A Study on Development of Domestic School Library Standard (우리나라 학교도서관 기준에 관한 연구)

  • This study researched the domestic School Library Standards(SLS), and analyzed specificities and differences by criteria. The Ministry of Education, Science & Technology have enacted the School Library Promotion Law(SLPL) supporting school library. SLPL and SLS could not reflect a change of school library environments in recent years. In particular, these standards have the problems with budget assignment, educational services, information resources, and human resources. Therefore, this study suggested a new model of SLS and set up some definite criteria for school library management.

Copyright Issues in Nigeria: Analysis of Nigerian Copyright Commission Cases Between the Years 2008 - 2018

  • Nigeria Copyright Commission is saddled with the responsibility of ensuring adherence to the copyright law in Nigeria. However, it has been observed in the last decade that copyright right issue is still rampant in Nigeria. Therefore, this study analyzed cases that the Commission in involved in between years 2008 to 2018. The study adopted citation analysis. The study collected data from three selected law reports, which include Intellectual Property Law Reports, Nigerian Weekly Law Reports and Nigeria Law Intellectual Property Watch. It was found that Nigerian Law Intellectual Property Watch has the highest number of reports of cases involving Nigerian Copyright Commission while none was reported by Nigerian Weekly Law Reports. It was also found that most of the cases handled by the Commission were on copyright infringement. The study concludes that Nigerian Copyright Commission has been paying credible attention to issue that surrounds software infringement but there has been little attention paid to book piracy. Moreover, it was established that the poor attention given to book piracy may entrench the publication of pirated copy and would subsequently lead to poor library service provision at the long run.

A Study on the Analysis and Direction for Revision of the Small Library Ordinance in Gyeonggi-do (경기도 작은도서관 조례 분석 및 개정방향에 관한 연구)

  • It is expected that Gyeonggi-do Small Libraries will increase in quantity in the future due to the current SOC complex project being implemented by the government, and it is deemed that institutional and policy support must be provided with priority in order for the Small Libraries to grow qualitatively through the implementation of substantial measures. Based on the findings of this study, the reform measures proposed to revitalize Gyeonggi-do Small Libraries in terms of ordinances as follows: ① strengthen the library law and business promotion related to Small Libraries; ② enact the mandatory library law provisions for the installation of and support for Small Libraries; ③ even if there are relevant provisions in the 「Library Act」, the local governments' Small Libraries Support Ordinances should at least simply state that they must meet the criteria specified in the 「Library Act」; and ④ provisions on the number and qualifications of operating personnel of Small Libraries reflecting the number of users and the size of collections of books of Small Libraries of cities and counties.

  • The National Library of Korea recently proposed a draft of an Act on Legal Deposit and Use for the Online Digital Products and researches about deposit system and remuneration of the digital products are in progress. Based on the law of library and copyright, remuneration of deposit and use products is paid. A draft of a proposed law include information about the remuneration payment. For these reasons, the method for efficient remuneration management is required. In this paper, we propose effective remuneration management system which follows a draft of an Act on Legal Deposit and Use for the Online Digital Products.

A Comparative Analysis on Copyright Limitations for Libraries in Major Countries (주요 국가의 저작권법상 도서관관련 권리제한 비교분석)

  • Since the England's Parliament revised the British copyright law and enacted the first copyright exception specifically for libraries (user or service) in 1956, copyright exceptions applicable to libraries have been an important part of world copyright laws through the last few decades. Copyright exceptions for libraries are a critical legal tool to preserve intellectual and cultural heritage, promote equitable access to knowledge and information to the public, and to support learning and research. Based on these reasons, this study analyzed and compared the current state of copyright structure and limitations or exceptions for library in six major countries(United States, United Kingdom, Germany, France, Japan, and Republic of Korea).

  • This study is to recognize the function of the regional central library's role and to address its support to the community public libraries ; such is one of the focuses of the revised library law. Through the mixed layer model, the regional central library can contribute to a better cooperation between the national central library and community public library in each region. Regional libraries. under the supervision of regional library service committee, can execute many local enterprises efficiently such as library informatization projects. the associative storage, the regional librarian education and the establishment of information commons through integrating the regional information.

A Comparative Analysis of the Library Exceptions in Copyright Laws in Major Countries (주요국 저작권법의 도서관 예외 규정 비교 분석)

  • The purpose of this study is to enhance the understanding of the provisions for library exceptions in copyright laws and to suggest the direction for the revision of provision in the Copyright Act of Korea. This study compares and analyzes the provisions for library exceptions in several countries' copyright law including Korea, Japan, UK, Australia and USA. This study found that the most common issues in library exception provisions are providing reproduction for users, reproduction for preservation, reproduction for interlibrary loan and digitization of library collections but the conditions for each issue are quite different. The suggestions for the revision of the library exceptions in the Copyright Act of Korea are as follows: changing the amount of reproduction of unpublished works, of works which cannot be obtained at a fair price and of periodicals for users, the transmitting digital reproduction to the user under limited conditions, preparing conditions for reproduction for preservation in libraries, preparing the applicable provisions for reproductions for interlibrary loans and for the limitation of works to be digitized and extending their use at the same time.

An empirical analysis on the present situation of government publications and the operation of the publications in library (정부간행물의 출판현황과 도서관의 정부간행물 운영실태분석)

  • Government Publications are published to keep records of governmental activities and performances. In a rapidly changing information-oriented society, it is badly required for the operation system of government publications and a library to be effectively managed with government publications for satisfying 'right to know' of people and improving the obligation of government to 'let people know.' Accordingly, the purpose of this paper is to analyze such five research items as the situation of the publication and distribution of, government publications, the operation system of the publications in library, the number of publications regarding secondary information sources for the publications, and the legal deposit of the publications in the National Library, in order to proceed with a subject as to how much the government publication is satisfying 'right to know' of people. The research findings were suggested as follow : 1) Despite the fact that the publication of government publications has been gradually increased every year in numbers and kinds, it is unfortunately pointed out that the publications, distributions and sellings of them were not well organized and systematic. That is, the government publications had not been published more than 1.47% of all publications in number. Moreover, more than the half of the publications were non-periodically or annually published. To make the matter worse, it was not easy to get an access to the publications because of the publications not to be sold. 2) It a n.0, ppears that people could not use the publications efficiently because the library and administrative document office did not pay sufficient attention to public relations for all sorts of government publications. Not only that, there were not enough numbers of publications regarding such secondary information sources as bibliography, index and catalog. A speedy searching capacity for the information gave rise to another serious problem which the government publications could not be effectively used. 3) It is legally stated that all sorts of government publication should be deposited to the National Libraries. However, the law was not properly put into force because of lack of understanding of government agencies about the law.

The Study on Copyright Limitations for Activation of Use of Public Works (공공저작물 이용 활성화를 위한 저작권 제한 연구)

  • Public works has been created by the taxes of the people, so free access and use of public works without charge in the public sector must be guaranteed for the benefit of the public. To do this, above all, a legal basis for solving the problems of the process for copyright should be to establish. Therefore, this study examined the legal concept of public works and the concept and scope of public institutions. And this study, as legislation case to limit the copyright protection of public works, analyzed the relevant provisions of copyright law and the recent revised plan in the U.S., UK, and Germany. And then I analyzed the regulations for limitation of copyright protection of current copyright law and the draft of copyright law on public works in Korea. Based on the results of these analyses, this study suggested the legal revised plan to expand significantly the limitations of copyright in order to activate the use of public works in the library.

A Study on the Roles and Characteristics of Record Center(Jaryokwan) in Korea (한국 자료관 제도의 역할과 특징에 관한 연구)

  • The purpose of this study is to seek the characteristics of Jaryokwan m Korea and suggest the direction of the development for the future, through the analysis of the work process for Record Center(Jaryokwan) regulated in the Law of Records and Archives Management(the Law). According tn the Law, Jaryokwan is supposed to cover the areas of the management of semi-current records, government publications, books, and other records. The analysis of the Law shows that Korean Jaryokwan has the characteristics of divisional management of the semi-current records of governments, pursuing the integrated records and archives management systems, tightening the control function from the current-records stage, emphasizing the protection of evidences and security, contribution to the decentralizing storage of archives and simplifying the access to semi-current records for promoting it's usage. For the future development of Jaryokwan in Korea, this study suggests the imminent needs of the development of ideal model for Korean Jaryokwan, the legal enforcement of posting an Archivist the more detailed regulation, procedures and methods of work, the close collaboration with Library and Information Science, the pursuit of developing as a regional information center, increasing the flexibility of establishing Jaryokwan.
