스포츠조종사 자격증명의 국내 적용에 대한 연구 (A Study on the Legal Application for Sport Pilot Certificate in Korea)

  • In september 2004, a new pilot certificate scheme referred to as Sport Pilot Certificate was declared official and standardized in the US. The designation of Light-sport aircraft and the details of the relevant pilot certificate policy was announced out of the perception that a new regulation is required to be applied whereby the limitations on the manufacturing process enhancements and current aviation rules are considered the triggering factors. US Federal Aviation Regulation retains a comprehensive range of airworthiness certificates and aircrafts are managed systematically in accordance with FAR 21, 103. The airworthiness are further segregated into sub categories, which allows differentiated management. Korean Aviation Law classify aircraft into five different categories and powered air vehicle that weighs more than 150kg(19liters fuel capacity) for one seat, 225kg for two seats(38liters fuel capacity) while the systems that fall under a specific mass threshold level are known as ultralight vehicle. The research discusses the policy of the sport pilot certificate and the light-sport aircraft ratings announced official by the Federal Aviation Administration in an intuitive fashion with the analysis of the operations providing the evidence as to the viability of adopting the policy in local grounds. Based on the findings, the report discusses the case for introducing the light-sport aircraft and make recommendation on a strategy of applying the policy in Korea with respect to the pilot certificates, safety agenda, and the written test for the pilot certificate, and operating efficiency.

Information Sovereignty as the Basis of Modern State Information Security

  • In the context of globalization of information processes, the prevalence of information wars and terrorism, there are new threats to national interests in the information sphere, which actualizes providing the information sovereignty of modern states. Therefore, the purpose of the article is an in-depth analysis of the features and content of information sovereignty as a component of state sovereignty, its relationship with freedom of information and information security, as well as a characterization of the bases and directions of providing information sovereignty. The information sovereignty of the modern state includes its activities to determine national interests in the information sphere, the formation and implementation of information policy, providing information security, regulation and control of information processes. The realization of information sovereignty should be based on real freedom of information, information privacy and the state obligation to provide them. Ensuring information sovereignty also requires solving the problems of formation of modern information legislation, which would comprehensively establish the bases and directions of providing information sovereignty, exceptional cases of restriction of freedom of information.

광복이후 한국 공공도서관사 연구 -일제하 공공도서관제도의 영향을 중심으로- (A Study of the History of Korean Public Library after the Korean Liberation Day - An Emphasis on the influence of public Libraries System under the Japanese Imperialism-)

  • The study has tried to analize and appraise how did public library system under the Japanese imperialism affect the establishment and managemant of Korean public libraries. To achieve the purpose of the above-mentioned study, the contents of $\ulcorner$Japanese library statute$\lrcorner$ under Japanese imperialism and the current $\ulcorner$Korean library law$\lrcorner$ have been mutually compared, at the same time, the vestiage of Japanese imperialism in view of the establishment, personnel administration and reading systems have been concretely investigated, analyzed and compared. The conclusions obtained from the above are as followings. 1. In those days of the Korean Liberation, the situation of Korean public libraries was such as it under the Japanese rule and so, their names were only changed. However, as a part of its independent activities, the national library have once carried out the various programs such as the training of professional librarians, the establishment of the new classification schedule and the chief Librarian and deputy Librarian from the professional librarians in the office regulations, and they were well worth being the good examples for today's Korean library circle. Though the Goverment of the Republic of Korea had been formally established, the situation of the library circle was very dull owing to the Korean war for a long time. In 1963, $\ulcorner$The Korean library law$\lrcorner$ was promulgated, but the establishment of public libraries did not give satisfactory results because of the institutional fragility. In the 1980's the importance of library was embossed from the viewpoint of life-long education and the number of libraries was increased. However, there were still the remaining vestiges of Japanese library system in the practical library services. 2. After the Korean Liberation, the influnces of public library system under the Japanese imperialism showed in the office regulation of national library and the Korea library Law were also in the legal mechanism. In particular, the regulations of $\ulcorner$The staff-member of public library$\lrcorner$ and $\ulcorner$Admission fee of public library$\lrcorner$ including the chief librarian have referred to the library system under the Japanese imperialism since the liberation day to date. 3. At that time of the Korean Liberation, the U.S.Military Government Office had decided that the public library administration should be attached to the administration of local and internal affairs in accordance with the Japanese administative system. As a result, the public libraries had been forced to be indirectly affected by public library system under the Japanese imperialism for twenty years since the Liberation. 4. Since the Liberation, the personnel adminstration of public library has been so far on the steps of model under the Japanese imperialism. As the result of the field survey, the position standards of local chief librarians, non-professional character, the extra post system and the preponderant appointment of non-professional offices have analyzed by the influence of Public library system under the Japanese imperialism. Therefore, the Government authorities-concerned must readjust the standards of qualification and the divided duties corresponding to the position of public library staff members and to stipulate expressly in the revised library law. In addition, the regulation of the admission fee should be also actively detected for the free adminssion of library users. 5. Since the Liberation Day, the reading methods of public library have been so far similar to reading method under the Japaness imperialism. For example, the admission fee levied, the complicated procedures of using books including entrance and exit of a library, no-admission system, the limited lending books, the deposit system of outdoor lending books and the surety liable jointly and severally are originally caused by bureaucracy of under the Japanese imperialism. Therefore, the public libraries should make an offer space and opportunities which can enjoy freedom to the gull in future. The procedures and standards of library users will be simplified, if possible. As the above-mentioned, the actual conditions of Korean public libraries have been examined and analyzed. As the result of it, there are still the remaining vestiges of public library system under the Japanese imperialism in the establishment and management of the nation-wide public libraries. Such the remnants are an obstacle to the democratic development of public libraries and so, the authorities-concerned should take the proper-measures as soon as possible.

연안통합관리의 과학적 및 지역적 접근 (A Regional Approach for Integrated Coastal Management with Scientific and Local Knowledge)

  • 수산, 항만, 관광 등 남해 연안 바다의 이용은 지역경제의 중요한 부분을 차지하고 있다. 기존의 연안관리와 연안 환경 문제에 관한 일시적인 처방은 더 이상 유동성 적조, 산소결핍, 잘피 서식의 감소 등 연안 문제 해결의 방안이 되지 못하고 있다. 1999년 연안관리법이 통과된 후 2001년부터 현재까지 연안지역관리계획이 수립되고 있다. 연안지역관리계획에는 연안 생태도시 구축, 연안오염물질 감소, 제도적 장치 개발, 모니터링 계획, 예산확보 등이 포함되어 있다. 연안역 통합관리의 성공적인 출발은 중앙정부와 지자체의 협조뿐만 아니라 지역의 NGO와의 조화로운 모색이 필요하다. 연안관리의 해역분류 중 특별관리해역으로 지정된 마산만 지역에는 마산만 살리기 시민연합이 조성되어 과학적인 정보의 제공과 지역 특수성에 부합될 수 있는 여러 가지 활동이 진행됨으로써 성공적인 연안통합관리의 실행이 가능해지고 있다.

산림유전자원보호구역의 관리효과성 평가 적용 (Management Effectiveness Evaluation(MEE) in Protected Areas for Forest Genetic Resources)

  • This study aims to assess MEE(management effectiveness evaluations) on PAs(protected areas) for forest genetic resources which play an important role in biodiversity conservation, and then to suggest better ways to manage PAs for forest genetic resources. This study applies same indicators of the MEE on PAs as the ones described in the prior study(Ryu et al. 2011). The indicators applied are composed of five elements, thirty-two indicators which all would be grouped into one element by each traits. Overall indicators belonging to the element of output and outcome are comparatively low. Especially the ones related to the change of biodiversity, degree of ecosystem health, variation of civil complaint and visitor satisfaction are ranked mostly low. The element of input shows the low rank on the number of staff and budget. The score of indicators related to the identification of the threats of PAs and local communities' supports turn out to be low in the element of Context. The element of process, however, has scored low on Staff management, Education/Awareness programs and Governance, while the law enforcement, management regulation and capacity to prevent forest disasters have made relatively high score. Meanwhile, all indicators in the element of planning have scored relatively high as compared to the indicators belonged to other elements. This study suggests to strengthen a few constructive proposals, such as facilitating efficient management framework for PAs, developing local community cooperation program, establishing survey, research and monitoring system, and registering PAs to the WDPA(World Database on Protected Areas) according to the IUCN categories.

한국 기업의 브라질 현지 정치적 환경에 대응하는 경영전략에 관한 연구 (An Empirical Study on the management Strategies of Korean Firms corresponding with the Political Environment in local Brazil : Focusing on the Analysis of Structural Equation Modeling)

  • 본 논문은 브라질 현지에 진출하여 직접 경영활동을 수행하고 있는 한국기업들이 직면하고 있는 정치적 환경요인이 무엇인가를 규명하고 이에 어떠한 대응책을 마련하여 경영활동을 전개하고 있는 가를 밝히기 위한 것이라 할 수 있다. 기업의 경영활동에 영향을 미치는 일반 환경요인과 산업 환경요인 중에서 일반 환경요인으로 연구의 대상을 제한하였는데 그 이유는 기업이 오히려 일반 환경에 대한 분석을 체계적으로 실행하고 있지 않다는 지적이 있기 때문이다. 그리고 본 연구에서는 일반 환경요인 중에서 정치적 환경요인만을 분석에 대상에서 포함시켰는데 기업의 현지경영활동에 가장 직접적이고 가시적인 영향력을 가장 강력하게 행사하고 있다는 판단 때문이다. 선행연구를 통해 문헌분석을 실행하였고 이를 토대로 연구가설을 설립한 후 이를 검증하기 위한 실증분석을 실시하였다. 분석결과, 현지의 행정 관료의 비합리적 행태들과 관련 법 시스템의 임의적인 적용환경에 대응하기 위하여 합리적인 적응과 인간관계의 강화 등의 현지경영전략을 실행하고 있는 것으로 나타났다. 활용한 통계분석 프로그램은 기술통계를 위해서는 SPSS 12.0 그리고 추리통계에는 AMOS 12.0 등이다.

대형 유통업체 영업 규제가 농수산업에 미치는 영향 분석 (An Analysis of the Effects of Large-scale Retailer Operation Regulations on Agriculture and Fisheries)

  • Purpose - The Korean government has revised the distribution industry development law to regulate large-scale retailer operations to protecting medium- and small-scale retailers and traditional markets. According to the revised law, large-scale retailers must follow regulations on operating hours and compulsory store closures two days per month. Based on the revised distribution industry development law, most local governments regulate operation hours and they have adopted compulsory closure programs for large-scale retail stores. However, it is argued that fresh food producers suffer from a decrease in sales based on the compulsory closure of stores operated by large-scale retailers. Large-scale retailers reduce their fresh food orders from agricultural and fishery producers because of the compulsory store closures. Fresh food producers also suffer from a decrease in prices because reduced orders lead to a decrease in auction prices based on the availability of excess goods in wholesale markets. This paper investigates the effects of operation regulations for large-scale retailers on agricultural producers by surveying agricultural and fishery producer organizations. Research design, data, methodology - A survey was conducted on 117 producer organizations of fruits and vegetables, cereals, fisheries, and livestock products from September 10 to October 4, 2012. Survey items are annual sales, shares of sales accounted for by large-scale retailers, reduction of orders and prices from large-scale retailers, methods to deal with the sales reduction, unfair trade practices of large-scale retailers, opinion of the large-scale retailer regulations, and so on. The average sales of the sampled producer organizations are 13.7 billion won and the average share of sales accounted for by large-scale retailers is 35.4%. Results - Survey results show that the sample producer organizations' sales decreased 10.1% because of the compulsory closures of stores operated by large-scale retailers. It is estimated that the total sales of producer organizations decreased 371.2 billion won because of the regulations on the operation of large-scale retailers. In addition to the direct effect of a sales decrease due to order reduction, agricultural and fishery producer organizations suffered from the secondary effect of price reduction in wholesale markets. When orders from large-scale retailers decreased, most agricultural and fishery producer organizations shipped redundant products to wholesale markets, decreasing auction prices. It was estimated that the price received decreased 21.9% when sold in other marketing channels. As producer organization sales decreased, it was reported that the labor force employed by producer organizations also decreased by 15.1%. Therefore, we can conclude that the regulations for large-scale retailer operations resulted in negative impacts on agricultural producers. Conclusions - Although the sales reduction due to the regulations for large-scale retailer operations are not great, the cumulative effects due to the continued compulsory closure of stores operated by large-scale retailers could be great. This paper suggests governmental programs that could help agricultural producer organizations to find new and effective marketing channels such as direct marketing, farmers' markets, exports, Internet shopping, and so on.

일본의 민경협력치안제도에 대한 고찰 및 시사점 (Review on the Cooperative Policing System in Japan)

  • 현대 사회에서 치안서비스에 대한 국민들의 기대수준은 시간이 흐를수록 상승하고 있고, 경찰의 한정된 자원만으로는 감당하기에 부족한 현상이 발생하고 있다. 지금까지 국가가 독점했던 경찰활동은 다양한 치안활동의 주체들과 협력하는 시스템으로 변해가고 있으며, 지역사회는 경찰이 감시하고 법을 집행해야 할 대상 또는 공간이 아니라 효율적인 경찰활동을 위한 협력자로 인식하고 있다. 일본경찰은 오래 전부터 협력치안을 중심으로 한 경찰활동을 강화하기 위하여 지역주민과 함께 주민들의 신변을 위한 범죄예방과 검거활동, 주민의 불안과 고뇌 등의 다양한 문제 해결활동을 통해 지역사회의 문제를 파악하고 지역주민들과 함께 해결해 나가고 있다. 협력 치안활동을 위한 가장 대표적인 법적 근거에 해당하는 1979년 나가오카쿄시(長岡京市) 방범추진에 관한 조례를 시작으로 최근에는 도쿄도의 각 지방자치단체에서 안전 안심 마을 만들기 조례(東京都安全 安心まちづくり條例)와 함께 지역사회 내의 주택, 도로, 공원, 주차장, 번화가, 학교, 상업시설 등 공간에서 발생하는 범죄취약지역과 각종 시설의 안전을 도모하기 위한 시행규칙과 시행령이 제정 시행되고 있다. 일본의 민경협력치안활동은 단순히 범죄예방을 위해 경찰이 개입하는 것이 아니라 범죄의 도시를 재생하기 위해 오래전부터 실시해온 국가정책의 일환이며, 이에 경찰뿐만 아니라 국토교통성, 총무성, 법무성, 문부과학성, 수상관저실 등 모든 정부부처가 범죄예방과 퇴치 및 안전한 도시를 만들기 위해 협력하고 있는 민경협력치안활동 시스템은 가장 주목받는 시스템이며 그 시사점이 크다 하겠다.

  • 이 논문은 WTO 서비스 협상에 대비하여 우리나라의 방송규제 정비의 필요성을 논의한 정책 연구이다. 커뮤니케이션의 세계화 추세가 진척됨에 따라, 그리고 세계 경제가 정보산업에 의지하는 비중이 커감에 따라, 미디어 정책이 WTO등 세계경제기구의 관심과 논의의 범주에 들게 되었다. 이 같은 변화는 오랫동안 방송영상산업을 문화로 규정, 국가의 정책적 개입을 인정해온 관행에 일대 변혁를 요구하는 것이어서 국제사회에서 큰 파장을 불러일으키고 있다. 방송정책이 문화와 정체성 유지를 위한 개별국가의 고유권한인지, 아니면 시장론자의 견해대로 자유로운 시장유통을 저해하는 무역장벽인지의 문제는 단순한 이론적인 논쟁에 그치지 않는다. 여기에는 각국의 문화적, 경제적 이익의 추구가 관여되어 있으며, 각국의 이해관계는 미국 대 프랑스, WTO 대 UNESCO를 최정점으로 하여 세계 영상산업 지적도 상의 각국의 위상에 따라 다양하게 나타난다. 우리나라는 입지 조건적으로 국가지원 모델을 채택하고 있는 나라와 입장을 같이 하나, 대미관계 때문에 WTO 협상 논의에서 전적으로 자유로울 수 없다. 한국의 전략적 선택을 위해 우리나라의 방송 규제의 제문제를 여타 OECD 국가의 방송규제와 비교, 분석하였다.

보호수 지정 및 관리를 위한 남해안 지역 산림문화자산 실태조사 (A Survey on the Forest Cultural Assets in the Southern Coastal Areas for the Designation and Maintenance of Law-protected Trees)

  • 산림은 우리 생활 가까이에서 의복과 문화, 생존의 기반을 제공해 주고 있는 기본적인 자산이다. 이러한 자산은 문화와 생활로서 지역 주민들의 삶 속에 녹아들어 있으며, 후세로 이어져 나갈 것이다. 본 연구는 산림문화자산에 대한 조사가 부족한 지역인 남해안지역의 노거수 및 군락지와 숲에 대한 현지조사를 실시하여, 보호수로서의 지정가능성을 검토하기 위해 수행되었다. 현장 조사는 남해안에 접해 있는 경남지방 전남지방의 11개 시, 군에 위치한 노거수 및 군락지와 숲 등 80개소를 조사하였다. 노거수 및 군락지와 숲의 건강성과 관리상태를 비교적 객관적으로 측정하기 위한 판단기준을 전문가 표적토론(brainstorming)을 통하여 설정하였다. 현장 조사 결과, 현재 보호수로 미지정된 노거수 및 군락지와 숲 중에서 산림청 예규 제 574호의 기준에 의한 법정보호수 지정 기준을 통과하고, 관리상태도 좋은 노거수 및 군락지와 숲을 선정하였다. 군락지는 남해 난음리 비자나무 숲이 선정가능성이 높으며, 노거수는 하동 평사리 부부소나무를 포함한 13개소의 나무들이 지정 가능성이 높은 것으로 판단하였다. 노거수의 수종은 느티나무 3주, 팽나무 3주, 소나무 2주, 모밀잣밤나무, 왕버들, 후박나무 각 1그루씩이었다. 이러한 노거수와 군락지는 보호수로 지정하여서 국가의 체계적인 관리를 필요로 하며, 우리의 산림문화자산으로서 그 가치를 이어가야할 것으로 판단한다.
