EBS '다문화 고부 열전'에서 나타난 고부간 대화에 대한 융복합적 분석 (Convergence Analysis on Conversation between Mother-in-law and Daughter-in-law in EBS 'Multicultural Mother-in-law and Daughter-in-law Biograph')

  • 본 연구는 다문화 가정 내의 고부갈등을 심화시키는 '갈등대화'를 통해 다문화 가정 내의 고부 간 '의사소통'의 유형을 보기 위함이다. 이를 위해 3편의 EBS '다문화 고부열전' 에피소드를 모니터링 하고, 대화 내용을 기록하여 융복합적 분석을 하였다. 분석한 결과 다문화 가정 내의 고부 간 대화에서 '역기능적 의사소통' 유형이 나타났으며, 이런 의사소통의 유형은 고부갈등을 더욱 심화시키고 있었다. 따라서 다문화 가정 내 고부갈등을 완화하기 위해서 순기능적 의사소통을 위한 융복합적 상담 프로그램 개발 및 가족 상담 필요성을 제언하였다.

중국의 불법체류 외국인근로자에 대한 법적 규제에 관한 비교법적 연구 (The Comparative Law Research On The Mandatory Control About Illegal Foreign Workers in China)

  • 그동안 대부분의 국가에서 합법적인 취업활동을 위한 입법정책을 추진해왔지만 불법체류를 완화하기 위한 노력에도 불구하고 거의 성공적인 사례는 없을 정도로 어느 국가든 불법체류근로자들에 대한 사회문제가 발생하고 있다. 중국의 경우에도 예외는 아니다. 현재 중국 국내 외국인 불법취업 문제도 현재와 미래의 사회문제화 될 전망이다. 하지만 이를 법적으로 대응하는 중국 출입국관리법과 불법취업자에 대한 입법정책이 매우 소홀한 편이다. 불법취업 외국인 권리에 관한 법률규범 등 조정하는 수단이 부족하고 구제방법도 충분하지 않다. 국제적인 규범기준에 걸 맞는 중국 내 불법취업 외국인 권리보호에 관한 법적권리를 확보하는 것이 필요하다. 이를 위해 관련법 규범을 제정하고 이를 토대로 사후 행정 관리를 강화해야 한다. 주요 국가들의 추세와 경향은 불법체류자의 고용을 고용주를 중심으로 엄격하게 규제하고 있듯이 중국에서도 외국인근로자 대상의 단속보다는 고용주에 대한 규제를 강화할 필요가 있다. 이를 위해 불법외국인을 고용하는 고용주에게 과태료와 벌금, 징역형뿐만 아니라 각종 부담, 본국송환비용 지불 등 상당한 불이익을 받게 하여야 한다. 불법체류자의 자발적 귀환(Freiwillige $R\ddot{u}ckehr$)촉진프로그램 등을 운영하고 일정기일에 자진 귀국하는 불법체류자에게 범칙금을 면제하는 등의 조치를 취할 필요가 있다. 끝으로 중국에서도 불법체류 외국인정책의 방향이 불확실한 상태로 유지되어 고용주와 외국인근로자의 혼란 내지는 잘못된 선택을 방관하기 보다는 관련부처에서 적극적인 정책 방향성을 갖고 추진해나가야 할 것이다.

The Relationship between Productivity and Firm's Performance: Evidence from Listed Firms in Vietnam Stock Exchange

  • The study aims to examine the impact of productivity in addition to the policy of increasing the foreign investors' ownership rate on the performance of businesses which were listed on Vietnam's stock exchange market from 2010 to 2017. With the database of 3.961 observations, the study employs a statistical method - multiple regression to estimate the relationship between labor productivity, foreign ownership as well as other firm-level characteristics and firm performance. Research findings show that increasing labor productivity and increasing foreign ownership rates help increase firm performance. In addition, except for financial leverage, variables such as liquidity and firm size have positive effects on firm performance measured by Tobin's Q. These findings have theoretical contributions and practical implications for managers, investors and government in Vietnam. Managers should pay attention to improving labor productivity through employing incentive mechanisms, building a good working environment, investing in technology, etc. in order to enhance the firm performance. Investors could utilize the labor productivity and foreign ownership indicators to select stocks of good companies for investment. For Vietnamese government, relaxing the limit of foreign ownership and accelerating the divesting of State capital in State-owned enterprises could help increase the investment scale of foreign investors and resulting in positive effects on the firm performance.

국제적(國際的) 보증(保證)의 제문제(諸問題) (Various Issues on International Guarantee)

  • In many international financing transactions Korean companies are required to issue a guarantee. Thus far, however, legal issues on international guarantees have not been fully discussed in Korea. This is partly because most of the international guarantees are governed by a foreign law such as English law or the laws of the State of New York. In this articles the author examines major concepts or terms and conditions of a typical international guarantee, e.g., language on consideration, primary obligor, joint and several guarantee, unconditional and irrevocable guarantee, continuing guarantee, right of subrogation, representations and warranties, covenant or undertaking, currency indemnity, assignment, participation, governing law and jurisdiction clause, etc. For reference, standard forms of a guarantee and a standby letter of credit are attached to the article. In examining the terms and conditions, the author compares them with similar or equivalent concepts under Korean law. The author further discusses some Korean law issues that may arise under international guarantees governed by a foreign law. These issues include the application of the ultra vires doctrine under Article 34 of the Civil Code of Korea, the validity of an international guarantee which a Korean company has issued in violation of the guarantee ceiling set under Article 10 of the Law on Monopoly Regulation and Fair Trade of Korea and the validity of an international guarantee which a Korean party has issued in violation of the Foreign Exchange Transaction Law. In addition, the author discusses some issues under a so-called independent guarantee and a standby letter of credit. In this regard, reference is made to the Uniform Rules for Demand Guarantee (URDG), International Standby Practices (ISP98) and the Convention on Independent Guarantees and Stand-by Letters of Credit adopted by the United Nations in 1995. Finally, the author examines major terms and conditions of typical comfort letters and discusses some legal issues, such as the binding force of the comfort letter. In dealing with the issues the author underscores that to the extent the issues are not properly dealt with by an international norm such as Uniform Customs and Practice for Documentary Credits or ISP 98, the issues must be analyzed by reference to the governing law of the relevant instrument.

중소도시 여성결혼이민자의 결혼만족도에 영향을 미치는 변인에 관한 연구 (The Factors Related to the Marital Satisfaction of the Foreign Wives who Live in Small Town)

  • The purpose of this study was to identify what factors are associated with marital satisfaction of the foreign wives who live in small town. Data for the study were based on a snowball sampling of 101 foreign wives who married to Korean husbands and had residence in Changwon and Masan city, Gyeongnam, Korea. The respondents reported higher levels of marital satisfaction and lower levels of marital hardship. To identify the variables affecting marital satisfaction, a regression analysis was conducted. Independent variables included age difference, educational difference, monthly income, conformity of information about husband, marital hardship, relationship with parents-in-law and taking class with husband. While conformity of information about husband, marital hardship and taking class with husband had strong effects on marital satisfaction of the foreign wives, age difference, educational difference, monthly income and relationship with parents-in-law didn't show the significant effects on the marital satisfaction of the foreign wives.

한-EU FTA 비준에 따르는 법률서비스가 포렌식 수사에 미치는 영향 연구 (A Study on Influence of Korea-EU FTA Ratification upon Legal Service and Forensic Investigation)

  • 2007년 4월에 타결된 한-EU FTA가 2011년 5월 국회에서 의결되어 비준이 체결되었다. 한-EU FTA가 타결되어 비준화 됨에 따라 법률서비스 시장개방절차는 1단계로서 EU 회원국 로펌의 국내 대표 사무소(외국법자문법률사무소)의 설립이 허용되고, 2단계는 외국법자문법률사무소가 국내로펌과 국내외법이 혼재된 사건을 공동처리 및 이익분배가 가능해진다. 3단계로는 EU 회원국 로펌이 국내 로펌과 합작기업 설립이 허용된다. 본 논문에서는 한-EU FTA 비중에 따른 법률서비스와 포렌식 수사에 미치는 변화와 영향을 연구한다. 또한 법률 증거의 대부분을 차지하는 디지털 포렌식 증거가 공판중심주의 속에서 차지하는 위치와 전망을 연구한다. 전문증거로서 디지털 증거가 재판에 미치는 영향을 예측하여, 법률시장 개방화에 대처할 수 있으며, 영미법계의 로펌의 국내시장에 진출에 슬기롭게 대비할 수 있을 것이다.

  • The core of the foreign policy of the Yoon Suk-yeol government is the promotion of active economic and security diplomacy as indicated in Policy Tasks No. 98. To this end, economic consultative bodies such as Regional Comprehensive Economic Partnership Agreement(RCEP), Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP), and Indo-Pacific Economic Framework (IPEF) are taking the initiative to respond to the formation of supply chain, human rights, environment, and digital-related norms, and actively support Korean companies' overseas expansion. Due to the nature of the Ministry of Oceans and Fisheries (MOF) as an organization established centered on the space of the ocean, the MOF faces difficulties in bringing the functions of other ministries into the space of the ocean. Considering the vision, objectives, and detailed plans of the MOF, the contribution of the MOF in the field of active economic security, one of the main foreign policies of the Yoon Suk-yeol government, is perhaps too obvious. However, since the re-launch of the MOF, the ODA budget for the oceans and fisheries sector is too small compared to other ministries, so even if new policy demands are discovered, there are many difficulties in implementing these policies in practice. Recognizing these problems, this paper examines the background and contents of foreign policies that have been promoted for the efficient promotion of RCEP, CPTPP and IPEF and introduces the areas of cooperation in the oceans and fisheries sector in these foreign policies.

A Modern Analysis of 'Guanxi' of Foreign Investment in China

  • China is a land of guanxi, everything is connected with guanxi. China has a business culture based on guanxi connections underpinned by strong Confucian ethics. However, there are some reasons why it is difficult for western companies to run businesses in China. Firstly, foreign firms lack the understanding and experiences necessary for doing business in China. They don't know the absence of alternatives is one of reasons that guanxi is so powerful in Chinese society. Secondly, there are many misconceptions about guanxi. It is easier for many foreign scholars or businessmen to equate guanxi with corruption due to the ambiguity of guanxi. Thus, if a foreign enterprise possesses guanxi, it can be a source of competitive advantage for doing business due to lack of law systems for anti-corruption activities in China. Furthermore, it is gaining increasing importance not only in Business to Government(B2G) but also in Business to Consumers(B2C) relationships. Therefore,managers should pay great attention to the proper use of guanxi instead of being involved in corrupt behaviours because now the governments hold a strong attitude against corruption. In particular, establishment of working guanxi through red envelops(basically giving money) or illegal gifts can cause a great problem for both parties, which were naturally accepted among most government officials and businessmen until recently.

대외무역법 행정규칙의 개편방향에 관한 연구 (A Study on the Improvements of Administrative Rules of Korea Foreign Trade Act)

  • There are over 20 administrative rules related to Korea Foreign Trade Act including Export and Import Notification, Consolidated Notification, Notification for Strategic Materials and so on. The purpose of this research proposes to reform some administrative rules related to Korea Foreign Trade Act. First, the administrative rules are a little many and hidden in part, so the effort need for simplification and publication. Especially Export and Import Notification is no need more, and some articles can be transfer to the similar notification. Second, the prohibited or regulated items are only 135, and the reason is cooperation to world trade policy and Korea trade purpose. The item number of trade limitation are decreased sharply compare to several decades, but we still effort to decrease. Third, There are 2 tracks trade regulation both Korea Foreign Trade Act and 57 specific acts. The number of trade limitation item is over 5,000, so it is impossible to control by Consolidated Notification. The role of Consolidated Notification is the just guides for Export and Import, so trader has to use the specific trade-related law.

  • As market is more and more mature, the survival environment of exporting companies is getting severer, which throws exporting companies into great pressures of the process of growth and development. For most businessmen, the hardest part of starting a foreign business is to find buyers or to get customers, which is more critical for small and medium-size foreign enterprises. The fast changes of internal and external trade and market circumstances, together with the advent of e-commerce, led to the diversified of the way to find foreign buyers for exporting companies. But the performance differs in using different ways of finding foreign buyers. Therefore, this study examines the status of the methods of finding foreign buyers and performance of exporting companies in China. Based on the investigation of the ways of finding foreign buyers, this study tries to find out the most efficient ways of finding foreign buyers for them. And this study tries to propose some practical suggestions for the exporting companies based on the analysis that will help them to improve companies' performances.
