A theory and study on the LCM(Life cycle management) and evergreening according to the cases of patent litigation in the Korean pharmaceutical industry (제약분야의 특허분쟁사례를 통한 LCM과 에버그리닝의 이론과 논고)

  • To the analysis and discussion whether to conceptualization between the basis and LCM(Life cycle management) of patentability decisions and evergreening through research on patent application strategies and litigation cases. The Stakeholders have said that the LCM and evergreening strategies are an innovative effort to develop new pharmaceuticals, while others say that it is an effort to block generic pharmaceuticals from entering the market and permanently dominate the market by generic pharmaceuticals manufacturers or health economic perspectives. To achieve the goal of research, to discuss for conceptualization LCM and Evergreening strategies through patent application strategies for 14 pharmaceuticals for APIs and case studies for litigations. As a results, the LCM is getting patent rights for the results of research at the initial R&D stage and as such this shall be regarded as part of an effort for technology innovation. However, Evergreening is granting patent rights for the results by making high permission barrier to prevent the market entry of generic pharmaceuticals in the late development period during the pharmaceuticals development process or after their launch. This may lead to the problem of getting weak in health economic aspects and consumer welfare aspects by lowering the market accessibility of cheap generic pharmaceuticals.

The Effect of Tiered Copayment System on Pharmacy Benefit Expenditure of National Health Insurance in Korea: Scenario Analysis based on the Use of Oral Antidiabetic Medications (선택약가제도가 건강보험 약품비 지출에 미치는 영향: 경구용 당뇨병 치료제를 대상으로 한 시나리오 분석)

  • Purpose: This study was aimed to examine the financial effect of 2-tiered copayment system on annual expenditure of pharmacy benefit in the National Health Insurance (NHI) of Korea, focusing on oral antidiabetic medications. Methods: 284 oral antidiabetic products with 14 different active single ingredients listed in the National Formulary of NHI (August 2009) were assigned to tier 1 or tier 2 according to the selected criteria. 10 different combinations of coinsurance rates were selected to estimate the changes in drug expenditure cost of NHI. Results: The annual drug cost was estimated based on the drug price per unit listed in the National Formulary and the used amount of products in 2009 from the IMS Health data of Korea. In the combinations of coinsurance rate of 20% for tier 1 and 40% for tier 2, the total annual drug cost was estimated to be reduced by 1.3% in the case of no change of generic and original drug consumptions, and to be reduced by 4.3% in the case of 10% increased generic drug consumptions. Conclusion: The tiered copayment system with optimal coinsurance rates appears to be a potential strategy to reduce the financial burden of NHI in Korea by promoting the use of generic products.

A Comparative Analysis of Business Strategies between Full Service Airlines and Low Cost Carriers in Korea

  • Purpose: Establishing a competitive advantage in the aviation market is essential as the competition among domestic airlines intensifies. Therefore, this study examined the management strategies of both large domestic airlines and low-cost airlines. Research design, data, and methodology: This study classified domestic airlines into Full Service Airlines (FSA) and Low Cost Carriers (LCC), examined each airline's current status and characteristics, and conducted case analyses of FSA and LCC based on Porter's generic competitive strategy. Results: The analyses determined that LCC primarily implemented a cost-advantage strategy, and FSA implemented a differentiation strategy. However, as competition intensified, FSA pursued cost-advantage strategies while establishing LCC through subsidiaries. There are various specific cost reduction methods, including service simplicity, scalability, high utilization, low landing fees, low-cost unit, and point-to-point flight strategies. Conclusions: LCCs are focusing on cost advantage strategies that reduce costs; however, the FSA also runs special price events that are as good as LCCs and are comparable to LCCs on some routes. Furthermore, LCC has recently expanded its mid- and long-distance routes, making competition for long-distance routes with major airlines unavoidable.

  • This article recapitulates the recent changes in trade laws, which may be accentuated due to the intriguing emergence of fortified protectionism and Mega FTAs. It points out the need to formulate not only the corporate strategy for enhancing the product differentiation and architectural capabilities but also the public policy, which comprises the industrial adjustment policy to cope with possible negative impulses caused by the digital trade and foreign direct investment. It is imperative for Korea to facilitate the alignment between corporate strategy and industrial adjustment policy as an effective means of enhancing industrial structure by nurturing those linkage effects between relevant forward and backward industries. Given the drastically volatile trade norms of multi-track trade policies, it may be a pivotal momentum for Korea to pursue a paradigm shift of its trade policy with a prime objective of achieving such an alignment between corporate strategy and industrial adjustment policy, which affords increased value-added and the further development of product or generic technology instead of resorting to the misuses and abuses of economies of scale and production technology for the maximization of export amount.

  • This paper adopts an embeddedness perspective and discusses rationales for government intervention in relation to economic development. Looking at East Asian experiences with industrial and technology policy the paper examines the general requirements, specific areas of focus and appropriate techniques for industrial and technology policy. Eight generic policy requirements are identified, viz. government capacity; monitoring and adjustment; policy sequencing; incremental upgrading; progressive market reliance; performance-orientation; selectivity; and flexibility.

The Efficiency of Networks and Competitive Strategies (네트워크의 효율성과 경쟁 전략에 관한 연구)

  • This paper attempts to provide an overview of relationship between the characteristics of the network and competitive strategies. We review the theoretical background of the efficiency of network, which Is very important for the network-based industries. Network externality, positive feedback effects, bandwagon effects, economies of scale, economies of scope in network-base businesses are reviewed. Various network situations, including interconnection, and strategies are also discussed. In this purpose, simple but meaningful examples and cases are used to show the economic goals and means of network competition strategies. We try to link network strategies to the generic strategies and coopetition suggested by Porter and by Brandenburger and Nalebuff respectively. Since this study is an exploratory research, further studies on more complex network situation in the real work can be executed with taking advantage of this effort.

  • In this paper, we investigate the feasibility of a strategy of failure detection and identification. The point of proposed strategy includes a pattern extraction approach for failure identification using Auto-Associative Kernel Regression (AAKR). We consider a simulation data concerning 605 signals of a Generic Pressurized Water Reactor(GPWR). In the application, the reconstructions are provided by a set of AAKR models, whose input signals have been selected by Correlation Analysis(CA) for the identification of the groups. The failure pattern is extracted by analyzing the residuals of observations and reconstructions. We present the possibility of extraction of patterns for six failure.

A High-Yielding, Generic Fed-Batch Process for Recombinant Antibody Production of GS-Engineered Cell Lines

  • An animal-component-free and chemically defined fed-batch process for GS-engineered cell lines producing recombinant antibodies has been developed. The fed-batch process relied on supplying sufficient nutrients to match their consumption, simultaneously minimizing the accumulation of by-products (lactate and osmolality). The proportionalities of nutritional consumption were determined by direct analysis. The robust, metabolically responsive feeding strategy was based on the offline measurement of glucose. The fed-batch process was shown to perform equivalently in GS-CHO and GS-NS0 cultures. Compared with batch cultures, the fed-batch technology generated the greater increase in cell yields (5-fold) and final antibody concentrations (4-8-fold). The majority of the increase in final antibody concentration was a function of the increased cell density and the prolonged culture time. This generic and high-yielding fed-batch process would shorten development time, and ensure process stability, thereby facilitating the manufacture of therapeutic antibodies by GS-engineered cell lines.

A Study on the Impact of Attraction and Compromise Effects on Choice Probability of Private Brands (유인 및 타협효과가 유통업체 브랜드(PB)의 선택확률에 미치는 영향에 관한 연구)

  • The strategy of distributors using a PB(Private Brand) inferior to existing PB to increase choice probability of PB arouses difficulty in terms of cost. Therefore, the aim of this study is to verify incentive and compromise effects of PB using two realistic experimental methods. Looking at the verification results, incentive and compromise effects occurred to show increase in choice probability of PB when a new GB(Generic Brand) was added to NB(National Brand) and PB of a manufacturer. In specific during experiment 1, choice probability of PB, the target, was changed when decoy brand was introduced even if there is a large difference in preference and choice probability of the competitor and target due to characteristics of NB and PB. In experiment 2, incentive effect appeared when PB of competitor was positioned as an inferior alternative to increase choice probability of the company's PB. Strategic implications on the study results, limits of this study, and future directivity were proposed.
