guidelines from the practical perspective of LIS. Such convergent research will enable the systematic and efficient implementation of disclosure of information systems, contributing to the guarantee of the public's right to know and the enhancement of state transparency.

Measuring impac of electronic publications on scholarly communication using bibliometric analysis (전자출판물의 확산에 따른 학술커뮤니케이션 변화의 계량서지학적 분석)

  • Electronic publications, including e-journals, show a rapid expansion due to its several advantages for the academic and research community. The purpose of this study is to analyze the impact of e-journals on scholarly communication. The impact factors and immediacy indices were provided via JCR social science edition have been used to conduct a series of analysis on three subject fields, economics, law and psychology. The data from the last eight years show that the impact factors of e-journals have not changed, but immediacy indices have intensely increased in recent two years. Significant increase of immediacy indices is probably due to prevalence of e-journals or electronic sources of articles. The result reveals that e-journals play an important role in speeding up the scholarly communication. It is expected that the findings of this study can contribute to more efficient management of the digital libraries.

Analysis on the Factors affecting the Ruling on Construction Project Litigation - Focused on the Union Establishment of the Urban and Housing Redevelopment Project - (건설사업의 소송판결에 영향을 미치는 요인에 관한 연구 - 도시정비사업 조합설립인가 사건을 중심으로 -)

  • This study analyzed the factors affecting the ruling of litigation on the housing reconstruction and housing redevelopment project based on the cross analysis and logistic regression analysis. According to cross analysis result, the defensive process prerequisite group was showed significant in many variables which were past legal relation, no ownership or association member status, double lawsuit, abuse of lawsuit right·litigation trust, existence of claim-preclusion, no standing to sue·no standing to be sued, lapse of litigation period, no legal interest, no own defect of approval. On the other hand, the offensive cause of action group was found to have no significant variable. According to logistic regression result, the defensive process prerequisite group was showed significant in many variables which were past legal relation, no standing to sue·no standing to be sued, no ownership or association member status, double lawsuit, no own defect of approval, abuse of lawsuit right·litigation trust, existence of claim-preclusion. Meanwhile, the offensive cause of action group was showed significant in only one variable that was defect in relation with articles of association. Overall, it is noteworthy that the offensive cause group showed very low significant results compared with the defensive process prerequisite group.
