Legal Grounds for Withholding or Withdrawal of Life-Sustaining Treatment (연명의료의 중단 - 대법원 2009.5.21. 선고 2009다17417 판결과 관련하여 -)

  • Is it lawful to withhold or withdraw life-sustaining treatment applied to a patient in a terminal condition or permanent unconscious condition? In Korea, there are no such laws or regulations which control affairs related to the withholding or withdrawal life-support treatment and active euthanasia as the Natural Death Act or the Death with Dignity Act in the U. S. A. And in addition there has had no precedent of Supreme Court. Recently Supreme Court has pronounced a historical judgment on a terminal care case. The court allowed the withdrawal of life-sustaining treatment from a patient in a permanent unconscious state. Fundamentally the court judged that the continuation of that medical treatment would infringe dignity and value of a patient as a human being. And the court required some legal grounds to consider such withdrawal or withholding of medical care lawful. The legal grounds are as follow. First, the patient is in a incurable and irreversible condition and already entered a stage of death. Second, the patient executed a directive, in advance, directing the withholding or withdrawal of life-support treatment in a incurable and irreversible condition or in a terminal condition. Otherwise, at least, the patient's will would be presumed through his/her character, view of value, philosophy, religious faith and career etc. I regard if a patient is in a incurable and irreversible condition or in a terminal condition, the medical contract between a patient and a doctor would be terminated because of the actual impossibility of achievement of it's purpose. So I think the discontinuation of life-sustaining care would be legally allowed without depending on the patient's own will.

Suppression of Strategic Capacity Withholding by Capacity Payment in a Competitive Generation Market (경쟁적 전력시장에서 용량요금에 의한 전략적 용량철회 억제)

  • In a cost based pool market, the generation capacity can be used as strategic bids by generation companies (Gencos) with the cost functions open to the market. Competition using strategic capacities is modeled by Cournot and Perfect Competiton (PC) model, and transformed into two by two payoff matrix game with Gencos' decision variables of Cournot and PC model. The payoff matrices vary when capacity payments are given to Gencos in accordance with their capacity bids. Nash Equilibrium (NE) in the matrices also moves with capacity price changes. In order to maximize social welfare of the market, NE should locate in a certain position of the payoff matrices, which corresponds to a PC NE. A concept of a critical capacity price is proposed and calculated in this paper that is defined as a minimum capacity price leading to PC NE. The critical capacity price is verified to work as a tool for suppressing a strategic capacity withholding in simulations of a test system.

  • Transmission congestion is one of the Key factors to local market power in competitive electricity markets. Withholding is a one of the methods exercise the market power. This paper presents an alternative methodology in market power under transmission congestion and withholding. The proposed methodology was demonstrated with the Optimal Power Flow(OPF). Case study is fulfilled by GAMS simulation.

An Empirical Study on the Relationship between Employee's Knowledge Psychological Ownership and Knowledge Withholding Intention: Focused on Employee's Motivational Factors (구성원의 지식 심리적 주인의식과 지식공유 거부의도 간의 관계에 관한 실증연구: 구성원의 동기요인을 중심으로)

  • Many organizations have paid less attention to knowledge withholding intention (KWI) rather than knowledge sharing. KWI is the likelihood that employees will give less than their full effort to contributing knowledge. KWI can be affected by employee's knowledge psychological ownership (KPO), cultural level (Individualism/collectivism: I/C), and altruism for organizational benefits. Also I/C is an important motivational factor that affects KPO and KWI closely. The purpose of this study is to examine the relationship between employee's KPO and KWI in the perspective of employee's motivational factors (I/C, altruism for organizational benefits). The results of analysis show that employee's KPO and collectivism are driving forces leading to KWI and that individualism is the significant influential factor of employee's KPO. For theoretical and practical contributions, the research presents the grounds for arguments that KPO and I/C are employee's psychological motivation for individual KWI and organizations trying to pay attention to employee's KPO and individualism need to decrease employee's KWI under individual, leader, and organizational dimensions. Limitations arisen in the course of the research and suggestions for future research directions are also discussed.

An Analysis on Possibility and Effect of Market Power under the 3rd Long Term Power Plan (제3차 전력수급기본계획에 따른 시장지배력 행사가능성 및 영향분석)

  • In this paper, we try to analyze the likelihood of exercising the power of market dominance by certain generators in future power industry of Korea. Firstly, we estimated installed generation capacity and sales volume of electricity in Korea, based on 'The 3rd Long Term Power Plan' which was announced in December 2006. Secondly, we calculated HHI, an index showing the degree of concentration of an industry, and RSI, an index showing how adequate the supply of goods or services of an industry is, using Fast-Forward. Thirdly, assuming a major generator employs the strategy of withholding a part of its available capacity at a peak time, we simulated hypothetical movement of SMP over a certain period of time, which is compared with that obtained without assuming such strategy to generate Lerner Index. an index showing the degree of market power of a monopoly. Regulators, home and abroad, have not given much interest in analyzing the effect of market dominance that is likely to be exercised by certain players in the future. That said, this paper provides insight into developing methodologies of analyzing and mitigating such effect by proposing the above indices to gauge it. In addition, this paper also shows the potential impact of employing capacity withholding strategy on the financial account of a dominant generator.

The reasons of drug residues in bulk milk (원유내 약물잔류의 원인에 관한 연구)

  • The 102 farms received a positive result of the bulk milk drug residue test were selected to investigate the reasons of drug residues in bulls milk. The most frequent causes of drug residues were milker or producer mistakes (28.4%), failure to observe withdrawal time (21.5%), and withholding milk from treated quarters only (19.6%). Milker or producer mistakes occurred high at the farms having a parlor system (4 cases out of 11 farms), and related to the inadequate records and marking of treated cows. The lack of knowledge on the absorption of antibiotic from treated quarters and its excretion from untreated quarters caused mainly withholding milk from treated quarters only. Among the 91 farms identified the cause of drug residues, most of the route of drug administration was intramammary infusion (81.3%), and mostly drug used for the treatment of cows was ${\beta}$-lactam antibiotic (57.1%)

  • Exposure risk assessment of pesticide molinate using the RICEWQ model in a rice paddy plot was performed to observe the effects of various water and pesticide management scenarios. Several scenarios were developed to represent the specific water and pesticide management practices of rice cultivation in Korea. The results of the scenario analysis using the RICEWQ model simulation from the previous studies were analysed. The molinate risk for aquatic organisms is evaluated by the ratio of the predicted environmental concentration(PEC) and the predicted no-effect concentration(PNEC). The results showed that the no-effect periods for aquatic organisms for the deep, shallow and very shallow irrigation conditions were 33.3, 28.9 and 25.6 DATs for the lable rate application and 36.4, 33.7 and 30.8 DATs for the double lable rate application, respectively. The higher application rate showed greater exposure risk to the aquatic organisms. Based on this study, the withholding period of molinate practiced in Korea, that is 3 to 4 DATs, must be much longer. The results of this study can be used for the non-point source pollution control and environmental policy making regarding pesticides.

Comparative Water Relations of Two Vitis vinifera Cultivars, Riesling and Chardonnay

  • The leaf water relations and photosynthetic rate during acute soil drying were compared in potgrown grapevine cultivars, Vitis vinifera cv. Chardonnay and V. vinifera cv. Riesling. Leaf water potential in Riesling decreased significantly from day 2 after water had been withheld, while in Chardonnay leaf water potential for the water-stressed plants was almost identical with that in well watered plants during the first 4 days. Higher stomatal conductance and photosynthetic rate in Chardonnay than Riesling were observed until day 3 after withholding water. Photosynthetic rate in water-stressed Chardonnay was not different from that in control plants until day 3 after withholding water, while that in water-stressed Riesling was reduced markedly from day 2. In Riesling, osmotic potential at turgor loss point was not changed irrespective of watering conditions. However, in Chardonnay osmotic potential at turgor loss point decreased more in the water stressed conditions than in well watered conditions. The osmotic adjustment in Chardonnay under water stress conditions must contribute to the maintenance of higher stomatal conductance and photosynthetic rate than those in Riesling for a significant period of the drying process. Though difference in stomatal conductance between the two cultivars was shown in the process of soil drying, stomatal conductance of both cultivars responded to vapor pressure difference between leaf and ambient air, rather than soil water status and leaf water potential.

Attitude of Social workers toward Withdrawal 0f Life Sustaining Treatment

  • Purpose : This study is conducted to research the attitude of social workers toward withdrawing life sustaining treatment and compare and analyze the different types of their attitudes. Methods : Research design of this study is Q methodology approach. The study population is 23 social workers. Q sample to investigate the attitude of social workers toward withdrawing life sustaining treatment included 30 statements. After listening to the purpose and method of the study, the 23 social workers agreed to fill out a survey asking sociodemographic information and have been forced to be distributed in 9 scale Q-sample. Results : The collected data was processed through QUANL PC program, sorted into 3 types as followings. The first type was 'the pursuit of quality of life' that the quality of life is more important than the length of life, the second 'choosing to withdraw life sustaining treatment' that they want to write or encourage family to write advanced directive, the third 'withholding life sustaining treatment' regardless of the cost. Conclusion : In conclusion, the social workers attitudes toward withdrawing life sustaining treatment were grouped as three different types, the first type was 'the pursuit of quality of life', the second 'choosing to withdraw life sustaining treatment', the third 'withholding life sustaining treatment'.
