This paper examines some questions and issues of the effect of an arbitral award, and discusses about the restriction of the trial level in other separate actions permitted under the existence of grounds of setting aside arbitral award after the amendment of the Arbitration Act in 2016. Because there are no interests of litigation in the action for setting aside arbitral award due to the exclusion of res judicata by provisory clause of Article 35, filing an action for setting aside is not allowed even when the grounds of setting aside exist. If we examine the precedent on possibility of retrial for excluding the outward form of invalid judgement, we can find that the court did not approve the retrial. Therefore, the action for setting aside that which is for excluding the outward form of an arbitral award will not be allowed for filing. On the issue of whether an arbitral award having a ground for setting aside can be an object of the action for setting aside for excluding its outward form or not, the views of scholars are divided. In the case of an arbitral award that has grounds for setting aside, it could be interpreted that the arbitral award would not have a formale Rechtskraft or effect of sentence (bindende Kraft). Even if there is formale Rechtskraft or effect of sentence (bindende Kraft), the significance of existence of action for setting aside arbitral award under paragraph 1 of Article 36 is reduced because other actions separate from arbitration is permitted under the 2016 Act. The amendment of the Arbitration Act in 2016 provides an opportunity to review the position and the role of action for setting aside the arbitral award. It also requires further studies on efficiently treating other actions separate from arbitration. Because the restriction of the trial level of other separate actions can make arbitration active by making arbitration procedures become 3 trial levels from 4 trial levels, it needs to be solved with legislative action. Specifically, if the trial starts at the stage of trial on appeal, it can utilize the strength of both the arbitration and the litigation, playing a chief role in boosting arbitration by removing the problems of action for setting aside and enabling arbitration institutes and the person interested to promote the activation of arbitration.

The dust formation processes in novae are investigated with close attention to recent infrared observations. Using mainly the classical nucleation theory, we have calculated the time scales of dust formation and growth in the environments of novas. Those time scales roughly the typical observations. We have classified the dust-forming novae into three classes according to their explosion properties and the thermodynamic properties of dust grains. Oxygen grains form much later than carbon grains because of their thermodynamic properties. The effect of grain formation to the efficiency of stellar winds to drive the material outward is tested with newly obtained Planck mean values of dust grains.

This paper presents machine vision technique with a camera modeling that accounts for major sources of camera distortion, namely,radial, decentering, and thin prism distortion. Radial distortion causes an inward or outward displacement of a given image point from its ideal location. Actual optical systems are subject to varios degrees of decentering,that is,the optical centers of lens elements are not strictly collinear. Thin prism distortion arises form imperfection in lens design and manufacturing as well as camera assembly. It is our purpose to develop the vision system for the pattern recognition and the automatic test of and to apply the line of part manufacturing.

Recently, multiple metropolitan counties and local authorities have been actively working on improving their local existence with various methods and strategies. Such change cannot be observed when local authorities were chosen by the government. Also, the public administration has recently emphasized important factors of public design which seeks better lifestyle and outward beauty from quantitative growth and policy of strongly considering outward form due to the compressive modernization. Public design intends to complete aesthetic factor and improve the quality of life as the efficiency as the value of public administration. The purpose of this study is to discuss how public school has been evolved as public space and how to create local user-centered interaction. The study retrieve the communication which the essential publicness in the school public design and the self-management which is the original value in terms of sociology. The method in which the characters of the public design of the publicness have been changed will be concentrated on in public area. In addition, the study has been focused on the efforts of the reflection of the development in public design are the challenges for the aim of the design of the publicness.

Alloys of Fe-(5.3-29.8)%Mn-(1.1-1.9)%Al-(0.4-0.5)%C were oxidized at 550 ℃ to 650 ℃ for 20 h to understand effects of alloying elements on oxidation. Their oxidation resistance increased with increasing Mn level to a small extent. Their oxidation kinetics changed from parabolic to linear when Mn content was decreased and temperature was increasing. Oxide scales primarily consisted of Fe₂O₃, Mn₂O₃, and MnFe₂O₄ without any protective Al-bearing oxides. During oxidation, Fe, Mn, and a lesser amount of Al diffused outward, while oxygen diffused inward to form internal oxides. Both oxide scales and internal oxides consisted of Fe, Mn, and a small amount of Al. The oxidation of Mn and carbon transformed γ-matrix to α-matrix in the subscale. The oxidation led to the formation of relatively thick oxide scales due to inherently inferior oxidation resistance of alloys and the formation of voids and cracks due to evaporation of manganese, decarburization, and outward diffusion of cations across oxides.

The purpose of this study is to study the inner meaning and formative with distorted and atypical Informel image, body image expressed in modern fashion. Method of the study is as follow. The study method examined philosophy of art 19th century?in order to consider interconnections between social and cultural characteristics of expressionistic abstract art, a form of Informel and changed physical style. Based on this method, the Informel image that appeared in the plastic arts in terms of artistic significance and aesthetic value was examined. Based on the above discussion on modern fashion Informel images were expressed in any formative characteristics were considered. The results of this study are as follows. Contingencies through the spontaneous act of art to transcend the image of atypical lines formed elements of coincidence, was developed. Liberation was expressed from liberation of physical boundaries and created outward expansion of the free formative. Atypical was organic forms pursuing spontaneous plasticity and diversity, and appeared in the form of distortion and deformation.

The purpose of this study is to analyse the inclinations and expressions in contemporary architecture. Specially, we call this tendency and architectural movements as architectural metamorphosis. Metamorphosis in architecture present the core of the change of Forms and spirits in a change of outward shape and terrestrial identity. As in Ovid's extended dramatic poem of change and transformation, Metamorphoses, all Souls are deathless, and migrates from one form to another. Like these stories in Metamorphoses, Ovid tells the soul never dies, but leaps one form to anther, and can take any shape. So the architectural form, transformation and deformation in contemporary architecture means architectural sensations and cognitions can even approach the soul of form and shape under the transformation. The expressions and design strategies of metamorphosis in comtemporary architecture reveal continuous and sequential formations of space, linear structure with force and vector, rhythmical wavement and folding surface, lively wiggly flows of volumns and objects, and so on. Such qualities came from the periodical needs; separation of structure and surface, poly-surfacial movement, poly-sensual expression and experience, dematerialization and the dematerialized space, formless of non-formal architecture, digital architecture. Architecture of Metamorphosis is the ways and the needs of our period to overcome the static limits prohibits the liberal thoughts, to find the ways toward the opportunities and diversities and to unlock the imaginaire of the contemporary architecture.

The purpose of this study was to compare and analyze two original forms of slacks for thesis to extract outward appearance of design original form applying design measures of the above through diverse research methods. The results of this study are as follow: In original form F, the original form of slacks sloper suitable to elderly women 65~9 years old was W/4+3.5+0.5cm in the front/back circumference of waist, H/4cm in the front/back circumference of hip, (H/4+1+3.8)/2cm in the position of centerline, 19cm in actual measurement value of hip length, 25cm in actual measurement value of crotch depth, (knee crotch circumference~bottom line)/2+10cm and 90 (side waist dot~ lateral malleolus length)cm in actual measurement. front dart position was 1/3 and 2/3 of front waist centerline and back dart position was 1/3 and 2/3 of back waist circumference. It was suggested that front dart quantity (length) was 3.5(11)cm, back dart quantity 3.4 (10.2)cm, side waist up quantity 0.7cm, back down quantity 1.5cm, front crotch width (H/4+1)/4-1cm, back crotch width (H/4+1)/4+4, front knee width 21.8cm, back knee width 24.4cm, front pant leg 20.8cm, and back pant leg 23.4cm.

This study searched the philosophical and medical thought of mutual understanding and human body. Mutual understanding is a fundamental problem in all branches of oriental studies. In other words, mutual understanding becomes the existential foundation of heaven-earth-human(三才). So human beings, heaven and the earth can't exist if there is no mutual understanding. It comes out the problem of self-consciousness in philosophy, and qi movement pattern like upward, downward, inward and outward movement in traditional korean medicine. Human beings have mutual understandings with heaven and the earth from a macroscopic standpoint, on the other side the human body from a microscopic standpoint. Qi movement is the mutual understanding and response of qi in human body, so with which the physiological functions and pathologic changes of viscera and bowels comes out. Therefore we want to present how to complete qi movement between viscera-bowels and organs to examine mutual understandings in human body closely. The results was summarized as follows; First, upbearing the clear yang and down bearing the turbid yin of spleen-stomach is main pivot of upward and downward of qi movement, and it is true form of mutual understandings between viscera and bowels, so upward, downward, inward and outward movement of whole viscera and bowels can be controlled by spleen-stomach. Second, by restraining relationships between downward heart fire and upward kidney water, heart fire and kidney water have close communications physiologically and pathologically as upper-lower, yin-yang and water-fire. Third, by restraining relationships between upbearing and effusion of liver and purification and down-sending of lung, liver and lung are outer circles of upward and downward movement, so they have antagonistic functions. Firth, by the relationships between upbearing the clear and down bearing the turbid of spleen-stomach and free coursing of liver, free coursing of liver-gallbladder is the essential requirement that it certify transportation and transformation of spleen-earth, so the disease of liver-gallbladder induce spleen-stomach disease pattern to affect its function of transportation and transformation. Fifth, by spleen and kidney, spleen yang is based on kidney yang, so the weakness of kidney yang can affect the function of transportation and transformation of spleen-stomach as it can't warm spleen earth. Sixth, by homogeny of liver-kidney, essence and blood of liver-kidney and ministerial fire of liver-kidney have mutal generation and limitation physiologically and they mutually are affected in pathologically.
