  • In the case of failure images with controlling lighting like backlighting and excessive frontlinghting, the compensation scheme for a specific area in an image is required. The interested region is first selected by user in our method to compensate the first frame. Then we define the matching function of brightness and energy function is proposed with weight of matching function and the relationship among the neighbors. Finally, the energy is minimized by the graph-cut algorithm to compensate the brightness of the first frame. Other frames are straightforwardly compensated using the results of the first frame. The brightness variations of the previous frame is transmitted to the next frame via motion vectors. The reliability of the brightness variation is calculated based on the motion vector reliability. Video compensation result is achieved by the process of the image case. Simulation show that the proposed algorithm provides more natural results than the conventional algorithms.

The Delay of Re-Routing Flight and Scope of Extraordinary Circumstances in the European Air Transportation Law: A Case Comment on A and Others v. Finnair Oyj [2020] Case C-832/18 (EU항공여객운송법 체제에서 대체항공편의 운항지연과 특별한 사정의 범위 - 2020년 EU사법재판소 A and Others v. Finnair Oyj, Case C-832/18 판결을 중심으로 -)

  • This paper reviews and criticizes some issues as to the case of A and Others v. Finnair Oyj [2020] Case C-832/18 by examining EU Regulations and practical point of views. Under this case, the travellers brought an action against Finnair in light of the Air Passenger Regulation12, seeking compensation for both the first cancelled flight, and the delayed re-routed flight. Finnair had paid the first compensation, but refused to grant the second claim, arguing that the regulation did not set out that passengers were eligible for a second claim in those situations, and that the delay of the second flight was a consequence of 'extraordinary circumstances' under the regulation. The Court of Appeal in Helsinki has asked the CJEU whether an air passenger is entitled to a further compensation where a re-routed flight they have agreed to take is delayed, where both the original and rerouted flight are operated by the same air carrier. The CJEU held that the regulation does not in any way limit the rights of passengers where they find their flights being re-routed. As such, under earlier CJEU case law, the relevant travellers here were entitled to compensation for cancellation of the first flight and delay of the second flight. It also disagreed with Finnair's assessment that the technical failure in the re-routing flight was a matter of extraordinary circumstances.

  • The court handed down meaningful rulings related to medical sectors in 2013. This paper presents the ruling that the care workers could be the performance assistants of the care-giving service although the duties of care worker are not included in the liability stipulated in the medical contract signed with the hospital for reason of clear distinction of duties between care workers and nurses within the hospital in connection with the contract which was entered into between the hospital and patients. In relation to negligence and causal relationship, the court recognized medical negligence associated with the failure to detect the brain tumor due to the negligent interpretation of MRI findings while rejecting the causal relationship with consequential cerebral hemorrhage. The court also recognized negligence based on the observation on the grounds of inadequate medical records in a case involving the hypoxic brain damage caused during the cosmetic surgery. In terms of the scope of compensation for damages, this paper presents the ruling that the compensation should be estimated based on causal relationship only in case the breach of the 'obligation of explanation' is recognized, however rejecting the reparation for de factor property damages in the form of compensation, and the ruling that the lawsuit could be instituted in case that the damages exceeded the agreed scope despite the agreement that the hospital would not be held responsible for any aftereffects of surgery from the standpoint of lawsuit, along with the ruling that recognized the daily net income by reflecting the unique circumstances faced by individual students of Korean National Police University and artists of Western painting. Many rulings were handed down with respect to medical certificate, prescription, etc., in 2013. This paper introduced the ruling which mentioned the scope of medical certificate, the ruling that related to whether the diagnosis over the phone at the issuance of prescription could constitute the direct diagnosis of patient, along with the ruling that required the medical certificate to be generated in the name of doctor who diagnosed the patients, and the ruling which proclaimed that it would constitute the breach of Medical Act if the prescription was issued to the patients who were not diagnosed. Moreover, this paper also introduced the ruling that related to whether the National Health Insurance Service could make claim to the hospitals for the reimbursement of the health insurance money paid to pharmacies based on the prescription in the event that the hospitals provided prescription of drugs to outpatients in violation of the laws and regulations.

  • Residual stress in the forged parts affects the resistance to mechanical failure, dimensional uniformity, and the service life of the parts. In order to elucidate the development of residual stress in open-die forging process, elasto-plastic finite element analysis was implemented to radial forging process. Super duplex stainless steel SAF 2507 was selected as workpiece material and a series of mechanical tests followed by numerical compensation to deformation heating was conducted to obtain necessary flow data. The residual stress distributions were calculated using commercial 3-D FEM code and the effects of process design were evaluated from selected results.

  • This study was administered to demonstrate how unsatisfied customers would be influenced by the change in the quality of the service delivered to them after the dissatisfaction occurs. In light of the above, the objective of this study is to find out what leads to dissatisfaction in the minds of the consumers and also to identify the common behavioral patterns indicated by unsatisfied consumers. This study consists of two parts: a research based on the review of the literature and empirical study methods. As a result, a research for the popular forms of complaining patterns shows opportunities for restaurants to come up with measures to improve their service quality when customers are unsatisfied. In service recovery situation, distributive and interactional justice significantly influence customers' repurchase. Therefore, firms ought to offer monetary compensation, explain about the problems, and make their best efforts to recover the failure because the efforts also affect repurchase.

  • The number of disputes between physicians and patients caused by medical malpractice are showing a sharp increasing over the past several years. The disputes on medical malpractice may be resolved either in court or by direct negotiation between both sides concerned. There are no special acts relating to the civil or penal liability of the physicians in Korea. The medical disputes are decided merely through legal technicalities and without reference to actual medical practice. The current system which does not compensate injured patients adequately or equitably leads to taking a long time consuming for dispute resolution processes. The things make worsed, the problem is due to not being of insurance system or a proper funds for compensation. This research proposes a outline of new and comprehensive alternative for these problems and failure of conventional resolution of medical disputes. So far, we have learned lessons from the excperiencies of resolving medical malpractice disputes of Japan and the United States. The proposal first calls for an administrative arbitration and pretrial screening panels as a condition precedent to trial. The proposal also includes to facilitate with the funds for compensating the injured.

  • This paper proposes a new design for quick battery charger systems for electric vehicles that consists of a three-phase inverter and a full-bridge converter which use the phase-shift method. The 3-phase inverter controls the input and DC-link voltage by use of a current controller and a voltage controller. The full-bridge converter transfers the DC-link voltage to a fixed output voltage. Designs for the output-side converter and controller for improved performance are proposed in this paper. Design schemes for the filter and controller of an input-side inverter are also presented. Furthermore, the paper proposes a compensation method for the offset current that is caused by switch failure and circuit problems. Simulations and experiments have been performed on a 50kW-battery charger system that is suitable for vehicles. The presented results verify the validity of the proposed method and the superiority of the system over conventional methods.

  • Track jump control is a random access strategy for short distance movement. The most common track jump scheme is a bang-bang control of a kick and brake manner. In a conventional track jump scheme, a track-following compensator is turned off during kick and brake periods, and restarted at a target track for track pull-in. The inevitable controller switching with non-zero initial condition results in undesirable transient response, and excessive overshoot in the transient response causes track pull-in failure. In this paper, a new track jump scheme is proposed for enhancing track jump stability. Instead of control switching, internal states of a track-following controller are artificially manipulated for kick and brake actions in a digital control environment. Experimental results are provided in comparison with conventional track jumps.

  • This paper addresses major issues in localising sound sources in space using the experimental data set of head-related responses in the time or frequency domain. They come from the technical realisation steps for implementing the convolution of HRIR's with sound sources, the cross-talk cancellation for transaural filtering, the matched time delay compensation, etc. in real, those technical matters seem to be minor because they can be realised in off-line signal processing schemes. This paper puts much emphasis on what we misunderstood about the sets of HRTF's or HRIR's, More specifcaily, the sets of HRTF's or HRIR's of course supply relevant information to sound localisation but include much useless 'rubbish' that have made for us to fail to put spatial image into real souno signals such as voices and music's. This paper proposes possible reasons for such failure and, furthermore, introduces detained subjects that should be challenged so as to resolve them.
