A Study on the Global Strategy and Challenges of Paperless Trade in Korea (한국 전자무역의 글로벌 전략과 과제에 관한 연구)

  • Paperless trade is a new trade paradigm that has innovated on traditional trade procedures, which relied on manual work in the past, and applied an IT-based e-document standard. To realize paperless trade in Korea, a lot of efforts have been made. Korea has overcome many difficulties, a lack of awareness, trials and errors, etc. at the initial introduction stage and strived to establish a stable infrastructure through the government's policy support and active cooperation with the trade business communities and related organizations. Now, Korea became a well-known leader in IT industry, especially in the paperless trade infrastructure and strategic policies. The one-stop trading system named 'uTradeHub' is operated by a paperless trade service provider, Korea Trade Network(KTNET). uTradeHub includes trade finance and settlement, customs clearance and export and import logistics, improving trading procedures and reducing related expenses. Private-Public joint efforts from Korean government and private sectors which have respectively fulfilled their role and function with market-oriented practical policies and strategies has lead Korea a world leading country in paperless trade. Moreover, Korea expended its efforts to the global areas. Korea has started to activate multi-national paperless trade alliances such as PAA(Pan-Asia e-Commerce Alliance), ASEAL(Asia Europe Alliance for Paperless Trading) as well as established the bilateral cooperative networks with China and Taiwan. The one-stop trading system, uTradeHub should keep close cooperations between nations since trade itself is implemented in a cross-border ways. In the near future, it is expected uTradeHub can achieve best results in the simplification of procedures and cost savings when an international linkage is completely established with international cooperations.

  • The aim of this research is to develop a new business model using mobile RFID in exhibition spaces such as museums and art galleries. Using mobile RFID, the exhibition space is expected to be evolved from a simple media space only for the exhibition to an extended space integrating media, commerce and entertainment. This paper proposes a u-Exhibition business model and its scenario in the u-Exhibition space. We discuss the real-world issues for the implementation and show the ways of investigating working conditions for the business model through revenue simulation and analyzing the expected value of tag installed on the exhibition space by so-called 'tag evaluation model.'

  • Lately, electronic commerce through the Internet has been rising in attention. An important element in such commerce is EDI. EDI is mainly used with VAN but its use is not common due to the high cost of EDI transfer. Thus, only large corporations with frequent use of EDI are able U benefit from it, To smaller companies that have small usage, EDI is becoming a burden. Considering this fact as well as current changes within the enterprise environment, it is apparent that a new generation of EDI is required. To resolve the problems of VAN EDI, the proposed Internal EDI was implemented. Internet EDI deals with the use of the widely spread Internet instead of VAN. By using Internet EDI, it is possible to reduce the high cost that came when using VAN. There would be no extra transfer cost since transmission will be done through the Internet. Also, electronic commerce that is mostly used today between an individual and a company may grow to become a true electronic commerce between companies.

  • Two kinds of security devices such as independent guarantees and standby letters of credit have been widely used in the international transactions. These devices design to protect one of the parties from a breach by its counter-party. Main uses of these guarantees and standby letters of credit are as follows : bid guarantee, performance guarantee, advance payment guarantee, payment guarantee, retention guarantee, etc. The standby letters of credit were first invented in the U.S.A. and have been widely used in the international and domestic contracts in the U.S.A. But the practical use of these credits is very unsatisfactory in Korea. The purpose of this study is to serve the increase of practical use of the standby letters of credit in Korea through the comparison study on the practical use of the credits between Korea and the U.S.A. Both devices are very similar in function, but they are very different in forms. The one has the form of letter of credits but the other has the form of guarantee. The letter of credit has the stability of governing rule, the legal certainty, and the preference in the field of the trade community comparing to the guarantee. I recommend to use standby letter of credit instead of bank guarantee in international transactions because of the merits of the credit aforesaid.

  • This paper investigates the difference of writing requirements between the UCC2. and the UN convention on international sales of goods (CISG). To do it, the U.S writing requirement by statute of frauds was introduced by two sources of laws including common law and UCC${\S}$2-201. Although the U.S. statute of frauds requires some contract to be written with formalities, the way the requirement is satisfied is quite flexible in terms of its formalities. The UCC is more flexible than the common law in its formalities. The CISG does not require the sales contract to be written with any format, which is totally different from the U.S statue of frauds. Such differences between the U.S laws and CISG in writing requirement were investigated in the context of conflicts of laws.

  • At present, the scale of Electronic Commerce through internet has been rapidly increasing due to the development of information & communication technology, and aggregated to 2.4 billion dollar in America last year (1998). The market scale of worldwide electronic commerce is also presumed to be about 130 billion dollar in 2000, and to occupy more than 20% of the whole world trade in world 2020. Since the right of trademark, despite of being effective only in registered nations on the principle of territorialism, is unified on the cyber space of internet without domestic barrier or local limitation which make it easier to conduct the distribution of information rapidly through the address-internet domain name, those are very important that the systematic dispute-solving plan on problems such as decision of its Act and international jurisdiction to be established, in an effort to prevent the newly emerging dispute instances such as trademark infringement and improper competitiveness. In addition, it is natural that on the threshold of the electronic commerce age which formed with an unified area without the worldwide specific regulation, each country including us makes haste with the enactment of "electronic commerce Act" aiming at coming into force in 1999, in keeping with getting through "non-tariff law on electronic commerce" by U. S. parliament on May, 1998. In view of the properties of electronic commerce transactions through internet, there are the large curtailment of distributive channel, surmounting of restrictions on transaction area, space and time and the easy feedback with consumer and the cheap-required capital, from which the problems may arise - registration of trademark, the trademark infringement of domain name and the protection of prestigious trademark. Therefore, it is necessary to take the counter-measure, with a view of reviewing the infringement of trademark and domain name and the instances of each national precedent and to preventing the disputes. The improvement of the persistent system should be needed to propel the harmonious protection of those holding trademark right's credit and demanders' expectant profit by way of the righteous use of trademark.

Dynamics of Crude Oil and Real Exchange Rate in India

  • This scholarly work is an effort to capture the effects of oil prices on the actual exchange rate between dollar and rupee. This is done with reference to the U.S. dollar as oil prices are marked in USD (U.S. Dollar) in the international market, and India is among the top five importers of oil. Using monthly data from January 2001 to May 2020. The study used the real GDP, money supply, short-term interest rate difference between two countries, and inflation apart from the crude oil prices per barrel as the factors that help define the exchange rate. The analysis, through cointegration and vector error correction method (VECM), suggests long and short-run causality amid prices of oil and the rate of exchange fluctuations. Oil prices are found to be negatively related to the exchange rate in the long term but positively related in the short term. The result of the Wald test also indicates the short-run causation from the short-term interest rate and the prices of crude oil towards the exchange rate. The present study shows that oil prices are evidence of the existence of short-term and long-term driving associations with short-term interest rates and exchange rates.

  • 9.11 terrors which happen in 2001 in the U.S. recognize importance about national security and Department of Commerce, country safety department, Federal Communication Commission(FCC) etc. are establishing RFID sticking plan in harbor exit and entrance container for this, and it is real condition that is preparing preparation of law and system that establishes harbor peace law(Safe Port Act) on October, 2006 and acts on for U.S. about container load cargo Europe and Asia each countries. These law and system is logistics security that strengthen search for import and export freight and security to main contents. To meet in these circumstance subsequent, this paper is to examine the following three themes. First, examined necessity of logistics security and logistics security strengthening tendency, and second, examined in achievement of logistics business and RFID, and third, presented logistics security process that utilize change of realization about logistics security and RFID's role for logistics security. Through upper investigation, this paper suggested the realization about logistics security raising, logistics security connection system construction by export step, real-time freight chase that use RFID, construction necessity of executive system and development of logistics security equipment required.

Potentials for Uniform Treatments of E-Commerce

  • The Internet is a wonderland that can be enjoyed by the young, old, and those in-between. It is also a vast commercial market where many contracts are formed every second. The Internet and E-Commerce have created new situations that have generated sweeping proposals for fundamental changes in contract law. During the first half of the 20th Century. when many businesses expanded their geographic scope, there was a tremendous desire for uniform treatment of contracts for the sale of goods throughout the U.S.A. and the whole world. That same dynamic is now occurring in E-Commerce. There is a general recognition of the desirability of uniform contract law to govern E-commerce, but to date that does not exist, though there are extensive proposals for reform of contract law on the Internet. E-Commerce is currently plagued by some of the same problems that led to the passage of the UCC. In the absence of uniform legislation, state-by-state differences are inevitable with respect to E-Commerce. State-by-state differences in E-Commerce contract law is widely viewed as undesirable. To deal with this problem, a number of uniform bills have been proposed including UCITA, UETA, and revisions to Article 2 of the UCC (Subpart B). The thrust of these uniform acts is to create legal parity between paper records and electronic records. There is considerable resistance by consumer groups to this parity and progress towards Passage of UCITA, UETA, and revised Article 2 has been slow. The UCITA covers licenses of computer software but does not cover the sale oil goods on the Internet. The scope of the UCITA includes computer software. multimedia interactive products, computer data and databases, and Internet and online information, The UETA deals comprehensively with E-Commerce and contract law. The UCC covers the sale of goods, which does not necessarily involve E-Commerce. The basic principles of contract law are modified to deal with Internet transactions. Intent is inferred from the operations of electronic agents and "signatures" can occur with a response to an invitation to click to accept.
