  • The safety and health law, the basic regulation of occupational safety and health for industry, is overlappingly and unconsistently controled by many non-profit organization or / and government organization. Because of above reasons, it is hard to investigate and suggest consistently. This study is proposed to remove inefficient and overlapping regulation and suggest how to manage the safety and health regulation in private industry. Safety and Health is the most important managed area under business environment. The safety and health regulation or law for Korean private industry is compared with foreign country's.

Changes in Labor Regulations During Economic Crises: Does Deregulation Favor Health and Safety?

  • Objectives: The regulatory changes in Korea during the national economic crisis 10 years ago and in the current global recession were analyzed to understand the characteristics of deregulation in labor policies. Methods: Data for this study were derived from the Korean government's official database for administrative regulations and a government document reporting deregulation. Results: A great deal of business-friendly deregulation took place during both economic crises. Occupational health and safety were the main targets of deregulation in both periods, and the regulation of employment promotion and vocational training was preserved relatively intact. The sector having to do with working conditions and the on-site welfare of workers was also deregulated greatly during the former economic crisis, but not in the current global recession. Conclusions: Among the three main areas of labor policy, occupational health and safety was most vulnerable to the deregulation in economic crisis of Korea. A probable reason for this is that the impact of deregulation on the health and safety of workers would not be immediately disclosed after the policy change.

Analysis of the relationship between self-efficacy beliefs and industrial accidents (안전효능감과 산업재해의 관계 분석)

  • Two studies were conducted to examine the relationship between self-efficacy beliefs and industrial accidents. In the preliminary study, focus group interviews were conducted with employees working in manufacturing and construction sector, safety managers, and government officials to understand factors that were associated with industrial accidents. Based on interviews, a questionnaire survey was constructed to assess individual factors (such as self-efficacy beliefs, following safety procedures, life-satisfaction, and stress) that were identified as affecting industrial accidents (such as minor and major accident rates). The questionnaire were administered to a total of 917 respondents (542 employees working in the manufacturing and construction sector, 210 safety managers, and 165 government employee officials overseeing government regulations). The result indicated that three subscales of self-efficacy for employees (self-regulation, enlisting social support, and controlling the environment) were negatively correlated with the company's industrial accident rates. Moreover, those employees with higher self-efficacy were more likely to follow safety procedures and had higher life-satisfaction and lower stress levels. For safety managers, the self-efficacy beliefs were positively correlated with better implementation and higher effectiveness of the educational programs and negatively correlated with their company's accident rates.

  • This study includes definitions and major issues relating to product safety, and reviews about product safety laws of Korea and of other countries. In addition, this study suggests several ideas for a future governmental policy concerning product safety and the government policies to guide in securing consumers' safety of products. First, we need to set up consumer safety policies and laws dealing with complex consumer safety issues and to integrate existing laws for the safety of products. Second, opening a consumer safety agency and training workers who have relation to the safety policy, as a profession, are necessary. Third, it is required to redefine the product safety guidelines, strengthen the safety policy and to minimize safety regulations by the government directly. Fourth, each product of the safety management policies must be regularly evaluated and given feedback for improving its effectiveness. Fifth, information gathering, disclosing, and having a feedback system related to product safety should be rebuilt for the effective management of unsafe products. In addition, laws and the aims of product safety management being changed to focus on the consumers, control on imported products, collaboration with network and mutual-assistance systems of product safety-related agencies including international organizations and major countries and taking leading roles in the world are essential.

  • The Korean government had enacted 'Special Regulation on the Safe Maintenance of Facilities' and carried out regular safety inspections since the mid-1990s, consequently establishing and enforcing an effective maintenance and management system. And throughout this entire process, the government searched for new methods to increase the overall effectiveness of the system. Nevertheless, the reality is that our society remains structurally unprepared to implement a commercial mindset that views the concept of "safety" as a product that can be traded in the open market based on supply and demand. Therefore, the government should establish mid to long-term plans to implement such a system in successive stages.

The study on improving the regulation for industrial accident rate level assessment of construction companies (건설업 산업재해발생률 산정·평가기준 개선방안 연구)

  • The regulation for industrial accident rate level assessment of construction companies was introduced to the construction industry in the Republic of Korea since 1993 and has brought positive outcome on industrial accidents reduction at construction work sites. There were considerable decrease of industrial accident ratio and enforcing of contrators' safety organizations from the beginning of the regulation for industrial accident rate level assessment. In spite of these positive outcomes, there were some negative effects such as contractors' shrinking accident reports to keep good accident ratios since these figures had a great impact on pre-qualification stage of bidding when general contractors were competing for new construction projects. In addition, Comprehensive evaluation bid system, which replaces the lowest price bid system is applied to government-ordered construction projects since 2016. Comprehensive evaluation bid system includes construction company's accident rate as one of the evaluation items and carries out with the industrial accident rate level assessment of construction companies at the same time. The regulations of two systems have been called for improvement to unify these different procedures and standards which have led business stakeholders to confusion for several years. This study aims to devote on lessening shrinking accident reports and to reduce the waste of business stakeholders through changing the regulation for industrial accident rate level assessment.

The impacts of working time flexibilization on occupational safety and health: an expert survey

  • The policy proposal by the current Korean government that proposes flexible overtime rules is causing social controversy. This study has explored the 612 experts' opinions on the occupational safety and health impacts of the policy using an online self-report survey. They expected short-term overwork (87.25%), overwork inequality (86.44%), irregular working hours (84.31%), chronic overwork (84.15%), long working hours (83.66%), and unpredictability of working hours (81.86%) as a result of the policy change. They also responded that the policy change would increase industrial accident deaths (87.25%), mental illnesses (87.09%), deaths due to overwork or cardiovascular diseases (83.84%), and accidents (83.33%). They disagreed that the government's flexibilization policy, while agreeing that the necessity of policies on regulating night work (94.77%), guaranteeing wages to eliminate overtime (90.36%), establishing working time regulations for the bogus self-employed (82.84%), and applying the 52-hour workweek system to all workplaces (76.47%). These expert opinions are consistent with previous research on the health effects of working hours.

  • The government separated and established the industrial safety and health law from the Labor Standard law since 1981 to promote the labor's working environment and to improve the conditions of laborers. The government made a lot of effort to discharge the industrial safety and health law by continuous revision of the law thereafter. it is, however, difficult to establish clear-cut lines of authority and responsibility due to the fact that the substantial application of the industrial safety and health law is adapted by enterprise's autonomous management. There are frequent industrial disasters on the small and medium enterprises which have financial difficulty and it means this causes much more social cost. Finally, for the improvement of laborer's safety, health and working environment in the small and medium enterprises we need to raise the effectiveness of the industrial safety and health law through enhancing a government-office's administration and surveillance with the changing mind of a business proprietor. On this paper, we research on the actual condition of the administration, inspection and regulation of safety and health by means of the industrial safety and health law. Thereafter we analyze how much the Korea Occupational Safety & Health Agency and vicarious businesses of safety & health management help. we used the survey method to gather data from 380 laborers directly and analysed the data by SPSS v17.0.
