1951년 국민의료법 제정과정에서 한의사 제도를 둘러싼 논쟁 - 국회 속기록을 중심으로 - (Debate on License System for Korean Medicine Practitioners while Establishing the National Medicine Services Law in 1951: Based on Stenographic Records at 11th Provisional National Assembly)

  • The aim of this study is to reflect on the issues of the National Medical Services Law for Korean medicine practitioners (KM practitioners) in Korea, especially those discussed at the Assembly plenary session in 1951. In 1951, the National Assembly wanted to establish the National Medical Services Law (國民醫療法) replacing the colonial medical services law (朝鮮醫療令). Consequently the National Assembly passed the law establishing the license level of KM practitioners equal to that of Western practitioners. But the progress of establishing the law was not easy. There was much dispute over the KM practitioners system amongst the legislators at the Assembly plenary session in 1951. One of the main dispute was about setting the license level of KM practitioners. There were two main positions. One insisted that the license level of KM practitioners should be equal to that of Western practitioners. They had many reasons to support their contended point. From a historical, social, economical, medical and institutional point of view, they argued that the people had needed the KM and thus the new founded Korea had to reflect this situation. The other insisted that the license level of KM practitioners should be below that of Western practitioners. The reason was mainly that the KM was not scientific. This study concludes that the argument of the former was superior to the latter in quantity and quality.

  • Objectives: The aim of this study was to reflect upon the process of the legislation of the National Medical Services Law for traditional Korean medicine practitioners (TKM practitioners), especially at the Assembly plenary session of 1951. Methods: Various primary sources related to the legislation were examined, especially those in National Assembly Records and newspapers. Results: In 1950, the National Assembly wanted to establish the National Medical Services Law (國民醫療法) replacing the colonial medical services law (朝鮮醫療令), but it ended in failure. So in 1951, the National Assembly tried again. First, legislator Han Gukwon (韓國源), with 83 other legislators, introduced a bill for the new national health care system. The Society and Health (社會保健委員會) and the Legislation and Judiciary subcommittees (法制司法委員會) deliberated on this bill, and each proposed an amendment to the National Assembly. In the process of careful deliberation of these three proposals, the Ministry of Health and legislator Kim Ikgi (金翼基) each came up with a further amendment. Ultimately, Kim Ikgi's amendment was accepted by the National Assembly. According to his proposal, TKM practitioners were titled 'Hanuisa (漢醫師)', and the medical office name of TKM practitioners became 'Hanuiwon (漢醫院)'. Conclusions: The National Medical Services Law passed in 1951 was the beginning of the unique dual national medical license system of Korea. It recognized Western medicine and TKM practitioners equally under the national license system.

캘리포니아 침구 및 동양의학 교육과 면허관리 체계 연구 (A Study of the Education and Licensure System of California Regarding East Asian Medicine and Acupuncture)

  • In the United States, California is well known for its rigorous education and licensing system regarding East Asian Medicine and acupuncture. As in most other states in America, the State government controls the practice of acupuncture, massage, acupressure therapy, food therapy, and natural therapy using a board established to set, maintain, and uphold licensing credentials for acupuncturists and practitioners of East Asian medicine. In California the system started in the 1970s when the State Legislature passed a bill to measure competency, and license acupuncturists. This study briefly describes the California Acupuncture Board (CAB), which is authorized to control the related education, examination, continuing education, and management of licenses already awarded. This study addresses the essential and minimum educational requirement established by the CAB for licensure, that is mandate classroom lecture with additional 950 hours clinic training, and the 50 hours of continuing education credits earned every two years, for maintaining the license.

전문방사선사 제도의 개발에 관한 연구 (A Study on System Model of Clinical Specialist in Radiologic Technology)

  • License system of radiologic technologists has been started since 1965 in Korea. This study is to explore directions on radiotechnologists' license system classified by subspecialty. For this purpose, the authors surveyed on radiotechnologists' license system classified by subspecialty, with the subject related to radiotechnologic societies. Additionally, data on qualification and license system associated with medical and health care field were collected. The results are as follows. 1. The main body for subspecialty system for radiologic technologists should be the Korea Radiologic Technologists Association and the Association should maintain a close cooperation with radiotechnologic societies. 2. A radiologic technologist should be a basic role once they pass the license examination. In addition, they can get a special qualification by subspecialty in radiologic technology. 3. Radiotechnologists' license system classified by subspecialty will be keep priorities in order and done systematically. Execution order is as follows ; This study proposes that radiotechnologists responsible for ultrasonography, computed tomography(CT), magnetic resonance imaging(MRI) and security management be started for the first stage. For the second stage, radiotechnologists for mammography, angio-cardiography, digital imaging, maxillo-facial and dental radiography, nuclear medicine, radio-therapeutic field should be in force. 4. Professional education course(basic and intensive) and clinical training program have to be made for the eligibility of radiotechnologists' license system classified by subspecialty. 5. Eligibility system of radiotechnologists' license system classified by subspecialty(non-government or government) has to be made. Further more, inquiry commission to investigate eligibility for radiotechnologists' license system should be established.

미국 방사선사 면허제도와 기본 교육과정에 대한 고찰 : 텍사스주 일개 대학 사례를 중심으로 (A Study on Radiologic Technologist's License System and Primary Pathway Education Curriculum in the United States American : Focused on One Case of College in Texas)

  • The purpose of this study was to study on radiologic technologist's license system and primary pathway education curriculum in the United States American (USA), focused on one case of college in Texas. We were collected and analyzed through class participation at a community college in Tarrant, interviews with professors of radiologic science and clinical radiographers, field trips, an internet search, and literature reviews. As a result, first, the American radiologic technologists license system is composed of fifteen chapters, and the professional education courses for each field are being carried out through three courses of a primary pathway, a post primary pathway and a physician extender. Second, the primary pathway courses consisted the radiography, the radiation therapy, the nuclear medicine, the magnetic resonance imaging, the sonography. Third, the USA had about 30 times more clinical practice time than Korea. In clinical practice, students had done actually examination through X-ray exposure on patients. Last radiographers in the USA was able to perform intravenous injection of radiopharmaceutical agents on patient, so that he could perform rapid examination and efficient manpower operation. This study could be used as basic data for the globalization of radiologic technologists license system in Korea.

  • In the case of Korea, both of modern medicine and oriental medicine are admitted as medical practices in the system. In other words, healthcare system is dualized. However, medical practice that corresponds to oriental medicine in Korea is substitution of medical practice in cases of foreign countries. For use of medical devices, it is provided only for doctors and medical technician relevant to use. Particularly, although oriental medicine is recognized as orthodox medicine in terms of the features of Korean medical system, superintendency of oriental doctors is not identical with that of doctors for use of medical devices and superintendency toward medical technicians. Recently, Cheongju District Court decided that superintendency of oriental doctor upon physical therapist is not acknowledged. It can be said that the judgement is opposed to the original verdict which judged that oriental doctors' employment and guidance of oriental doctors upon physical therapist is permissible. Hence this study aimed to review on domestic medical law system, which is dualized, roles of medical professionals, intent of the medical license system, provisions related to medical technician law and relevant precedents. Regulations on practices other than licensed practices by medical professionals are made because medical practices may affect on danger toward life and body of human and public health also. Therefore, the nation regulates medical professionals having licenses to perform medical practices within the range of the licenses. It is clearly prescribed that medical technicians may perform medical practices under instructions of doctors or dentists pursuant to the medical technician law. In addition, the court also judges that it is out of the license of oriental doctors if they use CT devices and limits the use of modern medical devices by oriental doctors. That is to say that it limits oriental doctors' employment of medical technicians and pursuant of oriental doctors on medical technicians as well.

해외교육 치과의사의 국내유입에 따른 치과 의료의 질 보장 및 치과의사의 적정수급 - 일본과 중국을 중심으로 - (Quality assurance of dental care and appropriate supply of dentists in view of the increasing inflow of dental graduates from abroad)

  • The purpose of this study is to analyze the data on the medical personnel education system and license scheme and provide the basic material for an enhanced qualification system. In China, dental education reform has been underway with a view to providing an inclusive basic medical service package to the whole country by 2020. It is also estimated that the number of Korean dental medicine students in China would be fewer. And most of them desire to get a job in China after acquiring the Chinese license, suggesting little prospect of a massive inflow into Korea in the near future. In Japan, students are required to complete a clinical training program for over 1 year after receiving licenses to become an independent practitioner. But they can apply for the Korean preliminary examination without this post-graduation process. For this reason, the quality issue in license effectiveness review has been seriously discussed. It is deemed desirable to limit the Korean accreditation to Japanese graduates from the dental schools certified by the Japanese dental accreditation body.

한방의료기관 근무 한의사의 정책 현안에 대한 인식 조사 (A Survey on the Recognition of Pending Policy among Oriental Doctors Working in Oriental Medical Institutions)

  • Objectives: The objective of the study was to resolve various elements of conflict by presenting the results of the study and to help build an enhanced oriental medical service system. Methods: The researcher collected data from 12/15/2006 to 1/31/2007. A total of 1000 questionnaires were sent out to oriental medical doctors working at oriental medical facilities and the 15% (150 questionnaires) of them that were returned completed were analyzed. Results: 1. As to the proper proportion of oriental medical doctors to western medical doctors, they said it should be less than 20%. About separating the task of prescribing oriental medicine (herb) from oriental medical treatment, 80.7% of them were against it. 98.7% said oriental medical doctors needed the control of medical technicians. 2. 72.3% said they had no intention of taking the U.S. NCCAOM board to practice oriental medicine overseas. A majority (57.7%) were in favor of unifying oriental medical license with western medical license. 3. Oriental medical doctors had greater job satisfaction [than all oriental medical doctors number]. If they were to choose another occupation than oriental medicine they would consider becoming a research fellow above all other occupations. If they were to reenter college, they said they would probably choose oriental medical school. However, the choice of reentering oriental medical school was lower than that of western medical school. Conclusion: This study has also statistically determined the current issues that may pose conflicting views on the part of the respondents. A periodic study such as this one will hopefully aid in establishing policies for oriental medicine.

대학(대학원) 졸업 후 의사 수련교육 거버넌스 고찰 (Review the Governance of Graduate Medical Education)

  • Education on the physician continues with undergraduate medical education, graduate medical education, and continuous medical education. The countries such as the United States, Japan, the United Kingdom, German, and others are required to undergo training in the clinical field for 2 years after completing the national medical examination, and to become doctors after passing the clinical practice license test. Korea can obtain a medical license and become a clinical doctor at the same time if it passes written and practical tests after completing 6 years of undergraduate medical education or 4 years of graduate school. About 90% of medical school graduates replace clinical practice with 4-5 years of training to acquire professional qualifications, but this is an option for individual doctors rather than an extension of the licensing system under law. The medical professional qualification system is implemented by the Ministry of Health and Welfare on the regulation. In fact, under the supervision of the government, the Korean Hospital Association, the Korean Medical Association, and the Korean Academy of Medical Sciences progress most procedures. After training and becoming a specialist, the only thing that is given to a specialist is the right to mark him or her as a specialist in marking a medical institution and advertising. The government's guidelines for professional training are too restrictive, such as the recruitment method of residents, annual training courses of residents, dispatch rule of the residents, and the quota of residents of training hospitals. Although professional training systems are operated in the United States, the United Kingdom, France, and Germany, most of them are organized and operated by public professional organizations and widely recognize the autonomy of academic institutions and hospitals. Korea should also introduce a compulsory education system after graduating from medical education and organize and initiate by autonomic public professional organization that meets global standards.

인턴제도 폐지 논의 이후의 의학교육 변화 (Accelerating Change in Medical Education after the Dismantlement of the Intern Training System)

  • In light of changes in today's medical environment, whether to dismantle the 50-year-old internship training system in the Republic of Korea is under debate. Although the question remains open, discussions on such issues have drawn attention to the quality of the clinical clerkship and student career advisory programs in medical colleges. The purpose of this study is to analyze the experiential clerkship and career exploration issues. Ensuring excellence of the clerkship and career advisory sessions is an essential responsibility of educational institutions regardless of whether the intern training system is dismantled. Important objectives of the experimental clerkship include reinforcing prerequisites established by law, introducing a student practice license, developing a standardized clinical assessment and student portfolio requirement, and publishing a guidebook for clinical directors. For career exploration, it is necessary to broaden participants' experiences of specialties and to manage the variety of student career guidance programs. It is imperative for the Korean Association of Medical Colleges, in collaboration with medical colleges, to play a leading role in focusing more attention and effort on such issues.
