Since the diversification, complication of the construction industry, construction conflicts have been increased these days. Expansion of scale of construction has brought conflict treatment cost increase. Thus, needs of the study on construction conflict risk factors and its management is getting important. But the existing studies about construction conflicts and risk factors that need to be cared to decrease construction cost are almost focused on analysis of number of conflict proposed. It means those studies can be helpful when want to know how many conflict have been instituted, however, they do not contain a close examination between types of conflict and cost of conflict treatment. The purpose of this study, therefore, is an extraction of conflict causes based on the conflict treatment cost and the choice of significant risk factors to be managed to prevent conflict and its treatment cost, which enables reducing the conflict treatment colt on control the risk factors.

댐은 하천의 물을 조절하기 위해서 인공적으로 만들어진 하천구조물이다. 댐사용권은 공업화와 경제발전으로 통해 증가한 용수수요를 충족시키기 위하여 정부가 다목적댐을 건설함에 따라 추가적으로 확보되는 수량에 대한 소유권을 법적으로 인정하고 사고 팔수 있도록 하고 있다. 이는 최근 여러 가지 소모적인 물분쟁이 물분쟁의 원인이 되고 있다. 낙동강 권역의 댐들은 건설시기가 각기 다르며, 건설시의 댐계획량과 현재의 용수공급량은 기후변화와 수리환경 변화 및 용수수요의 증대로 인하여 차이를 나타내고 있다. 특히 상 하류에 건설된 댐과의 연계운영으로 이전 독립적으로 운영되었던 경우에 비해 용수공급능력이 변화할 수 있다. 그러나 이에 따른 댐의 용수공급능력을 재평가하기 위한 공식적인 방법이나 절차가 정립되어 있지 않아 댐 건설시의 계획량을 적용하고 있는 실정이다. 가용허가수량에 대한 재평가가 없이 수리권에 대한 갱신이 이루어질 경우 사용자 입장에서는 자신의 용수사용을 개선할 원인을 제공하지 못할 것이며, 임의적인 허가가 계속 부여될 경우, 갈수시 물공급의 안정성을 확보할 수 없게 될 것이다. 따라서 안정적인 용수의 공급을 위한 적절한 가용허가수량을 판단하는 것이 요구된다. 따라서 본 연구에서는 실제 낙동강권역 댐의 여러 가지 여건을 고려하여 21세기 프론티어연구개발사업 "유역통합물수지분석 및 수자원계획기술 개발"에서 활용된 통합수자원평가계획 모형 K-WEAP에 적용하였다. 이를 통하여 낙동강권역 댐의 가용허가수량을 분석하고, 현재 산정되어 있는 댐의 가용허가수량과 비교 분석하였다.

Recently, the term 'Provisional Sum(PS)' has been used in domestic public construction projects especially for civil works. Nevertheless, the guideline for PS has not been clearly stipulated in contract documents or construction-related laws. Due to these ambiguous contract situations, disputes between owners and contractors are surely expected to settle down PS in construction projects. This paper focused on suggesting a guideline to settle down PS in these ambiguous contract situations. The guideline suggested in the paper is expected to be used as a reasonable method to settle down PS avoiding nonproductive disputes about PS in construction projects

최근 건설업계의 최대 관심사 중 하나로 떠오르고 있는 근로자의 임금관계, 4대 보험 등 건설공사와 관련하여 발생되는 각종 노무분쟁이 발생하고 있다. 이에 따라 대한설비건설협회 서울특별시회(회장 강석대)가 회원사들의 경영활동에 도움을 주고자 지난 3월29일 설비건설회관 회의실에서‘회원사 대표자를 위한 노무특강’을 개최했다. 이날 특강에는 서울특별시회 고문 노무사로 있는 신흥식 노무법인 한길 대표가 강사로 초빙되어 임금 및 퇴직금에 대한 현안 문제점 및 대응 전략, 4대 보험에 대한 현안 문제점 및 대응전략 등을 강의하였고 인사∙노무관련 제반 사항에 대한 질의 응답 등을 통해 회원사 대표들의 궁금증을 풀어주었다. 본지는 이날 강연했던 내용을 지난호에 이어 이번호를 끝으로 게재한다.
