A Study on the Authority of Private Security Personnel (민간경비원의 권한에 대한 연구)

  • In this study, I would try to observe the scopes and related matters of the authority of private security personnel based on the basic discussion about the identity of private security. Everybody knows, the problems of private personnel have been mainly discussed in the relations of the public police. Because the roles of private personnel are similar to the police, and in the perspective of the law, private security are regulated by the police. When we compared with the police, the scopes of authorities of private personnel are considered in several points. First, most private personnel are just only 'citizen', so they can exercise the authority as citizen. It can include self-defense, self-help. flagrante delicto arrest. But when discuss the authority in the scopes of a possessionary right or managemental right, the authority of private personnel can be extended somewhat. Moreover, when private personnel are delegated by the special laws, their authority are extended much more. Finally, when the whole authority are delegated by such as the privatization, private personnel authority can be nearly same to the police. But, it can be considered that the degrees of the delegated authority are flexible. And the exercise of the authority must be performed in the limit that not infringe the individual freedom and rights. It seems to me that the degrees of fairness in use of authorities and it's a permitted limit are set forth a premise not only the legitimate base but also judicial judgement. Therefore, the attitudes of the courts related the exercise of authority are very important. And the growth of private security and the extension of authority followed are inevitably accompany the various problems of responsibility, so it must be considered about that in many perspectives.

  • It seems that security police's business to secure safety of state and citizens has existed since the mankind began to create a community. State was not fully responsible for such security business from the beginning. The business was carried out autonomously by the private sector for a long period. However, as the state system had been strengthened, the public sector absorbed the function. But in the modern society where various risks exist, safety of society could not be guaranteed only by public police. Accordingly, cooperation with the private sector is indispensable. In the limit of public police, autonomous organization of security companies and general citizens is expanding its scope. As a result, they should exercise partnership as a tripod to build social safety net. Security police failed to secure manpower exclusively responsible for security, despite various businesses and excessive mobilization. Accordingly, their professionalism and ability to cope with crisis are being questioned. In particular, efficiency of security police is becoming a more urgent issue in an era of international terrorism. Private sector can be classified into security companies and private autonomous organization. In case of security companies, the problem is quality and business ability of guards compared to a rapid external growth such as quantitative expansion and advancement into various businesses. In terms of pure private activity, the necessity of understanding of public police activity and conditions for organizational and continuous activity should be prepared. To tide over such problems and effectively achieve the common goal, changes in the method of employment, new establishment of security police department, and strengthening of professionalism and crisis management ability are necessary in the public police sector. In case of security companies, improvement of relations with public police through joint education, strengthening of business ability and activation of business cooperation through these matters are necessary. To maximize activity of pure private sector, it needs to establish reserve police, manage such private autonomous organization and bolster publicity with citizens.

Analysis of Influencing Relationship Between Private Security Guards' Positive Psychological Capital and Job attitudes (민간경비원의 긍정심리자본과 직무태도 변수간의 영향관계 분석)

  • The purpose of this study was to investigate the relationship between psychological capital on job attitudes. For this purpose, the private security guards who were working at private security companies in Gyeonggi province from September to October, 2016 were selected as the population and the convenience sampling method was used for 310 persons. A total of 295 copies of the questionnaire were used for the final analysis, except for 15 questions that were answered in appropriately or were partially missing. Data were analyzed by frequency analysis, confirmatory factor analysis, correlation analysis and structural equation modeling using SPSS 21.0 and AMOS 21.0. The results are as follows. First, the positive psychological capital of the private security guard has a positive(+) effect on job satisfaction. Second, the positive psychological capital of the private security guard has a positive(+) effect on job commitment. Third, job satisfaction of the private security guards has a positive(+) effect on job commitment. Fourth, job satisfaction is partly mediated in the relationship between positive psychological capital and job commitment. In summary, the positive psychological capital of the private security guard is an important variable that positively affects job satisfaction and job commitment, and the higher the job satisfaction of the private security guard, the higher the commitment to the job.

A Study on the Integrated Management for Multi-Family Housing Security Guard and General Security Guard (공동주택경비원과 일반경비원의 통합관리에 관한 연구)

  • The problem is that even though the cost of apartment buildings and general expenses are the same and similar tasks, there is a significant gap between them in quantity and quality. The apartment security guard needs more professional management in education and various reporting obligations. In particular, the reality of being away from the management and supervision of the National Police Agency, which is in charge of crime prevention and policing resources throughout the nation, is a task that needs to be improved quickly. Although the "security service" is a specialized area for protecting the lives and property of the people, it is managed and operated only in the category of apartment management, just because it is under the jurisdiction of the Ministry of Land, Infrastructure and Transport. This should be integrated into one cost-related law, such as the "Cost Business Act," for management and operation. Although the regulations concerning security guards under the "Joint Housing Management Act" are very limited, they should start discussing the integrated management of apartment security guards and general security guards in view of improvement of their treatment. The most realistic method would be to hire a new general security officer with a security law as a security guard in an apartment building.

  • This study aims to present implications to the basic directions according to organization's own objectives, roles, physiology and changes, etc for private security being activated. The change in organization can lead to foster the foundation for coping with sharp social environmental changes. The fundamental factors leading organizational changes should include intentional, planned and future-oriented activities. This is because organizational changes can be achieved by organizational learning. Besides, organizational learning is indeed important in terms of improvement in business methods and security services, but it should be also much more examined than in any other organization, since business particularity lies in getting in most sensitive contact with customers on the spot. Therefore, this study aims to propose the developmental directions of organizational learning by positively exploring the basic learning directions according to the influences of organizational learning, focusing the organizational efficientization strategies coping with environmental changes on the organizational learning.

Private Security Regulation: A Comparative Study of South Korea and Mongolia (한국과 몽골의 경비업법 비교연구)

  • In Mongolia, the regulation related to the private security industry, the Law on Contracted Private Security Services, was legislated relatively recently. The Law on Contracted Private Security Services was enacted into law in Mongolia 16 years ago, in 2000. This regulation has undergone two amendments since its inception. However, new revisions still need to be made to ensure that this regulation is in line with internationally accepted standards and practices. This paper compares the existing private security regulations of South Korea and Mongolia. The purpose of this comparative study was to identify the weaknesses of and problems in the Mongolian regulation and propose amendments to the Mongolian regulation. The comparative study of the two countries' regulations showed and underscored an imperative need to make further amendments to the Law on Contracted Private Security Services. Specifically, the weaknesses of and problems in the Mongolian regulation at issue include the following: the level of accuracy in defining certain legal terms and providing the proper names for various regulations; stipulations which set forth the procedure for registering a private security company; provisions regarding operating a private security company; the details of eligibility and accountability requirements concerning chief executives and security service officers; and the scope of work provisions. This study proposes constructive amendments to strengthen the Law on Contracted Private Security Services.

An actual Analysis on the Determinants of the Private Security Agents Career Choices (민간경비원의 직업선택 동기 결정요인에 대한 실증분석)

  • This study is to investigate determinants of the private security agents' career choices. Random sampling of newly agents working at the private security firms in Gyeonggi-do and ChungChong-do was used. The period of under review was from May, 2010 to June, 2011 and the total number of interviews was 382. For this study using SPSSWIN 18.0, factor analysis(EFA/CFA), reliability analysis, discriminant analysis and descriptive statistics. The followings are conclusions. The first factor is' the value of job'. It consists of public security, contributions to our society and nation, protection public safety, spirit of sacrifice, crime prevention, and maintenance security. The second factor is 'ease of career choice'. Qualifying conditions are not particular and it is easy to get the job, as a result, this job is easy of access, they chose this job. The third factor is 'occupational stability'. They think this is a good job because the job is future-oriented so they chose this job. The fourth factor is' curiosity'. They became interested in this job, so they wanted to know about this job and then they chose this job.

The Influence of the Organizational Environment and Culture of the Employees in Private Security Corporation on the Organizational Performance (민간경비업체 조직구성원의 조직 환경, 조직 문화가 조직 성과에 미치는 영향)

  • The purpose of this study aimed to examine work environment and culture of the employees in private security corporation on the organizational performance. 200 guards who worked at security employees in Julanam buk provinces in 2011 were selected by using the method of judgment sampling and 188 guards were used for analysis. The data were analyzed with frequency analysis, factor analysis, reliability analysis, and correlation analysis of the collected data from the respondents by using SPSS 15.0. The conclusion was as follows: First, there was significant relationship between work environment and culture of the employees, organizational performance in private security corporation. Second, organizational environment of employees in private security corporation exerts influence of organizational culture and organizational performance. That is, organizational environment of employees in private security corporation exerts direct influence on organization performance, but it exerts indirect effect through organizational culture.

Learning from the Licensing and Training Requirements of the USA Private Security Industry : focused on the Private Security Officer Employment Authorization Act & California System (미국의 민간경비 자격 및 교육훈련 제도에 관한 연구 - 민간경비원고용인가법(PSOEAA) 및 캘리포니아 주(州) 제도 중심으로 -)

  • The private security industry in Korea has rapidly proliferated. While the industry has grown quickly, though, private security officers have recently been implicated in incidents involving violence, demonstrating an urgent need for systematic reform and regulation of private security practices in Korea. Due to its quasi-public service character, the industry also risks losing the public's favor if it is not quickly disciplined and brought under legitimate government regulation: the industry needs professional standards for conduct and qualification for employment of security officers. This paper shares insights for the reform of the Korean private security industry through a study of the licensing and training requirements for private security businesses in the United States, mainly focusing on the Private Security Officer Employment Authorization Act (hereinafter the PSOEAA) and the California system. According to the PSOEAA, aspiring security officers shall submit to a criminal background check (a check of the applicants' criminal records). Applicants' criminal records should include not only felony convictions but also any other moral turpitude offenses (involving dishonesty, false statement, and information on pending cases). The PSOEAA also allows businesses to do background checks of their employees every twelve months, enabling the employers to make sure that their employees remain qualified for their security jobs during their employment. It also must be mentioned that the state of California, for effective management of its private security sector, has established a professional government authority, the Bureau of Security and Investigative Services, a tacit recognition that the private security industry needs to be thoroughly, professionally, and actively managed by a professional government authority. The American system provides a workable model for the Korean private security industry. First, this paper argues that the Korean private security industry should implement a more strict criminal background check system similar to that required by the PSOEAA. Second, it recommends that an independent professional government authority be established to oversee and enforce regulation of Korea's private security industry. Finally, this article suggests that education and training course be implemented to provide both diverse training as well as specialization and phasing.
