Alternate Dispute Resolution - Free and Speedy Complaints Redressal Framework using Technology: Ombudsmanship at Proverbial Doorsteps in Pakistan

  • Ombudsmanship is the framework to provide the speedy administrative justice to poor man which is originated in Sweden in the 19th Century and the modus operandi with modernized arrangement of public grievance redressal. Pakistan has thirteen different Ombudsman Institutions at both Federal and Provincial level with limited public accessibility. This paper presents a collaboration framework for extending the outreach of Ombudsmanship at proverbial doorstep of complainants. This framework has three main components as collaborative arrangements, Proceedings and Resolution of the complaints that increased the public trust. A pilot project titles Swift Complaint Resolution (SCR) was constructed and executed by Federal Ombudsman Secretariat to materialize the concept of speedy redressal of complaints. The SCR project first affirmed the strength of the components of the framework. The concept of SCR was first presented in the Federal Advisory committee for Administrative Justice, which comprised of highest level of the Parliamentarians, Public Officials, NGOs and Civil Society where presented guidelines to be adopted for the free and speedy redressal of grievances at proverbial doorsteps in tehsils and district headquarters ultimately to the extended to the union councils. In SCR, the complaints were decided within 25 days even though the Law permitted 60 days that is itself a record in any judicial /quasi-judicial forum.

Strategy for Establishing a Rights Processing Platform to Enhance the Utilization of Open Data (공공데이터 활용성 제고를 위한 권리처리 플랫폼 구축 전략)

  • Open Data is an essential resource for the data industry. 'Act On Promotion Of The Provision And Use Of Public Data', enacted on July 30, 2013, mandates public institutions to manage the quality of Open Data and provide it to the public. Via such a legislation, the legal basis for the public to Open Data is prepared. Furthermore, public institutions are prohibited from developing and providing open data services that are duplicated or similar to those of the private sector, and private start-ups using open data are supported. However, as the demand for Open Data gradually increases, the cases of refusal to provide or interruption of Open Data held by public institutions are also increasing. Accordingly, the 'Open Data Mediation Committee' is established and operated so that the right to use data can be rescued through a simple dispute mediation procedure rather than complicated administrative litigation. The main issues dealt with in dispute settlement so far are usually the rights of third parties, such as open data including personal information, private information such as trade secrets, and copyrights. Plus, non-open data cannot be provided without the consent of the information subject. Rather than processing non-open data into open data through de-identification processing, positive results can be expected if consent is provided through active rights processing of the personal information subject. Not only can the Public Mydata Service be used by the information subject, but Open Data applicants will also be able to secure higher quality Open Data, which will have a positive impact on fostering the private data industry. This study derives a plan to establish a rights processing platform to enhance the usability of Open Data, including private information such as personal information, trade secrets, and copyright, which have become an issue when providing Open Data since 2014. With that, the proposals in this study are expected to serve as a stepping stone to revitalize private start-ups through the use of wide Open Data and improve public convenience through Public MyData services of information subjects.

  • It is necessary to recognize the urgency and importance of administrative information dataset management and study effective management measures and specific procedures applicable in practice. Particularly, identify dataset records and developing records schedule for records management needs to be presented in detail and specific. This study designed and verified an identification method and appraisal procedure of dataset records in public administrative information systems dataset operating in public institutions. In addition, this study presented the role of the participants including the records center in the appraisal process. Through this, useful implications are derived for the development of specific and practical processes and tools for dataset management in the records center.

  • This study started to diagnose the perception of 'public official' who are exposed to various tasks through public institutions in our daily work. In particular, among the public officials in various fields, public officials engaged in social welfare, health and welfare, and administration were diagnosed with the attitude of public officials to be equipped. For analysis, Q method, which is a qualitative research method, was used to diagnose and typify perceptions. First, the analysis results were derived into four types. In each type, shows the uniform distribution of public officials in health, administration and welfare fields and is named "General Type". is named as "Administrative Public Official Type" because the distribution of administrative civil servants is high. has a high distribution of welfare officers and is named as "Welfare Official Type". is composed mainly of public health officials, and is named as "Health Official Type". The public officials who are subject to this study should be responsible for "public service", that is, the unique work for the state and the public. In order to do this, we emphasize the accountability of the public officials themselves, and expect to expand into empirical research in future research.

  • Medical institutions wishing to install and operate diagnostic radiation generators must complete appointment training within one year of appointment based on the 「Medical Act」 and the 「Rules on Safety Management of Diagnostic Radiation Generator Devices」 which will come into effect on January 1, 2024. Additionally, You must receive supplementary education every three years from the date you received it. The strengthening of safety management for diagnostic radiation generators used in medical institutions means that although the radiation exposure that may occur when using diagnostic radiation generators is low, the risk of carcinogenesis may be higher than previously evaluated. In addition, safety management of diagnostic radiation generators can be said to be an essential requirement because it has been reported that the incidence of leukemia and other diseases is increasing in diagnostic radiation tests. However, the safety management training targets and programs for radiation exposure management operated by other organizations other than diagnostic radiation generators are significantly different. In addition, since the public institutions that are responsible for radiation safety management are divided, there is a risk of duplicative, excessive, and under-administrative application to medical institutions and educational institutions that install and operate diagnostic radiation generators. Therefore, we would like to determine their consistency by comparing domestic and foreign related cases and the provisions of the 「Medical Act」 and the 「Nuclear Safety Act」.

Health Promotion Services and Administrative System of the University Health Clinic (대학보건실의 운영체계 및 건강증진 서비스 제공 실태)

  • Objectives: This study was conducted to analyze problems and priority of university health services through analysis of health promotion programs and administrative system of university health clinics. Methods: In first telephone survey, 349 colleges and universities nationwide were surveyed to find out whether they operate health clinic or not. The administrative system and health promotion services of university health clinics were analyzed in 198 schools which had health clinic in it. Results: 160 schools were included in the final analysis. The most common name of university health clinic was 'health clinic' (35.2%), and heads of 52 university health clinics were non-medical school professors. 20.9% of the school provided details of the rules and implement guidelines of health care service. Health promotion services of university health clinic were set the non-smoking area (90.6%), health counseling (81.8%), providing health information (74.8%), health check-up (65.4%), health education (61.4%), partnership with health institutions in a community (61.4%), and immunization (48.1%) in order of that. Conclusion: It is urgent to establish the regulatory and guidelines for university health clinic. Each member of school should have interests in their health clinic and acknowledge health promotion services which they can get at the university health clinic.

A Study on the Current Status of Community-Linked Projects in the Support Center for Childcare : Fousing on the Current Status of the 2018~2022 Projects (육아종합지원센터 지역사회 연계사업 현황에 관한 연구: 2018년~2022년 사업 현황을 중심으로)

  • This study aims to propose operational directions for establishing Support Centers for Childcare (SCC) as central institutions in local communities by examining the performance status of community-linked projects of SCC. To achieve this, an analysis of performance related to community-linked projects was conducted focusing on SCC activity reports from 2018 to 2022, encompassing the past five years. Upon examination of the analysis results, several findings emerged. Firstly, there was a substantial number of achievements with non-profit organizations and public institutions as the types of institutions involved in the Memorandum of Understanding (MOU), with a predominant focus on educational and informational support within the MOU contents. Secondly, collaboration among institutions within the local community primarily centered around education and administrative support, with a significant portion of support activities being conducted through meetings. Thirdly, individual volunteer contributions were prevalent in events and administrative support, while volunteer efforts were notable in areas such as cleaning toys. Based on these findings, recommendations for community-linked projects of SCC were derived.

  • This research proposed management plan of internal lecturer who is in charge of job training of researchers working in administrative, researching and developing institutes or public institutions related to information security. The education and training department of the government or public institutions selects and manages lecturers in member of the staff. We applied to the management plan of internal lecturers who are in charge of information security job training by analyzing the way in which internal lecturers are operated by public organizations or corporations. We propose the management plan of internal lecturer according to the position, because the institute of information security is applying the researcher 's position(rank) system. By the proposed circulation management plan by the position, the internal lecturer position is determined according to the position of the employees to be trained and the internal lecturer is selected and operated only at the same position. The proposed management plan includes internal lecturer selection, responsibilities and duties, education, evaluation, and training support.

Emergency Management Policy Issues during and after COVID-19: Focusing on South Korea

  • South Korea is currently facing many changes and challenges. To make matters worse, society has struggled to function as it did before COVID-19. This study describes the past and current COVID-19 situation to offer lessons on management during and after COVID-19. We provide implications from COVID-19 and the foundation for future disasters by employing the strengths, weaknesses, opportunities, and threats (SWOT) analysis and indigenous administrative conceptual framework on culture, institution, and instrument to add a circumstance perspective. This study used secondary data from prior research and literature. Resolutions for these policy issues are presented using the strength-opportunity (SO), strength-threat (ST), weakness-opportunity (WO), and weakness-threat (WT) strategies. We suggest utilizing instruments that consider diverse societies and preventing the disease with climate change by collaborating with social institutions. We hope these implications and resolutions will provide insights for the future and other countries.

The Collection and Transfer of Public Records and the Role of the Archivist (공공기록물의 수집·이관과 아키비스트의 역할)

  • The collection and transfer of records is a very basic stage in the whole process of records and archives management. However they are regarded as an non-professional art of work in records management that are performed easily by everyone. Therefore they have been treated not properly in the scholarly discussion of archival sciences in Korea. The collection and transfer of records play an active role in the making of effective administrative system, in accumulating and sharing the knowledge and informations of political, economical, social and cultural values. On the basis of proper collection and transfer of records our democracy can operate regularly and our daily experiences can be preserved as historical resources. For the optimal-functioned collection and transfer of public records the archivists for this task must have a comprehensive understanding of whole process of records management and possess suitable professional skills. Moreover there are many sorts of preliminary works needed for this task, as follows: an accurate defining of administrative organizations and their tasks, thorough understanding of records management institutions on their own competence and ability, and the establishment of technical standards for their tasks. Additionally the archivists are able not only to consider the present informational and evidential values of the records, but also the historical values. It can be said that the collection and transfer of records is a "synthesis of records management skills" exerted by an archivist. According to the newly established law of public records management, the collection and transfer of public records must be registered at first electronically. Through this procedure the whole contents of produced and transmitted records, which are to be transferred, can be reported in detail. By means of this report the archival institutions and the archivists can trace back the each items of records(archives) and the result of their arrangement to identify a certain object. There are also new storage strategies employed to increase the whole sum of stored informations, i. e. records and archives, in spite of reducing the storage costs. It will be achieved by differentiations of the preservation methods for each sorts of records by the criteria of storage-period, -place, and -method. Many supplementary methods are also prepared to help the collection of important records(archives) in a complete structure and form. To let this new concept and system of collection and transfer of records operate properly, a number of professional archivists should be posted in the needed places throughout the whole administrative body. Their training must be also updated for the newly defined task of collection and transfer of records.
