The Study of an Analysis on Patent Management Affecting the Company Performance: Korean Metal Industry (특허경영이 경영성과에 미치는 영향에 관한 연구: 국내 금속기업 중심으로)

  • Every country of the world in the 21st century is going to push forward the policy protecting their intellectual property right, and international movement to protect their intellectual right is still more strengthened. Under these situations, the firm is required to seek for more efficient methods of technology security and business management while the existence of business itself is at risk. The control of intellectual properties in business should be considered in the patent management. In the company, the industrial property right should be into one of the management resource, and its importance has great influence on the existence of the company. The information in patent data can be used for strategic planning purposes. This study systematically evaluates the patenting behaviour of sample of 27 business firms within the Korean metal industry. Utilizing the patent application data between 2000 and 2005, the relationship between these patenting management and company performance is analysed. This study showed that patent activity per employee and labor productivity are positive relationship, but patent activity per employee and firm size are negative relationship. Since a positive relationship between patenting and company performance could be shown, patent activity gains important as a instrument for R&D planning.

  • At the time when interest in the use of big data is rising in the face of the technological paradigm shift of the 4th industrial revolution, interest in the use of patented big data is increasing, especially as the proportion of intangible assets of companies increases. In addition to quantitative information, patent data contains various information such as unstructured text such as title, abstract, claim, citation and citation relations, drawings, and technology classification. It is judged that the use of treatment is important. Therefore, in this study, in order to systematically operate the innovative patent strategy framework and to secure a competitive advantage by strengthening the fundamental technological competitiveness of the company, we propose a method of using patent big data centering on the case of Company A, and verify its validity. I would like to suggest some implications. Through this, it is intended to raise awareness of the use of patent big data, and to suggest ways to use patent big data in connection with the company's company-wide strategy, business strategy, and functional strategy.

Determinants of Success in Ex-parte and Inter-parte Patent Litigation (발명의 특허성 및 특허의 유효성 분쟁결과에 영향을 미치는 요인분석)

  • This paper investigates determinants of litigation success in the two distinctive types of patent litigations, ex-parte and inter-parte cases, which are brought in the process where a filed application becomes a valid patent right. We regress winning rates of patent applicants on the characteristics of firms, trials, patent lawyer, and patent itself, using a probit model with sample selections. The paper finds that the relative suit rate of a firm, time to be sued, changes of patent agents by applicants, and multiple agents among explanatory variables affect ex-parte reexamination and in-parte post-grant patent trials differently in the point of average marginal effects. These variables lower the probability of applicant's victory in the ex-parte cases, while they raise the probability in the inter-parte trials. However, the experience that agents represent applicants is a winning rate-increasing factor both in inter-parte and ex-parte reexamination, unexpectedly. This result cannot be applied to the entire domain of the variable, since sample selection effects are reflected in the result. The number of claim increases the winning probability of the applicant in the both types of patent litigations. This study has some limitations because it ignores the information on the legal person to which a patent agent belongs, and confined agent's experience to patent filing. We leave it future studies to investigate the effects of lawsuit experience of patent agent, and those of characteristics of the law firm to which individual patent lawyer is affiliated.

  • Technology roadmap is a powerful tool that considers relationships of technology, product and market and referred as a supporting technology strategy and planning. There are numerous studies that have attempted to develop technology roadmap and case studies on specific technology areas. However, a number of studies have been dependant on brainstorming and discussion of expert group, delphi technique as qualitative analysis rather than systemic and quantitative analysis. To overcome the limitation, patent analysis considered as quite quantitative analysis is employed in this paper. Therefore, this paper proposes new technology roadmapping based on patent citation network considering technology life cycle and suggests planning for undeveloped technology but considered as promising. At first, patent data and citation information are collected and patent citation network is developed on the basis of collected patent information. Secondly, we investigate a stage of technology in the life cycle by considering patent application year and the technology life cycle, and duration of technology development is estimated. In addition, subsequent technologies are grouped as nodes of a super-level technology to show the evolution of the technology for the period. Finally, a technology roadmap is drawn by linking these technology nodes in a technology layer and estimating the duration of development time. Based on technology roadmap, technology planning is conducted to identify undeveloped technology through text mining and this paper suggests characteristics of technology that needs to be developed in the future. In order to illustrate the process of the proposed approach, technology for hydrogen storage is selected in this paper.

Analyzing Patent Trend of Mibyeong (미병 특허 동향 조사)

  • Objective : The purpose of this study was to analyze for the patent application tendency in mibyeong. Mibyeong is a concept in Korean Medicine meaning sub-health state, and treatment of mibyeong can be understood as preventive medicine. This concept laid a foundation for the development of Korean, Japanese and Chinese traditional medicine. In this paper, we describe a meaningful data for efficient R&D through patent analysis of mibyeong focusing on the Korea, Japan and China. Method : We collected patents about mibyeong using Focust, IPDL search tools. We analyzed patents according to the year, topic, country and etc. Results & Conclusion : We collected 1,577 patents and selected 807 patents as useful patents. After detailed analysis on mibyeong patent, we got to know that research about mibyeong was a growing field. In the collected patents, the patents on treatment device(except treatment compositions) were the majority and system of providing information were the second largest. We think that the mibyeong field is growing at a fast pace with high activity, and this research should be updated annually.

Technological Trend of Functional Clothing by Analysis of Korean Patent (국내 특허분석을 통한 기능성이 적용된 의복의 기술 동향)

  • Patent and utility indicate international competitiveness in the knowledge-based society of the $21^{st}$century where both the quantity and quality of the nation's scientific intelligence and innovative technology represent key criteria to evaluate its strength. Thus, discerning the trends of patents is inevitable for further development. This research is centered on apprehending the technological current of the functional clothing of Korea, through an analysis of patents and utility models. The number of patent applications in Korea was low until the mid-1990s. However, it began to grow rapidly in the 2000s and the number of patents surpassed the number of utility starting in 2006. The technological level of invention in this field has been turned into a higher level. The IPC code with the strongest application was the field related to temperature controllable clothing (A41D 13/005), followed by surgeon or patient apparel related fields (A41D 13/12), and reflective or luminous safety devices (A41D 13/01).The main technological idea was to give functionality that could protect the human body from various hazards and represents the goal of various applied techniques. About 66% of domestic patent applications belong to individuals; however, the proportion of corporate or institutional applications(including universities) remains poor. Consequently, more systematic and long-term support for research on patents is required.

  • Patent information has a great value of industrial information as well as technical information. However, Korean patent information loses the effectiveness by the lack of description rule and requires much additional efforts to use them in variety. In this paper, some examples of the studies on the problems in databases were introduced and patent application(from Jan. 2008 to Oct. 2008) data retrieved from information service system of KISTI(Korea Institute of Science and Technology Information) and KIPI(Korea Institute of Patent Information) was surveyed.

Analysis of Korean Patent Current Status Related to Food using Edible Insects (식용곤충을 이용한 식품 관련 국내 특허 현황 분석)

  • The purpose of this paper was to analyze domestic patents for food using edible insects. From January 1, 1980 to December 31, 2021, patents filed with the Korean Intellectual Property Office were searched, and a total of 242 valid patents were selected. The trend of Korean patent applications for edible insect food has increased since 2015, with 57 cases (the highest number) in 2017. As for the edible insects used in food, Bombyx mori L. were the most common with 127 cases, followed by Tenebrio molitor L. with 118 cases. By type of applicant, individuals accounted for the most, with 132 cases. As a result of grouping patents by food classification, 67 cases of edible insects were used in snacks, breads, and rice cakes. As a result of patent analysis, an effort was made to supplement insufficient nutrients by adding nutritionally excellent edible insects to existing foods, and efforts were made to improve the sensory properties of insect foods. It is expected that this study will contribute to establishing future R&D directions and patent application strategies related to edible insect food.

The Effects of Patents on Firm Value;Venture vs. non-Venture (특허활동이 경영성과에 미치는 영향;벤처기업 대 일반기업)

  • Utilizing the patent application data between 1997 and 2002, this study focuses on analysing the impact of patents on firm value. Especially we attempt to examine the difference of patents between venture firms and general firms. This paper first shows that the number of the patent applications of general firms listed on the securities market are more than those of venture firms listed on KOSDAQ. It is thought that this result is originated from facts that the size of firms of the securities market is usually bigger than the firms of KOSDAQ and that these large firms could manage R&D more efficiently. Second, this paper reports that there is no difference in the ratio of patent maintenance between venture firms and general firms. Both venture firms and non-venture firms would do their best to keep their patents after patent regisration. Third, in the regression of patent index and firm growth, we find that the excellence of patent and the number of patents per employee would have an impact on the growth of firms. Fourth, the regression of patent index and profitability shows that the excellence and the number of patents per employee might have an effect on the profitability of firms.

A Big Data Learning for Patent Analysis (특허분석을 위한 빅 데이터학습)

  • Big data issue has been considered in diverse fields. Also, big data learning has been required in all areas such as engineering and social science. Statistics and machine learning algorithms are representative tools for big data learning. In this paper, we study learning tools for big data and propose an efficient methodology for big data learning via legacy data to practical application. We apply our big data learning to patent analysis, because patent is one of big data. Also, we use patent analysis result for technology forecasting. To illustrate how the proposed methodology could be applied in real domain, we will retrieve patents related to big data from patent databases in the world. Using searched patent data, we perform a case study by text mining preprocessing and multiple linear regression of statistics.
