법령과 고시 - 제로에너지 건축물 인증제도 1월부터 본격 시행

  • 국토교통부는 녹색건축물 조성지원법 시행령 시행규칙을 개정하고 1월 20일부터 제로에너지건축물 인증제 시행에 들어간다. 제로에너지건축물은 고단열 건축자재와 신재생에너지를 결합하여 외부 에너지 유입을 최소화 한 건축물로 건축주는 인증을 원할 경우 인증기관에 신청하여 제로에너지건축물 인증을 받을 수 있으며, 인증받은 건축물에 대해서는 용적률 완화, 신재생에너지 설치보조금, 기부채납 부담률 완화 등의 인센티브가 제공된다.

이슈&이슈 - 제8대 집행부 사업추진 실적

  • 지난 2011년 3월에 출범한 제8대 집행부는 정해돈 회장을 비롯한 회원사 모두가 한마음으로 노력한 결과 괄목할 만한 사업성과를 거두었다. 특히 설비건설업계의 오랜 숙원사업인 공공공사 분리발주 확대 법제화를 위해 각고의 노력을 기울인 끝에 국가계약법 시행령이 개정되어 올해 1월 1일부터 시행에 들어간 성과는 1994년 법 제정 이후 20년 만에 일구어낸 아주 값진 성과로 평가되고 있다. 또한 녹색건축물조성지원법 시행령에 '국토부 장관이 5년마다 기계설비 발전정책을 수립하도록 의무화'한 조문 신설로 향후 기계설비 발전계획을 정부 차원에서 수립할 수 있게 되었다. 이와 함께 건설산업 공생발전위원회를 통한 주계약자 공동도급 확대와 저가하도급 심사제도 개선 등 불공정하도급 거래 관행 개선으로 회원사의 경영환경을 크게 개선시켰다. 본지는 2011년 3월부터 2014년 2월까지 제8대 집행부의 사업실적을 점검해 본다.

  • 건축기술의 눈부신 발전과 경제적 가치추구 등에 따른 국가 사회적 수요로 인하여 초고층 건축물의 건설물량은 이들 건축물에 대한 효과적인 피난안전대책을 정립하기도 전에 급속히 증가하는 추세이다. 우리나라는 2009년 7월 16일 재정된 건축법 시행령을 통하여 층수가 50층 이상이거나 높이가 200미터 이상인 건축물을 '초고층 건축물'로 규정하고, 이러한 건축물의 피난안전을 위하여 지상층으로부터 최대 30개 층마다 설치하는 대피공간을 '피난안전구역'으로 정의하였다. 이후 2010년 2월 18일 개정령에서는 초고층 건축물의 피난안전구역을 건축물의 '피난층'으로 인정하기에 이르렀다. 그러나 피난대상인원 등에 따른 대피공간의 면적이나 구조 등 내부시설에 대한 설치기준이 없어 피난안전구역으로서의 충분한 신뢰성을 확보하지 못하고 있어 이에 대한 심층적 연구와 기준의 개선이 필요한 실정이다.

  • The Ministry of Land, Transport & Maritime Affairs(former-The Ministry of Construction and Transportation)establish & promulgated the guide line of The Law of Post Evaluation on May 10, 2001(Article 58824-318) to public construction project under the Operation Law of Construction Engineering Management the 18 clause of Article 38 in order to induce & collect useful data about construction project when plan new similar project in the future about the initial planning phase, former and past accomplished businesses to construction works, results, efficiency, effectiveness. Ever since The Ministry revised 5 times, the former contents are composed for SOC, big volume civil project, and revised contents Article 2010-14(Jan 15, 2010) included some architectural project, but that was not definite the evaluation contents, direction & objective standard. So evaluation index implements are ambiguous about accomplished project. This research arranged the correctness evaluation indicators, criterions for decide the grades in order to helpful informations for similar architectural project in the future.

A Study on the Record Management of National Archives of Korea (국가기록물 관리의 현황에 관한 발전적 제언)

  • In this research the issues of record management of national archives in Korea are classified into four categories: 1) improving the status of the Central Archives of Korea, 2) constructing a new national archives, 3) revising the law on the record management, 4) creating qualifications for a professional administrator for Archivist. 1) In order to strengthen the function of the Central Archives of Korea, it is very urgent to create a systematic mechanism in which the Central Archives oversees and administers public archives(documents) collected from all the public institutions not only under the Administration but also the legislature and the judicial authorities. 2) This paper suggests that a new National Archives should be a symbolic building representing Korea as archives. Considering the fact that Presidents archives will be a part of this new National Archives, it also suggests that artistic and decorative pieces which embody Korea's representative archives or people should be included in the building. The budget for these should be supplied by the government. 3) This paper looks at the matter of revising the law on Record Management in two respects: (1)strengthening the function of the Central Archives of Korea, (2)making it obligatory to produce archives not open to the public, or making a protection clause for secret archives. This paper proposes that the Central Archives of Korea will be able to collect all the public archives from all the public institutions, and to oversee and administer them by revising the 5th and 6th clauses of the current law on the record management. It also proposes that some laws which make it obligatory to produce archives for documents not open to the public, and which protect those secrecy. 4) Regarding the qualifications for a professional administrator for the record management, this paper suggests lowering the qualification a little to the bachelor's degree of the record management. Also it suggests taking into consideration the persons in charge of the record management in public institutions and acknowledging their qualifications after a certain period of training at the Central Archives of Korea or something like that. In addition, it classifies the ranks of the professional administrators according to their qualifications.

Applying CVM for the Reinvestment Ratio of Development Profits Generated by Renewing Old Industrial Park in Daegu Metropolitan City (CVM 분석을 이용한 개발이익 재투자 비율 설정에 관한 연구: 대구광역시 노후산업단지 재생사업을 중심으로)

  • In December 2019, the Ministry of Land, Infrastructure and Transport announced the revision of the Enforcement Decree of the Industrial sites and Development Act. In this revision, the reinvestment ratio of development profits generated by renewing the old industrial park is delegated to the local government ordinance. According to this announcement, the reinvestment ratio can be adjusted to less than 50% of sales revenue from construction projects and 25% of land sales for non-industrial use depending on local government conditions. This study aims to investigate the policy rationale for the adjusted ratio of reinvestment in development profits and explore how Daegu City can use this policy when revising ordinances in the future. A survey was conducted with a total of 320 experts, including public corporations, public officials, and industrial site workers in the Industrial Complex Committee. We employ contingent value measurement (CVM) based on 262 valid responses. The results showed that 27% of sales from the construction business and 22% of sales from non-industrial land were derived with an appropriate reinvestment ratio. Although the results in this study might not be generalized in other regions, we provide a potential reference for other local governments who are interested in ordinance revisions in the future. Another contribution of this study is to suggest the statistical method to derive the relevant ratio.

AA Study on the Selection Criteria for Delivery Systems of Public Construction Projects in Local Governments (지자체 공공건설사업의 발주방식 선정기준에 관한 연구)

  • With the current trend in the industry toward increasingly complex, diversified and large construction projects, advanced countries in the construction field have already introduced and applied a variety of methods for placing orders in order to cope with such changes in construction circumstances. In Korea, there have been efforts to continuously improve approaches to placing an order. With the aim of diversifying the methods of Delivery Systems, the "Technical Proposal Type Bid," and the "Design Competition and Technical Proposal Type Bid" were introduced through a revision of Korea's contract law enforcement ordinance. In line with the government's efforts, criteria for a method of placing an order that is suitable for a public construction project should be presented. This study enumerates the current issues using a survey for construction projects already placed and an analysis of the current status, and presents the selection criteria for Delivery Systems by business type as an improvement for the problem.

A Study on the Efficiency of Evacuation Exterior Stairs in High-rise Buildings (고층빌딩에서 옥외피난계단의 효용성에 관한 연구)

  • Article 36 of the Building Code Enforcement Ordinance requires that an exterior evacuation stairs be installed for the buildings of three stories and over with cultural facilities or gathering places which have over $1,000\;m^2$ floor area of public performance halls or recreational facilities. The concentration of population together with the increase of high-rise buildings in cities call for various precautionary measures to be taken against human disasters. For the past ten years high-rise buildings showed 85% of increase, marking a steep rise. This increase of high-rise buildings may lead to human disasters in urban areas and, in case of fire breakout, may cause great loss of human lives and property damages. The most difficult fire-fighting activities in high-rise building fires are those of evacuation. Because smoke spreads through the upper floors, the securement of evacuation route in high-rise buildings may be the only way to minimize loss of lives. In high-rise buildings exterior escape stairs are necessary because it is difficult to secure evacuation route with only direct stairs or interior stairs. The Building Code now in force provides insignificant coverage on the exterior evacuation route installment and therefore becomes an inadequate means for evacuation route securement in high-rise building fires. To compensate for this inadequacy the Building Code should be revised to include a mandatory clause that an exterior evacuation stairs be established for the buildings of ten stories and over which can be categorized into high-rise building group.

A Study on the Types and Causes of Defects in Apartment Housing Information and Communication Work (공동주택 정보통신공사 하자 유형 및 원인에 관한 연구)

  • Entering the era of the fourth industrial revolution, information and communication technologies such as CCTV, home network systems and equipment are being used in the construction industry. In particular, in order to increase the autonomy of information and communication technologies in apartments, the government has announced an administrative revision of information and communication-related laws, and companies are focusing on developing technologies such as smart home services. In addition, most domestic and foreign studies on the information and communication work were mainly conducted on technology and management. However there is a lack of research on physical defects affecting the quality of ICT. Therefore, this study collected the defect data registered in the project management system of three domestic construction companies and classified them according to the standards of the Enforcement Decree of the Apartment House Management Act. According to the analysis of the frequency of defects work type, 88.10% of defects occurred in home network equipment work. In addition, analysis of defects type in the four detailed works showed the highest number of operation error. The cause was analyzed and prevention measures and countermeasures were presented in parts of design, construction, and maintenance. The results of this study will improve the quality of apartment housing and be used as basic data for future research on practical defect minimization and prevention measures.

A Selection Model of Suitable Tendering System for Public Construction Projects (공공건설공사의 최적 입찰방식 선정모델)

  • It is crucial In decision making to select a project delivery system (PDS) adjusted accordingly to the project characteristics. Furthermore, selecting a tendering system is the kernel in the process of selecting PDS. In October 2007, the Ministry of Finance and the Economy of Korea launched two new project delivery systems, "Best Value Contract (Design-Bid-Build)" and "Bridging Contracts (Design-Build)" by revising enforcement ordinances of "Act on Contracts to Which the State is a Party" to provoke the tendering systems. In order to support the proposed purpose, this research developed a selection model for suitable tendering system, which helps a public owner select a tendering system appropriate to the project characteristics. First, the framework of the model was set throughout analyzing previous researches and interviewing relevant experts. Additionally, by analyzing the survey result from 265 experts engaged in architectural and civil engineering business, the relative weights of the selection factors and the effectiveness values of the alternatives were suggested as the quantitative evaluation references. Finally, the practical guideline was suggested to apply this model to three public projects scheduled to be delivered. The result of applying the model to three case projects showed that further researches were needed to make the selection process logical and to suggest the standard weights and effectiveness values according to project type.
