The aim of this paper is improvement plan of mechanical field construct production system in Korea construction industry market. Recently Korea's construction production system is changing rapidly. While change, mechanical system construction field must prepare proper system for construction production system and later mechanical construction work will give order directly. Through this study the author will show the improved mechanical field construct production system and it can useful future construction industry production system in Korea.

최근들어 냉난방시스템의 변화로 인하여 오피스텔, 원룸 등의 신축 및 개보수 공사에 시스템에어컨 등의 시공이 활발해짐에 따라 기계설비공사업을 등록하지 않은 장비제조 또는 판매업체가 시공하는 현상이 많아지고 있다. 이에 따라 대한설비건설협회는 건교부에“시스템에어컨의 설치금액이 1천만원 이상인 경우 기계설비공사업을 등록하지 않은 자가 설치∙시공할 경우 처벌조항”에 대하여 질의한 결과, 건교부가“냉난방 등을 조립∙설치하는 공사는 기계설비공사업의 업무내용에 해당되는 것으로 이를 어길 경우 1년 이하의 징역 또는 1천만원 이하의 벌금에 처한다”는 회신을 보냈다. 시스템에어컨이란 건축물에 냉방 및 난방을 하기 위하여 건물의 냉∙난방 시스템을 건물에 설치하는 공조시스템으로 냉∙난방을 위한 에너지원으로 가스(LNG, LPG)를 사용하는 GHP(Gas Engine Heat Pump)와 전기를 에너지원으로 하는 EHP(Electric Heat Pump) 방식으로 구분된다. 시스템에어컨을 설치하기 위해서는 압축기에 해당하는 실외기를 건물 외부에 설치하고, 여러 가지 타입의 다수의 실내기를 실내에 설치한 후 냉매배관과 응축수 배관을 연결, 시공해야 한다. 따라서 이러한 공사는 건설산업기본법시행령 별표의 1의 기계설비공사업의 업무내용에 포함어 있다. 대한설비건설협회가 질의한 내용과 건교부의 회신 내용은 다음과 같다.

The CM(Construction Management) market has been growing steadily since 2000, but there are a lot of obstructing factors. Recently, many questions have been raised over the level of construction managers' technique, the appropriateness and efficiency of CM, and the performance of using CM because of its short history. In this respect, evaluating CM service quality is a very important issue not only to acquire a better position in unlimited competence markets but also to survive. Therefore, the objective of this study is to present a service quality evaluating model which can be adopted to CM companies.

The Construction Management(CM) System in Korea is systematized both in name and reality by being prescribed in Construction Industry Act('97) and Construction Management Act('01) through various discussions considering reformation of construction industry structure and enhancement of construction technology competitiveness. Specially in the public construction works, CM Pilot Project is promoted by central government for the activation of CM system introduced for efficiency of public construction project. The promotion of Pilot Project is not only the settlement and activation of CM system but also the process to embody and diversify the CM system. Now we should develop various CM application type such as Owner type, PM type and type for private capital project in doing so. And with this efforts, we could expect that CM system should play an important role to enhance the efficiency of public construction works and should affect private construction sector.

지난 3월 25일 제5회 한국로지스틱스 대상 수상식에서 건설교통부 물류혁신본부는 국가 물류혁신에 기여한 공을 인정 받아 대상을 수상했다. 건설교통부 물류혁신본부(본부장 이성권)는 지난해 9월 발족 이후 건교부가 주로 담당해온 물류인프라의 확충 등 하드웨어적인 시책뿐 아니라, 물류산업 육성, 물류인력 양성 등 소프트웨어적인 시책을 집중적으로 추진, 국제 · 국내 물류, 민 · 관 · 학 분야를 포괄하는 물류 경쟁력 향상을 위한 종합적 지원업무를 수행하고 있다. 특히 물류혁신본부는 물류기업 경쟁력 향상과 제3자 물류 활성화 대책의 일환으로 종합물류기업인증제를 도입, 본격적인 시행에 들어갔으며 현재 부처별로 분산되어 있는 물류정책을 통합조정하기 위하여 물류정책기본법, 물류시설법 제정을 추진 중에 있다. 물류혁신본부의 수장인 이성권 물류혁신본부장은 지난 4월 7일 대한상공회의소가 주최한 조찬간담회에 연사로 참석하여 '물류 경쟁력 강화를 위한 정부 정책방향'이라는 주제로 발표하였다. 이에 그 내용을 요약 게재한다.

Since May 23, 2014, the Construction Technology Promotion Act has been effect through the entire reform of the Act. Despite the extensive reform, the previous penalty articles remain intact. According to the article 85 (1), especially, if a service provider or an engineer has caused death or injury by violating the duty of good faith and by damaging the principal parts of facilities, the person should be sentenced for lifetime imprisonment or imprisonment for no less than three years. The article has been controversial in its clarity and adequacy. This study is to verify the characteristics and the scope of the article and to suggest the theoretical backgrounds by analyzing the article based on the principle of legality, which enables to set forth the possibility to improve the article. To achieve the goal, the provision has been analyzed in accordance with the basic laws in Korea including the constitutional law and the criminal law, the related cases have been collected, and the comparison of the relevant acts has been executed. The detailed discussion about the articles in laws and acts on construction and the long-term and integrated study are expected to vitalize through this research.

When the construction management method was introduced, there were arguments regarding the contractual responsibility of the construction manager. Accordingly, the provisions on damage compensation in the Construction Technology Management Act were revised in 2002, and the obligatory duty of care of a good manager is now required by the Framework Act on the Construction Industry. Even though the construction manager has a responsibility of a consultant in the CM-for-fee contract, however, the Korean construction environment does not clearly specify the consultant's scope of responsibility. In this study, the theory about the duty of care, which is a consultant's responsibility among the expert's responsibilities, was arranged. Based on the responsibilities of experts such as lawyers, the duties of care of a good manager of the construction manager were presented to provide the foundation for establishing the construction manager's responsibilities. To verify the resulting items, interviews with experts were performed to assess their importance levels.

The organic law on the Construction Industry, initially, this law was enacted with a view to preserving and fostering the specialty of each type of industry. By dividing each construction business boundary, it gradually settles the system of construction specialized on the basis of productive stages. Controversy over the abolishing regulations on business boundary still continues to swirl. Since the intensity of exclusion as well as rigidities become increased. This results from the fact that informations are not shared among business boundary and businesses under the protection of the business boundary regulations choose 'rent-sicking activity'. According to dissidents against this law, structure should be established not by artificially enforced institution but by voluntary efforts of participants in construction industry. This paper aims at improving the competitive of the construction industry by showing the efficient system of construction and proving the legitimacy of abolishing business boundary

Participation in official development assistance (ODA) construction projects can be proposed as a way to revitalize Korean small and medium-sized construction companies' entry into the overseas construction market. To this end, the necessary competency items were derived for the execution of the project, and a survey was conducted and an analysis of importance-current competency was performed. 24 out of a total of 32 competency items were analyzed as having a low level of competency compared to their importance, indicating that it is urgent to strengthen corporate-level capabilities for the smooth execution of related projects in the future. In detail, it is judged that it is necessary to seek to establish a preferential capacity-strengthening plan for contract management-related items such as the 'Construction-related fundamental laws, Contract management method, and International administration negotiation'.

The Construction Industry become to large. So, construction management is needed. In Korea, an organic law about construction industry was made in 1996. And CM was introduced, too. But CM is not activated with institutional inertia. A reason Is a perpetual friction between CM and Gamri. And it is not thoroughgoing enough about supply of CM's effect with Chf Best Practice checklist and Key Performance Index. This study will develop the CM Best Practice checklist with CM's work and technique in project-dimensional. The CM Best Practice checklist will guide to have a good result.
