보도기사의 재산권적 가치와 무단전재를 통한 저작권 침해에 관한 연구 (A Study on the Property Values of News Articles and Copyright Infringement)

  • 공공의 영역에 속하는 뉴스의 사실 자체는 공기처럼 자유로운 것이지만, 이것이 노동과 자본의 투자로 뉴스로 전환되었을 때, 상업성이 인정되는 재산권적 가치를 갖게 되며, 이를 생산한 언론사는 배타적 권리를 갖게 된다. 상품으로서 뉴스는 재산인 것이다. 재판부도 이러한 취지에 부합하게 사실보도에 대한 저작권 보호의 범위를 넓게 인식할 필요가 있다. 법으로 보호되는 것은 표현의 방법, 사건에 대한 기자의 분석과 해석, 문장의 구성과 자료의 배열, 단어의 선택, 특정한 부분에 주어진 강조 등이다. 즉, 침해의 핵심은 일반적인 주제나 사건 보도에 있는 것이 아닌 취급의 유사성이나 표현 방법의 착취에 있다. 보도기사가 사실적 요소들을 열거하여 정보를 전달하고 있지만, 소재의 선택과 문장 속에서의 용어의 배열, 강조 등은 학문이나 예술과 같은 고도의 창작성을 갖는 것은 아니지만, 낮은 정도의 창작활동에 속하는 것이다. 따라서 보도기사를 단순한 사실의 전달에 머물러 창작성이 결여되었다고 판단하는 것은 저작권법 원래 취지와도 배치되는 것이다.

라틴아메리카 국제중재의 최근 발전경향과 특징 (Recent Trends and Characteristics of International Arbitration in Latin American Countries)

  • The reluctance of Latin American countries to practice international arbitration is not a new topic in international law. This reluctance historically based on Calvo Doctrine provoked not only the absence of Latin American countries from the major international commercial arbitration conventions, but obsolete national arbitration legislation. Recently, however, these countries have undertaken major steps showing that the region is no longer reluctant to practice international commercial arbitration. Most Latin American countries have ratified the 1958 Convention on the Recognition and Enforcement of Foreign Arbitral Awards ("New York Convention"), the 1965 Convention on the Settlement of Investment Disputes ("Washington Convention") and the 1975 Inter-American Convention on International Commercial Arbitration ("Panama Convention"). The majority of Latin American countries have also modified and adapted their national legislation on arbitration to the UNCITRAL model law. Even judiciary has been following this pro-arbitration. This article will focus on some of these factors provoking the acceptance of international commercial arbitration in Latin America to trace the common trends and characteristics in an attempt to understand better how international arbitration set on its place firmly. For this purpose we selected five countries, Brazil, Argentina, Chile, Mexico and Venezuela, to analyse legislations and jurisprudence. Latin America is ready to challenge any obstacles to promote arbitration as alternative methods of judicial resolution. There is an ever-increasing number of international arbitration in Latin America. Both practitioners and judiciary have shown desires to promote the resolution of disputes by arbitration and used the legal instruments to ensure that process interpreting and applying legislations for pro-arbitration. Even there remains Calvo Doctrine's culture in Latin America still now, it should be certain this culture will disappear from the conduct of international arbitration.

Guarantees of Applying Disclosure and Transparency on the Companies Listed in the Saudi Capital Market

  • By explaining the essence of corporate governance as well as disclosure and transparency, the study examined the guarantees of applying disclosure and transparency to firms listed on the Saudi stock exchange. The research also addressed the disclosure and transparency duties of firms listed on the Saudi stock exchange. Finance to prepare a prospectus, as the Capital Market Authority's regulations required that the prospectus includes information that enables the investor in securities to make his investment decision based on real foundations based on the issuing company's financial position and to ensure that companies fulfill that disclosure in the prospectus. Firms who fail to disclose are required by law to do so, and the Capital Market Authority's laws mandate companies listed on the financial market to regularly report fundamental events linked to the issuer or the securities issued by it. The Capital Market Authority must make it available to the public dealing with the business issuing the securities, and The Capital Market Authority's Law and Regulations have imposed fines on corporations that do not comply with disclosure and make the Board of Director's report available. The research focused on activities that the legislator deemed to be a breach of the obligation of openness, such as the danger of many measures aimed at ensuring the impartiality and transparency of trading in the Saudi financial market, as well as the absence of conflicts of interest. The research also addressed the sanctions imposed on The source for failing to meet the obligation of disclosure and openness, as well as the mechanisms of compensating persons harmed by the failure to meet that responsibility.

북한의 외국인투자법과 대외경제중재법의 적용범위 (The Scope of Application of North Korea's Foreign Economic Arbitration Act and Foreign Investment Act)

  • The Scope of Application of North Korea's Foreign Economic Arbitration Act and Foreign Investment Act This article examines whether the Foreign Economic Arbitration Act and the Foreign Investment Act of North Korea apply to South Korean parties or companies. This article analyzes laws and agreements related to economic cooperation between South Korea and North Korea. Furthermore, this article compares and evaluates laws related to foreign investment and enacted in North Korea. Now, North Korea's door is closed due to economic sanctions against it, but it will be opened soon. Thus, this article prepares for the future opening of North Korea's markets. Is there a rule of laws in North Korea or just a ruler? Are there laws in North Korea? North Korea has enacted a number of legislation to attract foreign investors, referring to those Chinese laws. For example, North Korea enacted the Foreigner Investment Act, the Foreigner Company Act, the Foreign Investment Bank Act, the Foreign Economic Arbitration Act, the Foreign Economic Contract Act, the International Trade Act, and the Free Economy and Trade Zone Act, among others. Article 2 (2) of the Foreign Investment Law of North Korea states, "Foreign investors are corporations and individuals from other countries investing in our country." It is interpreted that South Korea is not included in the "other countries" of this definition. According to many mutual agreements signed by South Korea and North Korea, the relationship between the two Koreas is a special relation inside the Korean ethnic group. An arbitration between a South Korean party and a North Korean party has the characteristics of both domestic arbitrations and international arbitrations. If the South Korea and North Korea Commercial Arbitration Commission or the Kaesong Industrial Complex Arbitration Commission is not established, the possibility of arbitration by the Chosun International Trade Arbitration Commission, established under North Korea's Foreign Economic Arbitration Act, should be examined. There have been no cases where the Foreign Economic Arbitration Act is applied to disputes between parties of South Korea and North Korea. It might be possible to apply the Foreign Economic Arbitration Act by recognizing the "foreign factor" of a dispute between the South Korean party and North Korean party. It is necessary to raise legislative clarifications by revising the North Korea's Foreign Economic Arbitration Act as to whether Korean parties or companies are included in the scope of this Act's application. Even if it is interpreted that South Korean parties or companies are not included in the scope of North Korea's Foreign Economic Arbitration Act, disputes between South Korean companies and North Korean companies can be resolved by foreign arbitration institutes such as CIETAC in China, HKIAC in Hong Kong, or SIAC in Singapore. Such arbitration awards could be enforced in North Korea pursuant to Article 64 of North Korea's Foreign Economic Arbitration Act. This is because the arbitration awards of foreign arbitration institutes are included in the scope of North Korea's Foreign Economic Arbitration Act. The matter is how to enforce the North Korean laws when a North Korean party or North Korean government does not abide by the laws or their contracts. It is essential for North Korea to join the New York Convention (Convention on the Recognition and Enforcement of Foreign Arbitral Awards) and the ICSID Convention (Convention on the Settlement of Investment Disputes Between States and Nationals of Other States).

  • 이 글은 선박매매에 관하여 해사법상 법률관계와 영국 보통법상 판례의 판결 그리고 한국 해운산업에 대하여 몇 가지 입법적 제언으로 구성한다. 최근 신조선박의 수주량과 거래는 대부분 동아시아의 한국, 일본 그리고 중국에서 형성되고 있다 특히 한국의 주요 조선소들은 규모를 확대하고 있고 LNG(액화천연가스) 수송을 위한 새로운 해운산업을 개척하고 있다. 여기에 한국의 정부도 점차 인터넷을 통한 중고선박매매의 활성화에 관심을 두고 있으며, 한국해운거래소를 설립할 계획도 모색하고 있다. 그러므로 이 글은 선박매매의 법적 특질, 선박매매의 표준서식, 및 선박매매에 관한 해사법상 문제점 과 개선방안을 제언함으로 결론적으로 해사법상 선박매매의 입법적 제시와 한국형 선박매매서식의 제작, 해사법상 선박매매에 관한 현행법 제 ${\cdot}$ 개정 및 특별법제정과 한국해운거래소 설립의 필요성을 제언한다.

온천관광지 개발실태 조사연구 (Study on the Development Status of Korean Hot Springs)

  • Hot springs development will be more activated with the five-day work week system than before. Nevertheless, investment and development achievement of hot springs has not resulted in a successful performance to foster townships, and this calls upon locals to build a guideline to develop hot springs. This study intends to analyze laws on hot springs, which influence mostly on the hot spring development, to gather up the information on the present state of the development, and to suggest considerations for further development plans. Features of the hot spring development are as follows: One is that metropolitan cities will discover hot spring resources more than small cities. Therefore the development will be twofold : one for resort tour and the other for one-day rest and recreation. In addition, Korean laws on hot springs are more site development-oriented to support tourism and recreation than to protect environment and discover unused resources. This makes hot spring development easier and efficient being supported by hot spring law, law on territory development and use, and tourism promotion law. On the other side, planned landscape trimming can be uniformized and unharmonized in terms of local identity and environment-friendliness. This is why careful considerations such as goods and bads of the local resources, local history and culture are needed in hot spring development. A long-term development project should include remodeling based on local identity and development trends. The third point indicates that Korean hot springs development has recorded relatively low performance due to difficult private capital attraction, and a high fence on land purchase and development approval. It is essential to release restrictions on the hot spring development-especially on those whose development performance has not been successful so that best practice can be supported by the government in remodeling and marketing. New plans on hot spring development should be also examined based on developer's capacity and local authorities' volition on the plan. Last point shows that most hot springs development plans have been designed only based on territory utilizing plan and facilities arrangement, not considering much on fund-raising, operational plan or feasibility analysis. Therefore the tourism promotion law should reinforce guidelines on tourist site approval system by supplementing criteria. At the same time, an education on tourism development planning is necessary to deepen developers' understanding, since most developers are experts more on city development, landscape architecture, designing, constructing and engineering than tourism development.

경기주최자의 재산적 이익의 법적 보호방안과 지식재산권 도입론 (Study on the Legal Protection of Sports Organizer's Profit and Introduction of Intellectual Property Right)

  • 스포츠 경기는 저작물에 해당하지 않으며, 우리 법제는 경기주최자의 재산적 이익을 지식재산권으로 규정하지 않고 있다. 프랑스를 제외한 대부분의 국가들도 경기주최자의 지식재산권을 인정하지 않는다. 따라서 경기주최자의 재산적 이익 보호를 위한 법적 근거는 현행 법제에서 찾아야 하는데, 이에 대하여는 불법행위법, 부정경쟁방지법이 제시될 수 있다. 물론 이러한 법제가 타인의 투자와 노력에 무임편승해서 부당하게 경제적 이익을 취하는 것을 규제함으로써 경기주최자의 재산적 이익의 보호에 큰 역할을 할 수 있는 것은 사실이다. 그러나 지식재산권법의 보호범주 밖에 있는 스포츠 경기와 이와 관련된 정보는 '공공의 영역'에 포함된다고 보아야 하기 때문에, 이러한 법리에 기초하여 경기주최자의 재산적 이익을 보호하는 데에는 한계가 존재한다. 따라서 입법을 통해 경기주최자의 지식재산권을 창설하는 것이 경기주최자의 재산적 이익을 충실하게 보호하는데 기여할 것으로 보인다. 관람 스포츠 산업이 활성화 된 국가에서도 경기주최자의 지식재산권 도입에 대하여 활발한 논의가 진행 중이다. 다른 분야도 마찬가지겠지만, 지식재산권분야는 시장의 국제화로 인하여 국제적 동향이 상당히 중요하며, 여기에 민감하게 반응하여야 한다. 따라서 국제적 추세를 반영한 경기주최자의 지식재산권 도입을 위한 논의가 이어졌으면 한다.

  • Grouping ports in certain region by their characteristics could be used as the principal informations to establish national policy for port development or investment and also to analyze the competitiveness between ports. Currently Korean ports are divided into two groups such as the local port and the designated port containing foreign trade port and coastal port under the Korean port law. These divisions seem to be used for port administration as the matter of convenience but some qualitative grouping is needed for research of port problems. In this paper, 28 major Korean ports were clustered by the similar characteristics using Fuzzy C-Means and found to be classified 8 qualitative groups.

  • This paper presents the methodology which analyze the effect of harmonics in power system. 인도 소프트웨어산업의 혁신과 정부정책의 역할

  • The purpose of this paper is to evaluate the Indian Software Industry and t government's industrial policy by analysing the characteristics of the software industry, authority, development process, social infrastructure, and public sector. The Information age is creating profound changes in the way we live and work. It is transforming all aspects of society, stimulating new opportunities. Over the past decade, India has deliberately prepared itself to meet the new challenges of the information age. India became an important player in shaping world software industry. Through the industrial policy, Indian government is focusing on 1) the development of software industry, 2) dramatic increase in IT scientists engineers, and the promotion of education institutes, 3) the establishment of the software technology Parks (STP), 4) the inducement of foreign direct investment, 5) extensive standardization, 6) the coordination of the law and system. India has liberalized finance and telecommunications system in an effort to bring in more business, and has revamped education curriculums to encourage more creativity among students. Government has played crucial role in bringing India one of advanced software nation by presenting the grand vision and sophisticated plan, liberalizing telecommunication market, and enhancing the efficiency of bureaucratic system.
