Constitutional Legitimacy of the Maritime Cadet Training System : Justifiable Restrictions on the Cadet's Fundamental Rights at the College of Maritime Science of the KMOU (해사대학 승선생활교육의 헌법상 기본권제한에 관한 연구 - 한국해양대학교 해사대학을 중심으로 -)

  • This paper involves the constitutionality of the restrictive by-laws established by the 'College of Maritime Science' at the 'Korea Maritime and Ocean University' when they affect the cadet's fundamental rights, particularly, in connection with the training system of the 'Merchant Cadet Dormitory.' The issue in question is whether the school regulations may fall within a judicially permissible boundary in light of the general principles of constitutional rights in that the rules are enacted by the school itself in accordance with the Article 31, Section 4 of the Constitution and largely regulate the cadets' living conditions on a campus. However, the general scrutiny standard the courts apply requires the school enactments to pass three tests to be justified: (1) legislative authorization, (2) proportionality and (3) non-infringement on the essential elements of the fundamental rights as articulated under Article 37, Section 2 of the Constitution. The review in this paper shows that, first, the by-laws at issue find themselves statutorily authorized by the 'Higher Education Act' and the 'Decree of the Establishment of National Schools', with the proportionality as a second part observed within a justifiable scope and the essential elements of the fundamental rights as the third point not being marred. In conclusion, the school's dormitory training system is not found to cross the line and, however, the school authorities still need to keep overseeing the overall training course to secure the constitutional proportionality.

On-line Handwriting Chinese Character Recognition for PDA Using a Unit Reconstruction Method (유닛 재구성 방법을 이용한 PDA용 온라인 필기체 한자 인식)

  • In this paper, we propose the realization of on-line handwritten Chinese character recognition for mobile personal digital assistants (PDA). We focus on the development of an algorithm having a high recognition performance under the restriction that PDA requires small memory storage and less computational complexity in comparison with PC. Therefore, we use index matching method having computational advantage for fast recognition and we suggest a unit reconstruction method to minimize the memory size to store the character models and to accomodate the various changes in stroke order and stroke number of each person in handwriting Chinese characters. We set up standard model consisting of 1800 characters using a set of pre-defined units. Input data are measured by similarity among candidate characters selected on the basis of stroke numbers and region features after preprocessing and feature extracting. We consider 1800 Chinese characters adopted in the middle and high school in Korea. We take character sets of five person, written in printed style, irrespective of stroke ordering and stroke numbers. As experimental results, we obtained an average recognition time of 0.16 second per character and the successful recognition rate of 94.3% with MIPS R4000 CPU in PDA.

Effectiveness of Cognitive Behavioral Therapy Techniques for Control of Pain in Lung Cancer Patients: An Integrated Review

  • Background: Experience of lung cancer includes negative impacts on both physical and psychological health. Pain is one of the negative experiences of lung cancer. Cognitive behavioral therapy techniques are often recommended as treatments for lung cancer pain. The objective of this review was to synthesize the evidence on the effectiveness of cognitive behavioral therapy techniques in treating lung cancer pain. This review considered studies that included lung cancer patients who were required to 1) be at least 18 years old; 2) speak and read English or Thai; 3) have a life expectancy of at least two months; 4) experience daily cancer pain requiring an opioid medication; 5) have a positive response to opioid medication; 6) have "average or usual" pain between 4 and 7 on a scale of 0-10 for the day before the clinic visit or for a typical day; and 7) able to participate in a pain evaluation and treatment program. This review considered studies to examine interventions for use in treatment of pain in lung cancer patients, including: biofeedback, cognitive/attentional distraction, imagery, hypnosis, and meditation. Any randomized controlled trials (RCTs) that examined cognitive behavioral therapy techniques for pain specifically in lung cancer patients were included. In the absence of RCTs, quasi-experimental designs were reviewed for possible conclusion in a narrative summary. Outcome measures were pain intensity before and after cognitive behavioural therapy techniques. The search strategy aimed to find both published and unpublished literature. A three-step search was utilised by using identified keywords and text term. An initial limited search of MEDLINE and CINAHL was undertaken followed by analysis of the text words contained in the title and abstract, and of the index terms used to describe the article. A second search using all the identified keywords and index terms was then undertaken across all included databases. Thirdly, the reference list of all identified reports and articles were searched for additional studies. Searches were conducted during January 1991- March 2014 limited to English and Thai languages with no date restriction. Materials and Methods: All studies that met the inclusion criteria were assessed for methodological quality by three reviewers using a standardized critical appraisal tool from the Joanna Briggs Institute (JBI). Three reviewers extracted data independently, using a standardized data extraction tool from the Joanna Briggs Institute (JBI). Ideally for quantitative data meta-analysis was to be conducted where all results were subject to double data entry. Odds ratios (for categorical data) and weighted mean differences (for continuous data) and their 95% confidence intervals were to be calculated for analysis and heterogeneity was to be assessed using the standard Chi-square. Where statistical pooling was not possible the finding were be presented in narrative form. Results: There were no studies located that met the inclusion requirements of this review. There were also no text and opinion pieces that were specific to cognitive behavioral therapy techniques pain and lung cancer patients.Conclusions: There is currently no evidence available to determine the effectiveness of cognitive behavioural therapy techniques for pain in lung cancer patients.

A Comparative Study on Business Ecosystem of Samsung and Xiaomi: Focus on CPND Value Chain of IoT Industry (삼성과 샤오미의 기업생태계 비교 연구: IoT 산업의 CPND 가치사슬을 중심으로)

  • In response to changes in the global market environment, companies in the Information and Communications Technology (ICT) industry have begun to pursue cooperation and competition on a business ecosystem level. In particular, to become a leader in the new growth engine industry of Internet of Things (IoT), companies around the globe aim to consolidate vertically up the value chain through a solid establishment of their platforms. This paper looks at Samsung and Xiaomi, whose strategies for creating an ecosystem based on their own platforms differ in accordance to the ecosystem in which they compete. An analysis of these two companies indicate that Samsung pursues a strategy to become the market standard by openly sharing its platform with complementary companies, whereas Xiaomi pursues a strategy that achieves value as a channel owner through the restriction on which companies may become partners. This paper concludes that as Samsung and Xiaomi strive to become IoT industry leaders, each company pursues a variant of a platform-based value chain integration strategy based on the specific nature of the ecosystems in which they compete, thereby creating value through a symbiotic relationship with their partner companies.

An Assessment of the Quantitative Effect of TSS by Vessel Traffic Flow Simulation (해상교통류 시뮬레이션을 이용한 통항분리제도의 정량적 효과평가)

  • Marine traffic management could be defined as the implementation of managerial technical measures to improve vessel traffic safety. The managerial elements of vessel traffic management for ports and harbours or narrow channels include the total amount of traffic control, the vessel traffic separation scheme, speed restriction, traffic control by signals, the navigation information service and so forth. This research aims to quantify how much the traffic separation schemes(TSS) contribute to the alleviation effect of ship handling difficulty and to propose a design standard when the individual management measure is applied in an actual waterway. Traffic separation schemes have now been established in most of the major routes and congested waters of the world, and the number of collisions and groundings have often been dramatically reduced. In this part, the relationship between the alleviation of ship handling difficulty and the reduction of encounter figures among ships is quantitatively clarified by applying the ES model. As results of simulation analysis, it is recognized that a traffic separation system is most effective in the case of narrow width and heavy traffic volume. The centre buoy installation reduces about 1/4 of the alleviation of ship handling difficulty, TSS establishment 1/3, and design change to one-way traffic from two-way traffic reduces 1/2.

Standards on the Effectiveness of the Rights to Social Security of People with Disability (장애인 사회보장수급권의 실효성 기준에 관한 연구)

  • This study attempts to examine standards on the effectiveness of the rights to social security of people with disability. The current research makes the standards on effectiveness of social security rights to the disabled. This standards draw four right areas and five general principles from debates about effectiveness of general social security rights and extend for applying three social area to the disabled. Four right areas are benefit coverage, benefit structure, benefit restriction and rights relief. Five general principles are enforceable rule principle, national finance principle, unconditional principle, adequacy principle and penalties principle. These four right areas and five general principles apply to three social security areas of income support, employment security and medical security. Measurement values are 'high' and 'low'. These measurement values divided into two that are used to ensure same intervals. This study on standards to the effectiveness of the rights to social security of people with disability has political and theoretical implications. First, in political aspects, these standards provide objective understanding of the present level of social security policies for the disabled. Second, theoretically the current study expands debates about the effectiveness of general social security through multi-disciplined research. At once this study is significant to establish empirical research foundation.

Technical Review on Methodology of Generating Exposure Scenario in eSDS of EU REACH (유럽 신화학물질관리제도의 eSDS에 첨부되는 노출시나리오 작성법 개발 동향)

  • As one of the REACH obligations, the extended safety data sheet (eSDS) should be communicated within the supply chain under the REACH Regulation. Based on technical guidance documents published on the ECHAs website and survey of EU's recent REACH-related informations, this paper includes a study on details of how to develop exposure scenarios (ES) such as structure of ES, process of ES develpoment, standard workflows and key input data to develop ES with an introduction of eSDS concept. This paper also contains an overview on operational conditions (OCs) and risk management measures (RMMs) that are what to consider when building an ES. The structure of Chesar (Chemical Safety Assessment and Report tool) developed by European Chemicals Agency (ECHA) is studied with a review of the available exposure estimation tools for workers, environment and consumers. Case example of generic exposure scenario (GES) for organic solvent is presented. To guide Korean EU-exporting companies, their participating roles in three steps of preparing ES are addressed.

Analyses of Consumer Preferences and Perceptions Regarding Activation of Yacht Tourism Industry (요트관광산업의 활성화를 위한 소비자 선호도 및 인식도 조사)

  • The purpose of this study was to examine the preferences to yacht tourism and perceptions to importance of yacht tourism industry's activation strategies from consumers perspectives. In order to such a purpose, this study employed survey methodology with a total of 300 visitors to yacht facility and beach located in B metropolitan city. With 265 usable questionnaires, data collected were analyzed using descriptive statistics such as frequency, percentage, mean and standard deviation. Accordingly, following findings were derived from current study. First, 32% of participants had yacht tourism experiences and more than 64% of them had willing to purchase yacht tourism products in the future, which indicates optimistic increases in yacht tourism demand. In addition, amount of willingness to pay for yacht tourism was less than 100 thousand Won per day. Second, the most preferred product was a yacht training and experience program, and preferred time for yacht tourism was weekend and or vacation with the period of one day or one night and two days. The main motivation was to spend leisure time and enjoyment with accompanying persons of family or friend members. Third, consumers' restriction factors included high expenditures, time consuming and lack of various yacht tourism products but their selection attributes included low expenditures, associated tourism products and quality of yacht tourism products. Finally, the most important activation strategies included the development of yacht tourism products, building yacht tourism conditions and establishing marketing strategies, but the least important activation strategies from consumers views included policies, experts and facilities.

A Study on the Visibility Ratio Analysis Technique for Establishing the Cultural Property Protective Zone (문화재 보호구역 설정을 위한 가시율 분석 기법에 관한 연구)

  • In drafting the standards on changes in current conditions, the height or the number of stories is applied in a restrictive manner by limiting to securing the distance to vertical surface for cultural properties within the influence investigation area, but this is expected to have a negative impact on the surrounding sceneries as well as results in the dwarfing phenomenon for precious cultural properties. That is, the preparation for supplementing the insufficient objectivity that is likely to take place during the process of drafting the standards on changes in current conditions. Thus the author attempts to suggest the analytic method for the decision making related to objective and reasonable determination and regulation of the changes in current conditions through computer based simulation work that considers the cultural properties and surrounding environments under investigation. In order to achieve such research objectives, the author reviewed the subject sites where the cultural property dwarfing phenomenon was expected to occur in case of the permission for the changes in current conditions or where the impact of natural landscape and natural feature on the earth is less than architectural building or artificial structure or where the new policy program is likely to be adopted due to incomplete establishment of current condition change standard within influence investigation area, among other cultural properties with architectural building or artificial structure nearby located in Cheonan city and then selected Cheonansaji Dangganjiju(flag poles) and Jiksanhyun Gwana(government office). The author then undertook the quantitative visibility analysis in order to determine the comprehensive prospect rights for the cultural properties and surrounding environments concerned.

Detection and Differentiation of Herpes Simplex Virus 1 and 2, and Varicella-Zoster Virus in Vesicle Fluid, Joint Fluid and Serum using PCR Method (중합효소 연쇄반응에 의한 수포액, 혈액과 관절액에서 단순포진 바이러스 1, 2와 대상포진 바이러스의 검출과 감별)

  • The viruses of Herpes Simplex Virus 1 (HSV-1), Herpes Simplex Virus 2 (HSV-2) and Varicella-Zoster virus (VZV) which belong to the alpha herpes subfamily are important human pathogens. When eruptions were not fully developed from these viral infections, clinical diagnosis was not always easy and required virological confirmation test. The above viruses were reactivated in individuals who were compromised in immune competence for one reason or another. Polymerase chain reaction (PCR) enables rapid and sensitive detection of HSV and VZV DNAs. Its sensitivity was largely influenced by choice of primers. Authors conducted a study to detect of those three viruses in human specimens including vesicle fluid and joint fluid and serum using PCR methods. Primers used for this study were the general primer pair GPHV-RU which was known to amplify within the genes enjoying the highest degree of homology between UL15 of HSV and UL42 of VZV. PCR with primers hybridized pair GPHV-RU amplifies a 396 bp with THP-1 and HSV-2 standard strain DNA and 405 bp with VZV standard strain DNA. Restriction enzyme cleavage with HpaII and DdeI were used to detect and distinguish DNAs of THP-1 and HSV-2 and VZV. The purpose of this study was a rapid and easy detection of VZV and THP-1 or HSV-2 from various clinical specimens (vesicle fluid, serum and joint fluid) by PCR method. Used methods were: HSV PCR with primer 1, 2 and HpaII RE digestion; VZV nested PCR; HSV PCR with primer A, Band BssHII RE digestion. 1) In 33 cases (33/42, 78.6%) VZV was detected single or mixed infection from 42 clinical specimens which included vesicle fluid (5), serum form respiratory infected children (10), serum from immune suppressed adult cancer patients (7) and joint fluid from arthritis patients (20). 2) In 20 cases (20/42, 47.6%) HSV was detected singly or mixed infection and 19 of those cases were HSV-2 and 1 case was THP-1. 3) In 19 cases (19/42, 45.2%) VZV was singly detected which included serum from respiratory infected children (6 cases), joint fluid from arthritis patients (9 cases), vesicle fluid (2 cases) and serum form immunosuppressed cancer patients (2 cases). 4) HSV was singly detected in 6 cases (6/42, 14.3%) which included joint fluid from arthritis patients (5 cases) and serum form respiratory infected children (1 cases). 5) 14 cases of VZV and HSV mixed infection (14/42, 33.3%) were detected. They included vesicle fluid (3 cases), serum form immunosuppressed cancer patients (4 cases), serum from respiratory infected children (2 cases) and joint fluid from arthritis patients (5 cases). 6) HSV-1 and HSV-2 detection and typing by HSV PCR with primer A, Band BssHII RE digestion method was more sensitive and the results were easier to detect than on other method.
