Purpose - This paper studies whether CISG can be a suitable governing law for pure service contracts. When CISG was first drafted, there was little disagreement on the fact that contracts for the sale of goods and those for the provision of services were two different types of contract. Based on this understanding, CISG explicitly provides that the Convention will apply to contracts where the preponderant part of the contractual obligation is on the sale of goods, not services. However, as more sales transactions have come to include more elements of services, mainly due to the advancement of the IoT industry, the distinction between goods and services became more blurred. Based on the observation of recent changes, some scholars even argue that such a change supports the applicability and suitability of CISG to even pure service contracts. The purpose of this paper is to critically analyze and evaluate their argument. Design/methodology - This paper focuses on two separate but related issues: CISG's 'applicability' and 'suitability' to service contracts. For the first issue, this paper will examine the rules of interpretation of international treaties under the Vienna Convention on the Law of Treaties of 1969, and will apply its rules to find the proper answer. For the second issue, this paper will perform logical and empirical analyses on the reasoning employed by scholars claiming the suitability of CISG to service contracts. Findings - This paper concludes that CISG does not, and should not, apply to pure service contracts. The argument that CISG applies to pure service contracts directly contravenes Article 3(2) of the Convention, which expressly states that it does not apply to a contract wherein the preponderant part of its obligation is about services rather than sales. Similarly, CISG is not a suitable governing law for pure service contracts because it aims provide rules specifically tailored to the needs of transactions of sales of goods, not services. Servitization of sales of goods transaction does not change this conclusion. Originality/value - This paper presents different views from those offered by some eminent scholars on the issue of applicability and suitability of CISG to service contracts. By doing so, it is hoped that the confusion caused in discussions so far are clarified. Hopefully, this paper can also provide practical guidance to practitioners engaged in the fields of international sales, services, and IoT industries.

Introduction: Although shift work is an inevitable form of labor in modern society, it has been identified as a cause of many ailments, such as cancer and musculoskeletal disorders. Meanwhile, previous studies have also shown that musculoskeletal disorders account for a large proportion of total industrial accidents and a high prevalence rate of these ailments has been found in shift workers. Methods: Among the respondents to the 5th Korea Working Conditions Survey(KWCS) 3,916 shift workers(2,658 of whom have not experienced musculoskeletal pain and 1,258 who have experienced musculoskeletal pain) were asked how the work regularity of shift workers affected musculoskeletal pain. Results: The results of a dichotomous logistic regression by correcting the demographic characteristics of the study subjects showed a lower prevalence of musculoskeletal pain in the 'High' regularity group compared to the 'Intermediate' regularity group for the criterion 'Regularity of Time Fixation'. A lower prevalence of musculoskeletal pain was shown in the 'High' and 'Moderate' regularity group compared to the 'Very Low' regularity one. Conclusions: Based on these findings, it was found that musculoskeletal pain occurs less when the work regularity of shift workers is 'Very high' or 'Intermediate', and the effect of working regularity on musculoskeletal pain varies for each shift type of work. It is deemed that more precise observation and understanding are required when managing the working environment of shift workers, and further study of regarding this issue is needed.

Besides the changeable disease during the 24 solar terms is related to climatic change produced by movements of heavenly bodies. Purpose: The aim of this paper is to reduce the stress and the disturbance occur in selective action of patient. This article will also help us to control spreading and reduce the order and bacteria produced by leprosy disease among the lepers. This will be achieved with the help of several variables and these variables help us on health benefits is 5S (Sort, Straighten, Shine, Standardize, Sustain) i.e. ratio of sectional morphology, lessor 90 degree angles, day light, universal design building and maximum ventilation. The replies from the questionnaire were collected based on varying levels of satisfaction and gloominess on the scale of 1-10. Methods: The multi-layer methodological framework for maximising the healing environment obtained from the observation of schemes and parameters of ANOVA: (Analysis Of Variance between five deciding factors) are. Firstly applied for the calculation of the patient's satisfaction for U.V light from sun on ECOTECT simulation, secondly the number of $90^{\circ}$ angle, along the corridors. Thirdly understanding the ways to represent people's perceptual structures and way finding with Space Syntax software. Fourthly the ratio of depth to height of the building typology and finally interviewing the subjects describing their special experiences based on scale value. The focus of this testing of human subjects was to receive data for the existence of image scheme in way-finding and to identify the mechanisms by which sun light impacts human (lepers) health. Results: AMPVA studies concluded that there is similarity between I and O plan as well as L and H plan whereas U plan was difference among the five selected architectural shapes. Implications: The purpose of this research is to show the effects of the I-type, L-type, C-type, U-type and O-type plan design, and to analyse the morphology for EBD (Evidence-Based Design) healing environment which is a universal design for Munghopir Karachi, in Pakistan.
Dental caries is the most common disease in the maxillofacial area. There are many factors contributing to its development, but complete understanding and prevention is not fully known. Since the structure of the coronal and root portion of the tooth is different, the remineralization and demineralization process is also known to be different. In this study, by using a partially saturated buffer solution, we created artificial enamel and dentin caries and evaluated mineral loss. A remineralization solution with four different degrees of saturation (degree of saturation ; group 1, 0.268, group 2, 0.309, group 3, 0.339, group 4, 0.390, PH 4.3, F-2ppm) was used on a demineralized specimen. The mineral precipitating quantity and depth was evaluated by using microradiography. Using an atomic force microscope (AFM), hydroxyapatite crystals of normal, demineralized, and remineralized enamel and dentin were evaluated. The results were as follows: 1. As the degree of saturation of the remineralizing solution increased, the mineral precipitation in the enamel was increased. In group 4, mineral precipitation was limited near the surface. 2. As the degree of saturation of the remineralizing solution increased, the mineral precipitation in the dentin was decreased and it occurred in a deeper portion. In group 4, however, mineral precipitation occurred on the surface and its quantity increased. 3. There was a statistically significant interaction between enamel and dentin mineral content changes on specimens treated with remineralization and demineralization solution (demineralization r=0.44, remineralization r=0.44, p<0.05). 4. Demineralized hydroxyapatite crystals showed central and peripheral dissolving and widening of intercrystal spaces under the AFM. 5. In dentin remineralization small crystal precipitation occurred between the large crystals. We conclude that by adjusting acidulated buffer solution's degree of saturation, we can control enamel and dentin remineralization. In addition, the AFM is highly useful in evaluating changes in remineralized and demineralized hydroxyapatite crystals.
The purpose of this study is to seek improvement in clothing life education through a development and application of the clothing life education program for middle schools based on the education and experience in arts & culture. On the basis of art & culture education as well as, Dewey's experience, the clothing life area education program was designed and developed for the 2nd year students in the middle school. This program was applied to 350 students of 9 2nd year classes in M middle school during the 17 periods of clothing life area classes, beginning from May 23rd, 2011 and lasting to September 30th, 2011. The leaner-evaluation was performed in terms of the level of learning interest and academic achievement. To measure the level of academic achievement, a mind-map evaluation was performed and a learning effect survey, which evaluates the level of achievement of learning objectives, was carried out. For the purpose of class observation, classes were filmed and analyzed. Characteristics of a class were recorded on a teacher's diary and was used to support the qualitative evaluation. According to the results, the education program is analyzed as being helpful and useful in student understanding of fiber, textile and, clothes, which are materials and outcomes of culture and art; moreover, they have a historical, cultural and artistic value in themselves. It is also analyzed as being helpful for the development of student aesthetic sensibility and emotion, for the construction of meaningful experience through a learning process, for the improvement of learning interest and the level of academic achievement, and for the positive recognition of the learning effect.
This study is about Le Corbusier's early years of loarning and training at La Chaux-de-Fonds. It is an attempt to show how Le Corbusier's groundwork was laid which characterize his work throughout the life. Charles Edouard Jeanneret was trained as a watch engraver and wished to be a painter. C. L'Eplattenier was to play a decisive role in shaping the young introspective boy's future. He encouraged Jeanneret's habit of the close study and observation of nature. Jeanneret was not the product of an established school, but instead made the unusual choice of educating himself. He found two indispensible sources of inspiration in study the past and in contemplating nature. His four years of self-education consisted of extensive reading, summer travels and winter layovers in larger cities-Vienna, Paris, Berlin-while sketching in museums or apprenticing local architects-Pellet, Behrens-. All these impressions then blended together to become part of a comprehensive source book of knowledge and imagination of the later Le Corbusier. A largely self-taught man, he never stopped making notes, drawing and writing, always aspiring to a clearer understanding of the meaning and underlying principles of objects and architecture. Jeanneret's five villas in La Chaux-de-Fonds are barometers which show the sequences of his development and change as an architect. In 1917, being thirty, he uprooted himself from his hometown to get a wider range of opportunities and moved to Paris. By that time Jeanneret was almost ready to blossom into Le Corbusier It was during this formative years of his life that Le Corbusier established the working method, mind-set and philosophical basis that determined the course of an architect in the making.
The astronomical understanding of the heavens in "Hwangje-Naegyeong" can be divided into three main fields: the theory of cosmos, astronomy and calender. "Hwangie-Naegyeong" comprised the theory of cosmos, astronomy and calender established in the Han period. Astronomy was to describe the heavenly world and to interpret its phenomena. Calendar was to make numerical representations of the observations of all kinds of celestial bodies and to give them number-mystical meanings. Theory of cosmos treated what ancient Chinese speculated on the structure of the heavens including the earth. These three fields developed independently. However, they can also be be combined into one tradition, the astronomical knowledge. In the Han period that the astronomical knowledge grew from the mere accumulation of primitive knowledge to the established form. Throughout the Chinese history, the essential contents of astronomical knowledge including the theory of calendar, did not change much from what they were in Han period. "Hwangje-Naegyeong" use the lunisolar calendar(太陰太陽曆) and the Calendar in the late Han period(後漢四分曆). The use of the subdivisions of the seasons(24節氣) and the leap month(閏月) in "Hwangje-Naegyeong" means that it adopted the lunisolar calendar. The purpose of this study was to explain the influence of motivation, leadership, and discipline on the performance of the midwife at Sharia Hospital X in Central Java Indonesia before the Covid-19 pandemic. This research is a combination between quantitative research and qualitative research (mix method). The population in this study were all midwives sharia hospital x in central java Indonesia, totaling 75 people. The primary data in this study came from questionnaires, interviews, observation, and documentation, then from the results of the analysis and data processing the researcher interpreted it more deeply using qualitative methods. The results of this study conclude that motivation, leadership, and discipline are proven to have a positive and significant effect on the performance of midwives, thus it can be concluded that an increase in motivation, leadership, and discipline in work will be able to improve the performance of the midwifes Sharia Hospital X. These results give an understanding that every time there is an increase in motivation, leadership, and work discipline, it will increase the performance of the midwifes. Motivation is the biggest variable affecting the performance, leadership is the second and work discipline is the smallest variable that affects the performance of midwives.
The purpose of this research is to reveal the essential meaning of deviant peer through Phenomenological approach method on experiences of the teenagers. For an in-depth understanding of the experience world of the teenagers, researcher sought the essential meaning structure about the four Life-world Existentials of constructing human's live-world. Data had been collected through the researcher, the participants' observation, field note, content analysis, as well as in-depth interview "With them. Based on an analytical process of hermeneutical phenomenology of van Manen, researcher analysed essential meanings of the data in light of the four Existential categories through separating thematic statement, decision of essential theme and rewriting. The structure of the deviant peer experienced by the teenagers has been analyzed by the hermeneutical phenomenology so as to extract 28 composition meanings, 30 phenomenon and 18 structure of experience. The results examined by each theme are as follows. This study demonstrates that essential meaning structure of the study participants in the world is the experience of boundary, alert'.
