A study on the multilateralism in aircraft and air liners nationality and its implication with respect to the Article 7 of the Chicago Convention (항공기(航空機) 및 항공사(航空社)의 국적(國籍) 다원화(多元化)와 시카고 조약(條約) 제7조의 해석(解釋) 문제(問題))

  • In recent years, questions have arisen under several forms with respect to the need for adapting present legal order established under the Chicago Convention and relevant customary rules into newly developed environment surrounding the international air transport industry. Major feature of such trends included in opinions for modification of the present legal order might be defined as more liberalistic approach to this industry. In this respect, many scholars and lawyers in this field agree with a view that a theoretical tie between an aircraft/air liners and a register - State lies in political and strategical concern of the State so that each aircraft/air liners has been attributed a single nationality. In the context of such concern, each aircraft/air liners has been related with each register-State in the form of "genuine connection". However, present and near future development of air transport industry and its world - wide market requires some modification of such single nationality regime. Taking into account such circumstances, States as creator of present legal order are in the process of establishing new legal order where air liners with multi - nationality are capable of satisfying to such needs. As adopting a series of liberalization package for air transport industry in european continent, European Union adopts a concept of "community air carrier", by which an air space of each member State is open to each other, especially through the grant of cabotage right. A serious concern may arise in such grant because the Article 7 of the Chicago Convention prohibits such grant on an exclusive basis. While many theoretical opinions have been put forward concerning the interpretation of that article, a case of European Union shall be a good test of the range of its application. It is anticipated that future development around this issue shaH furnish us a major feature of the liberalization of international air transportation and an adaptation process of present legal order.

Ecological health assessments using multiple parameters of fish blood tissues to community along with water chemistry in urban streams

  • The objectives of this study were to identify multi-level stressors from blood biomarkers to community-level bioindicators and diagnose the stream ecosystem health in polluted streams. Blood chemistry such as total protein ($T_{Pro}$), blood urea nitrogen ($B_{UN}$), total cholesterol ($T_{Cho}$) and $A_{lb}$umin ($A_{lb}$) were analyzed from sentinel fish tissues; the functions of kidney, gill and liver were significantly decreased in the impacted zone ($I_z$), compared to the control zone ($C_z$). Histopathological analysis showed that fish liver tissues were normal in the $C_z$. Fish liver tissues in the $I_z$, however, showed large cell necrosis and degeneration and also had moderate lobular inflammation and inflammatory cell infiltration of lymphocytic histocytes. Species biotic index (SBI) at species level and stream health assessment (SHA) at community level indicated that chemical impacts were evident in the $I_z$ (ecological health; poor - very poor), and this was matched with the blood tissue analysis and histopathological analysis. The impairments of the streams were supported by water chemistry analysis (nitrogen, phosphorus). Tolerance guild analysis and trophic guild analysis of fish were showed significant differences (P < 0.01) between $C_z$ and $I_z$. Overall, multiple parameter analysis from biomarker level (blood tissues) to bioindicator level (community health) showed significantly greater impacts in the $I_z$ than $C_z$. This approach may be effective as a monitoring tool in identifying the multilateral and forthcoming problems related to chemical pollution and habitat degradation of stream ecosystems.

  • One of the most important hydrologic components is evapotranspiration. It is a process by which water is evaporated from moist land surfaces and transpired into atmosphere by plants. There are many methods of estimating evapotranspiration rate and its potential such as the methods of soil-moisture sampling, lysimeter measurements, water balance, energy balance, groundwater fluctuations and evapotranspiration. But it is very difficult to estimate evapotranspiration in terms of regional discrete characteristics of topography and/or vegetation. The evapotranspiration is strongly affected by ground covering vegetation, and the degree of vegetation growth. In order to grasp vegetation condition over a vast study area, NDVI (Normalized Difference Vegetation Indices) calculated from the data obtained from NOAA/AVHRR were utilized. Through multi-regression analysis, we developed a model equation to estimate the evapotranspiration using NDVIs and temperature data.
