Domestic Legislative Problems on the Civil Liability of Air Carrier in Korea Focus on the Example of Every Countries' Legislation (한국(韓國)에 있어서 항공안전인(航空運送人)의 민사책임(民事責任)에 관한 국내입법(國內立法)의 제문제(諸問題) ${\sim}$각국(各國)의 입법례(立法例)를 중심(中心)으로 하여${\sim}$)

  • This paper described the contents of theme entitled "Domestic Legislative Problems on the Civil Liability of Air Carrier in Korea" including the current example of fourteen countries' legislation ((1) Great Britain, (2) United States of America, (3) Canada, (4)European Union), (5) Germany, (6) France, (7) Italy, (8) Spain, (9) Swiss, (10) Australia, (11) Japan, (12) People's Republic of China, (13) Taiwan, (14) North Korea) relating to the aviation law or air transport law. Though the Korean and Japanese aviation act has provided only the public items such as (1) registration of aircraft, (2) persons engaged in aviation, (3) operation of aircraft, (4) aviation facilities including airport, (5) air transport business, (6) investigate of aircraft accidents etc., but they could not regulated the private items such as the legal relations of the air transport contract (1) air passenger ticket, (2) air luggage ticket, (3) airway bill, (4) liability of air carrier, (5) amount of compensation for damage caused by aircraft accidents, (6)jurisdiction, (7) arbitration, (8) limitation of action, (9) combined carriage, (10) carriage by air performed by an actual carrier other than contracting carrier, damage caused by aircraft to the third parties etc. in their aviation act until now. In order to solve speedily the legal problems on the limitation of air carrier's liability and long law suit and disputes between wrongdoers and survivors etc, it is necessary and desirable for us to enact a new "Draft for the Air Transport Act" including the abovementioned private items. I would like to propose personally and strongly the legislation of "Draft for the Air Transport Act" in Korea in emphasizing the importance of ensuring protection of the interests of consumers air passengers and shippers in carriage by air and the need for equitable compensation between air carriers and survivors caused by the aircraft accidents such as the German Air Transport Act (Luftverkerhrsgesetz).

Study on improvement of legislation for elderly welfare

  • It is expected that Korea will be entering with super aged society with its rapid changing to aging society compare to other developed countries. Such phenomenon is recognized from a long time ago and government has enacted Elderly Long Term Convalescence Insurance Regulation back in 1999. However, different from its actual purpose, there are many problems and improvements to be made, leading to legislative revision for several times. Still, it is left with many issues. This is one example showing there has been a continuous problem with elderly long term convalescence insurance system. Even this system in Germany which have started 4 years before us is to continuously revising regulation by raising issues to make strong structure for elderly welfare and long term convalescence, aiming to enhance life of elderly people by providing detailed standard for convalescence. Elderly related legal systematization may not enhance their welfare service or daily life right away. However, if details in regulation and its theory is systematically arranged, this will greatly reduce administrative confusion as well as increasing understanding and use of this system for the nation.

  • Among 28 land Categories, 'road' is that most frequently established or transformed. Like that of other 27 land categories, the boundary of road should be defined by boundary making principles and then fixed by cadastral laws. But, some criteria to determine the land boundary, especially in boundary making rule which can be used by geographical features, is confused partly in Land Use Planning stages. Because the purpose of making any rules in fixing road boundary may be misinterpreted, the gap between law and real land boundary can be occurred. Those related rules in determining the land boundary must be improved urgently. Cut surface' or 'slope' should be conformed as a legal term and I suggest that 'Structures' must be changed to 'geographical features'.

Research on Improvements of the Legal Deposit System for the Preservation of Online Electronic Book (온라인 전자책 보존을 위한 납본제도 개선 방안 연구)

  • This research compares and analyzes the legal deposit of national online electronic publishing and related laws that were recently amended in order to preserve the exponentially increasing number of electronic books(e-books). Based on the analysis, it also seeks ways to initiate a legal deposit system of e-books in South Korea. The research, therefore, defines the exact range and types of e-books. This research proposes three conditions to introduce the legal deposit system in order to preserve South Korean e-books. The first is to establish a clear definition and classification of e-books as data subject to legal deposit for preservation purposes. The second condition is to establish a legal system in order to deposit and collect network(online-exclusive) type e-books. The final condition is to reflect the opinion of publishers and to create security measures against any loss of the companies.

Managing Information as Records Asset : Public Records Policies in the Digital Transformation Era (디지털 전환 시대의 공공기록정책 기록자산으로서 정보의 관리)

  • The E-government Act is in the complete revision process to promote the digital information preservation of the administrative information systems although the preservation of digital information in public sectors is now being regulated by the Public Records Act. In this challenging situation reconstruction of the public records policies has become a task that can no longer be delayed. The current public records policies are insufficient to manage various forms of digital information. The purpose of this study is to suggest the directions of the public records policies in digital transformation era. To this end, it analyze the recent changes in public records policies in the U.K. and Australia as leading models. The analysis derives four trends such as; i) extending management policies from declared records to all information, ii) adopting digital continuity policy, iii) managing information as records asset, and iv) establishment of information governance systems at national level.

A Cost-Benefit Analysis for the Establishment of the Truck Transportation Information Networking System in Busan Region : Using the Scenario Analysis (부산지역 화물자동차 운송정보망 구축과 경제적 타당성 분석 -시나리오분석을 중심으로-)

  • Domestic trucking transportation market does not have only the poor business environment but also the serious defects on the transportation trading structure. It makes weaken the competitiveness of trucking industry and hinders the development of trucking industry. The problems of trucking industry such as the recession of the Korean economy and decrease of the trucking charge cause the truck drivers suffer. Korean government and national assembly try to change the law of truck transportation business. The suggested law includes the obligation of trucking information networking system and it can make the transportation business structures more efficiently. This article deals with the strategies for the establishment of trucking transportation networking system and examines the cost-benefit analysis assuming the four demand senario. The results suggest the establishment of the information system not based on the individual trucking industry but on the joint industry at the level of the local area. This article also suggests that the information system has a positive financial feasibility.

  • 물관리 주무부처인 국토해양부(이하 국토부)는 최근의 전 세계적인 기후변화와 더불어 유역의 도시화 등으로 인해 급격한 하천환경 및 사회적 여건변화에 맞추어 "하천법"을 전부개정(법률 제8338호)하여 2008년 4월 7일부터 시행하고 있다. 개정 "하천법"에서는 하천수 사용 관리 조정기능이 크게 강화되어 국가 및 지방하천에서 하천수를 취수하여 특정용도로 사용하려는 경우, 그 취수량에 관계없이 누구나 관할 홍수통제소장에게 허가를 받아야한다. 따라서 국토부 소속기관이자 국가 물관리 전문기관인 홍수통제소는 수문조사, 이수(하천유량 관리 등) 및 치수(홍수예보 등) 등의 주요업무 중 기존 국가하천에 국한되었던 하천수사용 관리를 지방하천까지 확대하게 되었다. 본 연구에서는 하천법에 따라 집행된 2009년 국가하천, 지방하천 및 일시적인 하천수 사용 인 허가 행위 등 하천수관리 현황자료를 조사 정리하였다. 현황 자료를 토대로 행정구역(시 도)별, 수계별, 용도별, 허가량별, 월별 분석을 수행하고 그 특성을 파악하였다. 그리고 일시적인 하천수사용은 상기 분석 이외에 하천등급별, 공사종별 분석을 수행하였다. 2009년 총 152건(반려, 취소 등을 제외한 행위는 총 131건 : 국가하천 43건, 지방하천 33건, 일시적인 하천수 55건)의 기본적인 통계분석을 통하여 낙동강유역의 하천수사용 특성을 제시하고, 파악된 하천수사용 특성 결과는 낙동강유역의 물관리정책에 소중한 기초자료로 활용될 것으로 판단된다.

  • 재난은 인류의 발전과 더불어 다양하게 발생되어왔다. 최근 21세기 들어 발생하는 재난은 그 현상이 더욱 다양하고 복잡하며 그 피해의 정도가 대규모로 진행되는 경우가 많아 졌다. 태풍, 집중호우, 강풍, 폭설, 지진, 황사 등의 자연재난은 지구온난화현상으로 국내뿐만 아니라 전 세계적으로 커다란 영향력을 미치고 있으며, 화재, 구축물의 붕괴, 지하철사고, 테러 및 감염병 등의 사회 재난도 더욱더 증가하고 있는 추세이다. 나아가 사스, 메르스, 지카 바이러스 및 대형 테러 등 전 세계적 차원의 사회 재난의 발생 또한 급증하고 있다. 이와 같이 현대사회에서 발생하는 재난는 개인이나 국가의 정책만으로 예방하고 관리할 수 없는 특성이 있다. 따라서, 자본주의 경제의 한축을 이루고 있는 기업의 재난을 관리하여 연속성을 확보하고 더나아가 리질리언스(Resilence)를 보장하기 위한 일환으로 2007년 7월 재해경감을 위한 기업의 자율 활동 지원에 관한 법률(이하, 기업재해경감법 이라함.)이 공포된 지 약 10여년이 경과하였다. 이는 법 제도화를 통하여 기업의 재해경감활동을 지원하기 취지에서 출발한 것 이다. 그 후 현재 까지 어느 정도의 발전이 있었지만 경과 년 수에 비해 아직 미흡한 실정이다. 이후 그 기업들이 좀 더 원활하게 재해경감활동을 위한 계획을 수립, 실행, 검토 및 유지하기 위한 지침으로서 기업재난관리표준을 2010년 4월 2일 제정하였고 이후 재해경감활동 수립계획을 제정하여 시행하기에 이르렀다. 또한, 기업재난관리표준은 제정된 이후 2013년 12월 9일 전면 개정작업을 통해 경영관리 프로세스 모델(Plan-Do-Check-Act)이 적용된 관리체계를 접목시키고 용어정의를 국제표준과 일치시켜 기업재해경감활동 상의 혼선을 방지하기 위한 노력을 하였다. 현 정부에서는 주무부처가 바뀌고 조직이 변화되어 행정안전부고시 제2017-1호(2017.07.26.일)로 개정되어 현재에 이르고 있다. 본 논문에서는 기업재난관리표준과 연관된 제반 법령 및 규정 등에 대한 법적성격 과 지위를 규명하고, 기업재난관리표준의 관련분야 적용 시 문제점 및 바람직한 제도개선 방향을 제시하고자 한다.

Issues of Income Tax on the Compensation for Employee Invention of the University (대학 직무발명 보상금에 대한 소득세 과세 관련 쟁점 검토 -대법원 2015.4.23. 선고 2014두15559 판결을 계기로-)

  • There has been some controversy about imposing income tax on the compensation for university employees' inventions. In this research, various issues of taxation related to such compensation are examined, with Supreme Court Judgement 2014Du15559 as a means of understanding the confusion associated with this taxation. An amendment of the Income Tax Law is proposed based on the examination results, in order to promote research in the university field, which is able to make various types of compensation for employee inventions fall into the category of tax exemptions. It is concluded that if the Income Tax Law is amended to refer to the definition of technology in the Technology Transfer and Commercialization Promotion Act, instead of that of the Invention Promotion Act, the compensation resulting from newly emerging IPRs and technical know-how, which are currently taxed, can become tax exempt.

A Study on the Improvement of Police Committee System in Korea - Focus on the National Police Committee -

  • Korean police have been established as a national police system since the liberation of Korea and have been operated as a centralized police system for a long time, and a police committee was established under the enactment of the Police Act in 1991. However, the National Police Commission has a problem that it cannot perform the functions of the original National Police Commission because it is only a simple advisory body, not an institution that reviews and decides major policies related to police administration. As a result, despite the passage of a full amendment to the Police Act in 2020 and the revision of the Act to the Organization and Operation of the National Police and Local Police, operational and compositional problems still exist. Therefore, this study intends to propose the current state of operation and problems of the police committee system and measures for improvement.
