  • Ships emit significant amounts of air pollution. To reduce ship emissions, the government has implemented the Eco-Friendly Ship Act to improve the marine air environment, under which the use of eco-friendly ships that use eco-friendly energy as a power source encouraged and technologies to reduce marine pollution are developed. Therefore, the revision of relevant laws and systems such as inspection and facility standards for the safe operation of eco-friendly ships is urgently needed, especially those for fishing vessels, which account for the majority of domestic coastal vessels. This study defines the core equipment for the application of electric complex propulsion systems to fishing boats and presents a minimum safety standard plan for the adoption and dissemination of eco-friendly fishing boats.

Estimation for Reclamation of Public Waters Demand Using Time-series Analysis (시계열 분석을 통한 공유수면 매립 수요 예측)

  • The Korean government is developing a 10-year master plan pertaining to the Public Waters Management and Reclamation Act. However, it was observed that implementation of the reclamation project through frequent changes would occupy a significant proportion. Thus, questions are being raised about the effectiveness of the master plan. In view of this, the need for a trend analysis on long-term reclamation demand is growing. Accordingly, in this study, a trend analysis of reclamation demand was carried out using the annual reclamation performance data. The results of the analysis indicate that the demand for reclamation of public waters continued to decline, and the trend has been particularly evident since the 1990s, when it was converted into a reclamation master plan. In addition, the total demand for reclamation during 2021-2030 was calculated to be at a maximum of 13.8 km2 and minimum of 1.7 km2.

  • CE RCD (Recreational Craft Directive) is a certification for the design and construction of small vessels, including pleasure yachts, which are widely used not only in the countries within the European Union, but also in Japan and Southeast Asia. Recently, South Korean leisure craft shipyards have developed interest in exporting to foreign leisure craft markets such as Europe; however, they have encountered difficulties because of the CE RCD regulations, which are relatively complex and difficult to understand. The requirements for buoyancy and stability, which are essential properties that must be understood within the early stage of ship design, are defined based on ISO 12217. However, preparing this assessment according to ship classification regulations is an exceedingly complex task, even with knowledge of naval architecture. In this research, we have developed design support tools to systematically support assessments and preemptively define design information so that buoyancy and stability assessments based on ISO 12217 can be systematically prepared. Our research results were applied to actual examples of yacht design to confirm validity. We believe that the improved yacht design process presented in this research can act as a foundational reference for enhancing the effectiveness and systematic buoyancy and stability assessments.

  • VTS service results from VTS watchman's mind as all other human conducts. Psychological motivations are divided into 4 factors ; collective unconscious, fear, responsibility, humanity. These motivations are beginning of VTS. Motivations awaken watchman and effect all other steps of service. Out of these motivations, higher factors ; responsibility and humanity act very positively and can be best solution for safety of vessel traffic ; the purpose of coastal VTS. Therefore, VTS officers should be educated to build up these virtues in their mind.

Legal Issues in Application of the ISPS Code under Marine Cargo Insurance (해상적하보험에서 국제선박 및 항만시설 보안규칙의 적용상 법률적 쟁점)

  • In view of the increased threat arising terrorism, the International Maritime Organization(IMO) adopted the International Ship and Port Facility Security Code (ISPS Code) which attached to the SOLAS Convention. The ISPS Code requires a comprehensive set of measures to enhance the security of ships and port facilities. For example, a shipowner must obtain the International Ship Security Certificate(ISSC). If the carrying vessel has not ISSC, the ship may be detained by the contracting governments. The Joint Cargo Committee(JCC) in London adopted the Cargo ISPS Endorsement, in which the assured who knowingly ships the cargoes on a non-ISPS Code compliant vessel will have no cover. However, where there is no the Cargo ISPS Endorsement in a Marine Cargo Insurance Policy and the cargo is carried by a non-ISPS Code certified vessel, the legal problem is whether or not it would constitute a breach of an implied warranty of seaworthiness and/or an implied warranty of legality. The purpose of this article is to analyze the potential legal issue on the relations between non-ISPS Code compliant vessel and two implied warranties under Marine Insurance Act(1906) in U.K.

  • In order to calculate the strength and to. see the variation af the stratification in the Southern Waters af Korea, the stratification parameter defined as potential energy anomaly (PEA, $V(J/m^3)$) introduced by Simpson and Hunter (1974) was used The data used in this paper were observed in August 1999 and February 2000 by National Fisheries Research and Development Institute (NFRDI). Also to know the effects af the temperature and the salinity an the stratification respectively, averaged temperature and salinity were used in the process af calculation the parameter. V is generally high in the offshore. However, in February, V in the onshore is higher than that of the offshore due to the vertical temperature gradient caused by the expansion of South Korean Coastal Waters (SKCW). In the summer, the increase af the atmospheric heating, the temperature inversion phenomenon act an the stratification as the buoyancy forcing. In most cases, the effects of the temperature on the stratification is stronger than that of the salinity. The temperature effect is predominantly due to the extent af the intrusion of Tsushima Warm Current into the study area. However, at stations where V is high the effect af the salinity is also significant. In the winter, V is very low due to the decrease of the buoyancy forcing, but same stations show the relatively high V due to the expansion of SKCW and Tsushima Warm Current.

  • The radio field environment is very different according to frequency band, therefore communication condition is equation that VHF is passed by direct radiation and HF is via reflect radiation in ionosphere. Load a ship according to the enforcement regulations of the ships safety act have specificated the radio equipment that should be operating. This paper have analysed by the simulation program about radio field environment for research the communications condition, which is VHF & HF band in domestic coastal. We have Predicted to radio field environment and communications condition using the data of analysis and domestic radio regulation regard to coast navigational ship. Therefore have proposed the necessity for rationally plan on improvement the radio regulation and network cooperation of VHF radio station.

A Study on the Safety Navigational Width of Bridges Across Waterways Considering Optimal Traffic Distribution (최적 교통분포를 고려한 해상교량의 안전 통항 폭에 관한 연구)

  • Bridges across waterways act as interference factors, that reduce the navigable water area from the perspective of navigation safety. To analyze the safety navigational width of ships navigating bridges across waterways, the optimal traffic distribution based on AIS data was investigated, and ships were classified according to size through k-means clustering. As a result of the goodness-of-fit analysis of the clustered data, the lognormal distribution was found to be close to the optimal distribution for Incheon Bridge and Busan Harbor Bridge. Also, the normal distributions for Mokpo Bridge and Machang Bridge were analyzed. Based on the lognormal and normal distribution, the analysis results assumed that the safe passage range of the vessel was 95% of the confidence interval, As a result, regarding the Incheon Bridge, the difference between the normal distribution and the lognormal distribution was the largest, at 64m to 98m. The minimum difference was 10m, which was revealed for Machang Bridge. Accordingly, regarding Incheon Bridge, it was analyzed that it is more appropriate to present a safety width of traffic by assuming a lognormal distribution, rather than suggesting a safety navigation width by assuming a normal distribution. Regarding other bridges, it was analyzed that similar results could be obtained using any of the two distributions, because of the similarity in width between the normal and lognormal distributions. Based on the above results, it is judged that if a safe navigational range is presented, it will contribute to the safe operation of ships as well as the prevention of accidents.

A Study on Seaman's Criminal Responsibility of Marine Accidents (해양사고에 따른 해원(海員)의 과실책임에 대한 형사실무적 고찰)

  • In general, the criminal responsibility of seaman should always be directly assumed by the seamen, according to the principle of self-incrimination. Therefore, the only possible countermeasures for the criminal responsibility of seamen may be to reduce the responsibility by using criminal procedures (ex. the warrant substance examination system, the review system of legality for confinement as much as possible. Another possibility is to reduce the penalty through the revision of the law. In detail, concerning the problem of fine, the maximum fine for oil spill accidents by criminal negligence is KRW 30,000,000 under the current Ocean Pollution Prevention Act, and when an oil spill occurs, the maximum fine tends to be levied regardless of the amount of the spilled oil; thus, it is judged that grading the fine according to the amount of spilled oil may be worth considering. Regarding P & I's payment of fine, contrary to general belief, it is only possible to make up the loss when P & I takes up the legal responsibility or acknowledges its payment. In order to solve the problem, it is possible to consider the option of introducing new collective insurance program or mutual aid system. Also, as seamen are not specialists in legal issues, the ship owners' association or the marine afficers' association need to develop some program through which they can receive systematic assistance from legal specialists including lawyers when they encounter any legal problems (ex. free legal aid programs for farmers and fishermen). Finally, it may be possible to establish enact new laws or revise the existing Act on Special cases Concerning the Settlement of Traffic Accidents to insert a new section on marine accidents.

An Analysis of Legal System for Strengthening Actions against Operating Vessels Under the Influence of Alcohol at Sea (해상에서의 선박 음주운항 단속 강화를 위한 법 제도 분석)

  • In the last 5 years, a total of 567 accidents of operating vessels occurred under the influence of alcohol at sea, most of which occurred in fishing boats. Accidents caused by operating vessels under the influence of alcohol at sea are causing human and physical damages. There were 69 accidents caused by operating vessels under the influence of alcohol, leading to five deaths and one missing. The social damage due to operating vessels under the influence of alcohol is also increasing. Under the current law, punishment is given lightly compared to the seriousness of violation. In order to prevent the recurrence of accidents caused by operating vessels under the influence of alcohol, cases in Korea need to be analyzed. Regulations on the crackdown in foreign countries were compared to those in Korea and reviewed. In addition, risks of operating vessels under the influence of alcohol should be provided to ship workers while improving related laws and systems. In addition, efforts should be made to reduce the number of accidents due to operating vessels under the influence of alcohol by strengthening crackdowns on ships at sea so that accidents caused by operating vessels under the influence of alcohol could be prevented in advance in the future.
