국제항공운송 승무원의 일상적 노무제공지 (The Place Where the Cabin or Flight Crew of International Air Carrier Habitually Carries Out his/her Work - CJEU, 2017. 9. 14., C-168/16, C-169/16 - Sandra Nogueira and Others v. Crewlink Ltd Miguel José Moreno Osacar v. Ryanair)

  • 국제항공운송에 종사하는 승무원은 업무의 성격상 여러 나라에서 근로를 제공하게 된다. 국제사법에 의하면 일상적 노무제공지는 국제근로계약의 준거법 결정(제28조 제2항), 국제재판관할의 결정(제28조 제3항, 제4항)에서 중요한 역할을 수행한다. 일상적 노무제공지는 국제재판관할과 준거법의 결정을 위하여 EU에서 제창된 개념으로, 국제항공법에서 항공안전을 확보할 목적으로 승무원의 피로관리를 위해 도입된 개념인 모기지(母基地)와 입법목적이 서로 달라, 일상적 노무제공지와 모기지는 같은 개념이라고 볼 수 없다. 승무원의 일상적 노무제공지를 결정하기 위해서는 (i) 승무원이 근무를 시작하고 종료하는 곳, (ii) 승무원이 업무를 수행하는 항공기가 주로 주기(駐機)된 곳, (iii) 사용자가 전달한 지시사항을 알게 되고 근무활동을 조직하는 곳, (iv) 근로계약상 승무원이 거주할 의무가 있는 곳, (v) 사용자가 제공하고 승무원이 사용할 수 있는 사무실이 있는 곳, (vi) 승무원이 업무에 부적합하거나 징계사유가 발생할 때 참석할 의무가 있는 곳 등을 종합적으로 고려하여야 한다. 그런데 위에서 열거한 사항은 모두 모기지 소재지와 동일하므로, 승무원의 일상적 노무제공지를 결정할 때 모기지를 가장 중요한 요소로 고려하는 것이 타당하다. 이와 달리 기적국을 일상적 노무제공지로 보아서는 안 된다. 대상사안에서 CJEU는 국제항공운송에 종사하는 객실승무원의 일상적 노무제공지에 관하여 최초로 판단기준을 제시하였는바, 이는 우리나라 국제사법의 모범이 되었던 브뤼셀 규정의 해석이므로, 국제항공운송 승무원에 관하여 국제사법상 일상적 노무제공지의 개념을 이해하는데 많은 도움이 될 것으로 보인다.

비닐 하우스용 작업복 개발에 관한 연구 (A Study on Development of Work Wear for the Plastic House Workers)

  • This study was designed to devise work wear for plastic house worker. It was carried out (1) research on the clothing actual condition through interviewings with plastic house worker and observations, (2) thermal manikin test to measure thermal resistance of experimental clothes and (3) clothing comparing test in the laboratory and in the plastic house. In the laboratory experiment, it was choosen general type (A) and new devised types (B, C) made of microporous fabric for experimental clothes. Experimental clothes were made of 6 combinations including 3 type work wears (A, B, C) and 2 type underwears (1, 2). In the plastic house experiment, it was choosen general types of A (without rest place) and B (with rest place), and devised type C (with rest place), which was appeared good effect in the laboratory experiment. The results were as followings. 1. Work environment of the plastic house in summer and winter was very different from the outer environment. Work motion in the plastic house was burden to the plastic house workers. 2. Plastic house workers had on the general type's work wear. 3. As a result of thermal manikin test, thermal resistance was appeared B1>B2>C2>C1>A1>A2 in orders. 4. In the laboratory experiment, experimental clothes A was appeared smaller burden than B, C. Effect of mesh underwear was not appeared in this study condition. In subjective sensation, experimental clothes C was lower vote than A. Therefore experimental clothes C was superior to A in subjective wearing sensation. 5. In the plastic house experiment, the experimental conditions with rest place were appeared smaller burden than without rest place. General type B was appeared more positive physiological reactions than devised type C but significances between two types was not appeared.

외국인근로자와 유학생의 안전의식에 영향을 미치는 요인 (A Study on the Factors Affecting the Safety Awareness of Foreign Workers & International Students)

  • The purpose of this study is to analyze which factors affect safety awareness of foreign workers and international students. In the correlation analysis, individual characteristics related to the safety awareness of foreign workers were nationality, status of stay(visa types), place of work, educational background, and Korean proficiency while international students were relevant with only the types of residence. There were significant differences in the safety awareness of foreign workers in nationality, status of stay(visa types), region of residence, educational background, place of work, and Korean proficiency. However, there was a significant difference only in the types of residence for the international students. In the regression analysis of factors affecting safety awareness, there were significant differences in nationality, status of stay(visa types), place of work, and Korean proficiency in the case of foreign workers. It was analyzed that nationality and status of stay had a negative (-) effect, and the place of work and Korean proficiency had a positive (+) effect. In the case of international students, it was analyzed that only the types of residence had a negative (-) effect on safety awareness.

  • 인터넷을 통한 공동작업이 활발해짐에 따라, 가상의 작업공간을 지원하는 시스템의 필요성이 증대되고 있다. 공동작업에 참여하는 구성원들은 이러한 가상의 공간을 통하여 서로의 정보를 효율적으로 교환하고 공유하게 된다. 이러한 시스템은 서비스의 안정성을 보장하면서도 다양한 사용자의 요구에 따라 용이하게 확장될 수 있는 것이 바람직하다. 본 논문에서는 협업지원 컴포넌트와 이를 통하여 개발된 iPlace (internet workPlace) 시스템에 대하여 기술한다. iPlace 시스템은 웹 상의 개인공간인 개인작업장과 그룹의 구성원이 공유하는 공간인 공동작업장을 통하여 구성원들 사이의 정보의 공유와 재사용을 효과적으로 지원한다. 또한, 협업지원 컴포넌트는 EJB(Enterprise JavaBeans) 기술을 이용하여 구현하여 높은 확장성과 안정성을 제공한다.

  • The chemical factory deals with dangerous element and more advance, human-error analyzes and becomes effective research for the country and region. This paper analysis the form of work-miss on human-error according to a safety accident for domestic chemical factory from 1999-2002. It include the present contents and raise issues human knowledge, behavior, judgment, sensibility as an important counter plan that makes the safety solution of work miss. For the point of view of human knowledge, it takes color standard for works to be effective in work place. For behavior, the test has been for risk Point of work place and infra worker movement, also the workers performed professional work as classify according to work. For judgement, the valuation sheet is reflected to minimize the human-error and the 3rd supervisor does a cross-check audit beforehand. For sensibility, it is applicable for human relations, information, communication by program to the consciousness and an attitude of worker-supervisor.

제프리 바와 건축의 장소적 특성에 관한 연구 - 루누강가 작품분석을 중심으로 - (Study on the Placeness of Geoffrey Bawa's Architecture - Focus on the Analysis of Lunuganga -)

  • This study was initiated by the fact that modern architecture caused the loss of placeness by seeing place with wrong interpretation and method and provided people with a phenonenon of separation between the depth of experience and honesty. As a solution for such problems, this study intended to suggest a direction through an analysis on the works of Geoffrey Bawa who was recognized as 'a genius of place' and the investigation on the place characteristics of his representative work 'Lunuganga'. Its process was as follows; First, this study explored the characteristics of the place, Sri Lanka, which was the background of his architectures, to see its impact on his life and architecture. Second, based on his representative works of each period and the contents that he mentioned in literature, the general characteristics appearing in his architectures were identified. Third, through an analysis on the work, Lunuganga, the place characteristics appearing in his architectures were investigated. Through such process, it could be recognized that Geoffrey Bawa's architectures reveal the place characteristics as nature, place characteristic as journey and stay, and place characteristic as sense. In this study, it could be verified that place was integrated and applied to Geoffrey Bawa's architectures through the above characteristics and the spaceness was manifested. Through this, this study intended to suggest an orientation for the above problems.

서울지역 일부 특급 호텔 조리종사자의 직무실태와 직업의식조사에 관한 연구 (The study on the job attitude of cooks at the Deluxe Hotel in Seoul)

  • A survey was carried out from 143 cooks working at the deluxe hotels in Seoul to obtain the information on the working environment, characteristics, and the satisfaction of the cooks to improve the culinary art training program and the working environment. The results were as follows: Most of the cooks(58.7%) worked for 8-9 hours/day and 51.7% of the cooks earned 1-1.5 million won in a month. The cooks had average 1.6 licenses per person, however, their licenses accorded with their work place only with 85.3%. Subjects were unsatisfied with the pay(55.2%), but 42.7% of the cooks hoped to work in their current work place. If they could transfer to other work place, they wished to run a restaurant of their own. The unsatisfaction rate was high among the cooks worked for 10-15 years, and 19.2% of them was unsatisfied with the environment of work place and 11.5% was in promotion. The longer the working period of the cook, the higher the recognition of the culinary skill. Also, the more frequently transfer to other places, the higher the self-estimation in their skills. Subjects answered that the most important factors for good cooking are the good taste and hygiene. The quality of ingredients was recognized more important among the cooks worked for longer period. The greatest hindrance for the improvement of cooking skill was indicated as insufficient knowledge among the cooks worked under one year, lack of confidence among those worked for 2-5 years, and authoritarianism of seniors for 6-15 years. They answered that the most important qualification for cook is the sincere attitude. The cooks with under 5 years of experience indicated experience and studying attitude and the ones with over 6 years of experience culinary skill as the important factors for cooks. The important factors for promotion was pointed out as culinary skill and human relationship.

한국 20·30대 여성의 직장 복식규범과 갈등 -직장의 유형에 따른 현황조사를 중심으로- (Clothing Norms & Conflict of 20·30s Women in Work Place -Focus on Types of Work Places-)

  • This study examined the fashion culture of 20-30s working women through clothing norm relationships in the workplace. A literature research was conducted along with qualitative research, in-depth interviews in order to understand the domestic working environment and fashion culture such as lifestyle and consumer culture characteristics of 20-30s working women. The results were: First, it showed that the increased number of members having various inclinations caused subcultures through an increase of women's economic activities and transition to a knowledge-information society in domestic work places that changed into a business casual that recognized employees' autonomy and diversity. Second, in the working place, clothing norms coexist as stipulated by statutes, company rules, and official documents as well as others implied by experiences of sanction against members. Workplace closing norms are classified into norms of exposure that draw attention to clothes and casual clothes. Third, it showed that factors pressuring clothing norms are classified as external pressures and by spontaneous self-censorship that cause conflict and confusion with working women's fashion according to the degree of pressure. Two kinds of pressure by others (or types of departments and members) were observed.

소규모 건설현장 떨어짐 사망재해 저감방안 연구 - 비계 및 작업발판 중심 - (Research of the reduction measures for fall accident death in small scale construction sites. - On the Basis of work plate and scaffolding -)

  • During five years (Year 2009~2013), Total victims of 72 %(81,560 people) and those 50.6 %(1,258 people) of death accident occurs in small scale construction site which operate 2 million USD less construction budget. Especially, falling death accident account for 785 people, in the share of 33.2 %(261 people) death disaster takes due to defect of original cause materials. The major safety issues in small scale work place take place while scaffold installation, disassembling, work-plate improper installation or non-professional skills of workers. Furthermore, labor subcontract systems make small construction site shortage of resources. Those workers regard work-plate as unnecessary and consumables supplies. Because of that most of workers use unsafe workplace in most construction site. Therefore, in order to prevent falling accident occurring in small scale work site, government should organize related regulations such as "Work site safety construction method" and then expands education support, financial aid, and sourcing safety supplies for work plate which offer broad variety experiences. Also, introduce certificate solutions for various work plates to improve safety function such as anchoring type method and anti sliding function.
