A Study on Crime Victims' Right to State (범죄피해자의 진술권리에 관한 연구)

  • It was just over 20 years ago that the victim who had been seen as the forgotten man in criminal justice system for a long time started to participate in criminal proceedings and state his opinion. Other countries such as America and Japan provide crime victims with the opportunity to state freely about facts of damage as well as their opinions in criminal proceedings at present. However, Korea gives the victim the right of statement as a witness, though the statement of crime victim's opinion is the constitutional right. That is, as crime victims are not free from perjury they cannot actively state their views. Meanwhile, if the freedom of crime victims' statement is guaranteed in law and victims can state opinions with their own voice, victims' statement of opinion will help the victims treat and relieve their psychological damages. For these reasons, it is desirable that Korea, like the U.S. and Japan, gives crime victims the right to state their opinion without fear of perjury in criminal proceedings not as witnesses but as the aggrieved party.

Subjectivity of Nausea and Vomiting of Pregnancy(NVP) in woman: Q Methodology (여성의 입덧 경험에 대한 주관성 연구)

  • Purpose: The purpose of this study was to explore the subjective opinions related to NVP experience in woman. Method: The research method used was Q-methodology. The statement of self-reference was derived from face to face interviews with 10 womans. Statement were categorized by researcher according to semantics. Twenty-seven of the self reference statement from categories of the Q-population were selected. Twenty-five of pregnant womans were selected by consideration of diversity in sociodemographic background. Based on a 1 to 9 point scale, the selected pregnant womans were made to participate in. Q-sorting. Analysis of Q-type was obtained by use of the QUANAL program. Result: There are three type of NVP experience of Korean womans. The first type focused on family support relate to NVP coping. The second type focused on physical self regulation related to NVP coping. The third type focused on actual strategy related to NVP coping. Conclusion: It is suggested that the results of this study may contribute to the development strategies for the purpose of decreasing the incidence of NVP.

Opinions on the Recovery of Outpatients with Schizophrenia and Their Wills to Recover (조현병 외래환자의 회복에 대한 견해와 회복 의지)

  • Objectives: To examine the opinions regarding recovery and assess their will to recover in outpatients with schizophrenia. Methods: Total 98 stable outpatients with schizophrenia were enrolled. To investigate the outpatients' opinions regarding recovery, we asked the subjects to write down the ways they could think they had recovered from their current disease. We classified their answers and chose final 39 statements. Using this questionnaire, they were asked to what extent they agreed with each statement. Moreover, the Recovery Assessment Scale (RAS) was used to measure the subjects' will to recover. Results: Many of the 39 subjects who were surveyed about their opinions on recovery agreed on 11 statements about taking medicine, social life, daily life, social functioning, positivity about life (happiness, hope, confidence, and tranquility), symptoms, occupation, and self-control. The RAS score showed a significant correlation with age (r=-0.26, p<0.01), age at onset (r=0.26, p<0.01), duration of illness (r=-0.52, p<0.01), and number of hospitalization (r=-0.46, p<0.01). Conclusion: This study shows that positivity about life is an important part of the patients' subjective recovery criteria in schizophrenia. Therefore, if clinicians pay more attention to this part of subjective recovery, it would strengthen the patients' will for recovery.

A Study into Pattern of Smoking Cessation Behavior of Smokers (남성 흡연자의 금연에 대한 주관성 연구)

  • The purpose of this study was to explore the subjective opinions related to of smoking cessation behavior of smokers. The research period was from Nov. 1, 1998 to May. 7. 1999. The research method used was Q-methodology. The process of the research was as follows : 1. Collection of concourse The statement of self-reference was derived from face to face interviews with 15 adult smokers Statement were categorized by researcher according to semantics 2. Extraction of Q-sample 30 of the self reference statement from categories of the Q-population were selected. 3. Selection of P-sample 31 of smokers were selected by consideration of diversity in sociodemographic background. 4. Based on a 1 to 9 point scale, the selected university students were made to participate in Q-sorting. 5. Analysis of Q-type was obtained by use of the QUANAL program. The results of this study reavealed as follows : There are three type of smoking cessation behavior of Korean smokers. 1. The first type focused on one's own initiative to smoking cessation. 2. The second type focused on environmental factor related to smoking cessation. 3. The third type was habitual smoker. They adhere to smoke and are not ready to smoking cessation. It is suggested that the results of this study may contribute to the development strategies for the purpose of increasing the incidence of smoking cessation of smokers

Korean Quality Assessment Criteria for Statement Analysis Reports and Testimony (한국 진술분석 보고서 및 증언에 대한 질적 평가 기준)

  • Statement analysis is a technique that examines the credibility of a statement by scientifically analyzing problems and psychological characteristics that appear in the content of the statement. The statement analysis report is prepared, submitted, and used for legal judgments when there is a suspicion of sexual abuse for children(under 13 years of age) and persons with disabilities since it is usually difficult to secure physical evidence nor eyewitnesses. However, the criteria for evaluating the quality of a statement analysis report or testimony are not available in Korea. Although forensic experts and professional organizations in North America and Europe are providing recommendations and guidelines for preparing forensic assessment reports, qualitative analysis research studies for forensic reports revealed a number of problems such as missing or poorly described essential information and lack of logical connection between evaluation results and forensic opinions. Therefore, forensic evaluation guidelines and forensic reports submitted to the courts in the United States, as well as the Structured Quality assessment of eXpert testimony (SQX-12) developed in Sweden were examined to suggest the Korean version of quality evaluation criteria for statement analysis report and testimony. This criteria can be used to improve effectiveness of forensic reports within criminal justice system and used as a guideline to assess the quality forensic reports or expert testimony prepared by experts. However, this criteria do not guarantee the reliability of the statement itself.

A Study on the Improvement and Problems of Environmental Impact Assessment (환경영향평가 내용의 문제점과 개선방안 -문화재항목의 영향평가를 중심으로-)

  • The objective of this study is to prepare a proposal for desired changes in the laws and regulations system of the Environmental Impact Assessment (EIA) about cultural assets preservation. The related Korean regulatory system and literature for EIA have been surveyed and case studies have been analyzed and actual cases where cultural assets protection were of issue have been studied to deduce the problems of those areas. Based on the result of this study, proposed changes are as follows; 1. "Status of cultural Assets" is to be included as common assessment factor for all categories of object projects in "Table 2: Essential Assessment Factors for Individual Project Category" of "Ordinance for Preparation of EIA Statement, etc." 2. "Status of Underground Cultural Assets and Potential Underground Cultural Assets" is to be inserted as a survey factor in "Table 3:Format of and Instruction for Impact Statement". 3. The clause of "-- the survey should be performed on-site and the investigation report should be submitted." is to be inserted in methods of survey in "Table 3". 4. Ground survey of cultural assets should be performed prior to completion of project planning, that is, from the stage of pre-study for site selection. 5. The application of impact abatement from "Methods and Plants for Impacts Abatement" of "Report for Development of EIA Statement Technologies" should be included, with proper modification of timing, in "Ordinance for Preparation of EIA Statement, etc." 6. The expense liability clause in "Cultural Assets Preservation Act" is to be revised as "a certain ratio of expenses for excavation should be borne by the government." 7. Regulatory device for collecting appropriate opinions should be established. It may include Cultural Assets Preservation Committee's hearing to the project owner's opinion. be established. Research on the Financial Data Fraud Detection of Chinese Listed Enterprises by Integrating Audit Opinions

  • Financial fraud undermines the sustainable development of financial markets. Financial statements can be regarded as the key source of information to obtain the operating conditions of listed companies. Current research focuses more on mining financial digital data instead of looking into text data. However, text data can reveal emotional information, which is an important basis for detecting financial fraud. The audit opinion of the financial statement is especially the fair opinion of a certified public accountant on the quality of enterprise financial reports. Therefore, this research was carried out by using the data features of 4,153 listed companies' financial annual reports and audits of text opinions in the past six years, and the paper puts forward a financial fraud detection model integrating audit opinions. First, the financial data index database and audit opinion text database were built. Second, digitized audit opinions with deep learning Bert model was employed. Finally, both the extracted audit numerical characteristics and the financial numerical indicators were used as the training data of the LightGBM model. What is worth paying attention to is that the imbalanced distribution of sample labels is also one of the focuses of financial fraud research. To solve this problem, data enhancement and Focal Loss feature learning functions were used in data processing and model training respectively. The experimental results show that compared with the conventional financial fraud detection model, the performance of the proposed model is improved greatly, with Area Under the Curve (AUC) and Accuracy reaching 81.42% and 78.15%, respectively.

  • The purpose of this study was to explore the subjective opinions related to of smoking behavior of university students with a history of smoking. The research period was from Feb, 1. 1996 to Sep. 10. 1997. The research method used was Q-methodology. The process of the research was as follows : 1. Collection of concourse : The statement of self-reference was derived from face to face interviews with 50 university students. Statement were categorized by researcher according to semantics. 2. Extraction of Q-sample : 38 of the self-reference statements from the 32 categories of the Q-population were selected. 3. Selection of P-sample : 30 of university students were selected by consideration of diversity in sociodemographic background. 4. Based on a 1 to 9 point scale, the selected university students were made to participate in Q-sorting. 5. Analysis of Q-type was obtained by use of the QUANAL program. The results of this study revealed as follows : There are three types of smoking behavior of Korean university students. 1. The first type focused on the right of the individual to smoke and the lack of recognition of smoking behavior as a health hazard. 2. The second type cared about smoking behavior as a hazard to health. 3. The third type was habitual smoker. They are bored and smoke habitually. It is suggested that the results of this study may contribute to the development of strategies for the purpose of decreasing the incidence of smoking of university students.

  • The utility and accuracy of intraoperative neurophysiological monitoring (IONM) has evolved greatly following the recent development of new devices for neurophysiological testing and advances in anesthesiology. Until recently, the need for IONM services has been limited to large academic hospitals, but the demand for neurophysiologists with expertise in IONM has grown rapidly across diverse types of hospital. The primary goal of the Korean Society of Intraoperative Neurophysiological Monitoring (KSION) is to promote the development of IONM research groups and to contribute to the improvement of fellowship among members and human health through academic projects. These guidelines are based on extensive literature reviews, recruitment of expert opinions, and consensus among KSION board members. This version of the guidelines was fully approved by the KSION, Korean Association of EMG Electrodiagnostic Medicine, the Korean Society of Clinical Neurophysiology, the Korean Academy of Rehabilitation Medicine, and the Korean Neurological Association.

  • The trend of Bring Your Own Device (BYOD) is gaining popularity all over the world with its innumerable benefits such as financial gain, greater employee satisfaction, better job efficiency, boosted morale, and improved flexibility. However, this unstoppable and inevitable trend also brings its own challenges and risks while managing and controlling corporate data and networks. BYOD is vulnerable to attacks by viruses, malware, or spyware that can reach sensitive data and disclose information, modify access policies, disrupt services, create financial issues, minimise productivity, and entail some legal implications. The key focus of this research is how Saudi Arabia has approached BYOD with the help of their 5-step solution model and quantitative research methodology. The result of this study is a statement about what users know about this trend, their opinions about it, and suggestion to increase the employee awareness.
