Imperial Nostalgia and the Detective Genre: Kazuo Ishiguro's When We Were Orphans

  • Kazuo Ishiguro's fifth novel When We Were Orphans (2000) tells the story of Christopher Banks, a private detective, who embarks on the ultimate case of his career, the puzzle of his own life. The novel consists of two overall parts, one taking place in London, the other in Shanghai-a division which reveals one of the novel's major themes, the relation between home and abroad. Set in the 1930s, Ishiguro's novel on the one hand contains all the classic ingredients of the so called golden age detective genre-an archetypal English private detective, equipped with fierce deductive skills and a magnifying glass, as well as suspects, criminals, and victims-and yet on the other hand it also deviates in significant ways. In this article, I will attempt to make some links between When We Were Orphans and the genre paradigm of the golden age detective story, arguing that Ishiguro's novel offers an exploration of the genre's ideological connections to a larger historical discourse of imperial nostalgia and decline.

Analysis of Actors' Interaction Patterns in the Formation Process of Sexual Crime Prevention Policy: Focusing on classification and case analysis (성범죄예방정책의 형성과정에서 행위자의 상호작용 패턴분석: 유형분류 및 사례분석을 중심으로)

  • The purpose of this study is to grasp the overall policy decision system of sex crime prevention policy and analyze the interaction and pattern of actors in policy formation process. This is a useful way to identify the causes and ways to improve the policy if the sex crime prevention policy fails. As a research method, we used a model of advocacy through case analysis and language network analysis. In the external environment, low reporting of sex offenses, technical improvement and supplement for preventive management, consciousness of victims of sexual crimes, amendment of legislation, and support of the president. The conflicts between the advocacy coalition opposed the strong regulation, the prevention of recidivism, the expansion of the range of objects to be worn, the temporary effect of the system and the retrospective of the bill. As a problem-solving strategy, it was confirmed that the opposing positions of pros and cons of lack of manpower and negligence of management through the extension of the system were acutely opposed. In the context of media reports, this tendency is more likely to be understood as the concern of prevention and management at the central government level to prevent sex crimes. Therefore, although the methods of prevention of sex crimes have been insufficient in the past, it is hoped that this study will be helpful in breaking the link of negative policy vicious cycle.

The Effect of Analytic-holistic Thinking Style on Intentionality Judgment: The role of crime typicality (분석적-종합적 사고 양식이 고의성 판단에 미치는 영향: 범죄 전형성의 역할)

  • This study was conducted to determine how analytic-holistic thinking style, one of the cultural characteristics, affects intentionality judgment and what role the crime typicality plays in the process. To this end, the psychological mechanism of intentionality judgment was confirmed in cases where the criminal typicality was manipulated by the moral characteristics of the crime perpetrator and victim. As a result, higher the criminal typicality lead to higher intentionality judgement. In addition, it was found that people with relatively holistic thinking style (with high causality and perception of change) judge less of the perpetrator intentionality. In particular, it was confirmed that the analytic-holistic thinking style interacts with criminal typicality and affects the intentionality judgment. Specifically, people with a holistic thinking style (high causality) judged the perpetrator to have high intentionality in typical cases, but judged in a reverse way in atypical cases. It means that, holistic thinkers, compared to analytic thinkers, strongly judge intentionality based on criminal typicality considering the moral characteristics of not only the perpetrators but also the victims. Along with the significance of this study, the relationships among analytic-holistic thinking style, criminal typicality and intentionality judgment were discussed.

Relationship Between Social Support Factors and Major Crimes in Korean Capital Area

  • Crimes must be reduced not only because of the financial, physical, and emotional damages they bring to the victims but also because crimes increase social costs by elevating distrust in society and instilling fear. With the increasing number of crimes in Korea, finding other factors that affect the occurrence of crimes is needed beyond the current viewpoint for crime analysis. Social support factors can be candidates for studies on the social support effect on crime occurrence in their initial stage. In this study, we identified the effect of social support factors on crime occurrence or deterrence, none of which has been considered important until now, given the emergence of spatial econometrics. The resulting Moran's I values revealed the existence of a spatial autocorrelation in all three crimes: heinous crimes, theft, and violence. As shown in the analysis using spatial econometrics and ordinary least squares, social support from families is significant in reducing all crimes especially violence. Social support from the local government is significant in preventing only theft. The spatial econometrics model is only valid in heinous crimes. These different effects of social support factors and spatial factors on crime occurrences are caused by the different characteristics of crimes. Hence, policymakers should consider the social support effect when they establish policies related to social housing or welfare.

A Study on Improving Support for Victims of Cyber-Violence (사이버 폭력의 피해자 지원에 대한 개선방안)

  • Recently, violence in cyberspace has been increasing and it causes not only severe emotional distress to the victims but also hampers a healthy cyber culture. This paper aims to find out about characteristics and the actual state of Cyber-Violence, and Evaluate the measures concerning it. Cyber crime is characterized as non face to face, anonymity, non-limitary, difficulties in attracting evidence, the Cyber Violence of these cyber crimes was shown in the form of cyber-insult, cyber-defamation, cyber-stalking, circulation of cyber-pornography, and that is the reality there are lack of practical measures. As a measure for protection the establishment of positive laws are needed on the cyber-contempt, adopting the Internet real-name system, strengthening the ISP's responsibility and legislation for criminal penalties. As a more fundamental measure, a greater effort of netizen's self-purification and systematic training and promotion for the prevention of damage is necessary.

Analysis of Korean Gamers' Personality Patterns with respect to the Victim/Attacker of the Misogyny and the Misandry in Game Playing (게임 내 이성 혐오 가해자와 피해자의 성격 패턴 분석)

  • As female gamers are rapidly increasing, the misogyny and the misandry in game playing situation are also increasing. Recent #Gamergate and GodGunbae incident exhibit that such discriminative/hate behaviour in game playing can be developed into real physical threat or crime. In this paper, we investigate and analyze young Korean game players on how the attackers group, victims group, and gender-issue-indifferent group behave differently in game playing through survey. We found that male gamers had high hostile sexism against female gamers especially on females' game attitude and streotyped hatred with respect to the gender ${\times}$ group interaction. In big-5 personality test, however, it is not clear if attackers and victims had a noticeable different personality patterns. In result, we verify that there exist gender stereotype and high hostile sexism among young Korean gamers. Active gender-equality education on their adolescent period is necessary to avoid such destructive hatred in game playing.

The Child Sexual Assaults by Kin -The Experience of YoungNam District Sunflower Center for Prevention of Child Sexual Assaults- (친족에 의한 아동 성폭력 실태 - 영남권역 해바라기 아동센터의 경험 -)

  • News from the media on sexual assaults to children committed by natural fathers doesn't attract social attention any more. The number of crimes related to Child Sexual Assault(CSA) is increasing every year in spite of the "Special Act on Prevention of Sexual Assault in Korea". The YoungNam District Sunflower Center for prevention of Child Sexual Assaults(SC-CSA) was established in Daegu, June 2005. The YoungNam District SC-CSA provides forensic evaluation of physical evidence, medical and psychological treatment for the victims less than 13 years of sexual assaults simultaneously. This study carried out 36 cases of CSA by kin reported to YoungNam District SC-CSA, among 180 cases in total until December 2006 since its opening. Most of the victims were girls (32 cases). 28 cases (78%) were indecent assaults (78%) and 8 cases (22%) were rapes. The assailants were overwhelmingly males (35 cases). The assailants of 21 cases (58.3%) were identified as the victims' natural fathers. The incident locations were victim's residence (31 cases, 86.1%) and the victims had been sexually assaulted regularly for many years (25 cases, 69.4%). Considering the above research, we can conclude that CSA committed by kin has specific characteristics. CSA is not a one-time incident, but consistently occurring crime. However, in 22 cases (61.1%), the victim's guardian didn't want to report about it or punish the assailants. As the assailants were natural fathers or relatives of the victims, the other family members probably thought it might be shameful to reveal their wrong doings and would lead to defamation of their family's reputation. The SC-CSA provides the counseling and medical treatment to the victims with the consent of the parents. Due to the guardians' misjudgment, the incident is sometimes not reported to the police. By not reporting the incident to the police, the assailant freely commits other crimes, which multiplies victims. The legal Act of supporting the management of the SC-CSA is still not regulated, so the stability of the SC-CSA is not guaranteed, yet. Even though it is obligatory to report incidents to the police, some cases are still not reported. Currently, there are three SC-CSA centers : in Seoul, in Daegu, and in Gwangju. More centers need to be established to diminish CSA cases in Korea.

A Study on the need of the Implementation for Criminal Penalty of Stalking (스토킹 처벌규정 도입의 필요성에 대한 고찰)

  • A stalking is becoming more diverse and the methods are developing over time as the society has changed over time due to the advancement of information technology but an initial countermeasure seems to be difficult as there is no sufficient legislations against such crimes as stalking. Our country passed laws regulating such stalking at 1999 and four more additional bills were proposed until the 18th National Assembly but they failed to become legalized. Two more additional bills were proposed during 19th National Assembly which are still pending. Crimes such as stalking violates and invades physical and psychological freedom of the victims and the crimes are severely inveterate and intentional. Advanced countries such as the United States, the Great Britain, Germany, and Japan enacted legislations that strictly regulates stalking and also appropriate responses. As these exemplary cases show, it is essential that our country also requires an effective legislations against crime of stalking and protecting a victim of the crime.

  • By reviewing relatively recent theory of coercive control, which considers gender as a key concept to conceptualize domestic violence, this article explores battered women's experiences with police responses and institutional law enforcement. Using data and interviews from Korea Women's Hotline, this article analyzes the effects of state intervention which fails to support battered women and sends a message to the community that domestic violence is not such a serious crime. Specifically, this study found some problematic responses and attitudes of police and legal system: first, police is equating domestic violence with physical attacks or serious harms. Second, police and law enforcement personnel blame victims based on her gender performance or gender roles. Third, by individualizing the problem of domestic violence, state intervention ignores important structural factors that cause and perpetuate it. Finally, police and the justice system disempower and discourage battered women by exacerbating victim's fears and risks. Viewing domestic violence as a liberty crime, this study concludes that enhanced understanding of the nature of domestic violence only can contribute to solving the problem and protecting women's human rights.

Research the Improvement for Cracking Down on Substandard Food Violations (불량식품 사범의 단속방안 개선에 관한 연구)

  • Recently, this government is implementing the "eradication of four social evils" policy to root out social evils which includes sexual violence, school violence, domestic violence and substandard food. In retrospect, these social evils are the crimes that have sprung from rapid social changes in Korea. These main four crimes not only badly affect certain victims but also spread their viciousness to broad population. Moreover, the prevention of the occurrence of the crime and the problem solving as an individual unit are hardly possible. Due to their critical effects and continuity, governmental safety policy enforcement is achieving higher support. As an alliance with the calling from the public for happier and safer life, this paper especially focus on regulating substandard food issue, according to the idea that food safety is an essential prerequisite for the healthy and happy life of the people. Through the reviewing, definition of the substandard food will be cleared and specified substandard food crimes will be introduced as well. And the paper will also pose questions in order to propose improved legal measures against the existing regulations, such as newly adding additional penalty article to food sanitation law.
