A Study on the Commercial Dispute Management and the ADR in the Republic of Korea -Stressed on the Trade Dispute and Commercial Arbitration- (우리나라기업의 상사분쟁관리와 ADR에 관한 연구 - 무역분쟁과 상사중재를 중심으로 -)

  • This study clearly shows that the commercial dispute management is very important for the enterprise and the national economy and the international commercial arbitration as a ADR needs to be activated to settle the trade dispute for the more in the Republic of Korea. The trade dispute has increased for more than thirty years from 1960s and the problem of the occurrence of trade dispute has been very serious in the Republic of Korea. In general, the annual average increase rate of trade dispute has been higher gradually to present and has been high more than the annual average increase rate of export from the 1960s. Also the annual average increase rate of trade dispute in R.O.K. in general high than the Japan and the Taiwan. Accordingly, the trade dispute has been the factor of weakening of international competitiveness. On the other hand, the occurrence of commercial dispute is apt to affect the enterprise and the national economy. It can be called as micro and macro effect. Also, it's analysed that all these problems occurred because of business quality of businessman than the quality problem of goods. Several improvements directions recommended are as follows according to the analyses above. The first, it's required that the consciousness level of commercial dispute management of businessman should be higher to prevent occurrence of commercial dispute and settle the dispute efficiently. The second, the government concerned had better fix policy to raise the standard of commercial dispute management since the trade dispute affects the enterprise and the national economy. And ADR institutions such as the KCAB cooperate with each other for the activation of ADR such as conciliation. The third, is's desirable that the KCAB should promote international commercial arbitration and activate the cooperation of international arbitration activity with other countries. The fourth, it's desirable that the system of Certified Dispute Manager(CDM) should be established to raise the standard of commercial dispute management and the trade order.

Seasonal Occurrence of Oriental Tobacco Budworm (Lepidoptera: Noctuidae) Male and Chemical Control at Red Pepper Fields (고추포장에서 담배나방의 성충 발생소장과 약제방제)

  • The oriental tobacco budworm, Helicoverpa assulta (Guenee) is a major pest of red pepper in Korea. Insecticide spray is a prevalent control tactic in most farms, but an effective control is difficult because the larvae are protected inside the fruit. Objective of this study was to investigate the seasonal occurrence of the male moths using pheromone trap and to evaluate the control efficacy of insecticide applications based on the trap catch data at red pepper fields in Suwon. The results of pheromone trap catch during three years showed that the moth flight activity occurred from late May to early October. Peak periods of the adult flight, which are indicators of each generation, occurred in late June, late July-early August, and late August-early September. Trap catches during the overwintering and first adult generation were closely linked with subsequent damage. Although the trap catch during the second generation was higher than the previous generations, damage level caused by this generation larvae was low. Experiment results revealed that fruit damage by H. assulta could be effectively reduced by five sprays of insecticides based on the trap catch data throughout the season.

Investigation of bacteremia after toothbrushing in orthodontic patients

  • Objective: The aim of this study was to investigate the occurrence rate of bacteremia following toothbrushing with toothpastes composed of several antibacterial agents and compare the results with the conventional oral hygiene maintaining methods in orthodontic patients. Methods: This clinical study included 100 adult orthodontic patients who were divided into 4 groups. Each group comprised of 25 patients, wearing fixed orthodontic appliances. In the first group, bacteremia was assessed after toothbrushing without using any toothpaste. In the second group, a 0.2% chlorhexidine gluconate mouthrinse was used before brushing with no toothpaste. In the third group, subjects brushed with a commonly used toothpaste which did not include an additional antimicrobial agent. The fourth experimental group used toothpaste which included tea tree oil, clove oil, peppermint oil and bisabolol as antimicrobial elements. Pre- and post-brushing blood samples were obtained using a strict aseptic technique. All samples were microbiologically evaluated using blood culture bottles. Results: Toothbrushing in orthodontic patients yielded to an increase in the occurrence rate of bacteremia when using normal toothpaste or no toothpaste at all. Conclusions: The use of chlorhexidine mouthwash before toothbrushing, and brushing with antimicrobial toothpaste did not show a statistically significant difference in preventing the occurrence of bacteremia (p > 0.05).

Dependence of solar proton events on their associated activities: solar and interplanetary type II radio burst, flare, and CME

  • We investigate the dependence of solar proton events (SPEs) on solar and interplanetary type II bursts associated with solar flares and/or CME-driven shocks. For this we consider NOAA solar proton events from 1997 to 2012 and their associated flare, CME, and type II radio burst data with the following subgroups: metric, decameter-hectometric (DH), and meter-to-kilometric (m-to-km) type II bursts. The primary findings of this study are as follows. First, about half (52%) of the m-to-km type II bursts are associated with SPEs and its occurrence rate is higher than those of DH type II bursts (45%) and metric type II bursts (19%). Second, the SPE occurrence rate strongly depends on flare strength and source longitude, especially for X-class flare associated ones; it is the highest in the central region for metric (46%), DH (54%), and m-to-km (75%) subgroups. Third, the SPE occurrence rate is also dependent on CME linear speed and angular width. The highest rates are found in the m-to-km subgroup associated with CME speed 1500 kms-1: partial halo CME (67%) and halo CME (55%). Fourth, in the relationships between SPE peak fluxes and solar eruption parameters (CME linear speed, flare flux, and longitude), SPE peak flux is mostly dependent on SPE peak flux for all three type II bursts (metric, DH, m-to-km). It is noted that the dependence of SPE peak flux on flare peak flux decreases from metric to m-to-km type II burst.

Uniform Seedling Establishment and Weed Occurrence Inhibition by Seed-Mulching in Wet Seeded Rice

  • In spite of simple and cheap cultivation method, water broadcast-seeded rice demonstrates uneven and unstable seedling establishment per unit land area and requires more herbicide and labor-input for weed control. Three experiments were conducted in a phytotron at 18$^{\circ}C$ to evaluate the adaptability of seed-mat mulching cultivation technologies in water seeded rice for the uniform seedling establishment and the inhibition of weed occurrence without herbicide application. Five different kinds of mat with different mesh sizes and fabric properties were tested. The emergence of rice was the highest in Lawn-mat treatment, being comparable with the control, in which seeds were sown without mat. The Lawn-mat also exhibited the lowest mat tension. Mat tension may influence the emergence of rice. And once it was soaked in water, it didn't maintain its original shape any more. The emergence rate of rice was the lowest in Safer-mat treatment. In Lawn-mat treatment, which was the most effective for rice emergence in the first study, the differences of emergence and seedling establishment of rice depending on the seeding position (upper, beneath, and between mats) treatments were negligible, while they were higher in dry seeds than in pre-germinated seeds treatment. The emergence as affected by the kinds of mat also showed the same trend when tested using barnyard grass. Depending on the kinds of mat, the inhibition effect of weeds was the greatest in Safer-mat and the poorest in Lawn-mat. These results strongly suggest the possibility that the uniform seedling establishment and weed management without chemical could be achieved simultaneously by seed-mat mulching through the combination of effective mat for the emergence of rice and another efficient mat for the inhibition of weed occurrence. This possibility was also tested in the field.

Review on the Occurrence and Studies of Potato Viral Diseases in Korea (한국에서의 감자 바이러스병 발생과 그 연구에 대한 고찰)

  • The occurrence of potato(Sotanum tuberosum) viral diseases caused by Potato virus X(PVX), Potato virus Y (PVY), Potato leafroll virus(PLRV), Potato vims S(PVS), Potato virus M(PVM), Potato virus A(PVA), Potato virus T(PVT), Alfalfa mosic virus(AIMV), Tobacco mosic virus(TMV), Potato mop top virus(PMTV) Tobacco rattle virus(TRV) and Potato spindle tuber viroid(PSTVd), potato witches' broom phytoplasma, have been identified so far in Korea. Major viral diseases such as PVX, PVY and PLRV had been studied more deeply, however, the others are just identified and only partially characterized since the first study on the relation between PVX nucleic acid and virus protein by Kim in 1961. The most studies on potato viral diseases are mainly focused on the problems of seed potato production. The National Alpine Agricultural Experiment Station(NAAES), since it began its activities in 1961, has given special attention to this problem by doing studies to identify, characterize and control potato virus diseases. This effort resulted in the development of new potato virus detection methods as a basis for elaborating new method of control, such as the production of seed potato free of virus and the selection of new virus-resistant transgenic potatoes. The further studies of potato viral diseases required would be fallowings: the continuous monitoring for the occurrence of identified or not identified potato viruses in Korea, the isolation of resistant viral genes, the development of control method for the non-persistently transmitted viruses like PVY, special vectors such as nematode and fungus transmitted viruses, TRV and PMTV and the development of control methods against potato viral diseases by viral cross protection, therapy, transgenic plant, and the use of the agents or molecules, such as virus inhibitors and antiviral proteins, etc., blocking viral replication.

A Ranking Method for Improving Performance of Entropy Coding in Gray-Level Images (그레이레벨 이미지에서의 엔트로피 코딩 성능 향상을 위한 순위 기법)

  • This paper proposes an algorithm for efficient compression gray-level images by entropy encoder. The issue of the proposed method is to replace original data of gray-level images with particular ranked data. For this, first, before encoding a stream of gray-level values in an image, the proposed method counts co-occurrence frequencies for neighboring pixel values. Then, it replaces each pay value with particularly ranked numbers based on the investigated co-occurrence frequencies. Finally, the ranked numbers are transmitted to an entropy encoder. The proposed method improves the performance of existing entropy coding by transforming original gray-level values into rank based images using statistical co-occurrence frequencies of gray-level images. The simulation results, using gray-level images with 8-bits, show that the proposed method can reduce bit rate by up to 37.85% compared to existing conventional entropy coders.

Reduction of contraction and expansion noise of refrigerator using thermal deformation analysis (열변형 해석을 이용한 냉장고 수축팽창 소음저감)

  • In this work, the mechanism of contraction and expansion noise generation is investigated, and effective methods are proposed to reduce the occurrence frequency of noise during operation of the refrigerator. First, the frequency spectrum analysis was made by using the sound pressure signal measured in an anechoic chamber to investigate the characteristic of noise and the frequency of occurrence. Second, a thermal deformation analysis was conducted to predict the location of noise source. It is found from the analysis that the biggest thermal deformation occurs in the middle of the left inner case in the freezer room. Following the investigation made, a noise reduction method is proposed. The method is proposed to reduce the contraction and expansion noise by reducing the thermal deformation through increasing ABS (Acrylonitrile Butadiene Styrene) thickness in the center of refrigerator.

Rare Disaster Events, Growth Volatility, and Financial Liberalization: International Evidence

  • Purpose - This paper elucidates a nexus between the occurrence of rare disaster events and the volatility of economic growth by distinguishing the likelihood of rare events from stochastic volatility. We provide new empirical facts based on a quarterly time series. In particular, we focus on the role of financial liberalization in spreading the economic crisis in developing countries. Design/methodology - We use quarterly data on consumption expenditure (real per capita consumption) from 44 countries, including advanced and developing countries, ending in the fourth quarter of 2020. We estimate the likelihood of rare event occurrences and stochastic volatility for countries using the Bayesian Markov chain Monte Carlo (MCMC) method developed by Barro and Jin (2021). We present our estimation results for the relationship between rare disaster events, stochastic volatility, and growth volatility. Findings - We find the global common disaster event, the COVID-19 pandemic, and thirteen country-specific disaster events. Consumption falls by about 7% on average in the first quarter of a disaster and by 4% in the long run. The occurrence of rare disaster events and the volatility of gross domestic product (GDP) growth are positively correlated (4.8%), whereas the rare events and GDP growth rate are negatively correlated (-12.1%). In particular, financial liberalization has played an important role in exacerbating the adverse impact of both rare disasters and financial market instability on growth volatility. Several case studies, including the case of South Korea, provide insights into the cause of major financial crises in small open developing countries, including the Asian currency crisis of 1998. Originality/value - This paper presents new empirical facts on the relationship between the occurrence of rare disaster events (or stochastic volatility) and growth volatility. Increasing data frequency allows for greater accuracy in assessing a country's specific risk. Our findings suggest that financial market and institutional stability can be vital for buffering against rare disaster shocks. It is necessary to preemptively strengthen the foundation for financial stability in developing countries and increase the quality of the information provided to markets.

Taper phenomenon of UV-laser punching process on zero-shrinkage substrate (무수축 기판 상에 UV 레이저 가공에 의한 Taper 현상)

  • With the miniaturization with both high functionality and high integrity of the probe cards, the highly precise laser punching on the zero-shrinkage high strength substrate has attracted more attention recently. Taper occurrence during laser-punching on green sheets appears as a problem in process. The size (diameter) difference between the entrance hole and the exit hole in tapered holes appeared to be inversely proportional to the hole size itself. To suppress taper occurrence, two-stage punching was adopted as the size of second hole was varied from $70{\mu}m$ to $79{\mu}m$ when punching $80{\mu}m$ via holes on the substrate with thickness of $380{\mu}m$. The minimal taper ratio of 11.9 % appeared with second hole size between 70 to $79{\mu}m$ before sintering. Taper ratio reduced to 7 % after zero-shrinkage sintering. The size difference between first hole and second hole appeared minimal when the size of second hole was 95~97 % to that of first hole.
